Well, I missed the 2-ish deadline, after which only the most dedicated or bored Ethics Alarms readers check in on Saturdays, and the blog is already mired in the predictable holiday slump. My fault. But as Saroyan said, if just one human being sings your song, you haven’t lived in vain…

1. I see that Ann Althouse has a leftist troll. Interesting. Although the Wisconsin law prof blogger is a center-left commentator herself, her commentariat has gradually become almost completely anti-progressive in tone and substance. I see this happening on all the blogs where the predominant and virtually mandatory anti-Trump bias isn’t encouraged or observed. Now she has a recently-pressed commenter named “President Toilet Paper Shoe’s Perfect Phone” who is flooding threads with supercilious attacks on the other commenters and even Ann herself. The comments are obnoxious, abrasive, and smug. Why does Althouse tolerate them, as she is an aggressive moderator? I think she is letting this guy get away with comment misconduct because she wants more viewpoint diversity.

I sympathize, but this is “The Leftist Jerk’s Pass.” She should ding him. I would.

2. Cute or not, having a baby mayor is child exploitation.  Whitehall,  Texas, has a seven months old honorary mayor after his parents bought the title  a charity auction in October, but his anti-abortion activist parents are promoting Charlie McMillan as the “new face of the anti-abortion movement in America.”

They have even attached a slogan to his “office”: “Make America Kind Again.” Continue reading →

The ABA Shuts Down Comments On The Articles In The ABA Journal

Now that’s ironic. Like so many other publications and websites that prefer one-way communications of ideas, the official publication of the American Bar Association has announced that it will no longer allow readers to comment on its content. Yes, a profession that is all about rights and advocacy finds advocacy in response to legal opinion and analysis too inconvenient to deal with, and its readers free expression of ideas too burdensome to countenance.

The ABA Journal’s announcement was filled with disingenuous statements and half truths as bullet-pointed reasons for the move:

  • “The tone of the comments has become rancorous and uncivil, with substantive commentary being drowned out by partisanship and namecalling that violate the ABA Code of Conduct.”

Wait: how does “partisanship and namecalling” in the comment section of a website “violate the ABA Code of Conduct?”

What an embarrassing claim: the ABA doesn’t understand its own Model Rules! The word “partisanship” doesn’t appear anywhere in the rules, and the argument is hilarious anyway, since the ABA itself, an allegedly non-partisan non-profit, is extremely partisan, as a brief perusal of the various public positions it has taken on matters that really should be none of their business would make obvious. (Guess which party! Come on, guess!) Extreme namecalling under certain  circumstances during the practice of law may occasionally involve a sanctionable ethics breach for lawyers, but not for non-lawyers, retired lawyers and many other readers. The larger problem is this: the ABA Rules are just guidelines. They don’t officially apply to anybody, not even to ABA members. You can’t literally “violate” them, like they are rules or laws.

  • “Our existing commenting system is vulnerable to trolls.”

Then fix your system, but only after defining “trolls.” It is often a lawyer’s job to make trouble, stir the pot, and create productive friction.

  • “Moderating the comments has become an unsustainable burden on our staff.”

I guess the ABA Journal is incapable of running a website, then. Moderating comments, which as far as I can determine involves fewer comments per article than the typical Ethics Alarms post, cannot possibly be that difficult or time-consuming. It’s a staff-member, and not a highly paid one. This sounds like cover for a financial decision.

  • “We have fielded a number of complaints from members about individual comments and the tone of the comments as a whole.””

Oh! Complaints! Well, we all know how much lawyers hate complaints! (Who wrote this?)

  • “With our large social media presence, there are a number of platforms for readers to engage with and discuss our journalism.”

“Now, you  folks can’t eat here, but there are some real nice places down the road a piece…”

I would write a searing comment about this, but the ABA Journal won’t allow it…

Ann Coulter: Take seriously at your own risk. Just like Donald Trump…

I have long been waffling over whether to bother mentioning Ann Coulter’s cheerleading for Donald Trump, which began almost a year ago. Coulter is freakishly unethical and proud of it, a rare professional fick, whose shtick (I guess one shouldn’t use fick and shtick in the same sentence: sorry) is to pander to The Angry Right in such obnoxious and inflammatory terms that the Angry Left goes bananas with hate, thus selling books and providing her with media appearances to promote them. I have  assigned her to the dark corner reserved for performance artists who posture and lie for a living, for that’s Ann. I have no idea what she really believes, just as I have no idea what James Carville, Milo Yiannopoulos or Rush Limbaugh really believe—and anyone who really thinks that they know what Donald Trump really believes is beyond redemption, since it is quite evident that he doesn’t know himself.

Thus when I heard that Ann’s latest book, doubtlessly written in about five hours of dictation and containing some measure of her trademark snark, which she is very skilled at, was called “In Trump We Trust: E Pluribus Awesome!,” I was sorely tempted to express my disgust, especially since Coulter, an educated woman and a lawyer, actually stooped to using that mark of an illiterate, “awesome,’ like the book was authored by a modern day Gidget. But why play into Ann’s hands? This is why she writes this crap: to cause buzz on the net and cable so she can sell the books to right wing idiots who will be soothed by her calculated pose.

The title is an absurd, almost Orwellian (“War is Peace”) lie. Trump, as much as anyone alive,  cannot be trusted regarding anything, especially to hold great power. The reasons for this are evident and undeniable, and have been so long before running for President, wrecking the Republican Party, threatening the United States’ public’s faith in democracy and handing the White House to the most corrupt candidate a Presidential race has ever featured was a twinkle in the Donald’s eye.

However, listening to Trump blather about immigration last week, and seeming to renege on his signature promise to depart each and every illegal immigrant, almost compelled one to direct massive schadenfreude Ann Coulter’s way. Continue reading →

Welcome To My In-Box!

-goonies-photoWhile I’m having colloquies with the mostly rational and open-minded visitors to Ethics Alarms, I am also fending off nut-case invective by, fortunately, the Angry Left, who are generally less frightening than the Angry Right, on my private e-mail account. Their discourse is instructive.

These sad zealots have been cyber-stalking me for several months now, I know not why. Clearly, it was some post that was critical of their One True God, President Obama, and this, in their eyes, labelled me a Tea Party member (since only Tea Party members are capable of identifying a hopelessly inept administration, apparently) and deserving of receipt of links to every news story that reflects poorly on a member of the Republican Party. Most of the time, I have already criticized the conduct involved, but never mind—these Furies seem to think that every example of a Republican’s misconduct is a dagger through my heart.

The most recent of these, copied in to a vast collection of fellow Leftists, plus my wife, just to clutter up her in-box as well, came from someone calling himself “Kenneth Martin”—I say this because I suspect that he uses other accounts and names to harass me. Ken–can I call you Ken?—sent me a link to the story about Rep. Grimm, which I had already posted on, with this typically fair and well-considered commentary, in bold:

“Funny!!!  The idiot’s already under investigation and they caught him on camera with an open microphone threatening a reporter who’d just interviewed him and asked him something he didn’t like.  So the ass walks away… and THEN comes back… didn’t realize the cameras were still running and threatens to throw the reporter off a balcony  and to beat him up. Don’t you lu-uv the Republicans!???!    LOLOLOLOLOLOLOL!!!” 

I know, don’t feed the trolls. Still, I couldn’t resist pointing out his logical fallacies to his large, copied-in audience, so I wrote back to all:

Hey, Ken, Thanks! I didn’t know Obama had appointed a Republican as Secretary of the Interior! https://ethicsalarms.com/2012/11/14/a-no-tolerance-rule-for-cabinet-members-dont-threaten-reporters/ Or that my own Congressman, serial thug Jim Moran, was a Republican

Of course, attributing Grimm’s thuggish conduct to all Republicans is not just something like, but exactly like, attributing Anthony Weiner’s conduct to all Democrats. Or Elliot Spitzer’s. Or Rod Blagojevich.

Please keep your hyper-partisan ignorance and bias out of my inbox. I have spam to read, you moron.

Ken, wounded, then proved my point by sending—just to me, this time—the following devastatingly witty retort:

“GO FUCK YOURSELF WITH YOUR INSULKTS!”

Which, you must admit, is as good an example of res ipsa loquitur as you are likely to find. Then, this morning, I hear from one “Kol Altai,” who may or may not be Kenneth Martin, and who also regularly sends unsolicited political rants and links, some of them completely incomprehensible, to my in-box and that of my long-suffering wife. Kol (is that name an anagram?) writes,

  “Wow, Jack!  One really has to admire YOUR “professional ethics”!!! Name calling!!  Insulting people because they don’t like a Republican who threatens to toss somebody off a balcony or break them in half like a boy. Yeah, Jack, you’ve got real “ethics”!!!  You’re really “professional”!!! “

“Hard not admire someone as lowlife as you!!!”

    “GO TO HELL!!!”

 

I mention this because of the ongoing civility debate currently raging on Ethics Alarms. Is there anything unethical about labeling the hostile sender of a moronic, unsolicited e-mailed message a “moron”? I don’t think so. I did not say that his opinion was moronic because he was a moron—that would be an ad hominem attack. There is no question that to conclude from the actions of one Republican congressman that all, most or even any other Republicans behave this way is a something only someone cognitively impaired could do. I pointed out the obvious and foolish flaw in Ken’s reasoning (Jim Moran (D-VA) is my Congressman–talk about thugs), and diagnosed the likely malady of its originator. Any other response would be to give the comment and the commenter more respect and credibility than he deserves.

Moreover, bestowing a title like “moron” communicates that fact that this e-mail and its author are not welcome in my in-box, and thus I will not treat them with the usual gentility that I would bestow on a guest. I might also call some screaming Eric Holder fan who bursts uninvited into my living room an “asshole” before I call the police, or have my son shoot him. Kenneth/Kol would probably argue that would be unethical of me as well.

But then, they are morons.

I just thought some of you might appreciate a glimpse of what befalls anyone who tries to render objective ethical judgments in hyper-polarized, 21st Century America.
