The Idiot, the Ex, and the Consequences

My position would usually be this: for an employer to use a privacy setting Facebook post as justification for firing an employee is unfair. That applies to vacation photos of an elementary school teacher holding a beer and looking bleery-eyed at a pub, a Sunday school teacher doing a strip tease at a bachelor party, and political posts of a radical, vulgar or offensive nature. Two factors can change the equation, though. Action may be justified if the posting reasonably calls into question the trustworthiness of the employee in his or her job duties, or if the posting becomes public, subjecting the employer to embarrassment or undermining the employee’s ability to do her job, as in the naked teacher cases.

Unethical Quote of the Day: Jo-Ann Youngblood

“There is nothing wrong with being an average (mediocre) employee. Not everyone aspires to be in management. If the person meets the requirements of their current job, and they like the job and want to stay in the job, so be it. Stop trying to force people to get to the next level. The reality is that work is not the most important thing in everyone’s lives. People have more important things in their life than work. Work is simply a means to get the money we need to pay the mortgage and our other bills. Work is a low-priority event for most people. I’m only willing to do the bare minimum that it takes to get a paycheck every two weeks. As long as I am meeting the requirements of my job, than that is good enough. Don’t expect any more of me because I will not be a slave to any company.”

Golz reprinted the comment today in a Times feature selecting highlights from the blog. I like Golz’s answer, which read in part:

“…As the owner of a business, I have the right to avoid hiring someone who only wants to do the bare minimum to get a paycheck. In fact, if I hire too many people with that attitude, I will be out of business. This is Capitalism 101, survival of the fittest. I operate in a very competitive market. Easy Call: Employers Asking For Facebook Passwords? It’s Unethical. So Let’s Stop It.

Ethics Alarms’ predecessor, The Ethics Scoreboard, had a feature known as “Easy Calls,” where I would render periodic ethics verdicts I thought should be obvious. Today’s talk radio and blogosphere sensation, the report that asking for a job applicant’s Facebook password is becoming a common practice of employers, is a classic easy call. And like a lot of those on the Scoreboard, an amazing number of people are getting this easy call wrong anyway.

For example, I heard lawyer-radio talk-show host Laura Ingraham today mock complaints about the practice, saying it was a legal request. Sure, it’s legal. It is still wrong, an indefensible incursion of personal privacy. “You are always free to look for a job somewhere else,” Ingraham says, as if that makes everything fine. Being free to reject an unfair and coercive job requirement doesn’t make it any less unethical. Law professor Orrin Kerr says that the Facebook demand is in the same league as demanding a job applicant’s house keys. Let’s see, what else could a prospective employer ask? Continue reading

When Business Rejects Ethics: the Sorabella Story

"So sorry about your wife's cancer, Carl. Let me know if there's anything we can do. Oh, by the way...you're fired."

I usually feel that organized labor rhetoric about cruel and heartless employers is archaic and exaggerated for political effect. This story, however, is almost enough to make me pick up a sign and start picketing.

Carl Sorabella, 43, got a merit raise in November for Haynes Management,  a real estate company in Wellesley, Mass., where he has worked as an accountant for almost 14 years. Then he learned that his wife, Kathy, had been diagnosed with advanced cancer. Told that the likelihood was that she had only months to live, Carl approached his boss. Sorabella explained that his wife’s illness would require him to have flexible hours as he supported her during her tests and treatment. He assured her that he would do whatever was necessary to keep his work up-to-date and complete his duties.

Ethics Double Dunces in Ohio: McDonald’s Owner Paul Siegfried and Rep. Jean Schmidt (R, OH.)

The great state of Ohio gave us two Ethics Dunces last week, both related to the upcoming election, both Republicans, both outrageous. Your call as to who was worse; it’s awfully close:

1. Paul Siegfried, Ohio Ethics Dunce #1: The owner of several McDonald’s in northeastern Ohio  distributed Republican campaign material to his employees and added a threatening note to their paycheck envelope “suggesting” that three G.O.P. candidates receive their support. Continue reading

Law School and High School Credential Corruption

In many high schools around the country, as many as fifty graduating seniors were designated “valedictorians,” because the traditional honor for the top academic performer is a coveted credential, and the schools wanted as many students as possible to have the benefit of it. On their future resumes, will these students footnote “valedictorian” to let potential employers know that it doesn’t mean they were #1 in their class? Of course not. Their schools have given them a license to inflate their qualifications and achievements. Until every school clones its valedictorians, the credential now is inherently deceptive, and it is the high school administrators, not the students, who are doing the deceiving.

Ah, but “you ain’t seen nothin’ yet!” The New York Times reported that at least ten law schools, S.M.U., New York University, Georgetown, and Tulane among them, have deliberately altered their grading curves—-some retroactively—in order to make their graduates artificially look better to employers. Over at The Juggle, Sue Shellenbarger examines the increasing tendency of employers to attempt to control health care costs by encouraging behavior and life-style changes on the part of employees and their families. I think this is inevitable, but it opens up a slew of ethical issues. Do we really want our employers trying to influence how we eat, exercise,and spend our free time? On the other hand, do we give up the right to complain when we expect them to pay for our health problems, even those that are self-induced?
