Show Business Ethics: Sorry, Nobody Feels “Safe” At Auditions

An actress named Ingrid Haas complained about a demeaning experience auditioning for the Super Bowl commercial advertising Bon and Viv Hard Seltzer. In a first-person essay published by Vice titled “My Bikini Audition From Hell Shows How Little Hollywood Has Change,” Haas wrote that she was embarrassed when a male casting employee told the women in the ad’s audition that they would have to dance in front of a camera for 30 seconds. When she asked why they had to dance, she wrote, the man responded: “Welcome to corporate America. This is how we sell stuff.” The actress says that she was proud of herself for refusing to dance, but the experience “humiliated and angered her.” And, of course, she did not get the job.

Anheuser-Busch, which makes the product, is now making politically correct noises and condemned the behavior that Haas described,  insincerely or ignorantly, though the first is more plausible, with Chelsea Phillips, vice president of the company’s Beyond Beer division, telling the media,

“The behavior described in the Vice article is completely unacceptable and goes against everything that our brand and company stand for. I regret that this individual had this experience. Anheuser-Busch does not tolerate any discriminatory or demeaning behavior. I reached out to the production company who produced the commercial, because we hold our business partners to this same standard.”

Baloney. The audition as described was neither atypical, unreasonable,  abusive, nor inappropriate. The ad’s producer’s CEO said,“Each actor was asked to dance at the beginning of their audition as this was a way to show one’s level of confidence.” This is not unusual or wrong. The Dumbest Casting Ethics Controversy Yet

Sometimes the line between confused ethics and plain old stupidity is razor thin. This controversy is one of those times.

Actor Bryan Cranston, best known for “Breaking Bad,”  is being criticized for playing a a quadriplegic billionaire in “The Upside,” his new film  released Friday, because he is not actually handicapped.

He’s also not a billionaire, but that doesn’t seem to be an issue for some reason.

Jay Ruderman of the Ruderman Family Foundation complained, “While we don’t know the auditioning history of ‘The Upside,” casting a non-disabled actor to play a character with a disability is highly problematic and deprives performers with disabilities the chance to work and gain exposure.”

No, Jay, it isn’t problematic, because the primary objective of the performing arts is not, and has never been, to provide “the chance to work and gain exposure.” This is the affirmative action mentality that as it gets stretched further and further from reality and common sense by the woke and the wokeness-addled, increasingly ensures that society eventually  rejects the whole tortured concept. The objective of the performing arts is to entertain, engage and enlighten the audience. That requires casting the best actors available, and in film, frequently the best know actors, in the judgment of the director and the producer. Bryan Cranston is one of the most skilled actors in the world. I am extremely confident that there isn’t a single quadriplegic actor that can equal him, if indeed there are any at all. Audrey Hepburn could also play a blind woman better than any of the few available blind actresses, when she starred in “Wait Until Dark.” Tom Hanks and cliff Roberrtson could play  mentally-challenged caharcters in “Forrest Gump” and “Charlie” better than any mentally-challenged actors.

Unethical, Shameless, Gutsy, Creepy Or Thought-Provoking: Kevin Spacey’s Christmas Video

What do we make of this, released by actor Kevin Spacey lastweek almost at the same time as he was being indicted for sexual assault?

Yikes.

The much-acclaimed actor  career collapsed in 2017 as more than 30 people claimed that Spacey had sexually assaulted them. Now he is speaking in the persona—with accent!— of his Netflix series villain, Frank Underwood, the central character of “House of Cards.” Or is he? Much of the speech seems to refer to Spacey’s own plight, and suggests that the actor is being unfairly convicted in the court of public opinion. By using the voice and character of an unequivocal miscreant however, for Frank is a liar, a cheat, a sociopath, indeed a murderer, such protests are automatically incredible.

Or is Spacey making a legitimate argument that an artist’s personal flaws should be irrelevant to the appreciation of his art, especially in a case like “House of Cards,” where the actor’s role can’t possibly be undermined by the actor’s own misdeeds: whatever one says or thinks about Spacey, he can’t  be as bad as Frank Underwood. If you enjoyed watching Underwood destroy lives on his way to power, why should Spacey’s conduct, even if it was criminal, make you give up the pleasure of observing his vivid and diverting fictional creation? This isn’t like Bill Cosby, serially drugging and raping women while playing a wise, moral and funny father-figure. Spacey seems to be arguing that there should be no cognitive dissonance between him and Underwood at all. Who better to play a cur like Frank  than an actor who shares his some of his darkness? Sunday Ethics Warm-Up, 12/30/2018: A Petition, A Career-Killing Joke, And Priestley’s Play [UPDATED]

Good Morning!

1. One more time...I’m really going to try to get a year-end ethics review up for 2018. In both of the last two years, I failed miserably, and The Ethics Alarms Best and Worst of Ethics Awards never posted. It is a very time-intensive exercise, and the traffic for the posts have never been substantially more than an average entry that is a tenth as long.

We shall see.

2. The Bad Guys, Redux. It’s a problem: one wants to curb the trend of demonizing political adversaries, and yet we keep seeing escalating examples of unequivocally despicable behavior that deserves to be demonized, because it is constant, self-righteous, and indefensible.

Over at GoFundMe, someone named Brian Kolfage, has posted a petition and a crowd-funding effort to pay for “the wall” if Congress won’t. He writes, “I have a verified blue check Facebook page as a public figure and I’m a Purple Heart Recipient triple amputee veteran.”

This is not encouraging. [Correction notice: I originally wrote “Facebook does not use a “blue check,” though Twitter and Instagram do, (and abuse it.)” I checked this, but my source was wrong. Facebook does give public figures “blue checks.”] I guess Kolfage is sort of a public figure. He is also a controversial one who has pushed extreme right-wing conspiracy theories. When asked why he doesn’t mention any of his controversial crusades and advocacy in promoting his crowdfunding effort, he has responded, “My personal issues have nothing to do with building the wall.” Fine: what do his war wounds have to do with building a wall?

Never mind: the appeal has raised over 18 million dollars to date, although the contributions have slowed considerably. It’s a futile effort; I suppose it has some value to show public support for enforcing immigration laws. If people want to donate their money to such a cause, it’s their money to give, though they might as well be making little green paper airplanes out of hundred dollar bills and sailing them into the wind.

Megan Fox reports, however, that someone who wants to punish anyone who doesn’t support open borders is taking names and doxxing contributors. She writes,

Did you donate money to the GoFundMe page to build the border wall? If you did, there’s a good chance this guy/gal or otherkin has doxxed your Facebook profile to millions of other nasty trolls who will now make it their business to harass and punish you with anonymous online mobs. Get ready, because your life is about to get more interesting. Based on my personal experience, once these monsters get your information and the directive to destroy you, the death threats, vandalism, obscene pornography, and harassment at work are not far behind. And the worst part is, no one will help you — not the police or the FBI or anyone else whose job it should be to stop intimidation and harassment.

Here Is How Free Expression Is Valued In Those Wonderful English-Speaking Countries The US Should Be More Like…

Australian Cardinal George Pell was convicted in Melbourne this week on five counts of child sexual abuse. This made him  the most senior official ever found guilty in the Catholic Church’s apparently endless child sexual-abuse scandals. The judge in the case, Peter Kidd, immediately subjected news of Pell’s conviction to a suppression order, the Australian equivalent of a gag order, on press coverage. Australian courts impose such orders to shield defendants from negative publicity that could prejudice future jurors in upcoming trials, and  Pell faces another trial next year on a separate set of abuse charges dating to the 1970s. Of course, the more the public knows about how many predator priests the Catholic Church has facilitated, covered up for, and allowed to prey on children, the safer it is. I am not convinced that this suppression of news isn’t a sop to the Church. Judge Kidd told defense and prosecution attorneys that some members of the news media are facing “the prospect of imprisonment and indeed substantial imprisonment” if found guilty of breaching his gag order

Never mind:  the web, social media and the Streisand Effect foiled the judge. Pell and the charges against him were quickly the subject of thousands of tweets and shared posts on Facebook. The posts included links to websites and blogs where the news was available, including NPR, the Daily Beast and the National Catholic Reporter.

The Washington Post reported the conviction, but the New York Times did not. The Times’ deputy general counsel, David McCraw, gave the excuse that the newspaper is abiding by the court’s order in Australia “because of the presence of our bureau there. It is deeply disappointing that we are unable to present this important story to our readers in Australia and elsewhere. . . . Press coverage of judicial proceedings is a fundamental safeguard of justice and fairness. A free society is never well served by a silenced press.”

So don’t be silent then.

The Associated Press and Reuters news services also did not report Pell’s conviction.  Both services have bureaus in Australia that could face potential liability. Tell me again about how courageous news organizations are.

Ethics Poll: How Bad Does A Theatrical Performance Have To Be To Ethically Obligate A Refund?

Apparently audiences were unhappy with an allegedly subpar performance  of “The Wiz”  at the Brown Theatre in Louisville, Kentucky. An unusual number of customers called to call demand refunds, based on complaints ranging from botched lines to a bad Cowardly Lion costume (he looked like e bear) and to a cheesy projection of magical land of Oz  from a laptop projector.

“The Wiz” is the hit Seventies Broadway adaptation of the “The Wizard of Oz,” but with an all-black cast, rock-style music, hip-hop dancing and contemporary slang. It was made into a successful film starring Diana Ross and Dorothy and Michael Jackson as the Scarecrow.

Tickets cost between $35 to $65. Despite the complaints, Lavarious Slaughter, the show’s producer for Island Entertainment KC, of Kansas City, Missouri has said that there will be no refunds.

(Lavarious Slaughter? He sounds like an escapee from a Harry Potter book.)

It’s hard for me to tell just how bad the performance was based on second hand accounts. (I wouldn’t pay 65 bucks for the greatest production of “The Wiz” ever. The whole concept behind “The Wiz ” was cynical, and all-black casts are a divisive gimmick. How bad was it?

Helen Barnett was one malcontent who talked to the press. “It was terrible,” Barnett said. “Dorothy was wearing a Walmart dress. They forgot their dialogues … at one point Dorothy said she wanted to go back to Texas!” (In “The Wiz,” Dorothy is from Harlem while Dorothy in “The Wizard of Oz” is from Kansas.) Other complaint noted that the computer projected set kept  being uninterrupted by pop-up dialogue boxes.

Yeah, that sounds pretty bad.

But funny!

One of the actors, Kori Black, who played the role of the Good Witch of the North tried to explain, “The three o’clock show ended up being pretty much our dress rehearsal because we didn’t have enough time to do the show full-out at the venue before we performed it.”

I have mixed feelings about this, as a former professional theatrical producer and a long-time director and performer. There is no excuse for a badly rehearsed, done-on-the-cheap production that isn’t aimed at giving the audience genuine entertainment. On the other hand, one of the features of live theater that TV and movies lack is that nothing is guaranteed. Stuff goes wrong; things don’t work, actors botch line and entrances, costumes rip, props break, lights blow out. The show goes on. Going to the theater is the ultimate caveat emptor—“Let the buyer beware.” I’ve demanded refunds when projectors broke down in movie theaters, and I’ve given refunds or rain-checks to theater audiences when a performance couldn’t be completed. (Among the causes for those catastrophes: a power outage, a smoke machine that went crazy and blinded everyone, and a lead actor who got knocked cold on stage.) I’ve also had to open shows that were not as ready as I would have liked, but that is a common occurrence everywhere. You can’t give refunds for missed lines. Getting Dorothy’s home wrong is bad for sure, but if that ruins the show for someone, they weren’t going to like anything. One of the most popular and best reviewed productions I ever directed was Orson Welles’ adaptation of “Moby Dick.” One night, the actor playing Ishmael forgot the first line of the play, which is “Call me Ishmael”–one of the most famous opening lines in literature, and also the character’s own name. I got some flack, but the rest of the show recovered.

I fear that audiences are so unfamiliar with live theater that they expect movie-like special effects and the slick perfection that digitally created, multiple  take filming provides. Live theater’s imperfections are part of what makes it dynamic and exciting. On the other hand, those pop-up dialogue boxes sound like the work of a production staff just trying to make a quick buck off the locals and then get out of town.

My policy would be that if a patron asked for a refund, I’d approve it. In 20 years, however, not one of our audience members demanded one.

Saturday Ethics Warm-Up. 11/3/2018: Cohen Does What He Does, Ocasio-Cortez Mongers Hate, And Hoggett Goes Rogue

I’ll give you a morning golden and true…

1 .Regarding Michael Cohen. The news media, Trump-haters and “the resistance’ are all giddy over Michael Cohen claiming that President Trump made racist comments in his presence. Lawyers who say such things about clients get disbarred. They get disbarred because it is proof that they lack the honesty, trustworthiness and integrity to be trusted professionals.There is no reason whatsoever to trust Michael Cohen, so relying on his account of anything is just an exercise in confirmation bias. He is not a reliable source, and what he says at this point should be taken for what it is: the latest effort by a desperate crook to somehow survive the consequences of his own low-life ways.

2. Alexandria Ocasio-Cortez easily makes my list of the dozen most unethical candidates seeking election next week; I hope to get that up soon. Here is the fundraising email the New York socialist sent out:

“Six days from now, we can defeat the brutal white supremacist forces of anti-Semitism, anti-immigrant nativism, and racism.We can hold accountable the cold-hearted monsters who have repeatedly attacked our health care. We can send a message to the bigots and billionaires that this country belongs to all of us. We can win if we show up on November 6. We must end Republican control of Congress and begin to reclaim our nation. A Democratic majority will not bring back the eleven Jewish people in Pittsburgh, massacred while they prayed. Or the two Black people gunned down days before at a Kroger grocery store in Kentucky. It won’t fully stop the relentless attacks against immigrants in America. But on Sunday evening, Pittsburgh mourners—angry and broken-hearted like us—chanted ‘Vote! Vote! Vote!’ They understand the magnitude of the midterm election six days from today: that it affords us the chance to forge a powerful bulwark against Donald Trump’s hate and hold accountable the Republicans who have been complicit in every step of his toxic, self-serving, and destructive agenda. We must offer a path out of the darkness….This is our chance to take action in solidarity with everyone whose lives are threatened by the hate-filled policies of Trump and the GOP,” she says. “Our chance to push back against white supremacist forces across our nation, against the xenophobes who are militarizing the border, against the bigots who seek to erase our transgender families, against the apologists for sexual assault and the Islamophobes who sow hate to divide us.”

I considered doing an ethics audit of this screed—remember, she’s supposed to be a rising star of the Democratic Party—but decided that any objective reader here is more than capable of doing so without any help from me. Res ipsa loquitur.

How should we characterize someone who would vote to give power to a candidate willing to sign such a message?

3.  By all means, let’s believe all female accusers...Judy Munro-Leighton, who as “Jane Doe” accused Brett Kavanaugh of rape in an email to Senator Kamala Harris, was treated as a credible accuser and caused the Judiciary Committee to question the SCOTUS nominee about her claims. Now she admits that it was all a partisan-driven lie.

Who suspected that?

She confessed to Committee investigators that she “just wanted to get attention” and that “it was a tactic.” She said she had called Congress during the Kavanaugh hearing process before the Blasey-Ford  accusation multiple times  to oppose Kavanaugh’s nomination. Regarding the false sexual-assault allegation sent to the Committee through Harris, she said: “I was angry, and I sent it out.” Asked  whether she had ever met Judge Kavanaugh, she said: “Oh Lord, no.”

Her false rape allegations against Kavanaugh had exactly as much corroborating evidence as Blasey-Ford’s: none whatsoever. Yet, still, to this second, an astounding number of smart, reasonable Democrats, especially women, argue, and presumably believe, that such an accusation–in Blasey Ford’s case, one that is three decades old and dates from high school— should disqualify a man with an unblemished adult and professional reputation from high office. And they are indignant about it, too.

I don’t get it.

Reportedly, the Senate received over a thousand claims from women claiming that Kavanaugh sexually assaulted or harassed them.

The Senate has asked for criminal sanctions against Munro-Leighton.

Mid-World Series Hangover Ethics Warm-Up, 10/27/2018: Mike Tyson, Intimacy Coordinators, And The Blackface Teacher Principle

This is how my morning began…

1. To get this out of the way..I watched every  second of every inning on last night’s longest post-season baseball game in history, as any loyal, ethical baseball fan is obligated to do. It was worth it, too, even though my team lost. The game was the sports equivalent of The Odyssey, “War and Peace,” “King Lear,” “The Ring Cycle,” “The Ring Trilogy,” “Nicholas Nickleby” or “The Seven Samurai,” a complex morality and adventure tale that had suspense, disappointment, wonder, exhilaration , humor and tragedy, heroes and villains. Such games reward all of the time and suffering a fan puts into following baseball seriously. It is worth the investment.

Ironically, this epic occurred shorty after the Wall Street Journal published a truly ignorant and idiotic opinion piece called , “Our Insane Ideas to Save Baseball/Baseball has problems. There aren’t enough hits. There are too many pitchers. The games take too long. So we bullpenned our solutions. Are you ready for Strike Four?”

It is a wonderful example of the incompetent variety of criticism I call “Wanting to change what you haven’t taken the time to understand.” I get it: the authors don’t like baseball, and barely pay attention to it., or, in the alternative, they are just seeking clicks. In any event, you can’t argue with people who say that the problem with opera is that it’s too often in a foreign language, or that the problem with hip hop is that it isn’t music, and shouldn’t, or that the problem with our democracy is that people can say things that upset other people. And you shouldn’t argue with them. They don’t respect the topic enough to be educated about it.

2. Of course, baseball games ARE too long, and the overwhelming reason is TV ads, which add about a half hour to every game, and more to post-season games. The disgusting response of Fox is to stick 10 second commercials into a split screen during the game, like between batters. Here’s a slugger walking to the plate in a tense situation, and half the screen is devoted to a quickie plug for “Ralph Breaks The Internet.” I hope fans are burning up social media attacking this greedy new form of broadcast pollution.

3. How is this possible? In a #MeToo Mad era when simply being accused of sexual assault without proof is deemed by even lawyers who should know better as sufficient justification to inflict serious and permanent consequences on the accused, Mike Tyson is the star of an animated TV show, is cast in movies, and is now shopping a TV show, based on the ex-boxer’s life as a marijuana grower and marketer, starring him and called “Rolling With the Punches.” Continue reading

Your Mid-Day Brett Kavanaugh Nomination Ethics Train Wreck Update

It’s kind of like following O.J. slow-mo escape, but more interminable, and lot more ominous...

I. No, Matt Damon is not a hypocrite because he mocked Brett Kavanaugh on SNL.

Why is this so hard to grasp for those not in show-biz? Actors act. They don’t have to believe in or live by what their roles stand for? Damon said earlier last December, speaking of the situation where he was falsely accused of harassment or sexual abuse…

“If you make the same claim to me today. it would be scorched-earth. I don’t care if it would cost me $10 million in court for 10 years, you are not taking my name from me, you are not taking my name and reputation from me, I’ve worked too hard for it, I’ve earned it, you can’t just blow me up like that.”

Now conservative pundits are writing that Damon is a sell-out and a hypocrite for helping a TV satire show attack Kavanaugh for standing up for his name and reputation. Morons. Damon didn’t write that script, and very few actors, especially fading, aging leading men like Damon, can afford to demand that they personally agree with the vehicles they appear in or the characters they play. Morning Ethics Warm-Up: Through The Teeth Of The Storm Edition

Good Morning!

Just flew to Florida on pressing business. Ethics knows no obstacles…

1. From the  “The Ends Justify The Means” Files, Democratic section: Led by Sen. Cory Booker, Democrats are releasing confidential documents willy-nilly, in breach of Senate rules.  The Washington Post calls this “civil disobedience.” Elected officials aren’t allowed to engage in civil disobedience, because their duties include maintaining civil order and the Rule of Law. This isn’t civil disobedience. This is Democrat Senators violating rules when they think it’s to their advantage to do so. Chuch Schumer, whose reputation and level of public trust should be in freefall for anyone paying attention, tweeted,

“I stand w/ Judiciary Committee Democrats who are well within their rights to release these very important documents that a former Kavanaugh deputy designed as “committee confidential.”

This is apparently another convenient Democratic Party rule change: restrictions don’t count if Democrats don’t like the official who has the power to issue them.

2. This is  pure bigotry and discrimination. Why isn’t that obvious? Why isn’t the news media pointing it out? From the LA Times:

Twentieth Century Fox was just days away from locking picture on “The Predator” when an urgent note came in: Delete the scene featuring Steven Wilder Striegel. Striegel, 47, didn’t have a big role in his longtime friend Shane Black’s reboot of the sci-fi thriller — just a three-page scene shared with actress Olivia Munn.But last month, Munn learned that Striegel is a registered sex offender who pleaded guilty in 2010 after facing allegations that he attempted to lure a 14-year-old female into a sexual relationship via the internet. When Munn shared the information with Fox on Aug. 15, studio executives quickly decided to excise him from the movie.

This reminds me of the scene in “Ship of Fools” when a passenger is exiled from the captain’s table on a German ship because a Nazi complains that he is Jewish. Continue reading
