Morning Ethics Warm-Up, 1/31/2020: A Man’s Home Is His Box, And More…

Hello, Ethics Alarms, Good-bye January…

Between the nauseating impeachment charade and baseball’s cheating scandal (and the largely ethically ignorant commentary regarding it),  the bias of the mainsteam media reaching critical mass in episodes like this and the Don Lemon panel’s mean girls mockery of those dumber than dumb Trump supporters, mounting evidence that Democrats are going nuts based on the rise of a superannuated Communism fan in the race for the party’s Presidential nomination, and, of course, my wife doing a face-plant into some asphalt,  it was a not a happy 31 days at The House of Ethics.

Amazingly, it has been a very good month for the President, becoming the first POTUS to unequivocally endorse the anti-abortion movement by appearing at the March for Life, cutting a partial deal with China, ridding the world of Qasem Soleimani (and in doing so, prompting  his domestic foes, including the news media, to publicly sympathize with a terrorist and a nation that habitually calls for America’s destruction), releasing a Mid-East peace plan that is garnering support everywhere but from Iran, the Palestinians, and, of course, the U.S. media, and seeing economic figures so good even the New York Times has been forced to acknowledge them, all while being called every  name in the book and an existential threat to democracy on C-Span by the Democratic House impeachment managers.

1. “Dolemite Is My Name” We finally watched “Dolemite Is My Name,” (on Netflix), Eddie Murphy’s homage to comic Rudy Ray Moore and  his 70s Blaxploitation film “Dolemite.” So much for my proud claims of cultural literacy: I never heard of  Moore or his film, which is apparently a genre classic. Moore is regarded as the Father of Rap; how did I miss this for so long? Murphy’s movie tells the mostly true story about how a group of complete novices, led by Moore, made an exuberantly idiotic movie (faithful to Moore’s formula for success with black audiences: “Titties, funny, and Kung-Fu”) for $100,000 that grossed 10 million.

The movie is fun as a black version of “Ed Wood” (same screenwriters, I discovered later) and won some awards. For it to be make any 2019 Ten Best lists, however, is blatant race pandering by critics. Continue reading

The Democratic Party’s Unethical And Irrational Obsession With Diversity, Part Two: Amazingly, It’s Even Worse Than I Thought

On December 14, 2019, I posted “The Democratic Party’s Unethical And Irrational Obsession With Diversity” at a point where I concluded that the Left’s diversity con had reached res ipsa loquitur dimensions, at least for Americans still capable of hearing what this res was loquituring despite years of pummeling by consultants and diversity seminars. That would be that “diversity” is a cover word for “quotas and affirmative action.”

I’ve been in some of those seminars; to my undying shame, I’ve even taught a couple for a fee. They are intellectually dishonest to the core, resting on the Bizarro World  argument that more diverse groups and bodies are necessarily better, wiser, and more effective than  homogeneous groups with more ability and talent. This is manifestly nonsense, except that it is not politically correct to say so. Is President Trump’s Cabinet better in any way because Ben Carson is Secretary of HUD? He’s a dolt, as anyone who watched the GOP Presidential debates knows beyond a shadow of a doubt. Is the Supreme Court better because Justice Sotomayor is on it? Read one of her opinions and then try to say that with a straight face.

The proof that diversity activism is a rationalization-based scam is everywhere, with the fact that it is only applied in one direction the smoking res. Nobody argues that NBA and NFL teams would be better of they had demographics closer to the nation’s. The Oscars were attacked because there aren’t “enough” black performers or female directors nominated this year, but no one complains about the lack of diversity in all-black awards shows. The impetus for December post was all the Democratic and mainstream media flesh-rending over the fact that the erstwhile Presidential candidates “of color” had been so weak and feckless that even Democrats had rejected them. “But…but..diversity!

Pointing to the Washington Post’s assessment of the top 13 people with the best chance of being on the party’s ticket as Vice President—all are women, minorities or both—I wrote, “What subliminal message are Democrats sending to the world when they exclude straight, white men as qualified candidates for Vice-President? That’s easy. They are saying that the party cares more about diversity than it does about leading the nation.”

Diversity without rigging the result can be a valuable measure of how race, ethnicity and gender-blind the culture has become, but the fact that any group or body happens to appear diverse is itself no indication of excellence. Anyone who claims otherwise is lying or deluded.

Morning Ethics Warm-Up, 1/14/2020: And The Ethics Beat Goes On…

Good morning.

That’s a perfunctory good morning, to be transparent. Mourning would be more accurate. Yesterday’s news that Red Sox manager Alex Cora, a man who had impressed me with his leadership ability, personality and, yes, ethical values, was exposed by an investigation as the primary instigator of cheating schemes that involved two baseball teams and World Series champions (the Astros and the Red Sox), disillusioned two fan bases, harmed his sport, and led, so far, to the fall of two of the games most successful and admired management figures. Cora is also the first minority manager the Red Sox have had, and was regarded as a transformational figure for the team and the city, both of which have long and troubled histories of prejudice and discrimination. Smart, articulate, creative, funny, brave, knowledgeable—all of his positive qualities, rendered useless by the lack of functioning ethics alarms.

1. Congratulations to Ann Althouse…on this, the 16th anniversary of her blog. With the demise of Popehat, she supplanted Ken White as my most admired blogger, and most quoted by far. The fact that her fiercely non-partisan analysis of ethics issues so frequently tracks with my own is a constant source of comfort for me , particularly during these difficult times. Ann has an advantage that I don’t—“I only write about what interests me” is her description of her field of commentary— because this blog is limited to ethics and leadership. Fortunately, Ann is interested in ethics, though she seldom says so explicitly.

2. Bernie vs Liz. Feeling that Bernie Sanders was pulling away as the standard-bearer of the Leftest of the Democratic base as her own support appears to be waning, Elizabeth Warren went low, and had her aides reveal the content of what was supposed to be two-hour a private summit between the fake Native American and the Communist sympathizer in December 2018. According to them, Bernie told Warren that he disagreed with her assertion that a woman could win the 2020 election. Bernie denies it. Observations:

  • This kind of thing stinks, though it is kind of fun to see Democrats dirtied by it instead of President Trump. Anonymous accounts of what was said in phone conversations and private meetings in which the participants reasonably believed they could speak freely are unreliable, untrustworthy and unethical.
  • The Warren camp’s spin on Bernie’s alleged statement is that it shows he’s a sexist. That makes no sense. If I say that I can’t win the election in 2020, does that mean I’m biased against myself? There is no logical reason to assume an opinion like “A woman can’t win is 2020” represents bias, though it could. I will state here and now that a gay man can’t be elected President in 2020, even if that man weren’t a pandering asshole like Pete Buttigieg, but I am not anti-LGBTQ is any way. The statement reflects my objective analysis of the state of the culture.
  • I suspect that Sanders meant, “YOU can’t win in 2020, nor can Kamala Harris nor any of the other equally weak announced female candidates.” The truth may hurts, but that doesn’t make it biased
  • (Psst! Bernie! A delusional septuagenarian socialist who honeymooned in the Soviet Union can’t win either!)

3. No, the fact that there are no more African-Americans running for President doesn’t mean an African-American can’t win. It means weak African-American candidates like Cory Booker, who just dropped out, and Kamala Harris, who is long gone, can’t win, not because of their race, but because they can’t convince voters that they could do the job. Your Ethics Reading Assignment: “The Cost Of America’s Cultural Revolution”

I swear, when I wrote the recent post about the lawsuit against the use of the standard college admissions tests, I had not read nor was even aware of Heather MacDonald’s superb essay on the topic of the manipulation of higher education in pursuit of ideological domination. (Thanks and gratitude to Instapundit for the timely link.)

Here is a taste:

The social-justice diversity bureaucracy has constructed a perpetual-motion machine that guarantees it eternal life. Minority students who have been catapulted by racial preferences into schools for which they are not academically prepared frequently struggle in their classes. The cause of those struggles, according to the social-justice diversity bureaucracy, is not academic mismatch; it is the lack of a critical mass of other minority students and faculty to provide refuge from the school’s overwhelming bigotry. And so, the school admits more minority students to create such a critical mass. Rather than raising minority performance, however, this new influx of diverse students lowers it, since the school has had to dig deeper into the applicant pool. The academic struggles and alienation of minority students will increase, along with the demand for more diversity bureaucrats, more segregated safe spaces, more victimology courses, more mental health workers, more diverse faculty, more lowered standards, and of course, more diversity student admits. And the cycle will start all over again.

The ultimate social-justice solution to the skills and behavior gap is to remove the competition entirely. From the moment children enter school, they are berated for their white heteronormative patriarchal privilege if they fall outside a favored victim group. Any success that they enjoy is not due to their own efforts, they are told; it is due, rather, to the unfair advantages of a system deliberately designed to handicap minorities. Teachers are now advised to ignore white male students, since asking or answering questions in class is another mark of male supremacy.

Eureka! Here’s One Way To Guarantee Diversity In College Admissions: Eliminate Objective Standards

Oh, it can’t be you! It’s always the test.

A group of students, advocacy groups and a primarily black and Hispanic California school district filed suit against the University of California last week,  alleging that  the SAT and ACT college admission tests discriminate  against black and Hispanic students and demanding that the school stop using standardized test scores in its admissions process.

The theory that the tests are biased against poor and mainly black and Hispanic students concludes that the system illegally discriminates against applicants on the basis of their race, wealth or disabilities, thus denying them equal protection under the California Constitution. This battle has been fought before, of course. There was a time, decades ago, when foes of standardized testing could point to test questions referring to yachting and Western philosophers, baking in a bias that handicapped students fromracial and ethnic  sub-cultures in America. Those prejudicial questions have been purged, but the long-time disparity between the test scores of white and Asian applicants on one side and black and Hispanic students on the other continues. The Democratic Party’s Unethical And Irrational Obsession With Diversity

There is mass outrage in the Democratic Party, we are told,  over the fact that Cory Booker and Deval Patrick won’t be on the debate stage in December’s candidate’s debate, and neither will former housing secretary Julián Castro, or Representative Tulsi Gabbard of Hawaii. True, Andrew Yang has qualified, but Asians don’t count as minorities to progressives, because they are so successful and don’t commit many crimes, heaven knows why.  That’s why Harvard can discriminate against them and get away with it. But I digress…

There’s just one reason Yang will be the only non-white candidate on the stage: the other minority candidates couldn’t justify their candidacy, even among the frightening weak competition of Joe Biden, Bernie Sanders, Elizabeth Warren, Tom Steyer, Pete Buttigieg, and Amy Klobuchar. Naturally, Democrats being Democrats and primed to blame any result they don’t like on racism, sexism or bias, this obvious example of democracy working the way it’s supposed to is being condemned.  Well, I should clarify that: It’s working the way I think it’s supposed to, the way the Founders thought it was supposed to, and pretty much the way everyone thought it was supposed to until progressives came up with the moonbat idea that results were only fair if they distributed benefits in strict accordance with demographic percentages, and were even better if they gave an edge to “historically disadvantaged minorities.”

Thus, even though the process of deciding the winners in the slow motion musical chairs of the Democratic nomination game seems to rely on who the voters think is best qualified, that process is, according to moonbattism, bad, as in racist and unfair, if the process doesn’t yield sufficient numbers of contenders with the  right skin shades. The party really thinks like this, or at least significant numbers of the party to render the entire party untrustworthy.

I don’t understand how anyone can responsibly put a party in power that has adopted such an obviously destructive and non-democratic position.

“What message is that sending that we heralded the most diverse field in our history and now we’re seeing people like her dropping out of this campaign?” Senator Booker asked a crowd in Iowa. He darkly suggested that Kamala Harris left the race “not because Iowa voters had the voice. Voters did not determine her destiny,” but because bigotry was afoot.

The message being sent , Senator, was that lousy candidates like Kamala Harris (and you), who bungled every debate and who appear to have no leadership qualities at all, don’t appeal to voters seriously looking for a President rather than a symbol, like Bracak Obama. It is deeply self-serving for Booker to attribute Harris’s failure to racism, since he appeals to even fewer voters than she did, and is also, like her, wearing skin in the darker range.

The New York Times gasps, “The Democratic primary is facing a reckoning. In two weeks, Democrats will gather in Los Angeles for a debate that is likely to feature an entirely white roster. That is not, several candidates and prominent party members say, how the party that emphasizes diversity and fairness should want to represent itself.”

How about the fact that none of the candidates on that stage appear to be competent, trustworthy or responsible? Shouldn’t that be more of a concern than the skin-tones of the various socialists and panderers debating each other?

Not in Democrat Quota Land, I guess. Here’s a howler from the Times that only a thoroughly brain-washed progressive zombie could read without laughing:

“Some blame the rules for qualifying for the debates. The polling requirements give an advantage to candidates who can invest in extensive television advertising to get their name out. Others note, however, that the candidates of color in the 2020 field have not drawn significant support from black and Latino voters.”

Observations On The Charleston, W.V., “Christmas War” (And The Way The Mainstream Media Reported It)

There are many lessons, ethical and otherwise, to be learned from Charleston, West Virginia’s short-lived “Winter Parade.” I originally missed the story, which apparently took place over three days in October. Fox News, which has led the “War on Christmas” narratives since the days of Bill O’Reilly, covered it.

Even before Halloween, Charleston’s  new mayor (and its first female occupant of the office) Amy Goodwin sent out a Facebook announcement that “The Charleston Winter Parade will begin at the corner of the Kanawha Boulevard and Capitol Street.” For years, the city has had an old-fashioned “Christmas Parade” (you know, like they show in “A Christmas Story” ?) with Christmas-themed floats, marching bands, fire trucks, Shriners in their tiny cars and Santa Claus. Suddenly it was officially a Druid-sounding “Winter Parade” because Mayor Goodwin wanted to signal that her city embraced all faiths and cultures. “I wanted to show that Charleston is a welcoming and inclusive city,” she said.

A large number of Charleston residents didn’t welcome her unilateral decision at all. “The new mayor needs to be voted out if she does away with the Christmas parade,” read an early comment on ther Facebook post. “Christmas is all about Christ, not some winter parade.” Columnists and radio shows weighed in, almost unanimously condemning her decision. The largely white and  Christian city of 48,000 hadn’t exactly been racked with controversy over the Christmas parade, but now renaming the parade felt to many like a rejection of Christianity and tradition.

The New York Times quoted the president of the West Virginia Chamber of Commerce in Charleston, Steve Roberts: “The community reaction was a collective groan, It’s a cute little parade with cute little kids and can’t we just have a Christmas parade?”

The change threatened to start a chain reaction. The Times story says that Brandon Willard, a junior high band teacher, began to worry about his musical selection for his student band scheduled to march in the parade: Leroy Anderson’s “Sleigh Ride.”It’s a secular Christmas tune of long-standing (they always played it at my High School Christmas assembly), but Willard became worried that he would be accused of having the band take side. Maybe parents would pull their children from the parade in protest, maybe even preventing the band from having enough musicians to march. It would be a big disappointment to the students, who march every year in Santa hats and with decorated instruments, and this year, with new  light-up necklaces he had ordered. In California, A Black Lives Matter Ethics Mess

Here’s the story, and then we’ll look at the ethics miscreants who made an ethics  mess of it….

At Del Paso Manor Elementary, near Sacramento, a parent volunteer in a sixth grade class asked the teacher if she could teach an art lesson about diversity. The male teacher told her in front of the class that “his lessons would contain lessons with ‘a bunch of old white guys’ so her content may not fit.” The volunteer  was confused and “a bit concerned” by the statement, but went ahead with the project she had envisioned. She asked the students to each make  a poster that focused on something “they wanted to see changed at the school.”  Four students created Black Lives Matter posters.

The next day, the teacher told the parent volunteer that he had thrown the four posters away because they were “inappropriate and political.” The teacher asked the volunteer “whether students were getting shot at the school and demanded answers regarding why a presentation on Black Lives Matter was relevant” to the school.

The volunteer complained to the principal, who backed up the teacher and his decision, agreeing that Black Lives Matter posters are political statements and off limits for public display in the school. Then someone, perhaps the volunteer but maybe a parent, took the matter to the ACLU. The group then contacted the  school district, and argued that  Black Lives Matter posters were protected speech under the California Education Code because they “convey a student’s thoughts, ideas and beliefs in the support of black lives,” and were also protected under the California Constitution.

Here’s A “War On Christmas” Angle I Was Not Aware Of….The War On Hannukah

In Portsmith, New Hampshire,  the UNH & Seacoast Chabad Jewish Center requested that a 9-foot  menorah be placed in Portsmouth’s Market Square during the eight days of Hanukkah this December (22nd-30th). Blogger Jeff Dunitz, whose platform is the excellent blog, The Lid, darkly predicts that Portsmith will soon be headed to “Fesivus” like neighboring Durham, which has banned the tree-lighting ceremony (yes, it’s a “holiday tree”) as well as the wreaths thatthe town had previously displayed on town light poles.  The town council appareently feared that they were too much of a Christmas reference. Town manager Todd Selig said the town might agree to hang something from the poles, “non-descript star,” to “add light and festivus” to the season.

Ethics Warm-Up, 11/15/2019: Idiots, “Friends,” Rationalizations And Doing Things The Hard Way

1. The media, doing its best to make the public stupid. Yesterday the collected dolts  of “The View” managed to mangle the concept of hearsay, following a Democrat rep’s absurd contention that hearsay evidence cold be “better” than  direct testimony.  The panel show also misrepresented how the Clinton impeachment proceeded.

Sunny Hostin, the alleged conservative on the panel,  said that  President Clinton’s impeachment  was the result of Linda Tripp’s  testimony, saying , “Clinton was impeached because of Linda Tripp’s testimony, which was complete hearsay!”

How wrong can a statement be? Clinton was impeached because he lied under oath in a hearing involving the civil law suit against him by Paula Jones (as well as for lying to a grand jury and obstruction of justice.) Tripp had made an illegal tape recording of Lewinsky, which was not hearsay. Tripp’s tape was used to get Lewinsky to admit the affair, which was clearly not hearsay. Then there was that stained dress. Had not direct testimony and physical evidence backed up Tripp’s account, Clinton almost certainly   not have been impeached

2. This is why we can’t have nice things. It was inevitable, with all the recent resurgence in interest in the 90s sitcom “Friends,” that the long-running and still-popular show would finally be subjected to one of those depressing reunion specials. This was especially likely because the aging cast isn’t much in demand these days, and mots of them could use a boost.

But Beware, “Friends,” the woke posse is watching. The show about six white hetero singles living in New York was not diverse, and has been criticized in the 15 years since it ended for being implicitly racist, sexist, and anti-LGBTQ. Thus the Righteous have decreed, “Friends’ reunion is all we have wanted for years, but HBO Max version better have more racial diversity and LGBTQ representation.”

Thus we get this,

[T]he iconic NBC show is not without its problems, and yet it entertained us in real-time for ten years and for years after that, making us laugh on the days we are feeling low and making us believe that they will be there for us. It is only natural that we want to relive those feelings again, but even those of us who grew up on ‘Friends’ have outgrown those insensitive jabs about Chandler’s (Mathew Perry) drag queen father, unwarranted fat-shaming of Monica (Courtney Cox), repeated complicity of Joey’s (Matt LeBlanc) sexism and so on.

When the show does return in – hopefully – 2020 for an HBO Max audience, we should hope that it is rich in diversity without it being about tokenism. It is unfathomable that this group of friends who live in New York, the melting pot of America, hasn’t made friends with more diverse backgrounds. Even more so, it is difficult to believe that they haven’t even interacted with people of different sexualities, sexual identities, and races for them to know better than to make jokes about them. It may have flown in the 90s and 2000s, but it definitely isn’t going to in the current day and age.

No, we should hope that it is funny, but if awkward virtue signalling and making sure that all the EEOC boxes are checked while making up for ten years of insensitively showing a group of friends who hung out primarily with people like themselves (like most of us), are going to be the priorities, and you know they will be, it would be kinder and more responsible to leave Ross, Chandler, Joey, Phoebe, Rachel and Monica where they belong—in the past, on re-runs.

Incidentally, one of the two funniest jokes I ever heard on “Friends” involved “fat-shaming.” The groups was watching an old home movie taken when Monica was a grossly over-weight teen. The now svelte woman, embarrassed, said, “They say that the camera makes you look 15 pounds heavier,” to which Chandler replied, “Just how many cameras were on you?”

3. Upon reflection, I don’t think I need to add this new rationalization. The Rationalization List is stuck at 99, and I have been wondering what #100 would be. When I was writing about the now-fired Canadian hockey pundit Don Cherry bringing himself down with his big mouth, I was annoyed by how many of his defenders argued that Don was just being Don, and since he was always Don, and “didn’t mean anything” by being Don, and was popular because he was Don, being Don shouldn’t be held against him. I suspect this bothered me so much because it appears to be the only thing keeping Joe Biden from being ripped to pieces by #MeToo Furies, as he richly deserves to be. So briefly I considered the need for a “It’s just who he is” rationalization.

Upon reflection, I demurred. This is cutting the rationalizations too thin. We already have Rationalization 41 A. Popeye’s Excuse, or “I am what I am”:

Sure, let’s stipulate that the jerk is exactly who and what he presents himself as being. This doesn’t excuse his conduct in any way. He is what he is, and what he is is an irresponsible, narcissistic, rude, boorish, uncivil, nasty, destructive, ignorant, impulsive untrustworthy and despicable creep. Being a real  irresponsible, narcissistic, rude, boorish, uncivil, nasty, destructive, ignorant, impulsive untrustworthy and despicable creep is no more ethical than being a phony one. In this case, transparency is not a virtue.

..and Joe Biden even has his own rationalization springing from Cherry-like excuses, Rationalization 38B, Joe Biden’s Inoculation or “I don’t deny that I do this!”

A sub-rationalization to #38. The Miscreant’s Mulligan or “Give him/her/them/me a break!,” Joe Biden’s Inoculation argues that habitual bad conduct is mitigated by one’s open admission and acknowledgment that one’s engaging in it is an ongoing problem.

I think this base is well covered. The search for #100 goes on…

4. Why didn’t she just take the bar exam one more time?  I don’t understand this story at all.

Roberta Guedes graduated from Stetson University College of Law in 2014, but she  failed to pass the Florida Bar exam twice. The traditional remedy for this is boning up and taking the exam again, and again if necessary, but noooooo. 

Instead, federal prosecutors say, she used the name of a classmate  to register two new law firms with the state Division of Corporations. Agnieszka Piasecka attended law school with Roberta, and the friends  talked about starting a law firm together, When Guedes flunked the bar exam, Piasecka who did not flunk,   opened her own firm in Clearwater,  specializing in wills and trusts, immigration, and divorce cases.

The plot began when Guedes offered Piasecka the free use of her  office in downtown Tampa to meet with clients a few times.

In September 2014, Guedes incorporated a firm she called Ferguson and McKenzie LLC, listing Piasecka as its registered agent. In November, she started a second legal services business called Immigration and Litigation Law Office, Inc., listing another woman, Arlete Chouinard, as a vice president and manager.  Neither Piasecka nor Chouinard knew about this. She created websites for both companies, including claims of  national and international offices that didn’t exist, and faked partners and associates using stock photos. She also represented clients, accepting fees while never telling them that she had no license.

Now Guedes, 40, faces prison time after pleading guilty to federal charges of mail fraud and aggravated identity theft. It is fair to say that it is now too late to pass the bar exam.
