Ethics Quiz: The Garage Sale Treasure

CNN is reporting the story of a man who bought two small boxes at a garage sale ten years ago and just discovered that they contained 65 previously undiscovered glass negatives by famed nature photographer Ansel Adams. He purchased the boxes for $45 (haggled down from $75), and their contents are now assessed to be worth at least $200 million.

Doctors and the Deadly Anti-Snitch Reflex

Everybody, or almost everybody, hates to report friends and colleagues for misconduct. This is the anti-snitch reflex, a strongly programmed response from childhood. Telling authorities about the misconduct of others sets off internal alarms that have been installed by parents and peer groups, ensuring that we feel terrible if we “tattletale.” This is betrayal, a violation of loyalty, and most of all, a breach of the Golden Rule: we’d never want anyone to snitch on us.

For professionals, however, this reflex is false, mistaken and even deadly. The duty to report dishonest public employees, crooked cops, unethical lawyers, conflicted accountants, self-dealing business executives, fraudulent researchers and others in the workplace—even if they are colleagues and friends—trumps childhood codes, personal loyalty and general discomfort. There is nothing noble or admirable about allowing innocent people to entrust their life and livelihood with untrustworthy professionals. Nevertheless, a disturbing large proportion of all professionals can’t bring themselves to do the right thing when it comes to the core ethical duty of stopping workplace dishonesty, incompetence or corruption when it involves a colleague.

Fairness Dilemma:When Should Past Misdeeds Affect Present Trust?

The Shirley Sherrod case raises a broader ethical question that surfaces frequently, both in current events and in private life. When, if ever, is it fair to lower one’s opinion and level of trust in an individual’s character based on events that occurred long ago?

In Sherrod’s case, an twenty-four year old incident she cited in a speech before the N.A.A.C.P. as a lesson in how not to behave got her fired from her job at the U.S.D.A., condemned by the N.A.A.C.P., and called a racist by conservative news commentators. Ethics Dunce: Evan S. Cohen

The New York Times has a provocative examination of the ways cyber-bullying and abusive social networking sites and posts are challenging schools and courts. It also exposes a particularly cruel Ethics Dunce, Evan S. Cohen.

In 2008, Cohen’s daughter videotaped her friends as they mocked and made vicious comments, some of them sexual about another eighth-grade girl. Then Cohen’s daughter posted the video on YouTube, traumatizing its victim.  The school was alerted by the devastated girl’s parents, and then suspended Cohen’s daughter for two days.

Daddy, however, is an attorney, and he knows overstepping authority when he sees it. He sued the school district, arguing that the school couldn’t reach into his daughter’s off-campus activities and punish her for them. Of course, he was right, and won the lawsuit. He also won $107,150.80 in costs and lawyer fees. Continue reading

Vuvuzela Ethics

Applied to an international soccer match, the argument that players, fans and broadcasters should be broad-minded and tolerant of the peculiar conduct of various national groups is a good one—up to a point. The point is reached when a custom begins ruining the game for everyone else. The vuvuzelas–those small plastic horns that produce an ear-splitting atonal drone like a horde of cicadas— go well beyond that point at the World Cup, and in any other sports setting are the equivalent of racist taunts, 400 pound naked men, on-field trespassers and giant fart machines. Asking For a Favor And Turned Down Flat

There is someone who has needed a lot of help from me recently—rides, errands, a shoulder to cry on, and mostly time.  I try to help out people when I can, especially if I am asked, because, obviously, it’s the right thing to do.

After a day in which my assistance to this individual was especially inconvenient and aggravating, essentially blowing a day that I could not afford to have blown, I learned about a personal situation facing me the next day that was going to be a problem, and realized that the person I had been assisting would be able to make my life a lot easier by granting a favor, and not a very difficult one.  So I asked her. Unethical Quote of the Week

“Client will not consider/review anyone NOT currently employed regardless of the reason.”

Job posting for a “qualified engineer”at an anonymous electronics company in Angleton, Texas, placed on The People Place, a  recruiting website for the telecommunications, aerospace/defense and engineering industries.

A Huffington Post article by Laura Bassett properly condemns this hiring requirement as offensive, irresponsible, cruel and unfair during a recession, when there is widespread unemployment. The practice would also be offensive, irresponsible, cruel and unfair during an economic boom or an eclipse of the sun. Bassett interviewed a human resources representative for Benchmark industries, which follows the same hiring policies, and its rational was this: Continue reading

Richard Bach’s World Without Trust

I recently encountered a quote from Richard Bach, the pop philosopher/author who wrote Jonathan Livingston Seagull, that bothered me. The context isn’t important, but it was cited with approval as enduring wisdom by the quoter. The statement:

“Anybody who’s ever mattered, anybody who’s ever been happy, anybody who’s ever given any gift to the world has been a divinely selfish soul, living for his own best interest, no exceptions.”

I can see why this quote might be popular, unlike his career-making best seller, which I threw against the wall after eight pages. It provides the perfect rationalization for selfishness and unethical conduct for people who don’t have the patience to read Nietzsche or the stomach for Ayn Rand. As a whole, it is nothing but a repackaging of “everybody does it,” but with a devilish seductive twist: everybody who’s smart, talented and successful does it. Wow. Translation: if you are divinely selfish, it means you might be one of the people who “matter.” Continue reading

Ethics Hero: Detroit Pitcher Armando Galarraga

When Umpire Jim Joyce apologized to Detroit pitcher Armando Galarraga, the man whose perfect game he destroyed with an erroneous “safe” call on what should have been the 27th and final out, he gave him a hug and graciously accepted it without rancor. In interviews, Galarraga has said, “What else could I do?” A great many of his colleagues would have had some alternatives, and they would have not been pleasant. Galarraga is handling his disappointment, frustration and bad luck with superb grace and kindness, in the best tradition of the Golden Rule.

“Nobody’s perfect,” he told ESPN, accepting Joyce’s mistake as human and not malicious. But Armando Galarraga was perfect, both on the mound in Detroit, and in his noble response to misfortune.

Baseball Ethics Confusion: When Respect Is Disrespectful

After the Florida Marlins’ Brett Carroll stole second on Chicago White Sox pitcher Scott Linebrink in an attempt to pad a 7-0 lead in the fourth inning of an interleague game between the two teams, the White Sox cried foul.
