Sorry, Tony! Overnight, New Jersey became uncorruptible. Time to move to Washington, D.C.

The Center for Public Integrity got what it wanted yesterday, which was headlines about its extensive new study of public ethics laws in the U.S. In order to get its cherished publicity, the Center added to the public’s confusion about what corruption is, what ethics is, and how one discourages one while iencouraging the other in our various governments. They released results that graded the 50 states according to “corruptibility”, and found that New Jersey was the least corruptible of all.  I hope the Center’s officials and scholars are happy with their PR, but if they have a shred of integrity and common sense, they should be ashamed of themselves. The Professions Most Likely to Cheat on Their Taxes?

Gee, where do "Treasury Secretaries" fall on the list?

A study of I.R.S. data by a University of Chicago graduate student, now Doctor, Oscar Vela,  produced the following list of the professions most likely to file fraudulent tax returns, at least according to his analysis. Make of it what you will. The Time Magazine website blog post about the list is worth reading, first for the blogger’s highly questionable theories explaining, for example, why lawyers aren’t on it, but mostly to see conclusive proof that Time is hiring English-as-a-second-language night students, relatives of Ko-Ko the talking gorilla, or stroke victims to write their blogs. Sample sentence: “His conclusion was that as much as we would like to think so we pay taxes out of  the goodness of our hearts, or even because we are fearful of fines or worse.” Henry Luce just did a back-flip in his grave.

Dr. Vela’s theory is that the professions that are required to maintain a perception of integrity are less likely to cheat. Let us say that I am dubious. Why then are scientists so high on the list?

Kansas City Star reporter Mary Sanchez has posted an excellent column entitled “James O’Keefe and the Ethical Bankruptcy of ‘Gotcha’ Journalism.” Outside of an unfortunate final “Let’s see some genuine evidence that NPR’s coverage is biased” conclusion (you mean, other than its choice of stories, its lack of ideological balance, Nina Totenberg, its treatment of Juan Williams, and its institutionalized positions on issues like Palestine, gun control, abortion,  and illegal immigration?), she makes a strong case. But her piece is marred by a tell-tale gaffe that makes me doubt her own ethical orientation.

When TV’s Ethics Matter, and When They Don’t

As one who has argued that certain TV commercials, notably the infamous “green shirt” Tide commercial, the Twix commercial  and Direct TV’s disturbing (but often funny) series showing football fans hurting rival team supporters, I know I’m asking for trouble by declaring, as I officially do here, that for compliance firm Global Ethics to criticize TV shows like “The Office” and “30 Rock” for supposed workplace ethics violations is absurd. But it is absurd. And criticizing the commercials in question is not.

Olbermann’s Donations: A Breach of Ethics Policy, But Not Unethical

I’ll make this short, but I can’t pass up the chance to come to MSNBC host Keith Olbermann’s defense when he deserves one. It may never happen again.

Politico is reporting that Olbermann made campaign contributions to two Arizona members of Congress and losing Kentucky Senate candidate Jack Conway beforeTuesday’s election , which is a violation of NBC ethics policies.

Olbermann made the maximum legal donations of $2,400 apiece to Conway and to Arizona Reps. Raul Grijalva and Gabrielle Giffords.  Grijalva appeared as a guest on Olbermann’s “Countdown” show the same day that Olbermann made the gift. NBC, like most news organizations, has a policy against employees contributing to political campaigns on the theory that it indicates a breach of journalistic independence and a lack of objectivity.

Yes, Keith broke the rules of his employer. That is wrong, no matter what the rule is, and justifies whatever punishment NBC deems appropriate.

The rule, however, is itself unethical, because its objective is to deceive the public into believing that reporters who are anything but objective, are. It isn’t a contribution that makes a reporter partisan and biased, it is wanting to make the contribution that shows his bias, whether he makes it or not. The rule prohibits reporters acting in a way that alerts the public to what their biases are. But I want to know what they are. Don’t you? Continue reading

Unethical Quote of the Week: Slate Editor Dahlia Lithwick

“[The G.O.P. nominee for the U.S. Senate, Christine] O’Donnell explained that “when I go to Washington, D.C., the litmus test by which I cast my vote for every piece of legislation that comes across my desk will be whether or not it is constitutional.” How weird is that, I thought. Isn’t it a court’s job to determine whether or not something is, in fact, constitutional? And isn’t that sort of provided for in, well, the Constitution?”

The Unethical Culture of the Congressional Black Caucus

Ethics does not appear to be a priority for the Congressional Black Caucus. Instead, the C.B.C. regards ethical rules and standards as a nuisance, and, like law enforcement, color-blind college admissions and merit-based promotions, a tool of racism. In what A.E.I. government ethics scholar Norman Ornstein correctly dubbed “a pretty good working definition of chutzpah,” the Caucus is calling for restrictions on the new Office of Congressional Ethics, because it is interfering with the dubious, sometimes illegal and often profitable habits of a lot of  C.B.C. members.

In an ethical organization, a responsible one dedicated to good government and public service over protecting its members from appropriate ethics oversight, the response to the spate of ethics allegations against Congressional Black Caucus members would be, “All right, we better work on cleaning up our act.” This, however, is the group that thought former member Rep. William Jefferson, now a convicted felon, was unfairly suspected of wrongdoing after $90,000 of bribe money turned up in his office freezer. Continue reading

The Ethically Obtuse Bauer Memo

According to both the Washington Post and the New York Times, the memo from White House Counsel Robert F. Bauer shows that the Sestak/Clinton/White House scandal is nothing to waste time over. Or, as the Times puts it today’s Ethics Dunce-worthy editorial,* “nothing terribly unethical” happened.

I see. Our standards for the ethical conduct of our President and his staff isn’t that they should behave ethically, but that they shouldn’t be terribly unethical.  Certainly that is the attitude conveyed by the Bauer memo, which is unconvincing legally and appears to be written by someone who never heard of the concept “ethical.” Continue reading

Ethics for Bureacracies—On An Index Card

Ethicist Bob Stone has proposed a useful and perceptive solution to the perplexing problem of lax ethics in government bureaucracies. Calling on them to adopt “a strong sense of mission and a culture of trust, with authority and responsibility shifted from the few at the top to the many front-line workers,” Stone declares that too often “what passes for ethics is merely another set of rules to comply with, and ethics training usually consists of badgering workers about bribery, conflict of interest and favoritism.”

As a solution, Bob proposes a statement of ethical principles, so brief that it would easily fit on an index card:

I will:

  • Do my best at work
  • Avoid conflict of interest
  • Speak truth to power
  • Be a good citizen
  • Shun any private gain from my employment
  • Act impartially
  • Treat others the way I would like to be treated
  • Report waste, fraud, and corruption

When in doubt, my test is can I explain my actions to my mother or to my child.

Stone recommends that leaders and managers customize this to their own organizations, print it, distribute it, and then–and this is the most important part—regularly use events and decisions to discuss ethical lessons and principles with the staff, using the Statement of Principles as the starting point.
