Ethics Movie Ethics Quiz: “The Edge” (1997)

Anthony Hopkins winning an upset Oscar this year reminded me of the action film he made with (yecchh) Alec Baldwin 25 years ago. I would have written about it then, but 1) I didn’t see it then, being driven to my sock drawer at the thought of paying for any movie with Baldwin in it, and 2) it was a long time before Ethics Alarms.

The film explores survival situation ethics, a topic that “The Walking Dead” has thoroughly beaten to walking death in the last decade, with the assistance of some sharp David Mamet dialogue. Hopkins, a wealthy, cocky and obnoxiously competent businessman, survives a small plane crash that dumps him and two other men in the middle of the Alaskan wilderness. One of them, the younger Baldwin, is secretly having an affair with Hopkins’ super-model trophy wife, whom they left back at the hunting lodge.

Hopkins’ encyclopedic knowledge of everything and Eagle Scout-level survival skills keep his wilderness ignorant companions alive and hopeful until a rampaging Kodiak bear eats the man who isn’t Baldwin (thus showing good taste). Then the remaining two become the hunted. Eventually, after many scares and narrow escapes, Hopkins and Baldwin solve their hungry bear problem and find an abandoned cabin conveniently stocked with food, guns, and a canoe. Baldwin, confident that he no longer requires Hopkins’ expertise to survive long enough to be rescued, takes a functioning rifle, loads it, admits that he’s having the affair with Hopkins’ wife, and marches Hopkins outside to shoot him. But Fate takes a hand: Baldwin falls into a pit before he can shoot and is rendered helpless, with a broken leg and other life-threatening injuries.

Ann Althouse Meets Spuds: On Althouse Saturday, Two Canine Ethics Questions From The Blogger I’ve Been Meaning To Answer

Our rescue dog Spuds is gradually coming into his own now: after being starved by his previous owner, he finally is secure enough to leave some food in his dish and finish it later. He’s also finding his inner puppy at 2 and a half, which is both challenging for us as he gets stronger, and fun. I honestly don’t know how we went so long without a dog in our home after Rugby left us.

Ann Althouse, whose opinions have been unusually visible on Ethics Alarms today,  raised two dog-related ethics issues since we adopted Spuds last month, and since the dog left me panting by running me over hill and dale this morning as I allowed him to run off leash for the first time, addressing them now seems like a timely task.

1. On August 23, Althouse wrote,

Why don’t the people who think you should get a “rescue” dog when you want a dog also think you should get a “rescue” child when you want a child? In fact, isn’t the argument for adopting an older child with special needs even stronger than the argument for adopting an older dog that hasn’t had the advantages of a loving home and careful training? After all, many dogs are euthanized, but we strive to keep all our children alive even when they have terrible behavioral problems. And dogs are kept under the control of owners all their lives, while children become adults and are allowed to move about freely in the world even when they are quite dangerous. It’s therefore especially important to take great care of all of the children who have been born into this world.

People will say that they want their own biological offspring, but what makes you think what you have to give genetically is so wonderful? Dog breeders have much higher standards selecting which dogs to use for breeding. People just decide to use themselves. When you have your own biological children, you’re picking yourself because you are yourself. I’m not saying that’s wrong. In fact, I think it’s quite beautiful, making something out of your own body and the body of a person you love. So I’m beginning to see the answer to my question. When you have your own child, you’re not being a eugenicist, looking for the ideal baby. You’re accepting the randomness of who you happen to be and who you’ve found to love. The baby grows out of that is more like a rescue dog than a breeder’s dog.

I do think Althouse answered her own question., at least the human part. Having a child (or many) with someone you love is part of the human experience, helps bind couples and society together, and is a spiritual as well as a natural biological act. Of course, that description assumes a lot: that the child was planned, that the parents love each other, that they are married, and that there are no known toxic hereditary traits to avoid. From The “Saint’s Excuse” Files:The Catholic Church, Penn State, and Now Choate…What Have We Learned?

The renowned private boarding school school Choate Rosemary Hall, alma mater of such luminaries as John Dos Passos, Edward Albee, Glenn Close, multiple Kennedys and dozens more of the rich, famous and powerful, , just revealed that at least twelve former teachers had sexually molested, and in one case, raped, students without the crimes being reported to police. The pattern continued over decades. In some cases, teachers were allowed to resign after being confronted with evidence of abuse, and administrators wrote still letters of recommendations for them after they were fired. The predators then went to other schools, sometimes in positions of power and authority.

After the similar institutional conduct revealed by the Catholic Church and Penn State, does anyone believe that this is a rare occurrence in institution, including the most prestigious—and virtuous!—ones? The lesson is that established, powerful, iconic institutions are programmed to protect themselves above others, and regard their own missions and continued vitality more precious than any single individual, even a child.

Revisiting one of the most important of the Ethics Alarms’ 92 rationalizations:

13. The Saint’s Excuse: “It’s for a good cause”

This rationalization has probably caused more death and human suffering than any other. The words “it’s for a good cause” have been used to justify all sorts of lies, scams and mayhem. It is the downfall of the zealot, the true believer, and the passionate advocate that almost any action that supports “the Cause,’ whether it be liberty, religion, charity, or curing a plague, is seen as being justified by the inherent rightness of the ultimate goal. Thus Catholic Bishops protected child-molesting priests to protect the Church, and the American Red Cross used deceptive promotions to swell its blood supplies after the September 11, 2001 attacks. The Saint’s Excuse  allows charities to strong-arm contributors, and advocacy groups to use lies and innuendo to savage ideological opponents. The Saint’s Excuse is that the ends justify the means, because the “saint” has decided that the ends are worth any price—especially when that price will have to be paid by someone else.

Animal Ethics: The East African Topi

The Topi is an African antelope. It’s hard to even google this animal, because Google keeps changing the word to “topic.”

Topi (that’s the singular and plural)  are strange. Their females are fecund only one day a year, which obviously makes that day a little frantic for the males. The males have to corner the females to mate, which is not always easy. Some of the males cheat by lying—there’s no other word for it.

All year long, male Topi warn the herd  of approaching predators by making a special, loud grunting sound that is immediately heard by all as “Watch out! A lion (or facsimile) is nearby!” When Topi hear the sound, they freeze and look  for the potential attacker.

Researchers have found that some male Topi win the mating sweepstakes by unfairly using the sound that 364 days a year means, no kidding, “We’re in trouble!” It has to be believed, for the safety and survival of the herd, and is. One day a year, however, on mating day, there are male Topi who falsely use the warning grunt to freeze shy females in their tracks, and while the girls are searching the area for something with sharp teeth, they get a big surprise from behind. These deceptive males sneak up on them, and it’s wham, bam, thank you, Miss Topi!

Topi males that use this subterfuge, researchers find, mate three times as often as those who play by the rules. Males who don’t cheat, and who don’t risk the effectiveness of a vital species defense device by playing “The Horny Topi Who Cried ‘Lion,” are less likely to pass along their genetic material.

The Topi are encouraging an unethical culture. It works for a few Topi now, but if each generation has more cheaters, will the Topi warning grunt become ineffective the rest of the year? I doubt that Topi have calendars.

If Topi were human beings, would the fake grunt tactic be unethical? Immoral?

“Walking Dead” Ethics: Hypocrisy, Substance Abuse And Survival

If you can stand the periodic spectacle of shambling, rotting flesh and heads being lopped off or split down the middle, AMC’s “The Walking Dead” still provides the most daring and interesting ethics storylines available on television.

The latest episode, titled “Indifference,” raised two gutsy issues that are unpopular in today’s culture to the point of taboo. It was revealed that Carol, previously the simpering and tragic mother of the now dead, zombified and executed little girl Sophia, has morphed into a stone-cold pragmatic survivalist who advocates killing on instinct when the threat is sufficiently severe. In addition to teaching methods of mayhem to the children entrusted to her instruction in the grim, abandoned penitentiary where our heroes have fortified themselves against the roaming zombie hoards, Carol summarily executed two members of the community who were fatally ill with a pernicious virus on the grounds that they threatened the safety of the rest. For this, Rick, the sheriff-turned farmer alleged leader of the non-zombies, orders her out of the prison.

Strange. In a world without doctors, medicine and hospitals, where the objective is simply to survive long enough for some remote miracle to rescue humanity, a runaway virus is as much of a threat as a maniac with a hatchet. Rick and the rest have long ago accepted the necessity of killing members of their group who are bitten by zombies, since they are certain to “turn”after death and start indiscriminately eating people. True, the preferred method is to withhold execution until the second after the living become undead after becoming unliving, but this is a distinction without a difference. Carol is quite right that a breathing, doomed, virus-carrier is as much of a threat to the group—perhaps more—as a newly-minted brain-muncher. Why is her strong action in defense of the group, a defensible utilitarian act, reason for exile? Continue reading

timebombHere is a stimulating comment by Zoebrain in the “Zero Dark Thirty” torture thread. I’m especially fond of it, because as theoretical and probably impossible as her resolution would be in practice, it neatly addresses the central problem conflict in the “torture is an absolute wrong but you might have to use it to save the world” scenarios, like the familiar “ticking bomb” hypothetical.  In her analysis. one violates the absolute rule, but accepts a proportional penalty for doing so.

I advocate a similar approach in legal ethics in situations where a lawyer decides as a matter of personal conscience that he or she must violate core legal ethics values, like keeping the confidences of a client, in furtherance of a higher objective not recognized be the Rules of Professional Conduct, such as keeping a serial killer from going free.

Ethics Bob Asks: “Did Torture Lead Us To Bin Laden”? My Answer: “So What If It Did? It Was Still Wrong.”

The last time my friend “Ethics Bob” Stone blogged about ethics, it was way back in August, and he was writing about some guy named “Romney.” Now he’s back on the job, thank goodness, with a comeback post titled “Zero Dark Thirty: Did torture lead us to Osama bin Laden?”. And he’s ticking me off.

“Zero Dark Thirty” is Hollywood’s treatment of the search, apprehension and execution of Osama Bin Laden. The film suggest that methods of torture were employed by the CIA to uncover crucial intelligence that led to the terrorist mastermind’s demise. Torture opponents, including some U.S. Senators, are alarmed by this, and disputing the film’s account. (Imagine that: a movie that misrepresents history!) Meanwhile, conservatives, neocons, Bush administration bitter-enders, talk radio hosts and admirers of Dr. Fu Manchu and James Bond villains are citing the film as confirmation that they were right all along: torture is a wonderful thing.

I am puzzled that Bob got in the middle of this debate as an ethicist. “It worked!” and “It came out all right in the end!” are not valid ethical arguments or justifications. The first is an embrace of a pure “the ends justify the means” rationale, a favorite tool of Auric Goldfinger and Dr. No. The other is consequentialism. When ethicists and principled opponents of torture allow the issue to be adjudicated on this basis, they are surrendering their principles at the outset. “Torture doesn’t work” is a pragmatic argument, not an ethical one. If the societal consensus regarding torture is going to be determined by how much we can benefit by returning to the rack and wheel, then ethical considerations have already been jettisoned. TV Ethics, Viewed From A Sickbed

[ As regular readers here might have guessed, I am ill, and have been since Thanksgiving. I can barely read, can’t really research, and whatever appears below was composed in 10 minute increments with hours or days in between. I’m hoping to be catching up very soon. Thank you for your patience]

What do you do when any movement or exertion makes you cough your guts out, when you can’t sleep but have to rest, when your brain is so blurry from viruses and medication that you can’t even compose a blog post for three days? (Sorry.) If you are me, and I hope for your sake that you aren’t, you watch TV.

I got one jolt of legal ethics horror that I hadn’t remembered re-watching Kevin Costner’s “The Untouchables,” directed by Brian DePalma. In the movie’s climax, Al Capone’s trial on income tax evasion has come to a crisis point, as Elliot Ness (Costner) realizes that the jury has been bribed to acquit him. Despite documentation of that fact, the corrupt judge tells Costner that the trial will proceed, whereupon Costner extorts him to prompt “a change of heart.” Now the judge shocks the courtroom by announcing that he is trading juries with another trial next door. The new, un-bribed twelve will decide Capone’s fate.

This is, of course, beyond ridiculous. Adversary attorneys must be able to choose a jury in voir dire, where each potential juror is questioned. Trading juries just invalidates two trials. Even if they could trade juries, which they couldn’t, the Capone trial would obviously have to start all over again since the new jury wouldn’t know what was going on.

None of this occurs to Al Capone’s panicky lawyer, however, who, realizing that the jig is up, announces that “we” are changing “our” plea to “guilty.” Chaos reigns. Capone (Robert DeNiro) punches his lawyer in the face, and I don’t blame him one bit.  A lawyer can’t plead guilty against the wishes of his client! The judge couldn’t accept such a plea, and Capone wouldn’t be bound by it. This would be an embarrassing distortion of the justice system in a Warner Brothers cartoon, but for a movie based on historical figures and events to sink so low is unforgivable. (“Carrie” aside, Brian DePalma was a hack.) Continue reading

Mother’s Day Reflections On A Wonderful Mother With Flawed Ethics

My mom and Ma Barker had some things in common.

I am spending this Mothers Day in mourning, as today is the first time I have had to experience the holiday without a mother. My mom died earlier this year, as I mentioned here at the time, and she has been buried for less than a month. My mother used to be a regular feature of my ethics seminars, as I would reference her whenever I talked about the so-called “Mom Test,” one of the three famous ethics tests that are useful to set off sluggish ethics alarms, the other two being the Gut Test (“Does this feel wrong?”) and the New York Times Test (“Would I be willing to see my conduct on the front page of the New York Times?”). The “Mom Test” is whether you could tell your mother about your ethically-dubious conduct without hesitation or shame, and I often told my classes that with some mothers, like my own, this test didn’t work very well. “My mother,” I would explain, “has the ethics of Ma Barker.” I was only partially kidding. Bush’s Torture Admission, Absolutism, and America’s Survival

George W. Bush, currently hawking his memoirs, has admitted in the new book and in interviews about it that yes indeed, he approved waterboarding of terrorist suspects, believed it was legal, and moreover offers evidence that the information thus acquired saved American lives. W’s opinion on these matter are hardly a surprise, but they have re-energized the defenders of the Administration’s policies of “enhanced interrogation” and rendition of apprehended terror suspects to foreign locales where the interrogation techniques were “enhanced” even more.

“NOW do you agree with the policy?” they ask, as if the answer was obvious. “The information prevented a horrific terrorist attack on Heathrow Airport (in England). See? See?

Let us assume, just to simplify things, that everything is as President Bush represents. Waterboarding was, by some legitimate analysis, legal. The information saved American lives and prevented terrorist attacks. Do these facts mean that the use of torture—and waterboarding is torture, whether one defines it as such or not—by the United States of America was justified, defensible, and ethical?

No. I don’t think so. I believe that for the United States of America to approve and engage in the use of torture is by definition betrayal of the nation’s core values, and thus threatens its existence as the nation our Founders envisioned as completely as a foreign occupation.  I wrote on this topic in 2009… Continue reading
