Ethics and the CALM Critics

The Commercial Advertisement Loudness Mitigation, or CALM Act, is now on the way to President Obama’s desk. The law addresses a long-time irritation to TV viewers, who have been complaining about television commercials booming out at ear-splitting volume as soon as a moderately-loud program takes a break. The advertising trick, which has been around for a while, has become even more blatant in recent years with availability of new sound technology. Some televisions have been equipped with devices that supposedly even out sound variations, but they do not completely solve the problem. The new legislation directs the Federal Communications Commission to require advertisers, within a year, to adopt industry technology aimed at lowering the volume on televised sales pitches.

This is a classic example of law doing what law is supposed to do: step in when individuals or organizations refuse to respect ethical values and cultural norms in the pursuit of their own self-interest, and set penalties to inspire them to engage in fair conduct, since “doing the right thing” isn’t motivation enough. GlaxonSmithKline Inspires a Fun Game For Your Holiday Party: “Forcast That Ethics Scandal!”

Almost all ethics scandals and examples of outrageous unethical conduct are thoroughly predictable, whether they involve individual, organizations or institutions. The most obvious proof of this is in politics. Once we consider past patterns, current conditions, institutional habits and what we know about human nature, the question when a new political party takes over isn’t whether there will be instances of bribery, influence peddling, self-enrichment, and conflict of interest, but only which elected leaders will be caught at it. Sometimes even that part is easy: everyone should have been able to guess, long before they occurred, that Tom DeLay’s ethics-free philosophy of politics as warfare would lead him to commit serious misdeeds, just as the odds against former Florida Rep. Alan Grayson running a fair or civil campaign for re-election were prohibitively high. Similarly, sports scandals can usually be seen coming a long way off. Once New England Patriots coach Bill Belichik was caught making surreptitious videos of his team’s opponents’ practices, it was easy to guess that he wasn’t the only one, and that since both he and his team were so successful, it would be only a matter of time before a similar incident came to light. And it did, last week.

As I look through various Ethics Alarms posts, it is striking how many of them could have been written in advance, in fill-in-the-blank format. All you need to do is identify an industry with a history of ethics problems, a weak ethics culture, a trusting, under-informed audience, the potential for increased profit, power or influence, and a large population of corruptible, lazy, incompetent, venal, ambitious or cowardly allies. I’m sure a computer program could be developed, but for this holiday season, why not forecast next year’s ethics scandals as a party game? Challenge your guests: Which TV reality show will be shown to have completely manipulated “reality”? Which revered sports figure will be disgraced in a sex or drug scandal? Which Wall Street firm will be caught violating the “sacred principles” posted on its website? Which school will suspend or expel a student for violating the letter of an overly broad and horribly-written rule without actually doing anything wrong? Which universally accepted scientific research will turn out to be the result of manipulated data? Which embarrassments of the Obama Administration will only be reported by Fox News, and which outrages committed by Republicans will the same network ignore?

And, of course, where will TSA employees put their hands next?

This occurred to me as I read about the recent Big Pharma-manipulating-medical-practice scandal, involving drug giant GlaxonSmithKline, while slapping my forehead and shouting, “Of course! This was the logical next step!” Continue reading

Allied Against Consumers and Ethics: Google and the Sociopathic Businessman

Today the New York Times extensively documents the unethical business strategy used by the owner of a web-based eyewear business.

After making the discovery that Google does not distinguish between positive and negative mentions of a business on the Internet, he resolved to treat complaining customers as badly as possible to encourage complaints about his company on consumer sites. I do mean “as badly as possible”: the Times relates the accounts of customers who received insulting phone calls, threatening mail, and other harassing and bullying communications from the entrepreneur, who uses multiple aliases. The method works well: since on-line diatribes, complaints and bad reviews have piled up over his poor service, outrageous conduct and often shoddy merchandise, the man’s business is booming. Its name consistently nears the top of Google’s search results when a potential customer types the name of his or her favorite eyewear designer and “eyeglasses,” sometimes placing higher than the designer itself. Ten Ethics Questions for the Pat-Down Defenders

I, like you, have been reading and listening to my various “My Obama, may he always be right, but my Obama, right or wrong” friends try to argue that having TSA agents sexually assault non-consenting adults is a perfectly reasonable and benign exercise of government power. I, like you, am tired of the posturing and excuse making. Their arguments, in essence, all boil down to: a) they have no choice b) they have our best interests at heart c) it’s no big deal, and 4) trust them, they know what they are doing.

I suggest that you, as I will, pose the following questions to your trusting friends, perhaps beginning with a preliminary query regarding whether they themselves have undergone the humiliating and invasive pat-down procedure that they so willingly approve of for others.

The Pat-Down Rebellion: Government Arrogance and Abuse of Power, Meet American Culture

We may be seeing a sterling example of the innate American resistance to intrusive and excessive authority, just when it looked as if many citizens were prepared to  accept reductions in their dignity, privacy and freedom that past generations would never have countenanced.

As usual, the fuse has been lit by a combination of incompetence, bad management, and arrogance. Since the tragedy of 9-11, airplane passengers have been remarkably passive and tolerant in accepting increasingly inconvenient and de-humanizing security procedures at airports. They have allowed political correctness to hold sway over fairness and logic, subjecting decrepit seniors,  ten-year-old girls and U.S. Senators to aggressive wanding rather than employing reasonable profiling techniques. They have allowed near-miss terrorist attacks caused by sloppy Homeland Security procedures and execution to be addressed by punishing the public with increasingly more intrusive search techniques. But when new procedures involving full-hand body searches were recently instituted without due warning, while the new full-body scanning devices were standing unused because of a shortage of trained personnel, anger, resistance and traditional American refusal to be pushed around finally made their appearance. Why, passengers are asking, must they be molested to compensate for intelligence failures? Where are reasonable alternatives? Why are we being treated this way? Continue reading

Chevron, Environmentalists, Hoaxes, and the Ethics of Dialogue

Chevron, the oil giant, rolled out a new ad campaign this week. It announced that Chevron agrees with critics and environmentally concerned Americans that it has critical responsibilities, such as reinvesting profits into socially responsible projects, seeking renewable energy sources, and taking extra steps to protect the environment. “We hear what people say about oil companies – that they should develop renewables, support communities, create jobs and protect the environment – and the fact is, we agree,” says Rhonda Zygocki, Chevron’s vice president of Policy, Government and Public Affairs, in the company’s press release. “This campaign demonstrates our values as a company and the greater value we provide in meeting the world’s demand for energy.  There is a lot of common ground on energy issues if we take the time to find it.” Continue reading

The Ethics of Teacher-Student Facebook Friending

Sometimes what appears harmless and benign at first glance starts looking inappropriate and unethical after we learn more about it. Social networking media has been teaching this lesson with alacrity over the last year, and we now have another example that will be making some friends of mine re-evaluate their Facebook friend list…I hope.

The New York Post has reported that least three educators from New York City  public high schools have been fired in the past six months for having inappropriate exchanges with students on Facebook, including one of which culminated in a sexual relationship. Continue reading

Murchowski’s Unethical Zombie Endorsement

Former Senator Ted Stevens is dead, the victim of an August plane crash. Yet there he is on TV, enthusiastically endorsing defeated Republican Senator Lisa Murchowski as she runs as a write-in candidate against Joe Miller, the man who beat her in the primary for the GOP nomination.

I don’t care that Ted Stevens taped an endorsement of Murchowski’s primary candidacy before he died, and it doesn’t matter that Stevens’ family approved the use of the zombie endorsement now. Murchowski’s use of the video is doubly unethical. It is misleading and dishonest, because it implies that Stevens endorsed the Senator for her write-in campaign…impossible, because he died before she lost the primary. Continue reading
