Compelled Ideological Conformity In Higher Education: Part I, The Students

This is frightening, infuriating, and, of course, unethical. Sharing responsibility, however, are the supposed devotees of intellectual freedom, freedom of thought and freedom of speech who have been asleep at the switch while dedicated anti-democratic, anti-American values revolutionaries seized control over nearly all U.S. colleges and universities. Not only has the essential resistance to this siege been weak, late and under-publicized, the public’s awareness of the phenomenon is shockingly dim.

Good job, everyone.

A recent and blatant example of restrictions on ideas and beliefs comes to us from California (naturally), where the campus chapter of Young Americans for Freedom had sued Clovis Community College after the administration ordered the removal of flyers that had previously been approved.

In November 2021, three Clovis students received permission from administrators to post anti-Communist flyers on bulletin boards inside Clovis’ academic buildings. The flyers were later removed when the school reversed its position in response to student objections. A month later, the college denied the YAF’s’s request to post anti-abortion flyers on bulletin boards in the academic buildings. Instead, the flyers were only allowed at an outdoor “free-speech kiosk” on the Clovis campus. The censored students are being represented by the Foundation for Individual Rights and Expression (FIRE), the nonprofit that has taken over the national role of non-partisan champion of free speech now that the ACLU has sided with the rising totalitarians in our institutions and government.

Details And Nuance In The Dartmouth/FIRE/College Republicans Collision

The contretemps between the campus Republican group at Dartmouth, the college, and the Foundation for Individual Rights in Education was discussed here a couple of days ago, using sources I thought sufficiently thorough. They weren’t nearly as thorough, however, as Ethics Alarms commenter Curmie, who performed a superb deep dive into the facts and competing narratives.

As you would expect with such careful research, his analysis is consequently more nuanced and fair than mine, though it reaches a conclusion regarding Dartmouth that is close enough to the Ethics Alarms version for horseshoes. I wish I had written the equivalent of Curmie’s analysis at the outset, but at least we have the fuller story now.

Add Dartmouth To The List Of Elite Colleges Deliberately Chilling Non-Woke Campus Speech

I suppose it should be soothing to know that not only Yale and Harvard are Ivy League schools dedicated to ideological indoctrination, but that Dartmouth is a player too. I’m kind of a glass-half-empty kind of guy these days though.

The Foundation for Individual Rights in Education has had to step in to battle Dartmouth over heavy-handed censorship of its College Republicans group. In January, the school unilaterally canceled the student organization’s live in-person event featuring conservative journalist Andy Ngo, forcing it online based on unspecified “concerning information” from the Hanover police. Queried by FIRE, the Hanover police denied that such concerns came from them. Now Dartmouth has informed the College Republicans that they owe $3,600 in security-related charges for the Andy Ngo event, which only took place online.

Those Zoom police are expensive.

Oh, Fine: Now I Have To Revise My Harvard Reunion Boycott Letter…

…by adding yet another reason for my absence. Harvard is practicing straight-up segregation. It really is. But it’s OK, see, because only non-black people are being discriminated against. This is the quality of reasoning at Harvard in the 21st Century.

“Macbeth in Stride” is currently being performed by the American Repertory Theater at Harvard University’s Loeb Drama Center, near Harvard Square. This adaptation of the Shakespeare tragedy includes modern music and a version of Lady Macbeth as an “ambitious black woman” to elevate “black female power, femininity, and desire.” <YAWN!> When I see Orson Welles in Hell, remind me to thank him for inflicting on the culture an endless parade of Shakespeare updates with lazy and facile political metaphors, all executed by adapters and directors less talented than he was.

But I digress. For the reason I will have to add to my report of protest is this: Harvard’s major theater on campus has decided that we white folk aren’t welcome to one performance. From the show’s webpage,

We have designated this performance to be an exclusive space for Black-identifying audience members. For our non-Black allies, we appreciate your support in making this a completely Black-identifying evening. We invite you to join us at another performance during the run.

The production is under the auspices of Harvard’s theater department, and the race-segregated performance is on campus, in a university building and held under the college’s banner. This astounding example of direct racial bias must have been approved by Harvard itself.

A New Victim At Umpqua Community College

The name of the school was so familiar, I thought I had already written on this issue. But no: the past Ethics Alarms pieces were related—dimly–to the fate of student Kaylyn Willis, but this ethics outrage in involving her is new. In 2015 there was a mass shooting at the school, prompting the usual eruption of finger-pointing and dishonest claims by the anti-gun hysterics. I wrote about the latter here and elsewhere. Obviously, the tragedy is a raw wound, but that’s no excuse for what the school has done to Willis.

In the winter 2021 term, Willis enrolled in “Chronic I,” a class taught by Patrick Harris. Harris assigned students to use “critical imagining” to create stories from the perspective of a person suffering from a chronic disease. For a May, 2021 assignment, Harris asked his students to reflect on the support systems of chronically ill individuals and how a person with a chronic illness might respond to the sudden and unexpected loss of such support. Willis imagined a scenario in which a woman suffering from ALS shoots her husband, who is also her primary caretaker. Her fiction was based on a real case where a jury found a man “not guilty” of murdering his wife and sister-in-law because he suffered from ALS-related mental health issues. She posted her assignment on-line, as she had been directed to do.

Harris, it is fair to say, flipped out. He gave Willis an F, saying, “Do you honestly think that your post on a nursing school assignment was appropriate? Joking about killing your husband? I’m really questioning your critical thinking if you think this was an appropriate discussion post.”  Harris indicated that he viewed her story as particularly offensive after the 2015 shooting on UCC’s campus. 

School officials informed Willis that she was expelled from the program because her post violated its handbook prohibiting “[a]cts which are dishonest, disrespectful, or disruptive.” The Grievance Panel’s written decision stated that Willis’ post was “insensitive” and “failed to take into consideration the events of UCC’s past and the impact her post could have.” Her appeal was denied and she is now unable to seek admission to any other Oregon Consortium Nursing Education programs.

Victim, Weenie And Enabler: The Persecution of Prof. Jason Kilborn

News: Now even “N-Word” will get you in trouble with the thought-police.

Related issue: Is it that conservatives are weenies, college administrators professors are weenies, Americans are weenies or all four?

University of Illinois law professor Jason Kilborn used a hypothetical about a employment discrimination case for his final exam. The exam referred to the use of racist and sexist rhetoric such as “n——” and “b—-“. The same question has been on the exam for ten years, but with compelled speech and the the enforced conformity with progressive cant on the ascendant, more than 400 people signed a petition condemning Kilborn, saying in part,

“The slur shocked students created a momentous distraction and caused unnecessary distress and anxiety for those taking the exam,” said the petition. “Considering the subject matter, and the call of the question, the use of the ‘n____’ and ‘b____’ was certainly unwarranted as it did not serve any educational purpose. The question was culturally insensitive and tone-deaf.”

[Clarification: Apparently some readers were confused regarding whether the actual words were used or the version with dashes instead of letters so as not to offend. I thought the opening sentence of the post would make the facts clear: the words themselves were not used. I state once again that the Ethics Alarms policy is to use words themselves if the words themselves are the issue. The coded versions were used in this post because they were what was used in the exam.]

The petition also demanded that Kilborn be removed from all faculty committees, and that the school implement “mandatory cultural sensitivity training” for faculty and staff.

If the school did not have damaged ethics alarms and a lack of respect for academic freedom and fairness, it would have responded to the petition by explaining that the signatories were censorious and ignorant, that their petition was irresponsible, unfair and wrong, and if they could not accept this, their tuition would be refunded as they sough education elsewhere. Instead, the institution announced an investigation The Foundation for Individual Rights in Education (FIRE) in turn sent a letter to the University of Illinois-Chicago demanding that it protect the rights of faculty members. Ethics Catch-Up, 7/23/2020: Waiting For Baseball Edition [Corrected]

This moment in “Field of Dreams” was how I started off my baseball and culture presentation this week. Ironically, the speech has always irritated me, because of its stagey blocking, and because it is a speech that sounds like a  speech, and is essentially right out of the book the film was based on. In the novel, “Shoeless Joe,”,the “Terrence Mann” character played by James Earl Jones was real life (and then, still living) recluse author J.D. Salinger. I dislike the speech, but the scene always moves me, for a personal reason.

As Terrance Mann stands, giving his speech, the ghostly players of the past silently assemble behind him in Ray Kinsella’s (Kevin Costner, of course) magic corn field. One of the players behind him has been identified in the film as Smokey Joe Wood, a 30 game winner with the World Champion 1912 Boston Red Sox. Just a few years before the film was made, I had been in the Fenway Park grandstands as  Smoky Joe, feeble, in his mid-nineties and in a wheel chair shortly before his death, barely threw out—more like dropped—the first pitch at a Red Sox Old Timer’s game, to a standing ovation.  And here he was, in that  corn field, but young and vital again.

Gets me every time….

1. Ethics query: is it ethical to perform “Piggies”? I just caught an old concert clip in which George Harrison and Eric Clapton performed the obnoxious pseudo-Marxist ditty “Piggies” (from the White Album) to thunderous applause.

[Notice of correction: I originally wrote that “Piggies” was a Lennon composition. All these years I assumed it was, heavy-handed and juvenile politics that it was. I am stunned that the song was George Harrison’s doing; I thought better of him.]

This was well after the Manson murders: I had never heard anyone perform the song in decades. Admittedly, it is just moral luck that a madman seized upon the White Album Beatles songs as his inspiration to mastermind the slaughters of  Sharon Tate, her unborn child, and her house guests, as well as supermarket executive Leno LaBianca and his wife Rosemary the following night. However, “Piggies” was the one song referenced directly in both murders. It is not inconceivable that if the White Album had omitted that song—no great loss, either–at least the LaBianca murders might not have taken place. I know I can’t hear the song without picturing carnage, and it seems to me singing the song is like a celebration of Manson’s work. I wouldn’t ban it; I don’t believe in banning anything.  I just think it’s bad taste to play it or perform it.

Is that inconsistent with my objection to “canceling”  “Dixie,” “My Mammy,” “Rockabye Your Baby with a Dixie Melody,” “When Johnny Comes Marching Home,” “Oh Susanna!” and other songs that are redolent of the Old South? I would argue that those songs have the virtue of being great tunes and important cultural touchpoints…in other words, works of musical art that justify themselves. “Piggies,” in contrast, is musical junk, like about 20% of the White Album filler. FIRE Names The Ten Colleges That Most Abuse Freedom Of Speech. Yes, Harvard Is On It. Of Course It Is.

And yes, for the exact reason that caused me to turn my diploma to the wall.

Here are the Foundation for Individual Rights in Education’s 2020 selections as the 10 Worst Colleges for Free Speech:

Babson College (Wellesley, Mass.)

Babson College fired adjunct professor Asheen Phansey for a Facebook post parodying  President Donald Trump’s (dumb) tweet threatening to bomb 52 cultural sites in Iran. The professor’s satire wasn’t exactly Dave Barry, but it was obviously a joke:

“In retaliation, Ayatollah Khomeni should tweet a list of 52 sites of beloved American cultural heritage that he would bomb. Um… Mall of America? …Kardashian residence?”

The post was shared by a local gossip blog, and Babson administrators suspended Phansey pending an “investigation,” intoning that the college “condemns any type of threatening words and/or actions condoning violence” and that it was “cooperating with local, state and federal authorities.” That was some investigation: less than a day later, Babson  fired him.

FIRE  protested to Babson  earlier this month, pointing out that Phansey’s post was  obviously a criticism, not an endorsement, of threats of violence, mixed with sarcasm about American culture.

Jones College (Ellisville, Miss.)

Last spring, administrators and campus police at Jones College twice stopped student Mike Brown  when he tried to recruit students for a campus chapter of Young Americans for Liberty, telling him he needed the school’s explicit permission to speak on campus. When  Brown and two others displayed a sign inviting students to give their opinions about legalizing marijuana, a staff member called campus police. Brown was taken to the police chief’s office and, according to Brown, was told  he was “smarter than” to engage in such conduct on campus without permission. Two months earlier, a Jones administrator called campus police when Brown and a friend produced  an oversized beach ball they dubbed a “free speech ball” for students to write messages while Brown  talked to them about free speech and Young Americans for Liberty.  The Horror. Yes, the police told them they were not allowed to have a provocative beach ball on campus without permission from the school.

Brown has filed a First Amendment lawsuit with FIRE’s help. The Department of Justice has piled on, telling the school that its policies are unconstitutional.

Foundation For Individual Rights In Education (The FIRE) Report: America’s Top Universities Deny Students Fair Hearings

The FIRE, the heroic non-partisan non-profit that is dedicated to fighting restrictions on student speech, expression and other civil rights, has issued an important report showing how badly respect for Constitutionally guaranteed rights eroded during the Obama Administration’s embrace of the “war on women” narrative and radical feminist propaganda regarding the “rape culture” at American universities. From the press release:

“Spotlight on Due Process 2017” surveyed 53 of America’s top universities and found that a shocking 85 percent of schools receive a D or F grade for not ensuring due process rights. The schools were judged based on whether they guarantee those accused of campus misconduct 10 core elements of fair procedure, including adequate written notice of the allegations, the presumption of innocence, and the right to cross-examine all witnesses and accusers. FIRE awarded each institutional policy a grade based on how many of those elements it guaranteed.

“Most people will probably be surprised to learn that students are routinely expelled from college without so much as a hearing,” said Samantha Harris, FIRE’s vice president of policy research. “This report should be a huge red flag to students, parents, legislators, and the general public that an accused student’s academic and professional future often hinges on little more than the whim of college administrators.”

FIRE’s report found that 74 percent of top universities do not even guarantee accused students the right to be presumed innocent until proven guilty. Making matters still more unjust, fewer than half of schools reviewed (47 percent) require that fact-finders — the institution’s version of judge and/or jury — be impartial.

Additionally, 68 percent of institutions fail to consistently provide students a meaningful opportunity to cross-examine their accusers or the witnesses against them — despite the fact that the Supreme Court has called cross-examination the “greatest legal engine ever invented for the discovery of truth.”

Most universities try students under one set of procedures for sexual misconduct, and an entirely different set of procedures for all other offenses. Of the 49 institutions in the report that maintain separate policies for sexual and non-sexual misconduct, 57 percent grant students fewer procedural protections in sexual misconduct cases — even when those cases allege criminal behavior. Troublingly, 79 percent of top universities receive a D or F for failing to protect the due process rights of students accused of sexual misconduct….

The report later says that not one institution covered by the study received the top grade. Continue reading

Ethics Hero: Notre Dame Political Science Professor Vincent Phillip Muñoz

Vincent Phillip Muñoz is the Tocqueville Associate Professor of Political Science and Concurrent Associate Professor of Law at The University of Notre Dame. Following the violent protest that prevented his announced lecture at Middlebury College earlier this month, Prof. Muñoz invited Murray to speak at the University of Notre Dame next week. This occasioned some protests and objections from students and faculty at his own college, and he responded with an essay at RealClearPolitics, writing in part…

Charles Murray is speaking at Notre Dame because I and another Political Science professor assigned his book “Coming Apart” in our classes. His visit is one of several outside lectures that are part of this semester’s Constitutional Studies offerings. My class, “Constitutional Government & Public Policy,” addresses some of the most important and divisive issues in American politics: abortion, gay marriage, religious freedom, inequality, freedom of speech, death penalty, race and the meaning of constitutional equality, immigration, euthanasia, and pornography.

 The class is designed to prompt students to think more deeply and thoughtfully about contemporary moral and political issues. I don’t assign a textbook or “neutral” readings that summarize the issues; I require students to read principled thinkers who advocate vigorously for their respective position. I want my conservative students to read smart, persuasive liberal thinkers, and I want my liberal students to read thoughtful conservatives. Educated citizens can give reasons for their beliefs and can defend intellectually the positions they hold. That requires that we understand and articulate the positions with which we disagree.

…“But Murray is controversial and will make students feel uncomfortable,” my faculty colleagues say. Don’t I know that he has been accused of being racist, anti-gay, and a white nationalist? I’m told that bringing him to campus is not fair to Notre Dame’s marginalized students.

I have no desire to inflict unwanted stress or anxiety on any member of the Notre Dame community, especially our minority students. I appreciate the concern for student well being that motivates some of the opposition to Murray’s visit. But I believe what is most harmful to students—and, to speak candidly, most patronizing—is to “protect” our students from hearing arguments and ideas they supposedly cannot handle.To study politics today requires handling controversial, difficult, and divisive topics…

The price of a real education is hearing powerful arguments that make us realize our opinions are based on untested assumptions. Only then, when we realize that we do not know as much as we think we know, can genuine learning occur.

I invited Dr. Murray to Notre Dame months ago…Given what happened at Middlebury, it would be cowardly to disinvite Murray now. Rescinding his invitation would communicate that violence works; that if you want to influence academia, sharpen your elbows, not your mind. It would tell those who engaged in violence—and those who might engage in or threaten violence—that universities will cower if you just appear intimidating. Rescinding Murray’s invitation would teach exactly the wrong lesson…

Notre Dame faculty critical of Murray have implored me to think about the larger context of what his visit means. I am. That is why I will not rescind his invitation. As a professor and program director, my job is to do what we are supposed to do at universities: pursue the truth through reasoned dialogue and discussion. Whether you find Charles Murray’s scholarship persuasive or objectionable, his visit offers an opportunity to learn. That is why I invited him to speak at Notre Dame. After Middlebury, it’s all the more important that he do so.

It is almost an insult to academia to call Prof. Muñoz ‘s statement heroic. It should be obvious. Dissenters from the position he articulates should be instantly recognizable as regrettable outliers, the opponents of academic freedom and freedom of thought, the advocates of censorship and ideological indoctrination. Yet increasingly it is this traditional view of higher education that Muñoz advocates that is under attack. Continue reading
