Different Symptoms, Same Ethics Illness: The Mike Rice-Rutgers Scandal And The Sandusky-Paterno-Penn State Tragedy

The question isn’t, as many news reports would have us believe, whether the Mike Rice affair mandates an administrative house-cleaning at Rutgers. Of course it does. The question is why, after the far uglier Penn State scandal, anyone possessing the gray matter of the Scarecrow from “The Wizard of Oz” thinks otherwise.

In case you are really smart and pay no attention to the dire ethics swamp known as college sports: Mike Rice was a very successful Rutgers basketball coach until ESPN got a hold of a video compilation of him abusing his players on multiple occasions. Though the Rutgers athletic director had seen the damning evidence in November, he let Wise off with a fine and suspension; then the recent national exposure forced him to fire Wise. This prompted Rutger’s president, Robert Barchi, to fire the athletic director (Tim Parnetti) for not taking appropriate action once he had discovered his coach was hitting, assaulting, and taunting players. And Barchi? Even though he knew, or should have known, that Rice’s methods were unacceptable, he never looked at the video (or so he says) that was available to him six months ago, until April. The New York Times reports that many Rutgers officials as well as the university’s outside attorneys knew that Rice was abusing his players,and that he had been doing so for years.

The net lessons learned from the Penn State disaster are zero. As the Times article says, “interviews and documents reveal a culture in which the university was far more concerned with protecting itself from legal action than with protecting its students from an abusive coach.” Yes, a coach attacking student is far short of child-molesting, but that’s  irrelevant: the corrupt cultural syndrome is exactly the same.  Rutgers, top to bottom, placed winning basketball games above sportsmanship, decency, fairness, and protecting their own students. The difference between Rutgers and Penn State is Joe Paterno and moral luck.

Let us be clear: if a teacher physically assaults a student, anywhere, at any level, ever, that teacher has to be fired, and probably prosecuted. A coach is no different. This isn’t open to debate. Yet I listened, as my gorge rose, to the glib and simple-minded conservative radio host Sean Hannity jabber with ex-Notre Dame football coach and facile “inspirational speaker” Lou Holtz about how Parnetti got a raw deal. Why? Parnetti built a great program! So he lets his coaches assault his players—anyone can make a mistake! Isn’t this hindsight? Second-guessing?

“Players are spoiled today; they just aren’t ready to be criticized,” said Holtz, who speaks in platitudes and nostrums that cover a Neanderthal sensibility (so you know he’s much in demand for corporate speaking gigs.)  These men are both ethics-challenged fools, but they have plenty of company.  Rutgers’ report on Rice’s abusive treatment assembled excuses and rationalizations by the authors and others. Rutgers athletic assistants said the video clips showing Rice kicking his players and throwing objects at them “were taken out of context.” What?? In what “context” is it appropriate for a college coach to do this? None! Many of Rice’s players said he prepared them well for tough competition. The report noted that under Rice’s abusive, tortious methods, the players’ grades rose to a B average. Oh! Well, that must mean assault and battery is okay, then, because it works!  This is the ethical standard Rutgers is teaching its students.

Elsewhere, Rutgers’s internal report called Rice “passionate, energetic and demanding” and concluded that his intense tactics were only aimed at improving his team and “were in no way motivated by animus.” Ah! So beating kids is okay, as long as it’s well-intentioned! This culture is sick, sick, sick and as with Penn State, it is part of a large sick culture that pervades university sports. Here’s one official from another sick school defending Parnetti:

“I think it was unfair for them to fire Pernetti. There were probably a lot of things that went into the decision not to fire Mike Rice in December. And as gruesome as that tape was, it was also a first offense for Mike Rice. I think Pernetti is taking the heat for everything and sometimes in leadership roles you take the glory probably more than you deserve and you take the heat more than you deserve. I think right now Pernetti is taking the heat more than he deserves.”

A first offense???? The video was compiled from dozens of incidents, and Rice’s penchant for violence and abuse were already known! Yeah, there were  “a lot of things that went into the decision not to fire”  Rice, none of which add up to a single good reason not to get rid of any coach who beats up kids in his charge.

The New York Post interviewed a college official who believes its all Facebook and Twitter’s fault:

“The whole situation, top to bottom is a shame. But my opinion is that there is no manual or rule book for how to handle these types of situations. To say (Pernetti) should have handled this situation a certain way, well unless you’ve been in his shoes, it’s hard to comment on it. Obviously there was a reason why Pernetti kept Mike Rice around. What was that reason? We don’t know. But one thing I saw was that his kids, his players backed him. So In my opinion do you know what got Mike Rice and Tim Pernetti fired? Social media got them fired. People make comments and form opinions without knowing all the facts sometimes. That’s the world we live in now.”

Yes, there is a rule book, and it’s called ethics, not that this guy, or whatever college he works for, would recognize it. “Unless you’ve been in his shoes”? The translation of this fatuous and offensive rationalization is simple: “Hey, there’s a lot of pressure on this guy to win, and he’s not going to let a couple of bruised sophomores jeopardize the won-lost record and alumni support. I bet you’d let the kids get beat up too.”

I wonder what schools those two anonymous officials work for? That’s the frightening part;  they could be working at almost any big time sports school, because that’s the predominant culture there.

There are a wide variety of offenses that ought to lead to a college professor’s dismissal. Incompetence, for example. Our young minds should not be shaped by fools. A university should not tolerate discrimination and bias,  either. Every occupant of a classroom should  feel that he or she is equally welcome regardless of race, color, gender…well, you know the list. Abuse of power by a teacher shows  a lack of trustworthiness; that kind of conduct, as well as its close relative, bullying, must be strictly forbidden on campus. Then there are an assortment of character traits and professional deficits that must lead to severance from a teaching position when they are in evidence, traits like laziness, ignorance, lack of respect for core American rights, and stupidity, which, neatly enough, brings us back to incompetence.

This also brings us to the case of Dr. Deandre Poole, the Florida Atlantic University professor who ordered her class to write “Jesus” on a piece of paper and then to stomp on it. When one student, a devout Mormon, refused, and was clearly upset about it, he took steps to have the student punished for that old favorite, violation of the student Code of Conduct. The easiest place to render oneself disconsolate regarding the pit of warped values we must send our public school children into every day is Fark.com, which cheerily documents the child predators in the teaching ranks and their exploits. Let’s see, I haven’t checked in a while…I wonder what the tally is for February? Hey, February’s a light month! I have to go all the way back to the 19th to find the first, LaShawn Simmons, a 41-year-old former Pasadena middle-school math teacher who had sex with four students. She’s charged with sexual assault of a child, two counts of improper relationship between an educator and a student, online solicitation of a minor and possession of child pornography.

Actually, February was a terrible month to go to school, just not one with a bumper crop of child-molesting teachers. For example, in Port St. Lucie, Florida, we had a female teacher who didn’t have sex with a male student, she only purchased drugs from him and went drinking with him. It would be hard to top the teacher who poured pencil shavings in the special ed student’s mouth (and who wasn’t fired), but I think the Linden, California gym teacher who was caught on video stealing money from her students’ backpacks gets the prize. She was caught when a suspicious student and aspiring Nancy Drew hid in a locker to see if she could solve a string of thefts, and recorded the teacher’s larceny on her phone. It gets worse: when she brought the video to the attention of the principal, he told her to destroy the evidence. Luckily, she had already sent the video to her father. Continue reading

Contrived Ignorance In The Utah Highway Patrol

This shocking story from Utah demonstrates an ethical culture truism: when superiors ask subordinates to deliver results without proper guidelines, warnings, and insistence on using only ethical means to achieve these results, misconduct is inevitable, the leadership is incompetent, and the organization’s culture is rotting.

Utah honored state trooper Lisa Steed as the first woman to be selected as Trooper of the Year for shattering all records  with an astounding number of DUI arrests. Her supervisors spoke about her “sixth sense” in being able to detect impaired drivers when most officers would not. There was a reason for this, it turned out. Steed arrested drivers for DUI whether they were in fact drunk or not. Now her record-setting arrests are being challenged as invalid, and she is out of a job.

She had many victims, innocent drivers who lost jobs, promotions, reputations and thousands of dollars, because she was determined to make her bosses think she was a star. For example, she arrested Michael Choate, a now-retired aircraft logistics specialist at Hill Air Force Base, because her “sixth sense” told her that his driving while in a Halloween costume suggested he was inebriated. She arrested and charged him even though three breathalyzer tests showed no alcohol in his system. Choate says he spent $3,800 and had to take four days off of work to get his DUI charged dismissed. Soccer, Sports, Corruption, and Cultural Rot

Bitter rot After a moment’s reflection, I realized that it was inevitable that international soccer would be rocked by a match-fixing scandal. If I should have seen it coming, and I care as much about soccer as George S. Kaufman cared about Eddie Fisher’s social life*, then the officials of the sport should have seen it coming too.

From the New York Times:

“…A European police intelligence agency said Monday that its 19-month investigation, code-named Operation Veto, revealed widespread occurrences of match-fixing in recent years, with 680 games globally deemed suspicious. The extent was staggering: some 150 international matches, mostly in Africa, Asia and Latin America; roughly 380 games in Europe, covering World Cup and European championship qualifiers as well as two Champions League games; and games that run the gamut from lower-division semiprofessional matches to contests in top domestic leagues.”

Thus soccer, the most played, most followed, most passionately cheered of all major team sports has been rigged. It doesn’t matter that all the games weren’t rigged; what matters is that now nobody can be sure that a game isn’t rigged. How can a fan care, deeply care, about the outcome of an athletic contest when there is always a lurking, justified suspicion that victory is undeserved and that defeat is unfair? In the span of just a few weeks, we have heard the golden boy of American and international cycling admit that he was at the center of a cheating conspiracy, and that he used lies, influence and financial power to make his sport a contest of which competitor could break the rules most effectively. New revelations from Miami, meanwhile, indicate that Major League Baseball’s so-called steroid era, which supposedly had been vanquished forever, may never have gone away at all: several current stars, like the Yankees’ Alex Rodriguez and 2011 National League MVP Ryan Braun, have been linked to treatments at a clinic known for human growth hormone therapy. Big sports mean big money, and where there is big money, there will always be clever, dishonest people willing to crush laws, ethics, sportsmanship and public trust in order to get more of it. Yes, Putting Underpants on Michaelangelo’s “David” Is Unethical.

So is putting a bikini on the Venus de Milo, in case you’re wondering.

The issue has been raised because a huge replica of the nude male statue was unexpectedly donated to a Japanese town, where it is unsettling some people and frightening others. Clothing “David” in a big Speedo or something has been suggested as a way to make the artwork more viewer-friendly.

Uh, no. Not all art will be welcome in every culture, and it may be that a mega-“David” in a Japanese park was a mistake. It is a work of visual art, however, and it is wrong for anyone other than the artist to alter or censor that artist’s creative work, especially when such a change renders the work of art risible. Putting underwear on “David” is as unfair and disrespectful as putting Groucho glasses on the “Mona Lisa.”

The town of Okuizumo has precisely two ethical choices, and no more: remove the statue and give it to someone else who will take care of it and appreciate it, or leave it alone.

Fruit of the Loom is not an option.

Unethical Quote of the Week: Former NASA Official Jon Harpold

“Don’t you think it would be better for them to have a happy successful flight and die unexpectedly during entry than to stay on orbit, knowing that there was nothing to be done until the air ran out?”

—–Space Shuttle Columbia mission operations chief Jon Harpold in 2003, talking about the Shuttle crew then in flight, as quoted by former NASA flight director Wayne Hale on his blog this week. Harpold was musing on a hypothetical situation (he thought) where NASA had determined that the Shuttle couldn’t safely return to Earth.

Days before Columbia disintegrated on re-entry due to a damaged heat shield, NASA officials met to determine whether Columbia was safe to land despite some damage after takeoff. They decided, wrongly, as it turned out, that the Shuttle was safe. In the course of the meeting, Jon Harpold raised the hypothetical dilemma of a doomed Shuttle and an unaware crew.

Hale tells the story to make the point that NASA’s culture at the time was organizationally and ethically flawed. I agree.

Harpold’s position is kind but monstrous. It presumes to withhold the truth from those most effected by it, on the theory that it is better to die suddenly and unexpectedly than to have the opportunity to fight and strive to the end to solve what might be an impossible problem. Nobody should feel that he has the right to make that decision, to give up on life itself, for another who still has the capacity to think and act. This is disrespect for the values of personal liberty and autonomy, both much in the public mind today.

We each must have the right to make our own decisions about our fates, and must always have the information we need to make those decisions as wisely as we can. Those who fear the truth have insufficient reverence for it. Even the worst information may contain the seeds of victory.

I’m not going gentle into that good night, and damn anyone who tries to trick me into doing so out of misplaced kindness.

Yesterday, the media, history buffs and Kate Winslet fans were obsessed with remembering the Titanic, sometimes even with proper reverence to the 1500 men, women and children who lost their lives in the North Atlantic on April 15, 1912. A strong argument could be made, however, that the most significant event that occurred on April 15 took place in 1947, in Brooklyn, New York. For that was the day that Jackie Robinson ran out to his position at first base as a member of the Brooklyn Dodgers, and became the first African- American to play baseball in the Major Leagues since the earliest years of the game.

With that act, and his epic heroism for the rest of the season, Robinson changed baseball, sports, American society and history. It was a cultural watershed in a nation that had been virtually apartheid since the end of the Civil War, a catalytic…

“Certainly it’s a sad state of affairs when a woman (or man) has to keep to the well-lit areas in order to avoid the dangers lurking in the dark. If Emily’s post is a lamentation that it would be wonderful if people needn’t fear the darkness, then I agree wholeheartedly. And The Solution To This Phenomenon Is Simply Ethics. Why Is That So Hard?

construction_workers_at_voi_bigWith her “Letter to the Guy Who Harassed Me Outside the Bar” , Emily Heist Moss makes me briefly wonder, not for the first time, why all men haven’t been murdered in their beds by an organized feminist vigilante posse. The conduct she describes is disgusting and infuriating just to read about, and I don’t even have to experience it.

The amazing thing is that this kind of ritual harassment would vanish with some slight behavioral additions to our culture, many of which once were the norm, habits of good conduct like etiquette,  manners, consideration, civility, fairness, kindness, respect, and the Golden Rule. They could become cultural norms again, and rather easily, I would think, with an increase in responsible parenting, a responsible popular culture, and the development of role models with integrity. Not featuring serial and unapologetic sexual harassers as stars of sitcoms (Charlie Sheen) and political conventions (William Jefferson Clinton) would help; so would a serious effort by Hollywood not to trivialize workplace harassment as cute or amusing, as in the long-running “Cheers,” or in current TV  dramas like “Criminal Minds” and “NCIS.”
