Fake Charities Update: The Unethical Conduct That Makes All Of Us Worse

scamsIt’s one of the world’s oldest scams, one of the most lucrative and perhaps the most damaging: people preying on the best instincts of human beings to take their money for personal gain. The internet has made it easier to do than ever, and the  con is flourishing. I don’t often write about the incidents when they arise, in part because there’s nothing to argue about: everybody agrees that it’s not just unethical conduct, but bordering on evil. Fake charities are worse than scams, however, because they actively make people less kind, generous and caring for their own protection. Every fake charity exposed makes it harder for real charities to help people who genuinely need it. Like a friend of mine who never helped a homeless person again after seeing a beggar whom he had just given 20 bucks on a New York City street briefly get out of his battered wheel chair and nimbly run over to get a cigarette from a compatriot, those who stop trusting pleas for help seldom start trusting again. The fakes make us less kind and generous, and that makes society worse for everyone.

The Federal Government Apparently Finds Ethics Suspicious, And Other Alarming Developments

And not just ethics—music teacher ethics.

Thank God we have a federal government poised and ready to come down hard on monopolist schemers like her…

Like many professions, music teachers regard it as uncollegial, unprofessional and wrong to poach another music teacher’s clients—that is, little Marvin who’s learning the violin, or little Patrice who is practicing the piano. Thus the tiny Music Teachers National Association (MTNA) included a provision in its code of ethics condemning such conduct, and declaring that no ethical music teacher sets out to actively recruit another studio’s or teacher’s students.

Regulators are hired to regulate, which means, though big government fans refuse to admit it, that we have tax-payer funded government employees who spend their time looking for ways to justify their existence. One such employee at the Federal Trade Commission must have really been desperate, because the MTNA received an official letter from the FTC announcing that because of the association’s ethical ideals, the 22,000 member group of mostly piano teachers was under investigation for fostering non-competitive practices that would lead to price-fixing. Yes, the Feds find professional courtesy suspicious. Can’t have that.

“Let the Buyer Beware”? How about “Let the Seller Be Fair” and “Let the Pitchman Beware”?

A recent perusal of some developments in the ghastly realm of false advertising suggests several conclusions:

1. Too many merchants and vendors traffic in deceit, misrepresentation, and out right lies in order to separate trusting customers from their money.

2. The law is a pretty blunt instrument when it comes to controlling this. Too many tricks and tricksters, seldom enough evidence.

3. The ancient common law rule of “Let the buyer beware!” is less a warning to gullible purchasers than it is a green light for unethical business practices.

4. For every instance of dishonest advertising that is stopped, there are probably hundreds that slip by.

5. Anti-government types looking for legitimate uses of taxpayer funds for critical government regulation of private enterprise should start here.

Vanity Size Ethics

Esquire has revealed the result of its investigation, and it is this: many manufacturers of men’s pants routinely mislabel their products’ waist measurements, representing waist sizes as less, and sometimes considerably less, than they really are. Old Navy, by far the most outrageous of the size-liars, sells pairs of trousers with a 41 inch waist band as a 36. Other companies, like Hagar and The Gap, play the same game, though not as egregiously.

The practice is intentional, apparently, and even has a name in the industry—“vanity sizing.” The theory is that pants with smaller waist measurements make men feel better about their pot-bellied bodies, and thus have a competitive advantage over truthfully labeled pants. All other things being equal, a man is more likely to buy a comfortable pair of jeans that have a 36″ label on the waist than ones with a 38″ label. Continue reading

The F.T.C. vs. the Singing Pirate’s Not-So-Free Credit Reports

What does it say about the futility of federal regulators when the Federal Trade Commission thinks the best way to combat misleading commercials for “free credit reports” is to use taxpayer funds to produce and run a parody of  those ads? That’s right: the government is running TV commercials designed to look like the commercials that try to confuse consumers into using  a costly credit service rather than the government’s free service.
