Why Dan Pabon’s DUI Stop Matters To Everyone, And Why He Must Resign

Colorado Rep. Dan Pabon (D. North Denver) was considered a rising political star. Among his well-publicized public policy triumphs was to  help pass a law forcing convicted drunk drivers to appear before a DUI victim-impact panel.

Then Pabon himself was pulled over in his vehicle on St. Patrick’s Day evening for driving under the influence of alcohol. Instead of Pabon accepting his fate as an honest lawyer and elected official should, the video of the stop shows the legislator trying to persuade the officer who stopped him not to make the  arrest. He tells the officer that he is a state representative who is driving a car without his legislative plates. He asks the officer to call a supervisor or the city attorney so they can direct the officer to give him mulligan. When Officer Brian Bienemann explains that he cannot let Pabon off and indeed would be subject to discipline if he did,  Pabon pleads,  “Is there any way we can avoid this possibility? This is going to change my life.”

After Pabon pleaded guilty and gave an emotional apology (above) to the public and the legislature, saying  “I have taken full responsibility. I have done everything above board,” the editors of The Denver Post begged to disagree. They called for his resignation in an edotorial. They were correct, but they weren’t clear enough about why.

The Post was upset that Pabon didn’t specifically apologize for trying to use abuse his position and power to avoid legal accountability for a serious violation of the law, even after the video of the stop was leaked to the news media. Of course he didn’t. Like most current elected officials, he didn’t see anything wrong with that. Don’t they deserve special consideration and privileges?

There can be no sufficient apology for what Pabon did. Elected officials and other government personnel must not view themselves as deserving special immunity from the laws and regulations they impose on society. Pabon’s attitude and attempt to play the “Do you know who I am?” card is poison to democracy, and exactly the kind of “fix” Donald Trump’s speech last night correctly condemned.

The public sees a Secretary of State expose sensitive information to discovery by the enemies of the United States, and not only is she not punished, she is selected to run for President. The public sees HUD Secretary Julian Castro blatantly violate the Hatch Act, combining an official appearance with campaigning for Clinton, and  then learns that the President will not discipline Castro in any way. Casrto is also considered a “rising political star.” A nation in which individuals who break the law are still considered “rising stars” and prospects for national leadership has its values in a tangle. On Climate Change And The First Amendment, Yale’s Law School Dean Gives Us A Reason To Be Very Afraid

I just wrote in a comment thread,

“The one thing that could change my mind to believe that Trump is less dangerous than Clinton is that the trappings of Trump and his followers reek of stupidity, and the trappings of Hillary and her allies are redolent of totalitarianism.”

The effort by Democrats and anti-gun zealots to deliberately breach the Fifth Amendment to allow “pre-crime” anti-gun laws was one example of the Obama/Clinton/Sanders left’s creeping embrace of totalitarian principles.

Here is another.

Over the weekend, Robert Post, the current dean of Yale Law School where both Bill and Hillary learned to be unethical lawyers, authored a shocking 0p-ed for the Washington Post. In it, he attached his influence and credibility to the idea that the government should use the power of prosecution to intimidate opponents of government policy and widely accepted left-wing agenda items. I have never seen such a disgraceful breach of academic prestige. If I were a Yale grad, I would be heavily involved in calling for Post’s resignation.

Post is supporting the attempts by Democratic, climate change policy-supporting attorneys general to target Exxon-Mobil for fraud because the company opposes certain climate change measures. This comes after eco-facists like Robert Kennedy, Jr. and climate change shills like  Bill Nye (The Self-Promoting Not-Really-The-Expert-He- Pretends -To-Be  Science Guy) have suggested that “climate change deniers” should be jailed. That’s not the theory, though. The theory is that Exxon-Mobil has defrauded investors by misleading them about the results of their own research. Thus the company has been hit by demands for documents by the Massachusetts and New York attorneys general to reveal all of that research.

Exxon-Mobil, as well as others, has condemned this effort as an attempt to chill First Amendment debate. Post, who has allied himself with the censors because climate change is “settled science,”  bolsters the political inquisitioners’ deceit. “It may be that after investigation the attorneys general do not find evidence that Exxon-Mobil has committed fraud. I do not prejudge the question. The investigation is now entering its discovery phase, which means it is gathering evidence to determine whether fraud has actually been committed,” the esteemed dean writes.

Cute. Of course, once the precedent had been established that the government can force someone into expensive legal defense for “the fraud” of disagreeing with the pronounced truths of the State, then dissent and political opinion will be repressed, suppressed, and discouraged. Continue reading →

Is Predator Judge Joseph Boeckmann The Most Unethical American Judge Ever?

To designate recently resigned Arkansas Cross County District Judge Joseph Boeckmann the most unethical judge ever would require disqualifying the Nazi judges sentenced at Nuremberg, Judge John Hathorne, who played both judge and prosecutor in the Salem witch trials, and probably some others who have escaped my attention. He is nonetheless a 21st Century low, and we can only hope his record for depravity and abuse of power is never exceeded.

Boeckmann’s resignation came after the judicial commission informed  his lawyer that it was in the process of recovering as many as 4,500  photographs from the judge’s computer, and that they showed nude male defendants who had appeared before him in court.

“They all depict young men, many naked who are in various poses inside the judge’s home and outside in his yard,” the letter stated. “There are numerous photos of naked young men bending over after an apparent paddling,” the letter reads. “Please accept this as notice to not destroy [or] otherwise dispose of this paddle.”

All right, that last part is funny.

The investigation had commenced after Boeckmann was accused of a conflict of interest, and then stumbled upon allegations  a dozen young men who said they received lighter sentences from the judge in exchange for sexual favors. Nobody expected to find evidence of what appears to be 30 years of his using threats of imprisonment or fines to extort young men for sex. Continue reading →

I’ve called out the Tucker Carlson’s conservative news and commentary website The Daily Caller for this before. Apparently this is Carlson’s sick and unethical obsession: I guess he can’t stop his sophomoric fantasies and pain arising out of being a high school nerd gazing hopelessly at cheerleaders and the occasional attractive teacher from infecting his judgment and ethical values. Thus he—and his “education editor,” Eric Owens—think rape is ethically acceptable if the rapist is hot enough.

Once again, the site reports on an example of high school teachers exploiting their male students for their own sexual satisfaction with a slimy wink-wink-snort coded piece making it clear that the Daily Caller regards the episode is one big joke. This time the tongue in cheek headline, accompanied by the photographs of the two women involved, conveys Tucker’s attitude:

Unethical Quote Of The Week: President Obama

“Today, I want to update you on some important progress we’ve made to protect our communities from gun violence. As I said in January, these commonsense steps are not going to prevent every tragedy, but what if they prevented even one? We should be doing everything we can to save lives and spare families the pain and unimaginable loss too many Americans have endured.”

—- President Barack Obama, announcing new measures that his administration will pursue to help curb gun violence.

This is at least the second time, related to gun deaths, that President Obama has invoked the logically, practically, philosophically and ethically absurd “if only one life is saved” argument. President Obama isn’t as smart as his blindly loyal supporters think he is, and definitely not as smart as he thinks he is, but he must be smarter than that.

Yet he uses this ridiculous logic anyway. In Obama’s defense, his entire, nauseatingly inept administration has been rationalized on this basis, so it is a mindset that may be set in cement. Obamacare has allowed some Americans to get insurance that they desperately needed, so, the flawed logic goes, the fact that the legislation has also divided the country, caused millions to lose health care plans that they were satisfied with in favor of new plans they can’t afford, caused rates to skyrocket, suppressed hiring and done nothing to lower health care costs doesn’t alter the official conclusion that the policy is a success.

It isn’t just that the ends justify the means; the theory is that a single designated positive result justifies not only the means but other negative results too. True, prematurely withdrawing from Iraq caused the country to collapse and Isis to run amuck, but the United States withdrew, and that’s enough. Yes, the Education Department’s “Dear Colleague Letter” has caused male students to be unjustly tarred with unproved rape accusations, been the target of false charges and have had their educations disrupted without sufficient evidence or due process, but as long as some female sexual assault victims receive fair attention to their complaints that would not have occurred before, this gender-based persecution is acceptable collateral damage. Sure, Obama’s refusal to acknowledge that radical Islam is a terrorist threat have allowed irresponsible immigration and migrant policies to continue despite their existential risks, but what matters is that some, many–just one!—peaceful, law-abiding Muslims not be the victims of bigotry, fear and hate.

Obama’s latest “just one is enough” assertion is a direct call to the most naive, least aware and most cognitively impaired among us. If saving just one life were enough, then automobiles should be made of soft plastic and travel no more than a few miles an hour. Requiring airlines to use only airplanes that don’t fly, like the one pictured above, would surely save at least one life. Ships and boats never launched on water are very safe. Continue reading →

Gov. Rick Scott Provides A Perfect Example of “Punching Down.”

A political activist ambushed Florida Rick Scott when he stopped by a Gainesville Starbucks to get a cup of coffee, calling him an “asshole” and arranging to have the whole encounter videoed, so it could be placed on YouTube, where it  promptly went viral. I wrote about it here.

In a sad and petty example of tit for tat, Scott has unveiled an attack video against his tormenter, Cara Jennings, a former Lake Worth city commissioner. Beginning with Jennings asking, “A million jobs? Great, who here has a great job?” a male voice answers, “Well, almost everybody – except those that are sitting around coffee shops, demanding public assistance, surfing the Internet, and cursing at customers who come in.”

Scott’s video was called “Latte Liberal Gets an Earful,” appeared Friday on Scott’s official YouTube channel and features the words “Sponsored by Let’s Get to Work,” which is the governor’s political action committee.

It is hard to imagine a more petty, needless, demeaning example of “punching down.” Jennings isn’t running against Scott; she is just a citizen critic, if an especially rude and nasty one. For a governor to focus an attack ad on a mere citizen is an abuse of power and position. It is ethically indefensible.

It is exactly what Donald Trump would do, though.

Figures of great prominence, popularity and power end up abusing all of that by denigrating, attacking and criticizing private citizens, including corporate citizens. When such individuals condemn others, they naturally focus the antipathy of their supporters on the targets, and since the targets never have similar hordes to support them, this is a grand variety of bullying….in fact, lets call it Grand Bullying.

Thus Pope Francis is ethically wrong to publicly attack Donald Trump. It’s also unbelievably stupid and petty, but never mind: we’ll just concentrate on unethical.

Trump, in one of his periodic moments of clarity—if you pew out random thoughts about everything all the time, it is like a million monkeys eventually typing “Hamlet;” the odds say that eventually something sensible will come out by accident—said that the Pope was “political” and that Francis “doesn’t understand America’s problems.”  True…true. He also could have said that the Pontiff should stop meddling with U.S. illegal immigration and environmental policies when the principality that he heads doesn’t tolerate any of the former, and he has no practical reasons to be dubious about climate change, the Vatican having no jobs, industry, or trade-offs to consider. Rep. Alan Grayson, Incivility, Predicting Unethical Conduct…and Donald Trump

It should come as no surprise to anyone that Rep. Alan Grayson (D-Fl.) is under investigation by the House Ethics Committee for serious ethics violations. This was pre-ordained by the proclivities he has shown throughout his political career. In his case, the primary tell is his complete lack of civility, which is symptomatic of a crucial respect deficit. Those who do not regard displaying respect for colleagues, fellow citizens, political adversaries and, more broadly, societal standards of fairness and decency as an important behavioral mandate cannot be trusted to respect any other ethical values either. Occasionally one will find someone who deals in insults and personal denigration who is otherwise ethical, just as one will occasionally encounter a baby goat with two heads, but it is rare indeed. If you go through life avoiding uncivil, verbally abusive people like the plague (indeed, such people carry the plague of de-civilization) you will not miss out on very many good companions, and you will spare yourself a lot of misery as well the danger of personal corruption.

Grayson is without question the most uncivil, rudest, least professional member of Congress. I was amused to find that I had mentioned him in a post from 2010 about how many ethics scandals were predictable, given the past conduct of their principle actors. Once Tom DeLay was out of Congress, Alan Grayson was easily the most likely candidate for a scandal, because the man has no ethics alarms. In my very first post about Grayson, I wrote (in 2009),

“Grayson is the Congressman whose explanation of the GOP position on health care was that “they want you to die.” He said that Dick Cheney speaks with “blood dripping from his teeth.” His mode of debate and persuasion, in other words, is insult and hyperbole. Respect for opposing views: zilch. Civility grade: F… He has endorsed unethical rules and plays by them…”

That post was about Grayson trying to get the Justice Department to shut down a website that mocked him. Yes, he doesn’t believe in freedom of speech, either, when he is the target of insults rather than the generator of them.

All of which led me to react with a smile and a yawn when it was revealed that the disgusting congressman, now running for the U.S. Senate–Sure! Why not?—has been secretly moonlighting as a hedge fund manager. It sounds like a Saturday Night Live skit: “By day, a Wall Street-bashing, 1% hating, populist Democratic Congressman! By night, a wheeling and dealing hedge-fund manager!”

Do I need to explain why this is a slam-dunk conflict of interest with the appearance of impropriety? I don’t think so. It also smells of insider trading and using information privy to elected officials for personal gain. On the other side, he used his position as a U.S. House of Representatives member to attract clients.

A Rubio Scandal, And Now The Test: How Does He Handle It?

It looks like the Washington Post has Republican Presidential candidate Marco Rubio dead to rights on a substantial conflict of interest scandal, or worse. It dates back to 2002, when the Florida Senator was a rising politician serving as majority whip of the Florida House of Representatives.

The Post convincingly documents that Rubio used his official position to urge state regulators to grant a real estate license to his brother-in-law Orlando Cicilia, a convicted cocaine trafficker released from prison 20 months earlier. Rubio sent a letter on his official statehouse stationery to the Florida Division of Real Estate, recommending  Cicilia “for licensure without reservation.” The letter did not disclose that Cicilia was married to Rubio’s sister,  or that the convicted cocaine dealer was then living with Rubio’s parents. Rubio merely wrote that he had “known” Cicilia “for over 25 years.”

This is deception by omission, as well as an abuse of power and position. There is also the unanswered question of whether Rubio or his family received financial assistance from Cicilia when he had access to drug money from $15 million worth of cocaine he was convicted of distributing in 1989. The federal government seized Cicilia’s home, but the money has never been found. Moreover, the Post reports, Rubio-affiliated PACs and campaigns, including his current one, have paid Cicilia’s two sons more than $130,000 in the past decade. Continue reading →

This is what I feared: Barack Obama’s irresponsible and deluded belief that being elected President makes him the Authority In All Things—the belief that I have referred to as the result of a flat learning curve,  would become a precedent luring future POTUSes into mischief. Sure enough, here is Ben Carson presuming to tell terrified people confronted by a mad gunman how to behave.

Ben Carson doesn’t have a clue how to be President, much less how to play hero. He has no relevant experience with either challenge, and this most recent silly statement, and it’s not his first, shows why Carson should stick to the operating room.  I covered a lot of this issue here, pointing out that the theoretical, hindsight heroes who just knew they would have reacted better than Mike McQueary when he witnessed Jerry Sandusky apparently molesting a child in a Penn State gym shower are engaging in convenient self-glorifying fantasies.
