Ethics Verdict: Hillary Clinton, As Well As Her Spokespersons, Directly And Intentionally Lied About Her Emails, And The News Media Has An Obligation To Make That Clear

The fact that Hillary Clinton is a serial liar and is preparing to deceive her way to the Presidency of the United States is of utmost importance to the nation. This is a fact, by the way. So far, the news media has allowed the usual Clinton strategy of obfuscating, denying, confusing and blurring instances of their misconduct, as well as distracting attention with new scandals involving them (like this one), succeed as it has in the past. This must stop. Contrary to the Clinton Credo, character matters, and the greater the power a leader has, the more it matters. A leader who engages in blatant lying has no respect for those she leads, and cannot be trusted. Those who cannot be trusted should not lead. The news media has an obligation to let us know who cannot be trusted.

It is as simple as that.

We watched that classic Clinton strategy in action when two inspector generals announced that they were calling upon the Justice Department to investigate Hillary’s alleged mishandling of classified Sate Department materials via her private server, in violation of government policies, her own department’s policies, and responsible stewardship and principles of cyber security. Immediately, Clinton began muddying the water and boring the public by launching a dispute over whether or not it was a “criminal” investigation, using undue influence to get the New York Times to change its story, and suddenly making the controversy about the messenger rather than its message.

Oh, the Clintons are good at this, no doubt about that.

Now here is another example in the same controversy.  Though Clinton has insisted that there was nothing classified on her email system and that any dispute is just a technical dispute “between agencies” 41 of the messages turned over to State by Clinton were recently given classified status by the State Department. Clinton’s word-parsing defense has been that she did not send or receive any material marked classified, but as law professor Jonathan Turley explained succinctly (he has been in the classified loop in the past), virtually anything coming out of the office of the Secretary of State would be automatically considered classified as a matter of course until it was reviewed and determined not to be classified. Clinton’s denials are based on typical deceit designed to fool the uninformed: her exchanges on her illicit private e-mail server weren’t classified because they were made on her illicit private e-mail server!

(Meanwhile, there are all those other e-mails Hillary had destroyed before the State Department could review them and after she knew that they would be subpoenaed.  Who else has them? Never mind: we trust Hillary’s judgment, right?)

Bill Cosby’s lawyer Monique Pressley decided to become a hybrid attorney-publicity agent yesterday, and in doing so provided an impromptu seminar on why people hate lawyers, and often should. She was carefully spinning and dissembling on behalf of her client without breaching the ethics rules against lying, parsing words and phrases with skill and deftness, all in the service of a serial sexual abuser and perhaps the greatest hypocrite pop culture has ever produced.

At a “Movement for Black Lives” rally at Cleveland State University, a public institution, an announcement was made to the crowd that “this is a peoples of African descent space. If you are not of African descent please go to the outside of the circle immediately.” White reporter Brandon Blackwell retreated  to the back of the crowd while being jeered by participants, as he was told by members of the crowd to stop filming, accused of being a white supremacist,  and hands were held up in front of his camera. At one point as Blackwell demanded that those blocking his view not touch his camera, a participant in the rally confronted him by saying, “I got 800 black people behind me, what the fuck you going to do?” [The video is available here .]

Of Course Sandra Bland Shared Responsibility For What Happened To Her, And Other Observations On The Bland Tragedy

Let us stipulate that trooper Brian Encina behaved unprofessionally and atrociously by any standard in his handling of the vehicle stop of Sandra Bland in Prairie View, Texas, on July 10, setting into motion a series of events that led to Bland’s death by apparent suicide in a jail cell three days later. The police work shown by the dashcam video is unforgivable, and could be used in officer trainings on how not to handle a traffic stop.

That does not make him responsible for Bland’s death, however. He was not responsible for an incompetent bail system that had this woman in jail for three days, apparently because it was a weekend, and if she did take her own life (agreed: since her family has no reason to trust authorities at this point, nothing is likely to convince them of that no matter what the evidence, and also agreed, the suicide verdict looks mighty shaky at this point), that is, by law and logic, an intervening cause that exonerate the officer in Bland’s death. Activists will make the obvious Freddie Gray comparisons, but in this case there is no reason to believe that the officer, no matter how wrongful his conduct, either intended or contributed to her death. At worst, Encina is guilty of bad policing and using excessive force. This is not the Freddie Gray case, unless there was a dark conspiracy of frightening proportions.

Once again, however, a black citizen is dead after a confrontation with a white cop. For many pundits, civil rights advocates and black racists as well as irresponsible elected officials, that’s evidence enough that this was a racial incident. It isn’t evidence enough, however. The racial identities of the participants do not mean race was a factor, and absent some other facts that we have not learned about yet, any effort to suggest otherwise is nothing but the Zimmerman con, assuming racism unjustly to advance a political agenda. Let’s see if the Justice Department launches a civil rights investigation this time….again, assuming nothing more suspicious turns up.  That would be the smoking gun evidence of this DOJ’s bias. In the recent post, Stop Your Cultural Bulldozing, America: Disney World Taking Down Bill Cosby’s Bust Is Like Removing The Jefferson Memorial, I described the danger of removing well-earned cultural honors and memorials for individuals who later are found to have engaged in less than admirable conduct by current standards. I wrote in part…

“Sure, it’s uncomfortable having a bust of an unapologetic sexual predator in a Disney World attraction, and it might prompt some uncomfortable question from the kiddies. Well, good. It’s never too soon to learn that human beings are flawed, complex creatures, and that even the most brilliant and talented have dark sides, do terrible things,  and can be cruel, selfish, dishonest and even criminal. We honor Thomas Jefferson for his crucial role in giving this nation life, and defining its mission and values for the ages. Donald Trump is a human ethics train wreck.

Now boarding is Bill O’Reilly, who followed the equally rash and misguided Rush Limbaugh into being fooled by that sneaky ol’ cognitive dissonance scale. They both detest the left-biased news media so much that the fact that it is properly pointing out Trump’s numerous flaws seems like proof of Trump’s virtue to them. After all, the same people attacking Trump attack Rush and Bill, too.

Gotcha! They fell right into the media’s trap! Standing up for Trump himself, as opposed to defending the occasional instances when he, like the proverbial blind squirrel, stumbles upon the nut of a valid point, marks any defender as an ethics dunce, and a real dunce too. This is terrific for the unethically slanted media, because then it can then discount the justified criticism from Rush and O’Reilly—and others foolish enough to board this wreck—of mainstream journalism’s outrageous bias as just typical right wing delusion.

“Black Lives Matter” Is Unethical, And So Are Politicians Who Pander To It

black-lives-matterThat’s the tipping point for Ethics Alarms. “Black Lives Matter” is unethical, and those who use it are unethical. And politicians who grovel to those who criticize them for not embracing it are contemptible.

The Martin O’Malley embarrassment over the weekend clinched it for me. Demonstrators interrupted the former Maryland governor, mounting a pathetic campaign against Hillary Clinton for the Democratic presidential nomination, as he was speaking at the Netroots Nation conference. When they shouted, “Black lives matter!” a rallying cry of protests that has superseded “Hands Up! Don’t Shoot!” because that one was eventually exposed as a lie,  O’Malley—the naive, racist fool!!!!— responded: “Black lives matter. White lives matter. All lives matter.”

The activists  responded by jeering him and refusing to let him speak. .Later in the day, O’Malley, “showing the firm commitment to leadership in the face of adversity that we expect in a presidential candidate,” as one wag put it on Jonathan Turley’s blog—apologized, saying…

“I meant no disrespect. That was a mistake on my part and I meant no disrespect. I did not mean to be insensitive in any way or communicate that I did not understand the tremendous passion, commitment and feeling and depth of feeling that all of us should be attaching to this issue.”

I bent over backwards to defend Smith College President Kathleen McCartney when she apologized for using the phrase “all lives matter” in December of 2014. I wrote:

If an activist says to me, “too many children go to bed hungry!” and my retort is, “Too many people go to bed hungry!”, the unspoken argument is “So stop acting like children are a special problem!” If I say, “We need peace in Syria,” and a friend’s response is “We need to end war, period!”, I view that as an effort to minimize my concerns by launching it from the realm of a specific issue into vague, generic territory.  “Black Lives Matter!” in the context of recent police episodes where African Americans died under circumstances that many believe show police callousness and excessive force against blacks is a distinct assertion that suggests that the law enforcement and justice systems do not currently function as if black lives matter as much as white lives. It is true that “All Lives Matter” includes the larger subset “black lives matter”; it is also true that it blurs the issue at hand, and dilutes the protesters’ point. It is not inappropriate for  President McCartney to apologize in this context…unless, of course, she intended a rebuttal, in which case she is indeed spineless.

I still believe that made sense in December, but “Black Lives Matter” means something very different now, after six police officers were charged with murder to quell a Baltimore mob after Freddie Gray’s death, and after President Obama decided that the merciless shooting of a  young white woman in San Francisco by an illegal immigrant wasn’t worthy of the same attention he has given other deaths when it was a black life that had been lost. Ethics Observations On The Iran Deal And Its Media Coverage

Throughout the negotiations for the apparently now completed Iran nuclear deal, all I could think about is how it would have made my old negotiation professor, the late Adrian Fisher  (who negotiated the SALT treaty) throw up. He taught his negotiation class at Georgetown Law Center, where he was the Dean, that no advantageous negotiation can occur unless your side is willing to walk away from the table. It has been clear from the beginning that the Obama Administration was desperate for this deal for political purposes, not national security, which the treaty does not assist in any way.

Dean Fisher—and his frequent guests, like Averill Harriman— taught his class that deadlines were essential in the negotiation process, both as a tool to force the other side to make tough decisions, and as a demonstration of resolve.  In this negotiation, the U.S. repeatedly allowed “deadlines” to pass, with no consequences. That tells the Iranians all they need to know about the U.S.’s likely response when they violate the terms of the agreement, as they are certain to do, at least as long as this weak, feckless, posturing and irresolute President is in office.

Of course, to be fair, the Iranians had plenty of evidence on that score already, as did we all.  “Red line,” you know.

2. The administration admits that it does not trust Iran. GOP Senator Lindsey Graham, who opposes the treaty, stated that Iran has never kept any international agreement or promise,, and thus cannot be trusted to keep this one. Nobody is seriously disputing that. Under such conditions, the whole concept of the deal is irresponsible. Who signs a treaty that it seriously doubts the other side will obey? Graham called this is the equivalent of making a deal with “religious Nazis.” The comparison is apt, except that the Obama arrangement with Iran is in some ways even more reckless than the one Neville Chamberlain made with Hitler. At least Chamberlain believed—stupidly, naively—that Hitler wanted peace. The Iran deal is what the Munich treaty would have been if Chamberlain was pretty sure Germany would invade Czechoslovakia and Poland anyway.

Chamberlain’s “peace in our time” was a pathetic hope. Obama’s is more like a lie. Continue reading →

Cognitive Dissonance Chronicles: Now “The Cosby Show” Is Suddenly Racist And Part Of A Conservative Plot

When “The Cosby Show” was on the air on CBS from 1984 to 1992, it was unanimously praised—except by a few grumps and crackpots, for there are always grumps and crackpots—for being an unequivocally positive influence on racial understanding and the culture. Finally African American characters were on television every week who were not inner city criminals, hucksters, drug dealers or pimps. Finally, after dozens of white “Father Knows Best” style sitcoms, there was a comedy about black professionals heading a family with kids that used good grammar, didn’t skip school and were never in trouble with the law. “The Cosby Show” won awards and plaudits from educators and civil rights groups. It provided a positive model for an attainable future for black children, and an image of black Americans that combated racism by making it seem as illogical as it is. These were good people, good parents, good citizens, with the same values, hopes and dreams as everyone else.

The insidious power of cognitive dissonance is that it allows strong feelings about anyone or anything to unfairly and irrationally carry over to anything or anyone else that the object of those feelings touches. Today, as the fact that the creative force leading “The Cosby Show” had a hypocritical and despicable secret life as a sexual predator becomes undeniable, this process is triggering dangerous and ugly shifts in attitudes and advocacy. A confluence of events has resulted in Bill Cosby being teamed with the Confederate flag (remarkably, it murdered nine African American church members in Charleston! ) to trigger a troubling wave of attempted cultural and historical purges—and where it stops, nobody knows. Some progressives want to wipe all memory of Bill Cosby’s achievements from the nation’s consciousness, just as they want to  tear down every statue of a Confederate military hero and wipe the name of Robert E. Lee off hundreds of schools, streets and parks.

[Aside: Stations are now pulling The Cosby Show, once one of the most syndicated and ubiquitous of all sitcoms, from their schedules. This is just a reasonable business decision. The stations reasonably assume that the show will not be as entertaining or popular once it is impossible to watch Bill Cosby as Dr. Cliff without thinking about Dr. Cliff secretly drugging and raping his female patients. That’s not cognitive dissonance. That’s just reality. Actor Gig Young made some of the best romantic comedies of the Sixties with Doris Day and others. He was a skilled comic actor, but he murdered his wife and killed himself in a drunken rage, and it’s hard to laugh at Gig any more. Those movies are virtually never broadcast, and it is hard to find them on DVD. Among Bill’s victims are the member so of his cast, including the kids he professed to love like a father, who will lose millions in residuals because he couldn’t control his demons.]

A time machine is helpful in these matters, so Salon, the left-wing blog that is so predictable it sometimes catches me by surprise, since it is hard to believe that any publication will willfully rush into self parody, has suddenly decided that “The Cosby Show” was “based on a distorted and inaccurate presentation of the black community, one that has enabled a pernicious type of right-wing “colorblind” racism to flourish.”

Ah. Cosby is bad, so everything he did before we found out that he was bad was bad too. We weren’t just duped about him. We were duped about the values he stood for!

The author of the article is Chauncey De Vega, an African American journalist who doesn’t even try to hide one of his motives: he’s still steamed that Cosby dared to urge African American families to be responsible, and pointed out that wearing one’s pants like they do in prison wasn’t the way to get respect from employers and potential associates not recently out of prison.  Mostly, however, he is determined to re-cast “The Cosby Show” as complicit in embedding racism in U.S. society. At a government legal ethics seminar a week ago, one of my attendees told me of the nightmare he and his family were going through because all of his personal data, including confidential information from his FBI background check,and his fingerprints, were now available to those hostile to the US, and potentially hostile to him. He was furious. He trusted his government, and it proved incompetent…as usual, under this President

The data stolen from the Office of Personnel Management affected 22 million Americans directly, and indirectly many more, through their now imperiled families. It took an almost unimaginable amount of pure gall, as well as a complicity and incompetent news media, for President Obama and his supporters to be  claiming status a transformational leader because of a Supreme Court decision that was inevitable and that he had no hand in at all, while two more federal agencies  run by his appointees—Homeland Security is supposed to prevent such attacks— had failed the American people in epic fashion.
