I’m Shocked…SHOCKED!…That Those “Studies” Proving That Diversity Makes Companies Perform Better Are Hooey [Updated]

I miswrote a few weeks back when I stated that an assertion by a DEI pimp that “studies show that diversity” makes organizations more successful and effective was a Big Lie, one of those “facts” (like the alleged percentage of women who are sexually molested, or women only making 76 cents for every dollar earned by men for the same job) that have gained currency by repetition by activists without solid evidence to support them. There are studies that purported to support the DEI contention, all from the same management consulting firm McKinsey & Company, carving out a profitable little niche for itself. Aside: I have worked for and with consulting companies. Consulting is a business, not a profession, and such companies strongly tend to give clients what they want to hear, thus making such firms popular and wealthy. Sadly, this is also true of ethics consulting firms and ethics consultants. I won’t provide an expert opinion crafted to make a client happy, and that is why I’m about three months from living in a cardboard box.

Back when I accepted gigs to do training in “diversity” for bar associations, there were no such studies, and because the diversity virtue-signaling fad was already galloping along then, I carelessly assumed that some enterprising “researchers” hadn’t manufactured “science” to support what was already conventional wisdom in the years since I decided that I couldn’t in good faith keep accepting money to teach politically correct nonsense. The McKinsey & Company studies, all claiming to “prove” the value of “diversity,” were published in 2015, 2018, 2020, and 2023, thus giving the private sector, government, the military, the professions and academia something to justify their woke crusades.

A Rueful Note From Your Host…

I only got two posts up yesterday. That’s not acceptable, and I’m sorry. Ethics Alarms has a goal of registering four posts a day, come rain or shine, because even that level—it’s typically about 3,500 or more words a day, counting typos—doesn’t keep up. I don’t feel too badly when I can only manage three. Yesterday was a terrible day, beginning with the ordeal of having to deal with liars, incompetents and SOBs along with malicious technology as I tried to get an overdue waste water treatment bill handled. By the time what should have been a 15 minute process was over, it was after noon, Spuds was annoyed (I almost wrote “ticked” which has other meanings when a dog is the subject) and I was so furious and frustrated that I could hardly function.

Oh Look, What a Surprise…California is Considering Another Law Sticking the State’s Nose Where It Doesn’t Belong

I don’t understand why anyone continues to live or work in California, a state with a culture that lurches between stupid, irresponsible and deluded.

The headline above does not refer to the recent, bone-headed decision to give fast-food workers up to a 25% raise, with cooking Big Macs the minimum wage jumping to $20 an hour in that sector next week. “It’s a big win for cooks, cashiers and other fast-food workers ” says taxpayer-funded progressive propaganda organ NPR. Right. Fast food wages have been growing at a faster clip than almost any other sector since the pandemic, with the result that more outlets are moving to automation, which means, as has happened every time the minimum wage jumps, lower-paid workers—whose skills often aren’t worth the minimum wage— will lose their jobs. Meanwhile, fewer people with strained budgets will buy fast food because of the duel problems that it’s no longer fast, and is absurdly expensive, and California is already one of the most expensive states.

Oh, who knows: maybe all those vegans and health nuts in the Golden State want to wreck the fast food business. More likely, however, it’s just that legislators there—Suspense! Will they actually vote to make all Californians-of-the-right-color millionaires?—don’t understand economics, cause-and-effect and reality.

But I find the proposed law this post concerns more offensive from an ethics point of view if less destructive. California Assemblyman Matt Haney wants California to be the first in the country to give employees the legal right refuse to respond if their superior calls after hours. Then the law would permit workers to ignore emails, texts and other work-related communications until the next day after the work day has begun. “People now find themselves always on and never off,” the Nanny State fan said. “There’s an availability creep that has reached into many people’s lives, and I think it’s not a positive thing for people’s happiness, for their well-being, or even for work productivity.”

Oh, shut up. The law aims to give workers a legal right to be unprofessional. If you have a job and believe in ethical work values, you believe in diligence, responsibility and self-sacrifice. If you believe in personal autonomy and character, you believe that human beings need to be able to make intelligent choices about their life, including their careers, without being bolstered by the legal right to stand up to bullies, jerks and unreasonable supervisors.

The Axis Alerts Us That It Intends to Try Impeachment Plan C Again

The “Get Trump!” cabal is beginning to remind me of nothing so much as the Terminator as described by Kyle Reese (Michael Biehn) to a skeptical and terrified Linda Hamilton in the scene above. “That Terminator is out there. It can’t be bargained with. It can’t be reasoned with. It can’t feel pity, or remorse, or fear. And it absolutely will not stop. Ever. Until you are dead.” One of the main reasons that I wish the country had some safer and more reasonable option than Trump with whom to seek refuge from the totalitarian-aspiring Democrats’ blundering attempts to remake American society into some kind of socialist hellscape is that again, the “resistance,”/Democratic Party/mainstream media alliance (the Axis of Unethical Conduct) will be spending his entire term of office in furious efforts to to deny Trump the power and prestige of the Presidency while turning as much of the public as possible against him irrespective of his policies, actions or accomplishments. They can’t be bargained with. They can’t be reasoned with. They absolutely will not stop.

We were shown this once again with today’s new appeal to Plan C among the Trump impeachment/coup theories. “Trump’s Social Media Company Opens New Avenue for Conflicts of Interest: Ethics experts say Trump Media, now a publicly traded company, would present a new way for foreign actors or others to influence Donald J. Trump, if he is elected president.”

Somebody Please Sue Scribd, and Other Rueful Observations on the Collapse of American Customer Service

Too late to thank her, my wife’s death has made me realize what a terrible job she had dealing with all the companies, websites and cyber-traps one encounters trying to do business and deal with finances in today’s America. It also has brought into sharper focus what I had been aware of: that since the pandemic lockdown, customer service live and online has deteriorated to an extent that cannot be justified. When the Biden lackeys (like the execrable Paul Krugman) insist that the economy is wonderful and that the public doesn’t realize how great things are, this aspect of the economy should be thrown in their faces. Maybe elites like Krugman never have to go shopping in person or deal with a company’s website. If they did, they would realize that the quality of life has declined precipitously, and that it is fair to blame inflation (from profligate government spending) and excessive minimum wage levels as well as the remaining carnage from the Wuhan pandemic lockdown.

I hate to point a finger at Wells Fargo, as my bank has generally been more helpful over the past month than almost anyone else, but what follows is a prime example….

Baseball Gets the Gambling Scandal It Deserves.

Shohei Ohtani is, when healthy, the best baseball player alive as well as the most remarkable. No one since Babe Ruth (and no one before Babe either) managed to be a star slugger and an ace pitcher simultaneously, and Ruth never filled both roles in equal measure in the same seasons like Ohyani has. It may well be that the imported Japanese star isn’t as great a hitter as Babe or as overpowering a pitcher either, but never mind: he’s star quality on the mound and at the plate, and that is unprecedented.

The undisputed most valuable player in baseball signed a massive free agent contract with the best team in baseball (and, after the despicable Yankees, the best known), so Major League Baseball was confident that it had hit the metaphorical jackpot. And then…disaster struck.

During a Seoul, South Korea, series between the Dodgers and San Diego Padres, it was revealed that Ippei Mizuhara, Ohtani’s interpreter since 2013 who followed the star to the United States in 2018, had been illegally gambling on sports; a law enforcement investigation of a bookie uncovered his activities. Ohtani’s name was bank transfers to the bookie to cover Mizuhara’s gambling losses, but Mizuhara insisted that his boss and friend knew nothing about the gambling. The Dodgers fired Mizuhara and the official story coming from Ohtani’s lawyers was that Mizuhara had been stealing money from Ohtani.

Fixing This Problem Requires Leaping Onto a Slippery Slope: Should We?

Nicholas Kristof has sounded the alarm on the growing problem of artificial intelligence deepfakes on line. I must admit, I was unaware of the extent of the phenomenon, which is atrocious. He writes in part,

[D]eepfake nude videos and photos …humiliate celebrities and unknown children alike. One recent study found that 98 percent of deepfake videos online were pornographic and that 99 percent of those targeted were women or girls…Companies make money by selling advertising and premium subscriptions for websites hosting fake sex videos of famous female actresses, singers, influencers, princesses and politicians. Google directs traffic to these graphic videos, and victims have little recourse.

Sometimes the victims are underage girls….While there have always been doctored images, artificial intelligence makes the process much easier. With just a single good image of a person’s face, it is now possible in just half an hour to make a 60-second sex video of that person. Those videos can then be posted on general pornographic websites for anyone to see, or on specialized sites for deepfakes.

The videos there are graphic and sometimes sadistic, depicting women tied up as they are raped or urinated on, for example. One site offers categories including “rape” (472 items), “crying” (655) and “degradation” (822)….In addition, there are the “nudify” or “undressing” websites and apps …“Undress on a click!” one urges. These overwhelmingly target women and girls; some are not even capable of generating a naked male. A British study of child sexual images produced by artificial intelligence reported that 99.6 percent were of girls, most commonly between 7 and 13 years old.

Yikes. These images don’t qualify as child porn, because the laws against that are based on the actual abuse of the children in the photos. With the deepfakes, no children have been physically harmed. Right now, there are no laws directed at what Kristof is describing. He also links to two websites on the topic started by young women victimized with altered photos and deepfaked videos of them being spread on line: My image My choice, and AI Heeelp!

This quiz could be fairly paraphrased, if in vulgar fashion, as “Who’s the asshole?“

Established in 2019, the RBG Leadership Award is supposed to honor “trailblazing” men and women of distinction, with “distinction” having a rather broad and vaguely defined meaning, as the pronouncements of officials connected with the awards made clear. “Justice Ginsburg became an icon by bravely pursuing her own path and prevailing against the odds,” said Brendan V. Sullivan, Jr., chair of the RBG Award. “The honorees reflect the integrity and achievement that defined Justice Ginsburg’s career and legend.” “Justice Ginsburg was a legal entrepreneur who innovated and took risks in ways that rewarded us all,” said Matthew Umhofer, president of the Dwight D. Opperman Foundation, which administers the awards. “In a world that sought to define and limit her, she found ways to challenge and change the system, armed with nothing more than a brilliant mind and a powerful pen. Her impact transcended the law, and society is better off for it.” “Such is the spirit that defines the honorees of the RBG Award,” adds the award’s website.

This year, it was decided that the awards, which were originally limited to women of distinction (because Ginsburg was an iconic feminist and women’s rights advocate), should be awarded to men as well. “Justice Ginsburg fought not only for women but for everyone,” said Julie Opperman, Chair of the Dwight D. Opperman Foundation. “Going forward, to embrace the fullness of Justice Ginsburg’s legacy, we honor both women and men who have changed the world by doing what they do best.”

When this years’ honorees were announced, it is fair to say that the late Justice Ginsburg’s family flipped out. The awards went to…

…and the family’s and assorted Ginsburg admirers’ collective heads exploded. Jane C. Ginsburg, a law professor at Columbia University, said the choice of winners this year was “an affront to the memory of our mother.” “The justice’s family wish to make clear that they do not support using their mother’s name to celebrate this year’s slate of awardees, and that the justice’s family has no affiliation with and does not endorse these awards,” she said.

Trevor W. Morrison, a former dean of New York University School of Law and one of the justice’s former law clerks, condemned the choices in a letter addressed to the Dwight D. Opperman Foundation. “Justice Ginsburg had an abiding commitment to careful, rigorous analysis and to fair-minded engagement with people of opposing views,” he said “It is difficult to see how the decision to bestow the R.B.G. Award on this year’s slate reflects any appreciation for — or even awareness of — these dimensions of the justice’s legacy.” Shana Knizhnik, an author of “Notorious RBG: The Life and Times of Ruth Bader Ginsburg, ” spat out, “Honoring Elon Musk, who uses his platform to promote anti-feminist and anti-L.G.B.T.Q. sentiments, and Rupert Murdoch, who has used his immense power to undermine democracy, dishonors what Justice Ginsburg spent her career standing for.”

When Ethics Alarms Don’t Ring: The Nebraska Gas Heist

HEY EVERYBODY, FREE GAS!

Weeeell, not exactly free, but close enough, apparently, for a previously law-abiding, 45-year-old Lincoln, Nebraska woman, Dawn Thompson, to embark on a life of crime. I would love to hear what rationalizations she used to convince herself that what she did was okay. I’d bet anything that she employed a bunch of them.

Her gas-stealing rampage began to unravel when Lincoln Police got a call from Bosselman Enterprise’s loss prevention manager on Oct. 20, 2023. A Pump and Pantry had reported that someone was ripping them off. An investigation revealed that the convenience store’s gas pumps had received a faulty software update a year earlier in November of 2022. The update managed orders and reward cards, but it also allowed anyone who swiped a rewards card twice to shift a pump into its “demo mode.” Once it was set in that sequence, gas was free as far as the pump was concerned. One rewards card had been repeatedly used to fool the pumps, and police traced it to Thompson.

Weird Tales of The Great Stupid: O Canada!

I suppose it’s comforting to know that the U.S. isn’t quite as infected with the toxins of The Great Stupid as Great Britain or Canada. Yet.

The Goodfellas Wood Oven Pizza on Old Mill Dr. surprised diners recently with this at the bottom of the bill:

A 2% “carbon fee” ! For what, exactly? The bill explains:

Oh. Canada’s restaurant czars told reporters that the fee was legal since it wasn’t called a tax and that because the establishment’s website informs consumers that this is what they are in for, diners have to pay it. My reaction would be “Bite me!” If you are so fearful of the climate effects of eating, then don’t run a restaurant.The website explains in more detail, “what we eat fuels climate change. Goodfellas uses certified D.O.P products from Italy to remain true to the brand, and it’s not always possible to buy local. Adding 2% to every restaurant bill to invest in carbon capture will help offset our carbon footprint.”

The Toronto Sun’s article about this overt nickel-and-diming, virtue-signaling exercise says that the diners they interviewed said that the charge didn’t upset them. Canada, Land of Woke Weenies. The charge is unethical, obnoxious, and dumb. Anyone with any self-respect who hasn’t been indoctrinated and beaten into loving Greta Thunberg like Winston Smith loved Big Brother would refuse to pay the charge and dare the restaurant to have them arrested. Or say,”Fine: I’ll reduce my tip by three dollars.” Better yet, eliminate the tip entirely because the place had the gall to attempt this scam.

I don’t know how Canadians got this way, but it reminds me of “Invasion of the Body Snatchers. I think we need to start paying more attention to our northern border to keep these pod people out.
