Allison Green, a management advice blogger, received this jaw-dropping question from a relative of Mr Potter:

I manage a team, and part of their jobs is to provide customer support over the phone. …One employee asked to come in two hours after the start time due to her college graduation ceremony being that same day (she was taking night classes part-time in order to earn her degree). I was unable to grant her request because she was the employee with the lowest seniority and we need coverage for that day….I told this team member that she could not start two hours late and that she would have to skip the ceremony. An hour later, she handed me her work ID and a list of all the times she had worked late/come in early/worked overtime for each and every one of her coworkers. Then she quit on the spot.

I’m a bit upset because she was my best employee by far. Her work was excellent, she never missed a day of work in the six years she worked here, and she was my go-to person for weekends and holidays.

…I want to reach out and tell her that quitting without notice because she didn’t get her way isn’t exactly professional. I only want to do this because she was an otherwise great employee, and I don’t want her to derail her career by doing this again and thinking it is okay. She was raised in a few dozen different foster homes and has no living family. She was homeless for a bit after she turned 18 and besides us she doesn’t have anyone in her life that has ever had professional employment. This is the only job she has had. Since she’s never had anyone to teach her professional norms, I want to help her so she doesn’t make the same mistake again. What do you think is the best way for me to do this?

He also said that on one occasion he had granted a similar request “because they had concert tickets that they had already paid for, but this was a special circumstance because there was cost involved.”

In the wake of Attorney General Lynch’s acknowledgment of wrongdoing in meeting, however briefly and innocently, with Bill Clinton, some  reader comments here are redolent of the destructive distrust of government and leadership engendered by this administration and others, particularly Bill’s. Yet this attitude feeds on itself, and is to an extent a self-fulfilling prophecy. If leaders think that people expect corruption, they are less likely to shy away from it. Cynicism leads to acceptance. Of course, this is one explanation of why the tarmac meeting took place—pure arrogance and a belief that with the news media’s complicity, now virtually any degree of government dishonesty and corruption will be either effectively hidden from the public, or accepted by it.

This is untrue, still. Indeed, this episode is proof that it is untrue, though the news media did make (disgusting and ignorant) efforts to shrug off the clear appearance of impropriety represented by Lynch having a meeting with Clinton the Impeached under these circumstances. Why do I labor trying to write these essays explaining the legal and ethical context of such events if readers are so poisoned by bitterness and distrust that they can’t or won’t process them, and just default to “it doesn’t make any difference, all is shit, all is lost”?  If I believed that, I wouldn’t be spending time—work  time, uncompensated time—writing this stuff. I can earn peanuts directing professional theatrical productions: it makes people happy, gives actors work, and is a lot more fun, believe me.

Paranoia, suspicion, despair, and conspiratorial views of government, which are all these comments represent, are just forms of bias. Bias makes us stupid, and in this case, bias makes us dysfunctional as a people and fearful and miserable as individuals. Continue reading

In my metaphorical back yard, a kerfuffle over whether Chinese restaurants should serve rice  in individual bowls or family style resulted in bad publicity for a burgeoning restaurant chain, a family rift, some lost jobs, and an internet controversy.

I almost missed the last part. Luckily, my issue scout Fred misses nothing.

It unfolded thusly:

A group of four diners at the Peter Chang restaurant in Arlington, Virginia included a man who had lived in Beijing, and he expressed  surprise when the obligatory steamed rice arrived at their table in one large bowl.  He asked, “‘Oh, you guys don’t serve them in individual rice bowls?'” The server told the group that when rice is served to three or more diners at Peter Chang, it comes in a large bowl.

After the former Beijing resident (later termed “the know-it-all” in the ensuing social media debates) noted that it was an odd choice, considering that personalized bowls  were the norm in China, the server then offered to bring individual rice bowls instead. The group declined.

Oh…for some reason, three of the four men were in plaid jackets. Believe it or not, this detail is relevant.

When the diners received their bill, they saw that it had insulting typed commentary on it as well:  “im a plad asshole” and “i have a small penis”:

When they complained to the manager, he apologized and brought out the two servers responsible for the typed insults on the point-of-sale slip. One of the diners told the Washington Post that the manager and the server appeared embarrassed but not contrite. “It was just a joke” and “You weren’t supposed to see it” described their attitude, he said. Ethics Dunce: Miami Marlins Manager Don Mattingly

When new Miami Marlins manager Don Mattingly chose Barry Bonds as his batting coach, it was considered a bold move. Bonds, after all, is simultaneously baseball’s all-time home run champion, holding both the single season and career records, and its biggest cheat, having achieved both records while being secretly, illegally and unethically assisted by steroids. In addition to knowing how to cheat, Bonds undeniably knows how to hit (he was a great hitter before he decided to mutate himself), so this was a chance at redemption for Barry, as well as an opportunity to soften some of the sports media antipathy toward his conduct and character which has so far kept him out of the MLB Hall of Fame.

Asked this week how Barry Bonds was doing as batting coach, Mattingly replied,

“Him getting used to the coaching part of it is a work in progress from a standpoint of the amount of time and the preparation. You see [assistant hitting coach Frankie Menichino] still doing a lot of the prep work. Barry is still getting into the routine of the ugly side of coaching — being here at 1, and studying video, and studying on the plane and you don’t get a chance to watch movies, and things like that. It just depends how good you want to be as a coach. If you want to be a really good coach, you’ve got to do the work.”

Translation: “So far, Barry’s been lazy and isn’t doing his job. His assistant is doing it for him. The job requires a lot of hard, tedious work, and Barry hasn’t shown that he’s willing to do it. At this point, he not a good coach.”

Ethics foul. Mattingly was a fool to hire Bonds, and MLB is wrong to let this sport-wide ethics corrupter set foot in a clubhouse. Bonds is a living, breathing advertisement for the proposition that cheating pays, and should not be trusted not to promote that proposition to young players. Having hired Bonds, however, Mattingly still is obligated to treat him fairly and professionally.

It is not fair and professional to make a negative job review public by communicating it to the news media. Mattingly gave a critique of Bonds’ performance that should have passed from him to Bonds, and only from him to Bonds, in private. Attacking Bonds—and it was an attack, if a passive aggressive one—in the press is unfair, irresponsible, disrespectful, a betrayal of trust, and also cowardly.

Mattingly’s job is called “manager,” and this is atrocious, unethical management. He owes Bonds an apology, and if I were Marlins management, I would be thinking very hard about whether Don Mattingly is qualified for his job.

 

Hypnotist Ethics Amuck: I’ll Take the Chicken, Thanks

[I’m on the road, and have a commentary on last night’s debate to file, but it’s hard doing it right in cabs and airports. This stupid tale, however, doesn’t take as much thought.]

Like the last post, this one begins in Minnesota. Something strange is going on up there. I didn’t write about this lawsuit  a year or so ago when it first came to my attention, but it is apparently still live. It is unbelievable, but also true.

PRIDE Institute Inc. of Eden Prairie is a non-profit agency that works with lesbian, gay and transgender clients, helping them deal with “mental health, substance abuse and sexual health” issues. As a special treat for its staff, the HR department hired a hypnotist as entertainment at a staff holiday party. The hypnotist, Freddie Justice, started his act  by telling the employees that he recognized it was a work event and that they didn’t have to worry about, for example, being hypnotized to “cluck like a chicken.”  His audience put at ease, Freddie entertained the group for nearly an hour and a half, hypnotizing volunteers and persuading them to do various silly things for the amusement of their colleagues.

Then the hypnotist asked the agency’s director of human resourcesor permission to conduct a final special demonstration.. With her permission, Justice selected three female volunteers, hypnotized them and told them they were going to experience an intense orgasm, like Meg Ryan’s fake version in “When Harry Met Sally.” All three did, spectacularly so, in front of their co-workers and the CEO of the agency. “Wait…Gloria Steinem is political????”

Clothing retailer Land’s End lost its collective mind and chose Gloria Steinem as the first interview in the company’s “Legends Series,”a new feature in the Lands’ End’s catalog and website. What were they thinking? Steinem’s presence is inherently political. A company spotlighting her isn’t like a news medium interview: it looks like an endorsement. This is an election year. Not only is Steinem divisive between men and women, pro- and anti-abortion activists, radical feminists and more traditional women, old feminists and new feminists, Democrats and Republicans, progressives and conservatives, but even among Democrats and progressives. Steinem is campaigning for Hillary Clinton, after all.

I know what the company’s management  was thinking, if you can call it that. They thought this was a great way to attract the young female market, you know, like having more pink in the ad artwork, or mentioning “Twilight.”

So guess what happened. Land’s End was inundated with protests from customers who said they wouldn’t shop there any more. Did you guess? Sure you did. Why didn’t Land’s End? With all the relatively benign, non-controversial figures to profile, what dimwit in marketing chose Gloria Steinem? What lazy executives approved it? This is business incompetence writ Jupiter size.

Having made an astoundingly stupid mistake, Land’s End had no choice but to retrench, and pull the feature. This was unavoidable, and the right thing to do, as in competent. Political, partisan figures representing contentious social and political issues don’t belong in a merchandiser’s catalogue, unless that merchandiser wants to identify itself with ideological and political camps, like Ben and Jerry’s, and risk alienating a portion of its market. It especially doesn’t do this when an emotional issue like abortion is involved. Even Ben and Jerry haven’t come up with a flavor called Late-Term-A-Portion Peach, or Planned Parent-Good Peppermint, or Gosnell Gooseberry.

(Yet.)

Once the completely predictable push-back began, Land’s End management had an ethical duty to its stockholders to try to stem a disaster of its own making. In a prepared statement, a company spokesperson said,

“We greatly respect and appreciate the passion people have for our brand. It was never our intention to raise a divisive political or religious issue, so when some of our customers saw a recent promotion that way, we heard them. We sincerely apologize for any offense.”

If the company really chose Gloria Steinem as its first “legend” and had no intention to raise “divisive political or religious issues,” I’d sell that Land’s End stock if I were you, because the company is managed by Barbary Apes. Was Kim Davis going to be its next legend? Would it be similarly shocked if its gay and thinking customers found offense with that? Oh, probably. Next up: Dan Savage, then Pat Robertson, and maybe Trayvon Martin’s mother. “What? Controversial? We had no idea!” Continue reading

The Unethical Web-Shaming Destruction Of Holly Jones

“I will never go back to this location for New Year’s Eve!!!” young Holly Jones ranted on an Indianapolis bar and restaurant’s Facebook page. “After the way we were treated when we spent $700+ and having our meal ruined by watching a dead person being wheeled out from an overdose my night has been ruined!” The angry post accused the evening’s restaurant manager of rudeness, the party’s waitress of profanity and the establishment itself of inattention.

After a sharp on-line rebuttal by the restaurant, the Web Furies were unleashed. Jones’ post became the latest web-shaming catalyst and an invitation to join a cyber-mob where fun could be had by all turning an ordinary jerk into a national villain. Lots of people signed up. The mob tracked down Jones and bombarded her own Facebook page with hate—she took the page down—then moved on to the salon where she worked as a hairdresser, threatening a boycott unless it fired Jones.

So it did.

These exercises in vicious web shaming can be ranked along an ethics spectrum. At the most unethical end is the destruction of Justine Sacco, who had her legitimate marketing career destroyed by social media’s  hysterical over-reaction to a self-deprecating, politically incorrect tweet. Now she works promoting a fantasy sports gambling website, a sleazy enterprise that entices chumps into losing serious cash with a business model derived from internet poker—she not only had her life derailed, she was corrupted too.

At the other end is Adam Smith, the one-time executive who wrecked his own career, with the help of another cyber-mob, by proudly posting a video of himself abusing an innocent Chic-fil-A  employee because Smith didn’t like her boss’s objections to gay marriage.  Somewhere between the two is Lindsay Stone, who lost her job by posting a photo showing her pretending–she later said— to scream at the Tomb of the Unknown Soldier while flipping the bird at the “Silence and Respect” sign.

The distance between Smith and Jones is the difference between words and conduct. Smith’s video showed him abusing a young woman, and his posting of the video indicated that he saw nothing wrong with it. Jones, in contrast, did nothing, other than prove herself to be, at least at the moment she posted her rant, an utter jerk. Everyone along the spectrum, however, including Jones, were excessively and unjustly harmed by the web-shaming  campaign against them. Last I checked, Smith was unemployed and destitute three years after his episode of atrocious judgment.

In the current case, the cyber-mob forcing Holly’s employer to fire her is ethically worse, by far, than anything she can reasonably be accused of doing by posting her criticism of the restaurant. Continue reading

The Gawker Mess: Is Integrity A Virtue When It Means Continuing An Unethical Policy?

gawker1The website Gawker is reeling in the aftermath of particularly Gawkerish  (that is, slimy) story exposing the efforts of a high-ranking male official at Gawker rival Conde Nast to secure the services of a male prostitute.  Following backlash even from those who usually tolerate  Gawker’s smug invasions into celebrity privacy, Nick Denton, the president of  Gawker Media, had the story taken down. He then wrote a post titled “Taking a Post Down,” defending his executive action.  Gawker Editor-in-Chief Max Read and Gawker Media Executive Editor Tommy Craggs resigned, and the editorial staff has protested the episode, noting that “business executives deleted an editorial post over the objections of the entire executive editorial staff.”

First, regarding Gawker’s plight: good. Couldn’t happen to a more deserving website. Second, and more controversial is this interesting ethics question that we don’t encounter very often outside the realm of “The Godfather” films: Is integrity applied to an inherently unethical culture a virtue?

When the Conde Nast outing story received furious blowback from media critics but also gay activists, who are flying high right now and thus not to be crossed, Craggs proposed that Denton issue a statement that Gawker was founded as a media gossip site and had always “unapologetically and often mercilessly” invaded the private lives  those who work in  the industry. “We stand by the story, which meets our simple, unwavering standard of being both true and interesting,” the statement was to say.

That simple, unwavering standard is and has always been unethical. Gawker hurts people for fun and titillation, and makes a profit out of doing so. Printing what is “true and interesting” without considering whether the often prurient interest factor outweighs the harm to the individuals and their families done by the site’s prying is inherently unfair and irresponsible. The pulled story was not atypical, but then Gawker has been typically immune to shame and decency. What had changed?

At a government legal ethics seminar a week ago, one of my attendees told me of the nightmare he and his family were going through because all of his personal data, including confidential information from his FBI background check,and his fingerprints, were now available to those hostile to the US, and potentially hostile to him. He was furious. He trusted his government, and it proved incompetent…as usual, under this President

The data stolen from the Office of Personnel Management affected 22 million Americans directly, and indirectly many more, through their now imperiled families. It took an almost unimaginable amount of pure gall, as well as a complicity and incompetent news media, for President Obama and his supporters to be  claiming status a transformational leader because of a Supreme Court decision that was inevitable and that he had no hand in at all, while two more federal agencies  run by his appointees—Homeland Security is supposed to prevent such attacks— had failed the American people in epic fashion. When Typos Have Ethical Significance

I was chided over the weekend for mocking a misspelling in one of the cuckoo online comments cheering on Texas Governor Greg Abbott’s ridiculous “monitoring” of U.S. military exercises in his state. The thrust of my critic’s argument was that picking on such modes of expression was not only a cheap shot but an elitist cheap shot. I generally deplore the “You wrote ‘teh!'” school of online debate, and in my view, that wasn’t what I was doing when I pointed out this particular Texas paranoid’s spelling of government as “goverment” twice . His “position” didn’t require any rebuttal, as it was self-evidently batty; I alluded to “goverment” because I concluded that it was not a typo, but rather an indication that the commenter was as ignorant as granite block. If you can’t spell government, you haven’t read about government enough to have an opinion on it worth inflicting on the rest of us.

It led me to ponder, however, when a typo has undeniable ethical significance, and mirabile dictu, Above the Law today provided the excellent example you see above.

This is part of the marketing for a law firm—you know, those organizations that provide lawyers to ordinary citizens who need help negotiating the complexities of our nation’s increasingly impenetrable laws and regulations in order to live and prosper? Lawyers are supposedly trained in the precision of language, as the presence or absence of a comma or semi-colon in a statute, a motion or a brief can mean the difference between a client being a criminal or a free man, and an unnoticed typo in the draft of a contract, will, trust or settlement can decide the fate of millions of dollars, the ownership of disputed property, the existence of a prenuptial agreement, and other momentous, life-altering  consequences.

The very existence of an embarrassing  law firm marketing device like this one—I think it’s a coaster—leads to many conclusions:

1. It tells us that the law firm’s managing partners are inattentive to details, and in law, details are everything.

2. It tells us that the lawyers in the firm inadequately supervise the non-lawyers who work for the firm, and the ethics rules demand that lawyers be especially attentive to such employees and contractors.

3. It tells us that at least one firm lawyer, whoever approved the thing, either is illiterate or can’t be trusted to check the text of documents, even documents containing only three words.

4.It tells us, in short, that this law firm, and by extension the lawyers it employs, cannot be trusted to exercise care, competence and diligence when they are representing themselves.

How can it possibly be trustworthy when it is representing others?
