On The Disapproval Of President Trump

Talk about cognitive dissonance…

The recent barrage of  anti-Trump stories, self-inflicted Presidential wounds and media smears has the President’s approval ratings down again, back to his unshakable 37% or so core, presumable the American who, as he so memorably joked, would support him if he shot someone in Times Square. It has also been as high in some polls as 50% in the not so distant past, and substantively, not much has changed, except that the economic news keeps getting better. “There’s Never Been a President This Unpopular With an Economy This Good,”writes Bloomberg, and I’m sure that’s true. There was also never an individual as unpopular as Donald Trump elected President of the United States before he was.

The “disapproval rating” of his performance is incoherent, of course, because it is an undecipherable mess of apples, oranges, and wooden shoes.  Some disapprove of Trump because of his almost completely revolting character. Some disapprove of him because they disagree with his policies, since they are socialist, statist  One Worlders who believe, against all evidence, that Barack Obama was a great leader. Some are Republicans who are embarrassed to have such a man representing their party, no matter what policies he pursues. Some are conservatives who regard Trump as not sufficiently conservative, for indeed he’s not a conservative at all. Some are classist snobs. Some are morons who just believe what social media and the mainstream media tells them to believe. I’d love to know how this group breaks down, but we’ll never have that information.

Still, I find it encouraging that Trump remains unpopular despite his many positive achievements, some arguable, some not. It is good that the idea that there is more to being a respectable and admirable President than presiding over positive economic times, strong foreign policy, and military success. It is especially encouraging to see Democrats and progressives being driven to that position after stubbornly refusing to acknowledge that the character of a national leader is important during the Bill Clinton years, and after nominating Hillary. The President of the United States is not a CEO, and not a mere policy wonk (Yes, I recognize the absurdity of calling someone like Donald Trump a “wonk” of any kind). Leadership is as much a symbolic role as a pragmatic one. Leaders shift cultural values and norms; they define, or should, what a nation and its public regard as good, bad, right, wrong, admirable, and unacceptable. This was the basis of my initial, long-held, endlessly expressed, and unyielding opposition to his leadership style and personal demeanor, perhaps most forcefully explained here.

The importance of a President’s character goes far beyond being an automatic role model, however. A President, while he is in office, defines the Presidency itself. If he defines it in negative terms and values, everything connected to the Presidency suffers as well (See: the Cognitive Dissonance Scale): our system, democracy, the separation of powers, constitutional government and its institutions. A President has a duty to strengthen his office for future occupants, and to uphold the highest standards that his predecessors set. Donald Trump does not understand this aspect of his job, and never has. The reasons for this can be debated; he is obviously not a student of history, and as someone who has succeeded by breaking rules and defying conventional wisdom, he would be unlikely to understand why this role should be regarded as different from any other executive post. LATE Comment Of The Day: “Ethics Dunce: MSNBC’s Rachel Maddow”

My inexcusable failure to previously post this Comment of the Day by Curmie, originally offered nearly two months ago, is especially bad because of the rapidity with which the news media concocts, hypes, or otherwise featured new tangential assaults on President Trump every day. I had forgotten about this one: the White House posted an incorrect version of the Helsinki press conference transcript. Boy, that seems like a hundred scandals, real, manufactured, and imagined, ago!Allow me to refresh your memory and mine:

MSNBC hostess Rachel Maddow, along with many of her fellow journalist members of “the resistance,” pounced on the mistake, accusing the White House of intentionally editing the transcript. Then, after the Washington Post explained  that the omission was not the fault of the White House, Maddow, who is often cited as a trustworthy left-wing journalist simply because she is so much less flagrant than her MSNBC colleagues, denied that her reporting was incorrect, saying,

“This is one possible explanation for why the White House transcript & video from Helsinki doesn’t include Putin saying he wanted Trump to win. But Putin really did say that in Helsinki…..and the White House transcript & video still does leave it out. WaPo now says it has updated its own transcript. Will the White House? After more than a week of reporting on the bad transcript (see link below)…

(1): White House has let it stand uncorrected, and

(2): POTUS now asserts that Putin wants *Dems* to win, not him.

I love WaPo with the heat of 1000 suns, but nothing here from WaPo disproves our report.”

 Washington Post reporter Philip Bump, quickly pointed out Maddow’s dishonesty, writing,

“Your report asserts that the video was edited and implies that the incomplete transcript was posted intentionally. There’s no evidence for the first point and my piece provides context to suggest that the second was unintentional.”

With that background, here is Curmie’s much delayed Comment of the Day on the post, Ethics Dunce: MSNBC’s Rachel Maddow. He also gets extra points for the baseball reference at the end…

Apparently I’m one of the few lefties who comment here even occasionally these days. I trust I will not become an “exile.”

This story becomes an intriguing example of the partisan fragmentation of the country that has been happening for about a generation. Some people will believe everything Rachel Maddow (or Sean Hannity, or…) says; some will believe nothing. Too few will parse the content.

Maddow’s allegation that someone intentionally edited the tape/transcript is unsupported by facts, and her smug reassertion of a discredited argument is, to say the least, problematic.

But I’ve written on my blog about two variations on what I call the Christine Vole effect, named for the character in the Agatha Christie short story/play and subsequently Billy Wilder movie who intentionally allows her absolutely truthful testimony describing her husband’s guilt to seem instead to be the vengeance of a jealous wife. The jury was influenced by the implosion of her testimony, which was, by the way, unnecessary to the prosecution’s case; they acquit.

The variation, as we saw often in the likes of James O’Keefe, and here with Maddow, is the unintentional corollary: by making an extreme statement, the speaker undermines the rest of an otherwise persuasive argument. Continue reading →

Travel Notes…[UPDATED]

Every trip I take seems to require some ethical clarification…

  • Lose-lose. At our hotel in Ft. Lauderdale, a convention of either transvestites, transgender individuals, or some combination of the two dominated the hotel. The organization was “Himmaher”…I think I’m spelling it right. [Correction: I wasn’t. And that wasn’t the organization; it was the name that was listed for the gathering, and the name was HIMMERSHE. Thanks to Zanshin in the Comments below for the correction.]

I had several illuminating encounters. I don’t know that this is true of all such people, but the members of this association or club all seemed to want to make any non-club member they saw as uncomfortable as possible. Yes, that’s unethical. How you choose to dress, what you choose to have lopped off, and who you want to sleep with could not interest me less, and that is the  attitude a society like ours should strive to encourage. (None of those things should engender and advantages, either.) But what these people seemed to be seeking was imposed ethics zugswang. If you looked directly at them, the response was a chip-on-the-shoulder, “Go ahead and stare, honey: neverf seen a freak before?” If you appeared to be avoiding staring—I regard a six-foot ex-male standing in the middle of a hotel lobby in a  wig, skimpy bathing suit, 6 inch heels and speaking loudly in a base voice as parading a psychological problem or ten, and deserving the same social courtesy I would offer to a Tourette’s victim or a hebephrenic—then the individual decided to make it a project to get you to stare, as if your failure to provide the attention they craved was an insult.

From The Ethics Alarms “Democrats Must Be So Proud” Files: An Obvious Observation On Today’s Kavanaugh Hearing

It is disgraceful,  embarrassing, and dangerous, and only two or three steps away from Charles Sumner being physically attacked by Preston Brooks on the Senate floor.

It emerged during the proceedings that Senate Democrats planned to disrupt the orderly process of the hearings as a strategy. Nice. I guess that’s their replacement for the filibuster. I think I prefer the device used by Lilly Tomlin’s character in the Netflix series “Grace and Frankie”: when she can’t rebut an argument, she starts singing “She’ll Be Comin’ ‘Round the Mountain” as loud as she can, so nobody else can talk.

“The hearing began with protesters breaking in, and continued with serial efforts by Democratic Senators to postpone the hearing. To the credit of committed chair Chuck Grassley, he bulled on through. As he did so, the Democratic side degenerated into a contest regarding which putative candidate for the Democratic 2020 nomination could pander to the base more. Here is how the day began:

GRASSLEY: “Good morning. I welcome everyone to this confirmation hearing on the nomination of —“
HARRIS: “Mr. Chairman.”
GRASSLEY: “— Brett Kavanaugh –”
HARRIS: “Mr. Chairman.”
GRASSLEY: “— to serve as associate justice of the Supreme Court of the United States.”
HARRIS: “Mr. Chairman, I’d like to be recognized for a question before we proceed. Mr. Chairman, I’d like to be recognized to ask a question before we proceed. The committee received just last night less than 15 hours ago —“
HARRIS: “Mr. Chairman, regular order.”
HARRIS: “— 42.000 pages of documents that we have not had an opportunity to review or read or analyze.”
GRASSLEY: “You are out of order. I will proceed.”
HARRIS: “We cannot possibly move forward, Mr. Chairman. We have not been given the opportunity to have a meaningful hearing with Congress nominee–“[cross-talk]
GRASSLEY: “I extend a very warm welcome to Judge Kavanaugh, to his wife Ashley, their two daughters –[cross-talk]
UNKNOWN: “Mr. Chairman, I agree with my colleague, senator Harris. Mr. Chairman, we received 42.000 documents tat we haven’t been able to review —”
GRASSLEY: “— And everyone else joining us today.”
UNKNOWN: ” and we believe this hearing should be postponed —”
GRASSLEY: “I know this is an exciting day for all of you here and your you’re rightly proud —”
UNKNOWN: “Mr. Chairman, if we cannot be recognized I move to adjourn. Mr. Chairman, I move to adjourn.”
GRASSLEY: “— From Judge Kavanaugh —”
UNKNOWN: “Mr. Chairman, I move to adjourn. Mr. Chairman, we have been denied real access to the documents we need to advise —” (Audience cheering)
BLUMENTHAL: “Mr. Chairman, we have been denied the real access to the documents we need —[cross-talk] which turns this hearing into a charade and a mockery of our norms and, Mr. Chairman, I therefore move to adjourn this hearing.”
AUDIENCE: “This is a mockery. This is a travesty of justice. Cancel Brett Kavanaugh, adjourn the hearing. [ indecipherable].”
BLUMENTHAL: “Mr. Chairman, I ask for a roll call vote on my motion to adjourn.”
AUDIENCE MEMBER: “‘[indecipherable]'”
GRASSLEY: “Okay.”
BLUMENTHAL: “Mr. Chairman, I move to adjourn. I ask for a roll call vote.”
GRASSLEY: “We are not in executive session. We will continue as planned.”

A recurring theme was the disingenuous complaint that Democrats, who have received over 400,ooo pages of materials relating to Trump’s nomination to fill Justice Kennedy’s seat on the Court, as well as all of his judicial opinions which are what really matter, did not have time to read the most recently released batch of about 40, 000 pages. Everyone knows that what is in those documents doesn’t matter one bit, because the entire group of Democratic Senators have already made it clear that they are going to vote against Kavanaugh as a bloc. They are going to do it to express their outrage over Merrick Garland; they are going to do it to pander to the resistance narrative that Trump is an “illegitimate” President, they are going to do it because the party increasingly seeks to demonize conservatives, they are going to do it because they are afraid of their base. Oh, there are lots of reasons. All of the Democratic Senators, maybe most,  don’t seriously believe their party’s own scare-mongering that Kavanaugh will lead the Supreme Court to reverse Roe v. Wade, but there is the rapidly pro-abortion—not just pro-abortion rights but pro-abortion—feminist segment of the base to pander to as well.

Essentially, we are watching an entire political party embrace mob-style interference as an alternative to process, because they don’t like what the likely results of the established process will be. Of course this is dangerous to the nation and the Constitution. It is also a tantrum, just like the party’s reaction to President Trump’s election itself.

It was predictable that if the funeral of a Senator was exploited  as an opportunity to attack the President, the hearings on his Supreme Court nominee would certainly be. (I am not finished looking, but so far I can find no comparable direct attacks on Barack Obama during the hearings on his two nominees.) Here, for example, is the reliable demagogue Dick Durbin (D-Ill), doing his best Keith Olbermann imitation:

“You are the nominee of President Donald John Trump. This is a president who’s shown us consistently he’s contemptuous of the rule of law. He’s said and done things as president which we’ve never seen before in history. He dismissed the head of the FBI when he wouldn’t bend to his will. He harasses his attorney general on almost a daily basis in the exercise of his office, and I didn’t vote for Jeff Sessions, but I have to tell you there should be some respect at least for the office he serves in. And it’s that president who’s decided you are his man. You’re the person he wants on the Supreme Court. You are his personal choice. So are people nervous about this? Are they concerned about it? Of course they are.”

As in the hypocritical remarks by the McCain mourners. Durbin is hilariously self-indicting. Durbin’s party has been  contemptuous of the rule of law in areas where the President has been committed to enforce it, as with illegal immigration. Durbin and his party have undertaken direct assaults on the First, Second, and Fourth Amendments. The way Democrats are conducting themselves in this very hearing has never been seen before in history. Continue reading →

Fake News Watch: “Truth Isn’t Truth”

Okay, if “enemy of the people” is too strong, how about “incompetent and malicious professionals abusing the public trust by misleading and misinforming citizens for the purpose of destabilizing the government and undermining democracy”? How’s that? Better? But doesn’t such conduct make someone an enemy of the people? And it’s so much shorter!

I didn’t see the interview, but still knew immediately that Rudy Giuliani didn’t literally say and mean “Truth isn’t truth” as the news media was widely reporting yesterday. Rudy may have lost his edge, but he’s no idiot, and he is not going to fall into an “alternate facts” gaffe like Kellyanne Conway. If you didn’t know that with relative certainty, if you didn’t assume that the biased news media was intentionally trying to make Giuliani, and hence the Trump Administration, and thus Trump himself, inherently dishonest and ridiculous,  then you are gullible, dangerously ignorant of the complexity of language and the critical role of context, or stubbornly unwilling to accept what is res ipsa loquitur now, which is that journalism has become overwhelmingly partisan and cannot be trusted.

If one witnessed the interview with NBC’s Chuck Todd that produced the fake “gotcha!” and didn’t find that false representation outrageous, then one is simply a hopeless, principal-free “resistance” fanatic.

Morning Ethics Warm-Up, 7/31/18: The Self-Deception Edition

1. Ethics translation time! Baseball’s current World Champion Houston  Astros just traded for young, exciting closer Roberto Osuna from the Toronto Blue Jays. This raised some eyebrows, because the 23-year-old Osuna is just completing a 75-game suspension from MLB for allegedly beating his wife. The Blue Jays had decided that they wanted no part of Osuna, and that he would not be a member of their team going forward, despite the fact that he is regarded as one of the best late-inning relievers in the game.

Anticipating some criticism from Houston fans and baseball fans in general, who usually don’t like cheering for disgusting people,Astros GM Jeff Luhnow released a statement  following the trade, saying,

 “We are excited to welcome Roberto Osuna to our team. The due diligence by our front office was unprecedented. We are confident that Osuna is remorseful, has willfully complied with all consequences related to his past behavior, has proactively engaged in counseling, and will fully comply with our zero tolerance policy related to abuse of any kind. Roberto has some great examples of character in our existing clubhouse that we believe will help him as he and his family establish a fresh start and as he continues with the Houston Astros. We look forward to Osuna’s contributions as we head into the back half of the season.”

Translation:

“Our team has had bullpen problems all season, and as of now we have no closer, even as the team has lost three games in a row [now it’s four], two of our best players are injured, and we’re beginning a series against the Mariners, who are just a few games behind us. So in the interest of winning and because the ends justify the means, we are suspending our “zero-tolerance” policy regarding “abuse of any kind” to tolerate a player who Major League Baseball has determined to be a very serious abuser. I don’t know how we’re going to tell another player who is credibly accused of less serious abuse that we won’t tolerate his presence on the team when we just voluntarily brought an abuser onto the team, but never mind: there’s a pennant to win. I’m pretending that Roberto has complied with all consequences related to his past behavior when he is currently pleading not guilty in his pending Canadian trial on battery charges, in the hope that most fans aren’t paying attention.”

Ethics Dunce: MSNBC’s Rachel Maddow

Now substitute “smug, arrogant, incorrigibly biased, anti-Trump MSNBC anchor” for “beauty queens,” and the line is a perfect response to the awaited “correction and apology” from Rachel Maddow for getting the story of the mistranscribed White House transcript of the Helsinki press conference.

I explained the mistake here, and made it myself here, yesterday morning.  The White House did not, as Maddow and others reported, intentionally misrepresent the exchange. The Washington Post clarified what happened. Nonetheless, Maddow and MSNBC dragged their feet in correcting the story, not doing so until 2:45 PM (I updated Ethics Alarms at about 1 pm, the second I read the Post story, and I’m not a full-time news network) and afterwards, here is Maddow’s pathetic attempt to keep spinning…

Sunday Morning Ethics Hangover, 7/15/2018: “Animal House” And The Death Of Truth [UPDATED!]

1. Not being biased helps you be non-stupid…Yesterday, chatting with lawyer attendees at my ethics seminar, a former government attorney told me that he had several ex-FBI colleagues who were horrified at many aspects of the Peter Strzok hearings, as was he. Among their concerns:

  • The news media was failing its duty to explain to the public the duties of professionals, and why Strzok’s conduct was unacceptable, unethical, and undermined the credibility of the investigations he was involved in.
  • Democrats were defending the indefensible, and also breaching their duty to the public. They ought to be exactly as outraged as Republicans at a figure as demonstrably biased as Strzok polluting important law enforcement inquiries, and also should have rebuked him for his defiant attitude.
  • The Strzok scandal was immensely damaging to the public image of the FBI, and should be. It demonstrates an agency that has been seriously mismanages, and that has a damaged culture.
  • The simple fact that Strzok would use FBI equipment to send his texts demonstrated outrageous incompetence and lack of judgement. Even setting aside the bias issue, for a key figure in an investigation to behave so recklessly proves that the current FBI is untrustworthy.

Naturally this is gratifying, since the positions are all consistent with those I have expressed here, and also because they are correct.

2.  When miscreants emulate “Animal House” and Democrats applaud...We also discussed Strzok’s ridiculous “Otter defense”in the hearing, as he emulated the cynical (but in that case, funny) argument offered by the “Animal House” character played by Tim Mathieson (“Take it easy! I’m pre-law!” “I thought you were pre-med!” “What’s the difference?”) in a student council hearing over his fraternity members’ outrageous conduct, especially his own:

” Ladies and gentlemen, I’ll be brief. The issue here is not whether we broke a few rules, or took a few liberties with our female party guests – we did. But you can’t hold a whole fraternity responsible for the behavior of a few, sick twisted individuals. For if you do, then shouldn’t we blame the whole fraternity system? And if the whole fraternity system is guilty, then isn’t this an indictment of our educational institutions in general? I put it to you, Greg – isn’t this an indictment of our entire American society? Well, you can do whatever you want to us, but we’re not going to sit here and listen to you badmouth the United States of America!”

This, of course, is exactly the disingenuous tactic employed by Strzok when he pronounced himself grievously offended that his accusers would dare to impugn the integrity of the FBI, knowing well that the harm done to his agency was entirely due to his own actions. Continue reading →

Unethical Website Of The Month: HealthNews NJ.com

One of the most patently dishonest campaign tactics is for a candidate to put up a fake website purporting to report “news” that is really there to attack his or her political opponent. Who would do such a thing? Well, one good bet would be a U.S. Senator who already narrowly escaped conviction on bribery charges because his providing political favors to a “friend” who showered him with gifts could be proven to result from a quid pro quo arrangement.

Sure enough, the new website HealthNewsNJ.com, with the exception of a tiny-print disclosure at the bottom of its home page does all it can to convince readers that it is an independent news site.  In reality, it is a campaign-run hit site put up by the campaign of Sen. Bob Menendez (D-N.J.) to attack his opponent, Bob Hugin, the former CEO of the pharmaceutical company Celgene. A typical post on the website, which runs below a byline crediting it to “HealthNewsNJ Staff,” is titled: “How greedy drug company CEO Bob Hugin gouged cancer patients and enabled Donald Trump.” On Facebook, the site’s page calls itself  a “news and media website.”  Neither it nor the HealthNewsNJ  Twitter account mentions a tie to Menendez or his campaign.

Putting up a fake website like this is signature significance. Menendez is willing to deceive the public. He’s a liar, by definition. He cannot be trusted.

Luckily for him, he’s running in New Jersey, so it probably won’t matter.

From The Conservative Media: More Fake Stupid News

Boy I’m tired of falling for this kind of click-bait on the conservative news websites.

“Hillary Clinton Says Supreme Court Nominee Brett Kavanaugh Will Bring Back Slavery” shouted the headline on a story at PJ Media by Tyler O’Neill.  Uh, no, that’s not really what she said. This is; Clinton told the American Federation of Teachers (AFT) at its national convention:

“Let me say a word about the nomination of Judge Kavanaugh to the Supreme Court,”  “This nomination holds out the threat of devastating consequences for workers rights, civil rights, LGBT rights, women’s rights — including those to make our own health decisions. It is a blatant attempt by this administration to shift the balance of the Court for decades and to reverse decades of progress,” the former Democratic presidential nominee declared. I used to worry that they [the Republicans] wanted to turn the clock back to the 1950s. Now I worry they want to turn it back to the 1850s.”

Says O’Neill, maybe with a straight face: “Clinton was clearly suggesting that Trump and Kavanaugh want to return to the days when slavery was legal in the South.”
