Full disclosure: I went to college with Frank Rich. He gave me a rave review for a performance once. When he turned into the vicious, biased, hateful jerk he reveals himself to be in his not merely progressive but irrationally  hostile to conservatism op-ed columns and, prior to that, his vitriolic and hyper-critical theater reviews for the Times, I don’t know. Maybe if I had befriended him back then, he would not be the bitter misanthrope his is today. Maybe just an outstretched hand, a kind word, or a sharp, “Why don’t you stop being such a dick?” would have turned the tide of his life around. Alas, we shall never know.

Ferguson Ethics Train Wreck Catch-Up: The Shots, the Hashtag, the Huckster and the Snub

The Ferguson Ethics Train Wreck is slowing down now, though passengers keep getting on board and it will surely pick up steam again.

Here are some recent ethics outrages, as Ethics Alarms tries to keep up:

1. The Shots:

What’s wrong with this sentence? Don Lemon, CNN host, played a recording that was alleged to be of Officer Wilson shooting Michael Brown and preceded it by saying the tape had not been authenticated.

A burst of six shots can be heard, followed by a pause, and then several more shots, at least four. “He was in his apartment, he was talking to a friend on a video chat, he heard loud noises and at the moment — at the time he didn’t realize the import of what he was hearing until afterwards,” the lawyer for the unidentified man who made the recording told Lemon. “It just happened to capture 12 seconds of what transpired outside of his building.”

Almost immediately, speculation was rife that this called into question Wilson’s account, though we don’t know yet what that account is. IF the tape is accurate, this doesn’t look good for Wilson, opined one web reporter. Wait a minute! Why is CNN releasing anything that is not verified as authentic? Why not an unverified photo that purports to show a shadowy second shooter? Why not an unverified tape of Brown and a friend plotting to attack a police officer for fun? This isn’t evidence, and it isn’t news. It’s just chum in the water for a news media feeding frenzy, or more simply, crummy, irresponsible unethical journalism. Continue reading →

Bulletin: It’s Unethical For Government Officials To Use Twitter

Many law firms and other companies specifically prohibit their employees from using social media.  The reasons should be obvious: social media use is inherently reckless and unacceptably risky for professionals and those with high profile jobs. This is especially, and I would say fatally true of Twitter. It is an accident waiting to happen, and the more powerful the user, the more damage the accidents will be.

The latest example is the saga of Richard Stegel, Under Secretary for Public Diplomacy and Public Affairs at the U.S. Department of State. He used his personal Twitter account yesterday to comment on the crisis triggered by the downed airliner in the Ukraine, prefaced the tweet with the State Department’s Twitter handle, and ended it with the hashtag #UnitedForGaza, which would appear to indicate his support of the Palestinians in its violent clash with Israel.

Ethics Quiz, “Naked Teacher Principle” Division: The Alleged Naked Naval War College Professor

The AP reported that U.S. Naval War College professor John Schindler was placed on leave after a photo of a penis with the professor ‘s name over it was posted on Twitter.  It was unclear who sent it and who posted it.

After a blogger sent a complaint to the War College’s administration, the college’s president, Rear Adm. Walter E. “Ted” Carter Jr., ordered an investigation. A college spokeswoman said that investigators would look into whether the photo was not really of Schindler.

Now THAT should be an interesting investigation.

Schindler, a professor of national security affairs and a former National Security Agency intelligence analyst, has deleted his Twitter account. He has said his criticism of NSA leaker Edward Snowden and others has caused him to be the object of harassment on various social media.

1. Is it fair for the War College to place Schindler on leave before it has even been established that he sent the photo or that the body part in question belonged to him?

Ethics Dunces: The Idiot Who Pretends To Be Barack Obama On Twitter, Plus The Idiot Who Hired An Idiot To Pretend To Be Barack Obama, Plus The President, Who Apparently Doesn’t Know Or Care That He’s Being Impersonated By An Idiot

Let’s begin with the basics:  it’s unethical for the President to lend his name and office a Twitter account that purports to send out messages from him when in fact he neither sends out the messages nor approves them. It’s also stupid, and it’s unethical because it is stupid. A President’s credibility must be protected, by him and everybody else. If Obama isn’t sending a tweet, he shouldn’t permit an official tweet to go out that suggests otherwise. “Everybody” knows Obama isn’t sending the tweets, you say? If so, then why do so many Twitter users follow Fake Obama? Whether they believe it is him or not, he implicitly endorses and approves whatever is tweeted under his name. He is responsible.

From this follows the next point: it is irresponsible to hire a grade school drop-out to represent the President of the United States on the internet. Stating that Neil Armstrong walked on the moon in 1963 isn’t a typo: this was embodied in a graphic, and requires deep, frightening historical ignorance. I wouldn’t expect the President to have time to oversee this kind of petty operation, especially since he can’t find the time to oversee the I.R.S., the N.S.A, the V.A., the Secret Service, the Armed Services, or the Justice Department, all of which he should be holding to some standards of competence. I would expect, however, that whoever that supervision is delegated to would understand that making sure POTUS isn’t made to seem like Jessica Simpson on Twitter is paramount. I would also expect that the President himself would want to exert some effort to control the words others place in his mouth, as that would be the smart, responsible, professional and presidential thing to do.

But that is obviously expecting too much.

The Mind Of The Unethical Advocate: 41 School Shootings Just Isn’t Enough—Let’s Pretend There Are More

You have probably seen this map; it went viral on the internet almost immediately after it was first published on Twitter last week by  and editor at The Huffington Post. It purports to show the locales of the “1.37 deadly school shootings per week,” 74 in all,  that have occurred since the December, 2012 Sandy Hook massacre according to Everytown for Gun Safety. That is an anti-gun activist organization founded by Michael Bloomberg and Shannon Watts, and its release that “there have been at least 74 school shootings in America” since Newtown was just what the doctor ordered for the languishing gun control forces.

It’s an intentionally misleading number. Journalist Charles Johnson checked the facts, and these are not all “school shootings” in the sense that the public now understands the term and how honest journalists use it—episodes where someone brings a gun to a school and starts shooting teachers and kids. At least 33 of the “school shootings” just fit the conveniently broad definition used by Everytown for Gun Safety so as to make the strongest impression, fairness and truth be damned. They include not just Columbine and Newtown-type episodes, but also assaults, homicides, suicides, gang fights, and accidents involving guns that happened “inside a school building or on school or campus grounds.” Continue reading →

Ethics Dunces: The Republican Un-Tweeters

“Ha! They’ll NEVER find it now!”

Several Republican politicians leapt on the “Welcome Home Bowe!” bandwagon without bothering to a) learn the details and more importantly to them, sadly, b) gauge the reaction of their constituents, contributers and supporters.  Thus they tweeted praise for his release, perhaps echoing Obama’s designated liar Susan Rice’s unsupported assertion that he has served with honor, or evoking the Administration’s now discarded spin that he was a hero. When the transaction was revealed to be an utter botch by the Obama Administration (but I repeat myself), and the GOP officials realized that it would be partisan feeding time in the  shark tank, these brave public servants had neither the forthrightness to admit their errors, if errors they were, nor the courage to face the consequences.

Nor, unfortunately for them, the technological savvy to realize that trying to cover up what you put on the internet doesn’t work.

And makes you look like an untrustworthy sneak.

The Sunlight Foundation has a service called “Politwoops,” which collects elected officials’ tweets and makes them available if they are deleted in an effort to remove feet from mouths. It uncovered this, from Republican Senator Thad Cochran…

Michelle Obama’s Hashtag Mini-Train Wreck

The debate over Michelle Obama’s ill-advised foray into hashtag diplomacy–itself a misbegotten creature whose birth we will live to regret, if we don’t already–has turned nasty and stupid, and, of course, partisan, with the media, so incapable of objective analysis now that it hurts even to watch it pretend, rushing to defend the First Lady who walked right into this spinning blade, and should have known better.

Some observations and conclusions:

  • When the First Lady, any of them, presumes to wade into policy matters with the force of her husband’s office behind her, he is presumed to approve. When the policy matter involves international diplomacy, which, we hope, is carefully planned, whatever action or statement the First lady makes is indistinguishable from a Presidential action. Would the President of the United States appear anything other than weak and ridiculous if his response to any international crisis was to hold a sign in a photograph for Twiiter and make a frownie-face? No. Therefore, it was damaging to the President, the office and the nation for Michelle to tweet the same, but with her in his place, out to the world.
  • Two analogies, one real and one hypothetical, come to mind. In his short term of office, President Gerald Ford’s major domestic problem was exploding inflation, and he obviously had no idea what to do about it. His “program,” essentially, consisted of publicizing the mantra “Whip Inflation Now!,” most prominently embodied with the infamous “WIN” buttons. Ford was widely ridiculed by this exercise in futile gesture and magical thinking. He deserved it. Michelle’s stunt—it is a stunt—is redolent of Ford’s buttons.

The hypothetical: Imagine if the U.S. and the world’s (disgraceful and ) general policy of contrived ignorance of the Holocaust prior to our entering World War II was addressed by FDR having his “legs,” Eleanor, pose for a photo as she held up a sign reading “Save the Jews”…and frowning. Ethics Quiz: If There Is Going To Be A Racial Double Standard For Bigoted Statements, Can We Please At Least Know What It Is?

Item: Donald Sterling, billionaire owner of the NBA Clippers, while speaking with his mistress/girl friend/ escort in the bedroom, announces that he doesn’t want her bringing black men to Clippers games. In the process, he does not say anything specifically derogatory about African- Americans. He believes the statement is private, and that he is talking to someone he could trust.He was wrong. A recording of the conversation was leaked to the press, and Sterling has been roundly vilified as a vile racist, threatened with a boycott by the players, mostly African-American, in the NBA, fined 2.5 million dollars and banned from the game.

Item: Via Mike Wise, Washington Post sports writer—

“Following Wednesday’s Pacers-Wizards game in Indianapolis, during the time when NBA rules permit media members to be present, the music blaring in the Indiana locker room was filled with vile language: racist, homophobic and misogynist. Afterward, I complained on Twitter that if Commissioner Adam Silver truly wants an inclusive league, he ought to address this (common) practice.”

Result: Wise, who is white, was attacked as a racist. What NBA players listen to in the locker room is none of his business, he is told (but what Donal Sterling says in his bed room is their business.) The NBA has done, and is expected to do, nothing.

Item: Appearing on ESPN where he is a commentator, Charles Barkley, former NBA star (and an African-American), decided to deride the women of San Antonio, Texas as fat. “There’s some big ‘ol women down there,” said Barkley. “That’s a gold mine for Weight Watchers.” He added, “Victoria is definitely a secret. They can’t wear no Victoria’s Secret down there.” A spokesperson for a fat acceptance group protested:

“Making slurs about body size is just as offensive as making comments about body color. One would think being a black man, he’d be more sensitive to having his physical body criticized. It’s totally out of line. He should absolutely apologize.”

Barkley not only refused to apologize, but defiantly challenged anyone objecting to his remarks, jokes or future comments to “change the channel.”  Nobody expects Barkley to suffer any consequences from this series of events.

Item: In 2007, talk show provocateur Don Imus got into a facetious discussion with a broadcast team member about how te women’s basket ball team from Rutgers was “rough looking” and had some “nappy-looking ho’s.” He also referenced Spike Lee’s “Do the Right Thing,” and the film’s “Jigaboos vs.  Wannabes.” Imus apologized profusely, pronouncing the exchange inappropriate, thoughtless and stupid. Under pressure from various civil rights groups,  WFAN, which produced his show, fired Imus, who has never regained his previous prominence.

Item: In 2013, media professional Justine Sacco tweeted a race-based joke before boarding a plane to Africa: “Going to Africa. Hope I don’t get AIDS. Just kidding. I’m white!” A furious cyber mob condemned her as a racist, and demanded her punishment. When she landed in Africa, she learned that she had  been fired.

Jim Ardis, Mayor of Peoria, Uses The Police To Crush A Social Media Critic, But Never Mind, It’s Not Important Because He’s Not Racist

“OK, we know you have tweets in there! We’re coming in…”

This story is obviously trivial, because the news media doesn’t think it’s worth getting upset about. After all, it doesn’t involve race:

“PEORIA — Police searched a West Bluff house Tuesday and seized phones and computers in an effort to unmask the author of a parody Twitter account that purported to be Mayor Jim Ardis. The account — known as @Peoriamayor on the popular social media service that limits entries to 140 characters — already had been suspended for several weeks when up to seven plainclothes police officers executed a search warrant about 5:20 p.m. at 1220 N. University St. Three people at the home were taken to the Peoria Police Department for questioning. Two other residents were picked up at their places of employment and taken to the station, as well. One resident — 36-year-old Jacob L. Elliott — was booked into the Peoria County Jail on charges of possessing 30 to 500 grams of marijuana and possessing drug paraphernalia, but no arrests were made in connection with the Twitter account.”

The Twitter account was obviously a parody, if not an especially deft or clever one. After all, one would have to be a hopeless doofus, and an unusually dim one at that, to believe that the mayor of any city, even Toronto’s ridiculous Rob Ford, would happily tweet about his own drug use, crimes and corruption like the Twitter avatar of the Peoria mayor did.

Yet here was Mayor Ardis’s justification to reporters for his jaw-dropping abuse of power:

“I still maintain my right to protect my identity is my right. Are there no boundaries on what you can say, when you can say it, who you can say it to? You can’t say (those tweets) on behalf of me. That’s my problem. This guy took away my freedom of speech.”

Uh-huh. Show me a how “this guy” broke any law that justifies a police raid, you unbelievably arrogant, incompetent fascist.
