The Doctor, The Emergency And The Flight Attendant: A Depressing Ethics Tale With No Ethical Resolution In Sight

Tamika Cross, a young OB-GYN flying Delta from Detroit to Minneapolis,  heard flight attendants calling for medical assistance when a passenger  man two rows in front of her was found to be unconscious. Dr. Cross raised her hand, only to be told, according to Cross’s subsequent Facebook post on the incident, “Oh no, sweetie, put your hand down. We are looking for actual physicians or nurses or some type of medical personnel. We don’t have time to talk to you.”

Cross says she tried to  explain that she was a physician, but was “cut off by condescending remarks,” from the attendant. A moment later, when there was a second call for medical assistance and Cross again indicated that she was ready to help, the same flight attendant said, according to Cross, “Oh wow, you’re an actual physician?” She then quizzed Cross  about her credentials, area of practice, and where she worked. In the meantime, a white, middle-aged male passenger appeared, and Cross, she says, was dismissed.

On her now viral Facebook post, Dr. Cross concludes:

“She came and apologized to me several times and offering me Skymiles. I kindly refused. This is going higher than her. I don’t want Skymiles in exchange for blatant discrimination. Whether this was race, age, gender discrimination, it’s not right. She will not get away with this….and I will still get my Skymiles….”

What’s going on here?

Stipulated:

1. This was an emergency situation.

2. Dr. Cross sincerely felt insulted and treated with disrespect.

3. She also feels that she was the victim of stereotyping,, bias and prejudice.

4. Her account can be presumed to be an honest recounting of how she experienced the episode.

5. The Roshomon principles apply. We do not know how the flight attendant perceived the situation as it developed, and will never know, since the incident is already tainted with accusations of racism.

6. This was an emergency situation.

7. There is no way to determine what the flight attendant was thinking.

8. Despite all of the above, observers, analysts and others will be inclined see the event as confirmation of their own already determined beliefs and assumptions.

9. This was a single incident, involving a set of factors interacting in unpredictable ways.

Bernie Sanders, or most likely someone on his staff since I doubt that the Bern is a micro-manager, made his campaign look foolish by sending Wikipedia a DMCA take-down notice demanding that Wikipedia remove  images of Sanders campaign logos on its Sanders page, on the dubious grounds that such use was a violation of copyright law. More embarrassing than the specious copyright complaint is the rather obvious fact that a campaign should want Wikipedia to publicize everything about it. The complaint, to be blunt, was dumb. (The take-down notice was retracted in short order.)

Moe Lane is a fairly nasty right wing blogger, and he gleefully reported Sanders’ Shame, which is certainly fair game for critics. He could not, however, resist this cheap shot headline:

In October of 2011, Ethics Alarms offered an Ethics Quiz that asked, “Did the Internet Movie Data Base do anything unethical by publishing the actress’s real age without her permission?” The occasion was a lawsuit asking for over a million dollars in damages by an anonymous film actress who claimed that Amazon’s Internet Movie Data Base harmed her career by researching and publishing her real age without her permission. My conclusion at the time was that Actress X was

“shooting at the wrong villain. If there is age discrimination in Hollywood, confront it: a number shouldn’t disqualify her from any roles at all. I am not saying that fighting such a long-standing tradition in the show business culture isn’t a daunting task, but that’s the real problem, not a web service that conveys information about movies and movie stars by publishing facts.”

Ethics Dunce: “Saturday Night Live” Cast Member Jay Pharoah

In a spontaneous call for more black cast members to be added to NBC’s long-running late-night satire show, “Saturday Night Live,”  veteran cast member Jay Pharoah told an entertainment reporter that he wanted the producers to add actress Darmira Brunson. “Why do I think she should be on the show? Because she’s black first of all, and she’s really talented,” Pharoah said. “She’s amazing. She needs to be on ‘SNL.'”

By logic, rights and justice, Pharoah should be fired for such a statement. He is pushing his show, and therefore his producers and his bosses, into a controversy that they neither want, need, nor deserve. Sure enough, his comments have already ignited debate and commentary in major dailies and in the blogosphere. He can’t be fired, of course—no producer in Hollywood would dare fire a black performer for advocating politically correct causes like diversity and affirmative action, no matter how inappropriate and unfair his comments were—and Pharoah knows that. Breaking reasonable rules of the workplace—criticizing your own boss in public and causing trouble for your employer are pretty basic taboos—because you know you’re immune from punishment doesn’t make the conduct any better.

He’s not the producer, and casting isn’t part of his job. To announce his own candidate for a hire is as outrageous and out-of-bounds as for a Pentagon general to tell reporters who President Obama should appoint as his Secretary of Defense.

Then there is the  statement itself, which in the context of entertainment and show business, is an endorsement of racial bias and discrimination, even more than with most workplace diversity and affirmative action advocacy. “Because she’s black first of all?” First of all must only be “because she’s funny, and the funniest female comic available.” Saturday Night Live’s goal, which it fitfully achieves, is to make its audience laugh. If Brunson is the best performer to accomplish that, then it makes sense to hire her. Her skin color is irrelevant, except to the extent that it opens up comic opportunities for the show. Otherwise, Brunson is pressuring his employers to hire Brunson over  superior white, Hispanic or Asian performers because of some theoretical diversity formula.

The resulting media focus on the imaginary problem to which Pharoah’s comments alluded is full of reflections, names and statistics, but the basic facts are these:

  • Professional performance comedy is completely utilitarian: if a cast entirely made up of black performers of any gender mix could be shown to be the optimum way to get laughs, ratings and make money for the network and SNL’s producers, that’s what we would have.
  • A funny, talented, improvisational skilled black actress has obvious benefits for a weekly satire show, as the reign of Maya Rudolph amply demonstrated.  There is no reason to presume that the producers would not immediately hire such a performer if one was available.
  • The pool of top-rate improvisational comic actors in general isn’t large (if it were, SNL would be funny more often), the pool of such performers who are African-American is much smaller, and the number of female black improvisational comics is tiny. When the African-American Wayans brothers wrote and produced their own satire show (Jim Carrey was the token white), they included only one full-time black female in the cast, and she was their sister (also the weak link in the cast.)

We can argue about the general principle of affirmative action at another time and place, but applying them to entertainment, sports or any field that must be a pure meritocracy is irresponsible and unfair. Saturday Night Live “needs” funny, talented performers who its audience finds funny…like, say, Eddie Murray. It does not need any black performer, male or female, just to have more black performers, and to take away performing and career opportunities from superior performers whose sole deficit is skin color or ethnicity while simultaneously getting fewer laughs and lower ratings.

Oddly, nobody has ever argued that Saturday Night Live discriminates against improvisational comic actors over the age of 35. Only once has it cast an actor of that age—Randy Quaid, in 1985. 1985 was also the most disastrous and unpopular season in the show’s history. Why no middle age or senior cast hires?  The reasons are legion: 1) Improv comedy is demanding physically and psychologically. Few older performers practice it, or are capable of doing it on a regular basis. 2) SNL’s audience is very young (as well as very male and white). Comedy is generational. 3) Older performers are seldom “new faces.” The ensemble’s called the “Not Ready For Prime Time Players” for a reason. 4) Young actors playing older real life figures and comic characters can be funny; old actors playing younger celebrities or characters is seldom funny, and often creepy. Age diversity, in brief, would not improve Saturday Night Live. Diversity is only an asset to the extent that it allows more comic opportunities. The U.S. does not require, not should ikt ask for, a contemporary satire TV show that “looks like America.” What  it needs is a show that is good.

All of which makes Pharoah’s comments irresponsible, unfair, disloyal, and racially offensive.

And not funny.

Jay Leno, Age Discrimination, And Our Cultural Hypocrisy

One of the purposes of laws is to point the culture toward more ethical awareness and eventually, conduct. In the case of age discrimination, however, this isn’t working very well, and the recent foofaraw surrounding Jay Leno’s forced exit from the “Tonight Show” gives us some hints of why this is so.

NBC and the TV reporters covering the situation (in case you have a life: Leno has been forced to give up his 30 year reign at NBC’s flagship late night show in favor of his current follow-up on the NBC schedule, the lighter-than-air Jimmy Fallon) do not disguise the reason for Leno’s ouster: he is old, or at least considerably older than Fallon. Never mind that Jay still leads in the ratings over the despicable David Letterman, the Hell-spawn Jimmy Kimmel, and Jay’s former victim, poor, betrayed Conan O’Brien at TBS. Leno is 62, so he and his gray hair are being jettisoned by NBC in its fear that Kimmel, recently installed as competition by ABC, will siphon off more and more of the younger demographic that sponsors crave. I would think it would be much easier to tell Leno to start encouraging parents to torture their children too, but hey, what do I know?

What is telling is that nobody seems to see anything wrong with this. Old guys are a drag, we all know that, I guess. How many MSNBC hosts and Democratic Party flacks have loudly proclaimed that the Republican Party’s problem is that it is run by old guys? Old guys are trouble, sooner or later, so it certainly makes sense that anyone running a business or an organization figures out ways to dump them in favor of new blood, unless that pesky law stuff gets in the way. Ethics Quiz: Is There An Ethical Obligation To Help An Actress Lie About Her Age?

An actress who is, so far, unidentified is suing Amazon.com in federal court for over $1 million in damages for disclosing her age on its Internet Movie Database website, and refusing to remove the reference when she requested, then demanded, that it do so.

She says that IMDb misused her personal information after she signed up for the “industry insider” IMDb Pro service in 2008. Soon she saw that her legal date of birth had appeared on her online acting profile. IMDb refused to remove it.

Now, she says, she is being discriminated against in Hollywood for her age (40), as is its custom. Producers won’t hire her for younger roles, because she’s now regarded as “too old.” Yet she can’t get older roles either, because she still looks much younger. The lawsuit seeks $75,000 in compensatory damages and $1 million in punitive damages.
