In Case Someone, Like The Mainstream News Media, Is Claiming That The Justice Department Just Cleared Hillary Clinton Of Wrongdoing, Don’t Believe Them

Hillary Clinton was engaged in a long and lucrative influence peddling scam known as the Clinton Foundation.  It was a a brilliant, technically legal way to fund the family’s international travel, perks, and opportunity to set up lucrative deals for the family while pursuing other interests, but its was as corrupt as Rasputin’s beard was long.

The proof is in the chart above, unless you have been hit over the head with a skillet. Why would the Foundation’s donations dry up once the two senior Clintons were out of power and without prospects of regaining a measure of it?  Three guesses, and the first two don’t count.  Donations reached $134 million in 2010, right after Hillary became secretary of state, and stayed in that range through 2016. When she lost the election, support crashed, going from $217 million in 2016 to $26 million in 2017. The foundation fired 22 staffers and shuttered the Clinton Global Initiative.

There’s no mystery about what the Clintons were pulling. I teach a course every year on foundation ethics, and often discussed what a general counsel’s duties were once one discovered that their charity or non-profit was using the  non-profit tax laws this way. Nobody can argue it isn’t clever, though its not really unique: a lot of non-profits use the illusion of good works—just enough to meet legal requirements—to essentially launder funds. In this case, the foundation let foreign nations and others bribe the Clintons while getting a tax deduction. Sweet!

The Washington Post described the Justice Department investigation of the foundation as an effort to “mollify conservatives clamoring for more investigations of Hillary Clinton” about “vague corruption allegations.” Fake news. Morning Ethics Warm-Up, 10/19/2017: #MeToo, A Fact-Denying Fact-Check, And A “Resistance” Hit Job

Good Morning to you!

1 The contrived anti-Trump controversy over his conversation with a Gold Star widow is so disgusting and cynical that I hesitate to comment on it. This was so obviously a set-up: an anti-Trump woman, angry and grieving over the death of her husband, allowed a virulently anti-Trump Democratic Congresswoman to listen in on the call, then collaborated to make the accusation that Trump’s words that her husband “knew what he was signing up for” were a calculated insult. The New York Times somehow found this worthy of an above the fold article. No other President would ever be subjected to this kind of despicable “gotcha!” attack. No matter how clumsy Trump’s words might have been, and we can only take the word of two women who were predisposed to interpret them in the worst light imaginable, a President must be accorded a presumption of good will in such a situation. This, however, has been withheld from him in all situations by major segments of the Left from the beginning. Representative Fredricka Wilson (D-Fla) boycotted the President’s inauguration, and has made her motives and character explicit by laughing about how this latest controversy has made her a “rock star.” Well, maybe in “the resistance”–I have a somewhat different description for her. Now she’s race-baiting too, calling John Kelly a racist for referring to her, in his defense of the President, as an “empty barrel” who “makes noise.” Yup, I remember hearing stories about Klansmen calling blacks “Empty barrels.”

What did the wife of La David Johnson expect such a partisan, vicious hack like Wilson to do when she chose her to listen to the conversation with the President? It was another episode in the fake “the President is a white supremicist” pageant, and to anyone with a scintilla of objectivity, a blatant one. The Washington Post’s resident race-baiter, affirmative action Pulitzer Prize winner Eugene Robinson, wrote an unforgivable column calling Trump’s comment “mindless cruelty”he never never made a genuine case that there is anything wrong with what Trump said…because, you see, there isn’t. If the wife of a soldier doesn’t understand that when he enlisted in the armed services he was putting his life on the line for his country and knew it, then that’s her misconception. My father, who had his foot blown up in World War II, made this point more than once: if you enlist to fight, you can’t say you didn’t know that the possibility of being killed or wounded wasn’t part of the decision. If it wasn’t, there would be no innate courage in volunteering for service. This, like so much else that the President does and says, is only wrong because it is him saying it. This is the plan. This is how “the resistance,’ Democrats and their core seeks to cripple the government and undermine the President of the United States. They don’t even hesitate to politicize a simple condolence call and the death of a soldier toward that un-American end.

I think my favorite part of the negative spin put on Trump’s conversation with Mrs. Johnson was that “he appeared not to know the name” of the fallen soldier. Any parent who can’t resist excessive creativity and who names a boy “La David” has condemned him to having everyone hesitate to say his name for the rest of his life, as “Wait, this can’t be right…” locks their brains. This is Naming Ethics. Similarly, don’t name your girl “Mister Nancy.”

Accolades are due to another Gold Star widow, Natasha De Alencar, who has released the audio of a call the President made to her in April after her husband, a  member of the 1st Battalion, 7th Special Forces Group (Airborne) became the first American killed in combat in Afghanistan this year. That conversation shows the President as compassionate and willing to spend all the time necessary to express his respect—and she and her were Hispanic, and we all know that Trump just hates Hispanics. That call alone should ensure the President the benefit of any doubt regarding whether he would “insult” a military widow, but it won’t; not for those who want to assume the worst, and want to  make as many people as possible believe that the President of the United States is a monster.

This was an unconscionable hit job. The Democrats and the news media seem incapable of comprehending that the more ruthless, unjust and vicious they behave in their opposition to Trump, the more those who are not already incurable Trump-haters will conclude that their cure is worse than the disease. A Lawyer Ponders: “Will Obama Pardon Clinton? And If He Does, Will She Accept?” An Ethicist Answers…

Over at The Hill, lawyer David Weisberg examines the questions in the title above. Frankly, I assumed that Hillary needing a pardon from Obama was a dead issue, but Weisberg persuades me that it might not be.

Let’s begin by pointing out that it would be gallactically stupid for the Trump Justice Department to prosecute Clinton. Doing so would be a guaranteed circus; it would inflame Democrats who are already resembling The Human Torch, and it would appear to be a political prosecution. A winning President tries to put his losing opponent in jail would reek of banana republic vengeance, and that’s one reason why no American President has ever done it.

This is Donald Trump we are talking about, however, so who knows? Certainly many of his more angry and less grey matter-blessed supporters would love to see Hillary in the slammer. I am hoping and praying that Trump either is smarter than this or has advisors who can talk him out of his worst ideas, but I am not as confident as I should be. Weisberg makes the reasonable point that Hillary may not be confident either:

“Since being elected, Trump has been remarkably warm towards the person he used to call “Crooked Hillary.” But how confident could Clinton be that the Justice Department, under a Trump administration, would not prosecute? Prosecutorial decisions are supposed to be independent of political considerations, so Trump’s recent friendliness should not be controlling once the new attorney general is in office.”

That last sentence is both true, and following the wretched partisanship of the Obama Justice Department, very much in the category of  legal fiction. Continue reading →

Ethics Observations On The Trump Sons’ Influence Peddling Story

To catch you up: Celebrity gossip website TMZ  hyped the launch of new Texas nonprofit led by Donald Trump’s adult sons Donald Jr. and Eric based on what it called a “draft” of a soon to be released event brochure. The non-profit was offering, we were told, access to the new President during inauguration weekend  in exchange for million-dollar donations to unnamed “conservation” charities.  Prospective million-dollar donors to the “Opening Day 2017” event on  January 21, the day after inauguration, were to receive a “private reception and photo opportunity for 16 guests with President Donald J. Trump,” a “multi-day hunting and/or fishing excursion for 4 guests with Donald Trump, Jr. and/or Eric Trump, and team, ”as well as tickets to other events” and “autographed guitars by an Opening Day 2017 performer.”

The Center for Public Integrity was on this like a shot…and so was the news media. I received a link in an e-mail from someone who archly noted that “You seem to be interested in influence peddling,” a reference to my many posts about the real purpose behind the Clinton Foundation, “so perhaps you will find this of interest [Unsaid but understood: “…you Donald Trump enabling, racist, fascist bastard!”] In the link, TIME took the hand-off from the Center, and got a series of quotes from critics, like Larry Noble, the general counsel of the Campaign Legal Center, a nonpartisan campaign reform organization.“This is problematic on so many levels,” Larry said.  “This is Donald Trump and the Trump family using a brand new organization to raise $1 million contributions for a vague goal of giving money to conservation charities, which seems a way of basically just selling influence and selling the ability to meet with the president.”

Noble cautioned that the details of the event and its association with the new nonprofit listing the Trump brothers as directors were still unclear. “It’s really hard to identify all the problems when they’re so vague,” he said.

True. As of today, Donald Trump Jr. and Eric Trump are no longer listed as directors of a that non-profit. Papers removing their names from the Opening Day were processed by the state of Texas,  a spokeswoman for the Texas secretary of state told CNN Money.

Election Extra! This News Story Illustrates Why You Can’t Trust Hillary Clinton: Corruption! Conflict Of Interest! Lies! Cover-Up! And Of Course, The Mainsteam News Media Doesn’t Want You To Understand It, Which Is Part Of The Story Itself

[ I apologize: this is long. I also think it is important: I know this may be a tipping point for me. I hope you’ll read it, and share it.]

Yesterday, I saw this news item from Reuters, one of the few respectable news sources on the U.S. election that has not been distorting and withholding information to tip public opinion one way or the other. I tracked it all day to see whether the mainstream news media would highlight, or even mention it.

Significantly, the information involved came in a post-workday news dump on a Friday, a technique that has become a favorite of the Obama administration, and has been adopted by its party too.  If you missed it, in other words, that was the intention.

I’ll bold the most critical points:

Reuters:

The Clinton Foundation has confirmed it accepted a $1 million gift from Qatar while Hillary Clinton was U.S. secretary of state without informing the State Department, even though she had promised to let the agency review new or significantly increased support from foreign governments.

Qatari officials pledged the money in 2011 to mark the 65th birthday of Bill Clinton, Hillary Clinton’s husband, and sought to meet the former U.S. president in person the following year to present him the check, according to an email from a foundation official to Hillary Clinton’s presidential campaign chairman, John Podesta. The email, among thousands hacked from Podesta’s account, was published last month by WikiLeaks.

Clinton signed an ethics agreement governing her family’s globe-straddling foundation in order to become secretary of state in 2009. The agreement was designed to increase transparency to avoid appearances that U.S. foreign policy could be swayed by wealthy donors.

If a new foreign government wished to donate or if an existing foreign-government donor, such as Qatar, wanted to “increase materially” its support of ongoing programs, Clinton promised that the State Department’s ethics official would be notified and given a chance to raise any concerns.

Clinton Foundation officials last month declined to confirm the Qatar donation. In response to additional questions, a foundation spokesman, Brian Cookstra, this week said that it accepted the $1 million gift from Qatar, but this did not amount to a “material increase” in the Gulf country’s support for the charity. Cookstra declined to say whether Qatari officials received their requested meeting with Bill Clinton.

Officials at Qatar’s embassy in Washington and in its Council of Ministers in the capital, Doha, declined to discuss the donation.

The State Department has said it has no record of the foundation submitting the Qatar gift for review, and that it was incumbent on the foundation to notify the department about donations that needed attention. A department spokeswoman did not respond to additional questions about the donation.

According to the foundation’s website, which lists donors in broad categories by cumulative amounts donated, Qatar’s government has directly given a total of between $1 million and $5 million over the years.

The Clinton Foundation has said it would no longer accept money from foreign governments if Clinton is elected president and would spin off those programs that are dependent on foreign governments.

“MATERIAL” INCREASE

Foundation officials told Reuters last year that they did not always comply with central provisions of the agreement with President Barack Obama’s administration, blaming oversights in some cases.(reut.rs/2fkHPCh)

At least eight other countries besides Qatar gave new or increased funding to the foundation, in most cases to fund its health project, without the State Department being informed, according to foundation and agency records. They include Algeria, which gave for the first time in 2010, and the United Kingdom, which nearly tripled its support for the foundation’s health project to $11.2 million between 2009 and 2012.

Foundation officials have said some of those donations, including Algeria, were oversights and should have been flagged, while others, such as the UK increase, did not qualify as material increases.

The foundation has declined to describe what sort of increase in funding by a foreign government would have triggered notification of the State Department for review. Cookstra said the agreement was designed to “allow foreign funding for critical Clinton Foundation programs” to continue without disruption.

The State Department said it has no record of being asked by the foundation to review any increases in support by a foreign government.Asked whether Qatar was funding a specific program at the foundation, Cookstra said the country supported the organization’s “overall humanitarian work.”

“Qatar continued supporting Clinton Foundation at equal or lower levels” compared with the country’s pre-2009 support, he said. He declined to say if Qatar gave any money during the first three years of Clinton’s four-year term at the State Department, or what its support before 2009 amounted to.

In another email released by WikiLeaks, a former Clinton Foundation fundraiser said he raised more than $21 million in connection with Bill Clinton’s 65th birthday in 2011.

Spokesmen for Hillary Clinton’s campaign and Bill Clinton did not respond to emailed questions about the donation.

Now let’s get this out of the way up front: the import and significance of the facts in this story were covered up…by Clinton, by her Foundation, by State, and by the news media.This story was buried in October by the Donald Trump “pussy-grabbing” video, and the news media focused the public’s attention on little else. Of Bundys, Trump, Wikileaks, Rebellion—You Know, The Whole 2016 Election Thing

jury-nullThe jigsaw puzzle of an existential national crisis, a real one, are assembling sufficiently so an image can be distinguished. It is uglier than I imagined.

1. Item:  The Bundy Brothers were acquitted. This was pure jury nullification, because they were guilty as hell. It might be an aberration, but I fear it is not. The jury is a fractal of democracy, and when juries start finding lawbreakers innocent, they are sending a message that those in power ignore at their peril. They say “We don’t like or respect you or your laws, and you better change, or else.” The complete class, regional and ideological estrangement from the Federal government this decision represents shows how completely Barack Obama has divided the nation, and portend a long, long, difficult and, one can only hope non-violent recovery, if some competent leaders emerge who can handle it. As trust in our institutions have collapsed with accelerating speed over the last decade, civility has deteriorated and authorities have increasingly threatened the basic Constitutional rights of citizens while extending privileges to non-citizens for political motives, the connective tissue of our society has been frayed to the snapping point. Responsible leadership, objective  and rational citizens must not shrug this verdict off as just a bunch of gun nuts and cowboys throwing a tantrum.

2. Item: Donald Trump keeps saying that the election is “rigged.” This is beyond irresponsible, in isolation not more irresponsible than what Trump has said about other things, but the timing and sheer intensity of this drumbeat from him is truly horrible….and also likely to be effective.  Continue reading →

Exploring Double Standards In The 2016 Election, A Hypothetical Thought Experiment For Ethics Alarms Readers

While the news media has been almost totally focused on Donald Trump’s misogyny, alreday well-established long  but somehow decisively important once it was in full display from the video of a private exchange from 11 years ago, revelations about his opponent’s character and modes of operation have also been trickling out into view, and receiving far less attention from either journalists or voters.

They have also exposed many of Clinton’s lies. For example, after posturing about Trump’s birtherism and claiming that his defense that Clinton led the way in 2008 with planting conspiracy theories to otherize Obama, this  ugly email, surfaced from the 2008 Clinton campaign, including John Podesta and Paul Begala on the distribution list. It strongly suggest that an attack on Obama’s religion and citizenship was part of the strategy to defeat him, as well as using his alleged use of illegal drugs and support for gay adoption as ammunition.

The 2013 Goldman-Sachs speeches that Clinton received $675,000 to give to the investment companies have turned up, thanks to Wikileaks. More revealed files from the FBI have cast suspicion on the process whereby Clinton was cleared of criminal misconduct in her irregular handling of official e-mails.

Other documents have indicated that the federal government, “supported by tax dollars,” as the Wall Street Journal puts it, was working as an extension of the Clinton campaign. The State Department seems to have coordinated with her staff to blunt the email scandal, and the Justice Department kept her team informed about developments in the court case.

Clinton’s State Department, as documents obtained under the Freedom of Information Act show, also facilitated Clinton’s use of her official influence to provide special favors to Clinton Foundation donors. For example, in one  series of 2010 emails, a senior aide to Hillary  Clinton asked a foundation official to let her know which groups offering assistance with the Haitian earthquake relief were “FOB” (Friends of Bill) or “WJC VIPs” (William Jefferson Clinton VIPs).

The leaks show “that the press is in Mrs. Clinton’s pocket,” writes Kimberly Strassle at the WSJ.  Donna Brazile, now DNC chair, sent the exact wording of a CNN town hall question to Hillary ahead of a scheduled debate.  Other journalists gave the Clinton campaign the power to veto which quotes were used from interviews, helped facilitate press events, and offered advice to her campaign.

Less surprising but arguably more damaging if the average voter knew, the various leaks, e-mails and speeches reveal a candidate with little integrity and few core principles, an opportunistic policy Janus who constantly changes her position to maximize political gain. She told an audience that she believes in giving the voters one position while holding different ones, and has taken such dual positions on banks; international policies, trade, illegal immigration, energy, and more. Though many of the leaked e-mails reveal views of her staff that are only attributed to Hillary, it is likely that the voluminous discussions among Clinton’s advisors about  what false rhetoric she should use to recruit “the Red Army,” also called “the base of the Democratic Party.” are not inconsistent with her own attitudes.

All of this, and more is on the way, does not show an individual with Donald Trump’s repulsive narcissism and contempt for a full half of the world’s population, but does show Clinton to be, like Trump, untrustworthy, dishonest, corrupt, ruthless, and shameless. Unlike Trump, it reveals an individual addicted to showing the public a completely different political being than she really is.

Strassle concludes her summary by saying that “Voters might not know any of this, because while both presidential candidates have plenty to answer for, the press has focused solely on taking out Mr. Trump. And the press is doing a diligent job of it.”

So I wonder…what if, rather than requiring explanation, analysis, extrapolation, and connecting the dots, and without being marred by over-reaching and biased exaggerations of already damaging evidence by right-wing, Hillary-hating zealots, visual and audible smoking gun proof of Clinton’s lies, false poses and corruption was exposed to the nation?

Did You Know Hillary Confessed To Repeated, Intentional And Blatant Unethical Conduct As Secretary Of State? Because She Did…

Now, to be fair, you may not have realized that Clinton made this unusually candid—for her—admission, because the statement was made in a phone interview with CNN, with a typically ignorant and incompetent interviewer (“THIS is CNN!”) who either doesn’t know the first thing about government ethics, or doesn’t care if Clinton complied with them. Moreover, virtually no mainstream media sources pointed out the significance of what Clinton said, because…well, read the last part of the last sentence.

Talking about the various news reports and new email content that indicated a disturbingly close relationship between Clinton’s Foundation interests—that is, raising money that assists the Clintons’ personal fortunes in various ways—and her State Department duties, which were supposed to occur completely free of such conflicts of interest, Hillary said, straight out…

“I know there’s a lot of smoke and there’s no fire.”

Bingo! Gotcha! DINGDINGDINGDINGDING!

And there we have it, Ladies and Gentlemen, a confession of official wrongdoing! For as an officer of the Executive Branch and a government employee, Clinton was subject to  Executive Order 12731 of October 17, 1990, “PRINCIPLES OF ETHICAL CONDUCT  FOR GOVERNMENT OFFICERS AND EMPLOYEES,” as are all such officers and employees today. Veteran Clinton hired minion (I think that’s fair) James Carville’s reaction to the latest news about how Hillary used the State Department to reward Clinton Foundation donors (that’s a fair description too, and illegal) is wonderful in its way, as it comes as close to a perfect example of one of the most sinister and historically destructive rationalizations on the list, the Saint’s Excuse, as one is likely to see in a lifetime. It’s also useful, because if you find yourself finding his logic persuasive, then you are as devoid of ethics as James Carville is.

Trust me: you don’t want that.

 Carville said this morning on MSNBC’s “Morning Joe” that if the Clinton Foundation had decided not to accept foreign donations while Hillary Clinton was Secretary of State —as the Obama Administration swore to Congress that it would not do, as government ethics rules and laws forbade it to do, and as anyone with the tiniest understanding of conflicts of interest knows it could not do,

“…you’d be out hundreds of millions of dollars that are doing good. What the Clinton Foundation does, it takes money from rich people and gives it to poor people. Most people think that’s a pretty good idea.”

Most people? If so, those “most people” are also the ones who are completely ignorant of what corruption is, and exactly the kind of people that Bill and Hillary Clinton, and Carville, happily recruit to prey upon the rest of us. Continue reading →

All right, I know this is the lowest of low-hanging fruit, but come on.

The University of Missouri at Kansas City just opened a Women’s Hall of Fame and sought an appropriate female leader to speak at the gala luncheon launching it. It not only chose a non-leader, non-accomplished, non-much of anything except lucky rich kid Chelsea Clinton, but also paid $65,000 for her to speak (she’s also a non-professional speaker) for only ten minutes, and then to answer questions—which carefully crafted limitations on the questions—for another 2o minutes.  The money goes to the Clinton Foundation, which makes no difference to the ethics of the transaction, which are revolting in many ways:

1. $65,000 for a ten minute speech—that rate is about 11 thousand bucks a minute— is outrageous unless the speaker is Abe Lincoln. It is virtually impossible to say anything in ten minutes that is especially valuable, and unlikely to the vanishing point that Chelsea Clinton is one of the rare people who could accomplish it.

2. Any college or university that cannot find a better legitimate educational use of $65,000 than this is too inept to stay open.

3. The school says that Clinton’s fee was funded by private donors, meaning that $65,000 worth of donations that could have gone to, say, scholarships were diverted into the Clinton Campaign and Influence Peddling Slush Fund. Continue reading →
