Now That The ACLU No Longer Wants To Be The ACLU, The United States Needs An ACLU

In a confidential memo obtained by former board member Wendy Kaminer, the American Civil Liberties Union has defined a policy that retreats from and undermines—perhaps the best word is betrays— its traditional mission of protecting the Bill of Rights, and especially the First Amendment rights of all Americans.  The memo says in part,

Work to protect speech rights may raise tensions with racial justice, reproductive freedom, or a myriad of other rights, where the content of the speech we seek to protect conflicts with our policies on those matters, and/or otherwise is directed at menacing vulnerable groups or individuals….We are also firmly committed to fighting bigotry and oppression against other marginalized groups, including women, immigrants, religious groups, LGBT individuals, Native Americans, and people with disabilities. Accordingly, we work to extend the protections embodied in the Bill of Rights to people who have traditionally been denied those rights. And the ACLU understands that speech that denigrates such groups can inflict serious harms and is intended to and often will impede progress toward equality.

…There is no presumption that the First Amendment trumps all other amendments, or vice versa. We recognize that taking a position on one issue can affect our advocacy in other areas and create particular challenges for staff members engaged in that advocacy. For example, a decision by the ACLU to represent a white supremacist group may well undermine relationships with allies or coalition partners, create distrust with particular communities, necessitate the expenditure of resources to mitigate the impact of those harms, make it more difficult to recruit and retain a diverse staff and board across multiple dimensions, and in some circumstances, directly further an agenda that is antithetical to our mission and values and that may inflict harm on listeners…Our defense of speech may have a greater or lesser harmful impact on the equality and justice work to which we are also committed, depending on factors such as the (present and historical) context of the proposed speech; the potential effect on marginalized communities; the extent to which the speech may assist in advancing the goals of white supremacists or others whose views are contrary to our values; and the structural and power inequalities in the community in which the speech will occur….

Where the ACLU defends the right to speak of those with whom it disagrees, it should generally engage in counter-measures both to reinforce the
values the speaker attacks and to make clear that we do not endorse the substance of the views. Some options might include:

1. Denouncing the views in press statements, op-eds, social media, and other available fora.

2. Participating in counter-protests. When we assist people in securing the right to march or demonstrate for views we condemn, we can and generally should support and participate in counter-protests, with consideration given to participation by senior staff or board members to highlight the ACLU’s commitment and ensure that such participation does not disproportionately burden other staff.

3. Supporting other counter-speech by supporting, organizing or helping to organize events, facilitating access to media, or taking other actions that will amplify and
strengthen the voices of those espousing our values.

4. Expanding our work on behalf of the values the speaker attacks.

5. Earmarking any fees recovered from the case to projects within the ACLU that further the values that we support and the speaker attacked, or donating them to another organization that works to advance those values, preferably in the geographical area where the speech occurred….

Morning Ethics Warm-Up, 6/18/2018: Moral Luck, Non-Hypocrisy, Hypocrisy, Thomas Jefferson And WKRP

Good morning, Monticello, everyone…

1 The Inspector General’s Report and Tales of Moral Luck:  Stop me if you’ve heard this one: FBI staffer Peter Strzok, working on both the Hillary Clinton email investigation and the Russian collusion investigation, received a text from Lisa Page, Strzok’s co-worker and adulterous lover, that read, “[Trump’s] not ever going to become president, right? Right?!” Strzok replied, “No. No he won’t. We’ll stop it.”

 September of 2016, the FBI discovered that Clinton’s illicit emails had somehow ended up on the laptop of disgraced former Congressman. Anthony Weiner, who is married to Hillary’s top aide and confidante, Huma Abedin.  Strzok, we learn in Michael Horowitz’s report, was instrumental in  the decision not to pursue the lead, arguing that the Russia investigation was a “higher priority” at the time.”We found this explanation unpersuasive and concerning,” the report concluded. The laptop was available from September 29 until October 27, when “people outside the FBI” finally forced  the FBI to act on the evidence. “The FBI had all the information it needed on September 29 to obtain the search warrant that it did not seek until more than a month later,” the IG report stated. “The FBI’s neglect had potentially far-reaching consequences.”

“Comey told the OIG that, had he known about the laptop in the beginning of October and thought the email review could have been completed before the election, it may have affected his decision to notify Congress,” the IG report says, and also states,

“Under these circumstances, we did not have confidence that Strzok’s decision to prioritize the Russia investigation over follow up on the [Clinton] investigative lead discovered on the Weiner laptop was free from bias.”

Got that? The IG believes that anti-Trump, pro-Hillary bias led Strzok to delay the Weiner laptop investigation, and it may have backfired, helping Trump and hurting Clinton rather than the reverse. But the fact that moral luck took a hand and foiled his intent doesn’t change the fact that this is strong evidence that partisan bias DID infect the Clinton investigation, and probably the Russian inquiry as well. This makes the media’s spin that the IG report dispels accusations of bias even more unconscionable.

That Strzok’s biased and unethical tactics to help Hillary intimately failed spectacularly doesn’t change or mitigate the fact that a prime FBI staff member was intentionally trying yo manipulate the investigation for partisan reasons.

2. The Web thinks you’re an awful person.  A tease from a “sponsored site” in the margins of my NBC Sports baseball feed  says, “Jan Smithers starred in hit sitcom “WKRP in Cincinnati.” Try not to smile when you see what she looks like now!” Wait…what’s that’s supposed to mean? Is she a circus clown? No, these and similar come-ons apparently assume that normal people love mocking formerly beautiful young stars when they no longer look young. “Heh, heh..well, Jan Smithers, I guess you’re not so hot now, are you? What kind of person takes pleasure in the physical decay of others just because they were once gorgeous?

Actually, the photo of Jan Smithers did make me smile, because unlike, say, Jane Fonda,

…who at 80 has allowed plastic surgeons to make her look like one of the fragile immortal female ghouls who shatter into pieces at the end of “Death Becomes Her,” Smithers (who is younger than me and a decade and a half younger than Hanoi Jane) has allowed herself to age naturally, and by my admittedly biased lights, is lovely still: Continue reading

From Ethics Alarms “The Truth Hurts” Files: Target’s Fathers Day Card

Target came under fire for putting out the Father’s Day card above, and apologized, especially for having only a black couple version.

Interesting: what exactly is wrong about the card? It depicts the state of black fatherhood as it is: about 72% of black births are to unmarried couples, while about 32% is the white figure. Is the perceived problem that the card shames African Americans, or that it appears to give couples having children without bothering with marriage a societal pass by celebrating their lack of responsibility? Not being married to a child’s mother vastly increases the likelihood of absentee fathers, and being raised by single mothers is statistically linked to many social pathologies that disproportionately plague black communities.

Maybe Target isn’t the one who should be apologizing. One incensed critic wrote on Twitter, “This is an insult to black fathers and a slap in the face to the African-American community as a whole.” No, that would be true if the card’s implication wasn’t true. It is true. Now what? Getting angry at Target is a deflection.

Of course, the likelihood is that Target wasn’t thinking deeply about this at all. It just thought the “baby daddy” card opened up a new Fathers Day market.

Unethical Quote Of The Month: Outgoing Harvard President Drew Faust

…unless your racial origins would cause an imbalance in our carefully constructed palette of backgrounds, abilities and hues…

Asian-American groups  filed a federal lawsuit challenging Harvard University’s affirmative action policies as discriminatory, and the Justice Department backs of plaintiffs who say the university is discriminating against Asian-American applicants. (I wrote about the lawsuit here.) Of course they are discriminatory. In its quest for “diversity,” Harvard and other schools have penalized Asian-Americans, who confound Charles Murray-haters and racial-privilege mongers by being disproportionately excellent in academics. On a level playing field, in a purely merit-based admission system, they would dominate elite institutions, with numbers far beyond what demographics alone would predict. Can’t have that!  (This the leftist reaction, and they run U.S. education. My reaction: what an inspiring American success story!) Thus Harvard and other schools have used de facto quotas to reject Asian Americans who would have been admitted easily if they were a different color.

Outgoing Harvard President Drew Faust, a feminist proto-totalitarian who has shown an eagerness to stomp on basic human rights like speech, due process and association during her disastrous tenure,  sent the campus a message this week attacking the law suit. Here it is:

Dear Members of the Harvard Community,

In the weeks and months ahead, a lawsuit aimed to compromise Harvard’s ability to compose a diverse student body will move forward in the courts and in the media. As the case proceeds, an organization called Students for Fair Admissions—formed in part to oppose Harvard’s commitment to diversity—will seek to paint an unfamiliar and inaccurate image of our community and our admissions processes, including by raising allegations of discrimination against Asian-American applicants to Harvard College. These claims will rely on misleading, selectively presented data taken out of context.  Their intent is to question the integrity of the undergraduate admissions process and to advance a divisive agenda. Year after year, Harvard brings together a community that is the most varied and diverse that any of us is likely ever to encounter. Harvard students benefit from working and living alongside people of different backgrounds, experiences, and perspectives as they prepare for the complex world that awaits them and their considerable talents.

I have affirmed in the past, and do so again today, that Harvard will vigorously defend its longstanding values and the processes by which it seeks to create a diverse educational community. Tercentenary Theatre was filled with individuals from the widest range of backgrounds and life experiences. It was a powerful reminder that the heart of this extraordinary institution is its people.

A Lost Ethics Movie: John Ford’s “Sergeant Rutledge”

All right: not exactly lost, but certainly almost forgotten.  Released in 1960, “Sergeant Rutledge” was a daring Western with a racial justice theme well before Jim Crow had breathed its last. The iconic film version of “To Kill A Mockingbird” was two years from being made, and master director John Ford told the story of a black “buffalo soldier” wrongly accused of raping and killing a white woman and shooting an officer. The film was the first to feature the Buffalo Soldiers, the all-black cavalry units that continued through World War II, and was the first Western to feature a black protagonist. Sergeant Rutledge, played by the perfectly cast Woody Strode. Rutledge is innocent, but because he is black and a white girl was one of the victims,  he is presumed guilty. The prosecution in his military trial has blatant racist overtones, and Ford unsparingly focuses on the indignities imposed on African Americans in the unsettled frontier culture following the Civil War. In Strode, Ford had an almost too ideal star: everything about him is perfect. He’s brave, well-respected, professional, trusted and gorgeous: Strode was a magnificent former athlete who projected virtue quiet dignity in every film appeared in. I don’t think he ever played a villain.

The movie has some problems, including a Perry Mason-style resolution that is either over-acted, badly-acted, or badly-written: I couldn’t decide. It was also a flop, perhaps because the nation was more ready for the theme two years later, perhaps because Ford’s star was fading fast by 1960, but more likely because it had no major star like Gregory Peck  (or John Wayne, who was busy making “The Alamo”) to persuade audiences take a chance on an unusual film. It is Strode’s only starring role, and Hollywood was just beginning to cast Sidney Poitier in leads—Poitier was a far more versatile actor—in 1960. The other star is Jeffrey Hunter, best remembered today for making the original pilot for “Star Trek” as “Captain Pike.” Hunter never was a box office draw, though he was a strong second lead in Ford’s “The Searchers.”

Somehow the myth has grown that this was a film in which Ford, nearing the end, was “apologizing” for his previous racially insensitivity in other films. That’s revisionism. Ford made Westerns about cowboys and the West, and both were undeniably dominated by whites, with blacks in subservient positions. It’s not insensitive to be faithful to history.  Ford was, by the standards of his time, a progressive liberal, and the kind, apparently now extinct, who could still have close friendships and working relationships with conservatives, like Ward Bond, Walter Brennan, James Stewart and John Wayne. For example, Ford memorably stared down arch-Right director Cecil B. DeMille when DeMille was trying to get the Screen Director’s Guild to install a loyalty oath. Continue reading

Comment Of The Day: “When Businesses Have No Principles, No Courage, And The Community Likes It That Way”

Toxic woke is a specialty…

The bizarre episode in Portland, Oregon, in which two bakery employees were fired for following store policy because their doing so upset a black activist, and the establishment is so self-righteously “woke” that her demands were deemed sufficient to make injustice mandatory, has received almost no national publicity. I presume this is because it illustrates the worst of progressive logic, group preference, and hubris to a nauseating extent. Almost as awful as the Back to Eden bakery’s mistreatment of its employees are the addled statements of its owners, which betray an increasingly common (I wish I could write “rare”) certitude of a standard-issue social justice warrior’s virtue, despite overwhelming evidence to the contrary.

This story is fascinating on so many levels, from all angles: legal, business practices, ethics, public relations damage control, and a whole host of other areas. Thankfully, geometry and nationalized medical care were spared.

From the outset, it seems kind of dumb to deny a patron pastry at 9:06 p.m. because of a rigid application of store hours. This is a bakery and the business of a bakery is sell baked goods. Any sale of a baked good is a good sale, no?

Yet, if the bakery declares the store hours, the employees should not necessarily be punished for enforcing that policy. Otherwise, you would have people coming and going at all hours and the employees would have to stay beyond their shifts, which may result in hardships on them and others the employees depend on. For instance, if a child is at daycare, there may be an additional fee payable to the daycare because the employee arrived late to pick up the child. Termination of the employees for enforcing the store’s hours seems cruel, harsh, and unfair to the employees.

How this situation spiraled out of control is truly amazing. At first, I thought the fired employees posted about it; then, I learned the Lillian, the Perpetually Aggrieved, posted videos she took from outside the bakery on her Facebook feed, which then went viral. Many Facebookers banded together in a quasi-online lynch mob and filled the bakery’s Facebook page with love letters and messages.

The owners, dreaming of gluten free cookies, awoke to a public relations nightmare. One of the owners contacted Lillian via Facebook Messenger to try to apologize and resolve the problem (without knowing the real facts); though well-intentioned, he stepped into a virtual hornets’ nest. He then tried to make further amends by writing a preliminary statement, which failed miserably. His response: a 3400 word statement, which he subsequently deleted. The two statements, taken together are a brilliant lesson in multiculturalism, diversity, virtue signaling, damage control failures, capitulation to The Mob, sacrificing someone for the Greater Good, and the ranking order of privilege and standing in the Grievance Industry.

The initial statement had this little gem:

“Back to Eden Bakery is 100% committed to being a welcoming and supportive environment for all customers who share our values of inclusivity (sic?) and dismantling the white supremacist hetero-patriarchy.” Continue reading

When Businesses Have No Principles, No Courage, And The Community Likes It That Way….

This, by rights, should be a Kaboom!, but after the Starbucks fiasco, my head is no longer surprised enough by outrageous  race-bullying and craven corporations to explode. It is a terrible story, however. I don’t advocate boycotts, but this bakery deserves to be picketed.

On the other hand, it’s Portland, Jake, so maybe I should forget it. But still …hold on to your skull…

Two employees of a bakery denied a black woman service because the business had closed at 9 pm, as was its policy. The woman, however, cried racism, and the store released multiple apologies and public statements. In one, the bakery’s co-owner wrote, “We are doing business in a gentrified neighborhood in a racist city within a racist state of a racist country.”

I’m not even going to comment on that, except to recommend that the guy run onto the field of an NFL game and kneel.

Oh, I almost forgot the beauty part: the bakery fired the two employees. For following the store’s policies. For closing the store on time. For not giving special dispensation to a woman demanding entry because she was black.

According to its own surveillance video, a black woman named “Lillian”, who is  known  as a “professional equity activist”—that is, a social justice predator who was probably lying in wait until the store closed to provoke this controversy— entered at 9:06 p.m….after the bakery’s closing time, after the Catch 22-doomed employees turned off the “OPEN” sign. Two white women tried to enter the bakery two minutes before “Lillian, “and were properly informed that the business was closed for the night. Ah, but they had no race card to play. “Lillian” left the store briefly and began recording video. Of course she did.

The bakery’s statement—hold on to that cranium, now!— says that even though  the employees were following the business’s protocol of closing at 9 p.m. and did nothing to suggest racism, they were fired because “sometimes impact outweighs intent.”

In other words, they should recognize that society has handed blacks and the race-grievance mob the weapons to destroy them, and behave accordingly.  Is there any other interpretation? The bakery also said  that the way the employees went about denying the woman service, “lacked sensitivity and understanding of the racial implications at work” and that “this is more about how a black woman was made to feel.” Not a white woman, now or just a woman. How they choose to feel would be their own problem. A black woman, however, felt that the rules should be bent for her, and then felt that two employees trying to do their jobs had to be sacrificed.

Just Trying To Get The Rules Straight…[Updated]

Pardon me for being obtuse, America, but I want to make sure I understand this.

Samantha Bee, the comic who called Ivanka Trump a “feckless cunt” yesterday on her TBS show “Full Frontal,” apologized today, saying on Twitter,

“I would like to sincerely apologize to Ivanka Trump and to my viewers for using an expletive on my show to describe her last night. It was inappropriate and inexcusable. I crossed a line, and I deeply regret it.”

No repudiation of her words were forthcoming from TBS, or Turner Broadcasting, which owns that network as well as CNN. [UPDATE: After this was posted, TBS stated that Bee’s words were “vile” and “inappropriate,” and that it was their “mistake” as well as Bee’s.]

Now, Roseanne apologized for her tweet connecting Obama-whisperer Valerie Jarrett to the Planet of the Apes, yet was not only fired, but had her show, and its entire cast and crew, tossed as well. ABC, which did the tossing, explained that her tweet, which was on Roseanne’s personal Twitter account, did not comport with the network’s values. Well, did anyone think for a nanosecond that Roseanne was speaking for ABC with her obviously spontaneous, not-very-well-thought-out slur? Of course not. In contrast, Bee’s line that was “inappropriate and inexcusable” was  scripted, vetted by the network, and prerecorded, as well as previewed by network personnel . So it is fair to assume that calling the President’s daughter a ‘feckless cunt” is consistent with the network’s values. Right? Am I missing something?

Now this is confusing to me. Roseanne’s line was obviously intended as a joke, and supposedly comics need to have wide tolerance when jokes misfire. Bee’s statement wasn’t even a joke; it was just a vulgar insult. Moreover, a pre-taped, scripted TV show is obviously a more consequential forum than a single tweet, and a personal tweet is viewed as less of a representation of a network than a show on that network. Ethics Observations On The Roseanne Tweet Fiasco

1.  It is possible, after all, to revile Roseanne Barr’s gratuitously vicious “joke” about Valerie Jarrett, and to question the extended reaction to it. I feel especially emboldened, perhaps because you couldn’t have forced me to watch that show or anything associated with Barr had you been credibly threatening to blow up Fenway Park unless I tuned in. One of the ways the enemies of free discourse and thought further their agenda is by setting up these dilemmas, where to even suggest that a genuine miscreant’s punishment has exceeded reasonable bounds is to risk shunning and other serious cultural consequences—it’s the Cognitive Dissonance Scale again. “See, then we make them defend someone who would tweet something like that, and we’ve got em! Then they look like racists too! Bwahahahahaha!

2. No, I don’t think ABC and Disney were looking for an excuse to cancel “Roseanne” 2 because it was perceived as pro-Trump. The show was making money, and corporations place money above politics. However, there is no doubt that a conservative show has less margin for error in today’s biased media environment. It was up to Roseanne to understand that and moderate her conduct accordingly. This recent post is relevant.

Ethics Dunce (But We Knew That): Roseanne Barr [UPDATED…Again!]

Ugh. The new, surprise hit reboot of “Roseanne” self-destructed when it’s star, not for the first time, couldn’t restrain herself from being objectively repulsive and tweeted a racist insult to former President Obama’s black chief-of-staff, Valerie Jarrett. This morning the comic—at least some people think she is comical—tweeted that Jarrett was the offspring of the Muslim Brotherhood and “Planet of the Apes.” as in “muslim brotherhood & planet of the apes had a baby=vj.” Barr apologized, but ABC was quick: it cancelled the series, saying, “Roseanne’s Twitter statement is abhorrent, repugnant and inconsistent with our values, and we have decided to cancel her show.”

Rosanne didn’t just step on a landmine, she stepped on several, then jumped up and down on them to make sure they blew her to bits, or so it seemed. Can’t attack anyone associated with Obama. Can’t use “Muslim” as an insult. Can’t make monkey jokes about black people. Any of these can be career-killers, and Roseanne did all of them at once, in only ten words and two initials. Wow. It takes a Master Ethics Dunce to do that. I am in awe.

Does she deserve to lose her show over this? Of course she does. It was, by any standard, a racist, hateful tweet. No company, especially an entertainment company, especially a Disney company, can afford to be associated with that kind of  reckless, high-visibility employee,  She was on thin ice anyway, being a self-declared Trump supporter. She should have known that she had to be even more careful than other uncivil comics and celebrities, like Bill Maher, Stephen Colbert and Alec Baldwin, all of whom have  said or tweeted ugly and hateful things about the right kind of people—you know, whites, Republicans, the President, and his family.

One of Roseanne’s writers, stand-up comic Wanda Sykes, quit the show before it could be cancelled in protest over Roseanne’s “joke”, though Sykes herself was booed off the stage in 2016 after going on a hateful, expletive-filled rant against President-Elect Donald Trump, then flipping off the crowd as she exited to boos.
