Language Ethics: Letting The Inarticulate Control Expression

I know, I know.

Tell me about how the English language is dynamic. Next, “irregardless” will be in the dictionary—heck, maybe it is already; I’m afraid to look. Baloney. The fact that “everybody does it,” defined as “people in high places, like Joe Biden, who should know better but don’t,” does not justify treating inarticulate, lazy, careless, embarrassingly stupid language as acceptable. If “literally” means figuratively, then nothing means literally. When someone says that “her marriage was literally destroyed,” thanks to Google and the rest, the only way we know whether her marriage was destroyed or not is if we can find out whether or not the speaker is literate, and maybe not even then.

Call me a stickler, call me a crank, but making the public dumber and communication harder by declaring that those who are poor speakers and lazy thinkers are right and those who champion expressive and accurate language are wrong is not ethical. It is literally irresponsible.

Reddit’s OffMyChest forum is promoted as a safe social media site to post confessions and to seek support or advice for very difficult, personal, potentially embarrassing problems. Of course, there is no such thing on the web, and such posts are only as confidential as the forum’s participants are trustworthy.

An 18-year-old poster calling himself Pilot94 unburdened himself about a statutory rape (or two) that he escaped punishment for thanks to some good luck. But the episode obviously still troubled him. He began…

“I’ve never been good at this sort of thing. Never in my life have I fully told the truth to anyone, except my best friend…But there are things I need to say that I’ve never been able to say before. I am purposefully not using a throw away account, I highly doubt anyone I know will find this but if they do, I’m glad you now know… “

He went on to describe his life to date, and how it had begun to spin out of control:

“I basically turned into a drug dealer with my best friend. He took the pills and I sold them. We started to get into trouble with the police. Patrick and I vandalized numerous parks and places around our town. We got caught for that had probation and fines, etc. That didn’t stop the Dynamic Dumbasses though. We picked up charges for shoplifting, under age consumption, speeding, drunk driving, etc. But nobody knew. We were such good liars that we were able to keep it all to ourselves. …We ran from cops all the time and partied, got drunk, got high, and raised hell. I kept dealing drugs and we kept taking them. Somehow we avoided getting charged for that, though we were close multiple times.”

Then came the incident that prompted the post:

“I knew some girls from school (I thought they were 15-16, they ended being 13-14) that I met at a party. One night they called us up and said they were drunk and wanted to have fun. We couldn’t say no. We drove out and picked all 3 of them up. We parked by the neighborhood pool, got in the back of the truck, and started going at it. Everyone had their clothes off, the girls were making out with each other and having sex…After about an hour, we headed back to their house. We were out front when a cop pulled up. Then shit hit the fan. The girls accused us of raping them, getting them drunk and supplying drugs. They revealed their true age to the police…One of the girls was so drunk she had to have her stomach pumped and spend the night in the hospital. [My friend} and I went home with our parents as the police impounded my truck and started a full criminal investigation into what had happened. Apparently all 3 were virgins prior to the night, and only did this because they were drunk. The one with alcohol poisoning also had vaginal tearing, and they performed a rape kit on her. The evidence against us was incredible. I don’t know why we weren’t arrested on the spot…But for some reason, both the lead detective on the case and the chief of police were fired shortly after. We were told we would hear from the new officer in charge of our case, but we never did. I don’t know how or why, but it just disappeared.”

The near disaster prompted a life turnaround, he wrote, that at least so far was a success:

“Needless to say this scared us beyond straight. Going from expecting 10+ years in prison to miraculously being free was incredible. Somehow I straightened my life up and actually graduated with honors from a Top 500 school….I received a full ride Army ROTC scholarship to a prestigious military school to study Russian and International Affairs and eventually receive a commission as an officer. [My friend and I]  both have no idea how or why we were given another chance, but we definitely aren’t going to fuck it up. I know there are stories on here about suicide and other heavy subjects, but this is the most honest I’ve ever been in my life, and it feels amazing. Sorry for making it so long!”

So trusting was the author that he later posted a photo of a scholarship he received from Army Reserve Officer Training Corps to Reddit’s military forum. It included his name, and some Reddit users connected the scholarship, the school, the name and the earlier confession.

And alerted the school.

Now he may be kicked out, and perhaps prosecuted. When he asked on the forum why anyone would do this to him, one Reddit member, perhaps the same one who revealed his secret, wrote…

“You ruined a couple of girls’ childhoods. You make it sound like your a good person now and that you have turned over a new leaf but you never once indicated that you felt any remorse for these people you destroyed. I think you far exaggerate to us and yourself how good of a person you are, and how deserving you are of forgiveness.”

Another wrote:

“He considers drugging and raping 3 14 year olds in the back of his pick up “minor”, he has no remorse for the lives he’s hurt, only that he was caught. He is deserving of no forgiveness until he can show that he actually feels remorse.”

Are government ethics at all levels really getting worse, or is it just that we have more and easier access to the evidence than we used to? I hope it’s the latter. I fear it’s the former. Certainly I have never seen anything as disgusting as San Diego Mayor Filner’s determination to stay in office as evidence mounts that he is a serial sexual harasser and a menace to any woman who is unfortunate enough to come within arm’s reach. Despite the fact that the number of women coming forward to accuse him has reached eleven (actually I haven’t checked since last night…it’s probably more by now), and despite polls that show that two-thirds of the city’s voters think he should resign ( the other third are Democrats, which should, but won’t, cause some critical self-examination by the party that claims to be on the right side in “the war against women”), Filner refuses to do the honorable thing, and instead will force the city to spend millions on a recall.

The carnivals of the shameless in San Diego and New York have been keeping less spectacular but equally troubling tales elsewhere from getting proper attention. In Louisiana, for example, where ethics has always meant something other than, well, ethics, we have this  sequence of events.

Orange Jones is the executive director for the New Orleans chapter of  Teach For America. Which she was elected to the state Board of Elementary and Secondary Education, the state’s Ethics Board chose to declare, in opposition to the recommendation of its own attorneys, that the obvious conflict of interest—Teach For America bids on state teaching contracts, which are awarded by the board—wasn’t one, on the disingenuous theory that Jones was only the head of the city’s Teach For America operations, not the whole state’s. If one wants to puzzle through how Democrats can simultaneously trumpet a “War on Women” while generating standard bearers like San Diego mayor Bob Filner (now up to 9 identified sexual harassment victims, and counting; the latest appears to be Marilyn Monroe), Anthony Weiner, and of course, ex-President Bill Clinton (recall Juanita Broadrick?) , one need only to examine the schizophrenic values being nurtured in our great liberal arts universities, with the encouragement of the values–challenged Obama administration.

In May, universities received an ominous letter from Departments of Justice and Education announcing new guidelines regarding “sexual harassment” on college campuses. The new standards prohibit “any unwelcome conduct of sexual nature” and  include “verbal” conduct, meaning free speech is now officially suspect…and no longer free. (But if you have been following the news lately, you know that in Barack Obama’s America, free speech is just a trading chip for “higher priorities.”)

The new standards apply to every college receiving federal funding. According to Greg Lukianoff, president of FIRE, the government mandates  would allow a student to be charged with harassment if he asks another student out on a date and the target of his attentions deems that request “offensive.” Telling a sex joke could support a sexual harassment charge, as would using the word “fuck” in the presence of a female who resented it. FIRE points out that many presentations, debates, and expressions on campuses can now be censored as sexual harassment, citing campus performances of “The Vagina Monologues,” debates about sexual morality, and pro-con discussions on gay marriage as potential offenses.  Lukianoff, protesting that DOJ and DOE have now established speech codes that violate the First Amendment and completely ignore decades of legal precedent,says he is appalled at the attack on “free speech on campus from our own government.”

Appalled, yes, but certainly not surprised. The grip of political correctness is grasping for the throat of Free Speech in the Obama years, as the news media sits complacent and inert. FIRE is among those with the courage and determination to fight this blatant abuse of government power, but that does not diminish the seriousness of a Federal government that pays its election IOU’s to women’s rights groups by sacrificing free speech on campus.

But it’s worse even than that, for the modus operandi of this federal government, adopting the proclivities of its leader, is to speak loudly and carry a wet noodle. Just as the President is fond of making demands, ultimatums and condemnations, drawing lines and telling us to “make no mistake” about where he stands, and then following up with no tangible or meaningful action whatsoever, thus does his government fail to protect women’s bodies while trying to control what they hear. The 2011 federal Title IX investigation into Yale’s mind-blowing tolerance of rape on campus (it is referred to there as “non-consensual sex”) concluded  with a voluntary resolution that allowed Old Eli to avoid any disciplinary action for creating a “hostile sexual environment,” and this time we don’t mean allowing dirty limericks. Bear with me: I’ll get to Don Lemon eventually.

In a mature, rational, respectful democracy with an objective and competent news media, difficult and contentious issues would be thoughtfully debated with open minds and fearless honesty, without the toxic influence of rigid ideologies, partisan loyalties, group identification, or biases. The objectives: reach the truth, identify problems, begin solving them.

This process is difficult under the best of circumstances, and in the United States, circa 2013, it is nearly impossible on any issue, and dangerous on the issue of race, with both the media and elected officials actively seeking to exacerbate racial divisions and misconceptions. A recent poll suggests that the perception of racial divisions in America has worsened by 25% since Barack Obama was elected President, following decades of steady improvement. Why is this? There are many reasons, but the cynical pandering to misconceptions in the black community is one major suspect.

President Obama, had he been fair and responsible, might have used his remarks about the George Zimmerman trial to point out that neither the incident itself nor the verdict of the jury were relevant to race issues, or created by a “stand your ground” law that has been a lightning rod for accusations of racism in the justice system. Instead, he talked about how he “understood,” and apparently agreed with, an interpretation of the events based on past African-American experiences with racism. This was irresponsible and wrong. It was as much an endorsement of irrationality, ignorance and bias as it would be to explain that current day racists see blacks through the prism, “those sets of experiences” in Obama’s words, of their region’s history of culturally acceptable slavery, and we have to respect their views as a result. The President has not, as would be a far more justifiable statement, explained that opponents of same-sex marriage are not bigots, but see the issue through the ” sets of experiences” of their religious upbringing. Serial rapists may also see women through the prism of their childhood abuse—those are rather damaging “sets of experiences”— at the hands of their mothers.

There are always powerful reasons why people have hatreds and biases, and reasons why hatreds and biases cripple their ability to interpret reality and act responsibly. We can all understand that, but it doesn’t justify distorting the facts. Blacks are not inferior to any other race, no matter what the “prism” says. Gay marriage poses no harm to society, and gays deserve the same rights as anyone else, and the Bible doesn’t change those facts. Rape victims are not responsible for the misogyny of rapists, no matter how their distorted thinking came to be.

And the acquittal of George Zimmerman was not evidence of rampant white racism, regardless of the African-American experience. The President had a duty to say that. He had a duty to say, “I understand, but you are wrong on the facts.” He did not. Instead, he encouraged and supported a distorted and biased narrative that is harming race relations and respect for the justice system, and far too many in the news media—which is to say, anyone in the media who is stooping to this—are trying to continue the process. For example, Abbe Smith, in the Washington Post this weekend, had an article on a topic I have discussed here more than once: the challenge of a defense attorney representing a guilty and heinous client. It was an excellent piece, but the Post headline writers and editors unconscionably and unethically decided to pander to the city’s  predominantly black population’s bias by publishing it under this:

From across the pond comes a stupid story rich with buried ethics treasures.

Eleven-year-old Holli McCann was sent home from a week long school trip to the Isle of Wight (where Paul McCartney started vacationing  when he turned 64) because she violated one of the rules of the trip: no chocolate. The Bromet (in Watford, Herts) Primary School’s headmistress, Yvonne Graves, discovered the infraction by surreptitiously reading a private letter that Holly had written to her mother. After perusing the incriminating missive,Graves ordered teachers to search Holli’s room, which they did with the diligence and thoroughness of the FBI looking for forensic evidence of a serial killing, even emptying her toiletry bag into the sink and pulling out the lining of her suitcase. It was all worthwhile, however, because they discovered the yummy but incriminating substance they sought.

After the smoking chocolate was discovered, the headmistress contacted Holly’s mother and told her to pick up her daughter immediately—she had been voted off the Isle. The mother begged  Graves to reconsider, but was refused. She had to borrow money to make the 160-mile trip to pick up her daughter.

One of the criteria for admission to the practice of law is proof of good character, and what is considered proof of bad character will keep even a stellar law grad out of the courtroom. Bad character can be inferred from many kinds of conduct—criminal convictions, lies under oath, and failing to meet financial obligations, among others. The latter has occasionally blocked an otherwise qualified young lawyer from entering the profession when unpaid debts get out of hand, and that means that the most prominent unpaid debts in recent headlines, student loans, can sometimes foil a legal career. New York law grad Robert Bowman, last I checked, was still trying to convince the New York Bar that being over $400,000 in debt on his student loans didn’t mean he wasn’t fit to practice law. So far, he hasn’t succeeded.

I’ve flagged this kind of post before, and I’ll continue to do so until sophomoric bloggers and commentators stop snickering and winking about child sexual abuse and outrageous breach of trust.

Why it is hard to grasp the concept that a school teacher seducing and having sex with an underage student is a despicable and harmful crime, and not some sort of male fantasy come true, I cannot conceive. Our education system consistently fails at conveying values and knowledge, but the fact that public schools are too often hunting grounds for sexual predators seeking to use their positions and power to turn kids into living, breathing sex toys is, you know, kind of cute and titillating to people like Eric Owens, laughably called the “Education Editor” at the Daily Caller. Ethics Alarms has been light of late on tales of public schools  intimidating, indoctrinating and abusing children, all while teaching them that too often adult authority does not deserve the respect it demands. Of course, there is a reason for the relative dearth of horror stories from that sector: school is out.

Never fear, however: somewhere, some school administrator is embarrassing the education profession…in  Idaho, for instance, where Summer Larsen, a fourth-grade teacher at Declo Elementary School in Declo, Idaho, had the brilliant idea of having students who made their reading proficiency goals punish those who did not by drawing on the their faces with felt-tip markers. Blaming God For An Unfair Decision

Maddy Paige is a 12-year-old girl from Locust Grove, Georgia who was the starting defensive tackle for her sixth grade football team at Strong Rock Christian School until the school’s head, Patrick Stuart, decided that the order of the universe depended on his implementing a new policy declaring that “Middle school girls play girls’ sports and middle school boys play boys’ sports.”

For all the benefits and wisdom a conservative approach to public policy can add to society’s progress, conservatives will always erode their credibility and trustworthiness by their tendency to stubbornly insist on unjust and arbitrary rules because “that’s just the way it’s always been.” This will be the impact of  conservative opposition to gay marriage, now officially shown to be futile by the Supreme Court’s DOMA rejection yesterday on Due Process and Equal Protection grounds under the Fifth and Fourteenth Amendment, and it is the lesson to be harvested from Stuart’s fatuous move.
