Ethics Quiz: Looters

Looting has been reported in Houston. There are not too many species of human detritus lower than those who take advantage of natural disasters to prey on their neighbors, so the question arises, is it ethical for a city government to order police to shoot them?

This question usually arises in the context of martial law. A curfew has in fact been declared in Houston to minimize the looting; presumably an announcement that looters will be shot on sight will be even more effective deterrence. There are good reasons to discourage looting with strong measures. The conduct threatens civilized society itself, because it is not civilized conduct. If looting becomes widespread, the rule of law is suspended, and worse crimes may follow. In a situation like Houston’s, looting also forces law enforcement to choose between rescuing property and rescuing people. If police openly make the choice to let looters loot while they devote their attention elsewhere, then Looting Season has been declared officially open.

Over the years we have occasionally heard that orders were given to shoot looters on sight, but few looters have been shot. Usually the order is enough, which suggests that the order to shoot is a bluff, but usually an effective one.

Police shoot unarmed citizens alarmingly frequently already, however: that’s one order that shouldn’t be given in jest. Presumably most looters are unarmed; I’m not going to concern myself with the question of whether armed looters can be ethically shot. The answer to that is yes, especially when they shoot at rescuers, as apparently some have in Houston. No, your Ethics Alarms Ethics Quiz of the Day is this:

Ethics Quiz: A Police Hypothetical From, Of All Places, “Diagnosis Murder”

Hallmark has launched an all-mystery channel, moving into the territory NBC’s Cloo cable channel abandoned when it went belly-up in February. (The name should have doomed it anyway.) The mainstays of the new channel are a fleet of “Murder She Wrote” rip-offs starring a string of female C-list stars TV and has-beens: Allison Sweeney, Candace Cameron Bure, Kelly Martin and Courtney Thorne-Smith so far. The flagship show is the real McCoy, Jessica Fletcher herself. Take it from me: there is no current scripted drama as trite, predictable or badly acted or written than “Murder, She Wrote”—the closest in years would be Debra Messing’s  idiotic “The Mysteries of Laura,” but that was officially a “comedy.”

Another mainstay on the channel is “Diagnosis, Murder,” which is marginally less terrible than watching in Angela Lansbury collect a check for doing the same thing over and over, in part because I am entertained by Dick Van Dyke doing anything.  ( “Diagnosis, Murder” was a drama, yet still about ten times funnier than “The Mysteries of Laura.” ) Still, I don’t expect thought-provoking episodes on the Mystery channel.

Two nights ago, I was surprised. The episode showed Dr. Dick’s police detective son (played by Van Dyke’s real son Barry, who sounds just like Dad) chasing a perp he had stopped while the man was roughing up a woman in  the park. Barry was chasing him on foot, gun drawn, and in the shadows (it was evening), the suspect quickly turned, stopped and pulled something metallic from his pocket. The officer fired, killing him. Barry’s troubled partner shows up (he had been backing up Barry) and checks the scene as police sirens are heard. He finds a flashlight, not a gun, right by the unarmed deceased man, and Barry says, mournfully, “I though the had a gun” His partner (played by Joe Penny) pulls a revolver out of his  own pocket, wipes it, and places it in the dead man’s hand as he pockets the flashlight. “Don’t worry,” he tells distraught Barry, contemplating his career going down the drain, “It’s clean,” meaning “It can’t be traced.”

The police arrive, and Joe quickly tells them that it was a good shooting, that the victim was armed. Barry knows that his partner has strikes against him already for substance abuse, and to rat him out about the flashlight would end his career for certain, and maybe Barry’s as well. He doesn’t say anything, thus becoming complicit in the cover-up.

From The “Saint’s Excuse” Files:The Catholic Church, Penn State, and Now Choate…What Have We Learned?

The renowned private boarding school school Choate Rosemary Hall, alma mater of such luminaries as John Dos Passos, Edward Albee, Glenn Close, multiple Kennedys and dozens more of the rich, famous and powerful, , just revealed that at least twelve former teachers had sexually molested, and in one case, raped, students without the crimes being reported to police. The pattern continued over decades. In some cases, teachers were allowed to resign after being confronted with evidence of abuse, and administrators wrote still letters of recommendations for them after they were fired. The predators then went to other schools, sometimes in positions of power and authority.

After the similar institutional conduct revealed by the Catholic Church and Penn State, does anyone believe that this is a rare occurrence in institution, including the most prestigious—and virtuous!—ones? The lesson is that established, powerful, iconic institutions are programmed to protect themselves above others, and regard their own missions and continued vitality more precious than any single individual, even a child.

Revisiting one of the most important of the Ethics Alarms’ 92 rationalizations:

13. The Saint’s Excuse: “It’s for a good cause”

This rationalization has probably caused more death and human suffering than any other. The words “it’s for a good cause” have been used to justify all sorts of lies, scams and mayhem. It is the downfall of the zealot, the true believer, and the passionate advocate that almost any action that supports “the Cause,’ whether it be liberty, religion, charity, or curing a plague, is seen as being justified by the inherent rightness of the ultimate goal. Thus Catholic Bishops protected child-molesting priests to protect the Church, and the American Red Cross used deceptive promotions to swell its blood supplies after the September 11, 2001 attacks. The Saint’s Excuse  allows charities to strong-arm contributors, and advocacy groups to use lies and innuendo to savage ideological opponents. The Saint’s Excuse is that the ends justify the means, because the “saint” has decided that the ends are worth any price—especially when that price will have to be paid by someone else.

A New Rationalization For A Slow Sunday: #57A The Utilitarian Cheat, or “If It Saves Just One Life”

On another thread, a reader attacked the Rationalization List <GASP!>,, the beating heart of Ethics Alarms, arguing that many of what are labelled rationalizations are valid justifications and cited as such on this very site. A vile canard! Of course many rationalizations can also be valid arguments for or against conduct. Take #59. The Ironic Rationalization, or “It’s The Right Thing To Do.” We do the right things because they are right, but we also have calculated why they are right, which means dealing with and rebutting the counter-arguments that might suggest those decisions are not right.  However, #59 addresses the frequent use of the “It’s the right thing to do” as a argument-ender, employing it as evidence when it really has to be a conclusion based on other evidence and analysis.

The latest addition to the Ethics Alarms Rationalization List does not have this problem. It is almost always a cheap rhetorical device, slyly edging what needs to be a clear-eyed, rational analysis of proposed conduct into the confounding realm of emotion. #57 A, The Utilitarian Cheat or “If its saves just one life” is a sub-rationalization under #57, 57. The Universal Trump, or “Think of the children!”  (It could easily be the other way around.)

#57 A. The Utilitarian Cheat or “If it saves just one life”

Invoking Rationalization #57A is as good a test as there is for identifying an untrustworthy demagogue. The claim that something is worth enacting, eliminating, establishing or doing is ethically and morally validates “if it saves juts one life” is aimed directly at the mushy minds of sentimentalists  and the dangerously compassionate. If the argument is made in good faith, the speaker is an incompetent dolt; usually it is the desperate last resort of a someone who has found that their real arguments are inadequate or unpersuasive.

The insidious trick inherent in the device is that we agree that human life is precious, and that we can not and will not place a dollar sign on a human being. The next step, however, in which a single life, or even many, is deemed justification for any expense or other draconian societal trade-offs, is impractical and irrational. It would save many lives if automobiles were built like tanks and could never exceed five miles an hour. Locking up ever angry husband that threatened the life of an estranged spouse with a menacing phone call would save many lives. So would forcing women to carry their babies to term, eliminating the right to have an abortion. Torture used without restrictions probably would save one life or more. Prohibition was sold using #57A.

All of these policy conundrums and many others are too complex by far to use simple-minded absolutism as their ethical guideline, and about 30 seconds of logical clarity will usually make that clear.  Those who employ The Utilitarian Cheat, however, don’t want clarity. It is an appeal to embrace acts that can do wide-ranging harm to society, civilization, human aspirations and liberty, because un-named lives can be saved. Though it is opposite of the exploitation of human life for other goals that Kantian ethics forbids, it is equally invalid.

Ethics Quiz: Italy’s New Strategy To Fight The Mafia

Anyone who has seen “The Godfather” I or II has a sense of the mafia culture in Italy. That wasn’t fiction; indeed, it was probably understated, and is strong as ever. Now legislators are experimenting with a radical new approach to fighting organized crime in the country, a deep-rooted pathology that has persisted for centuries.The strategy is draconian: separating children from their mob families and moving them to a different part of Italy to end a generational cycle of crime. Families are the heart of organized crime: the “Godfather” films’ portrayal was absolutely accurate on that score.

Italian magistrate Roberto Di Bella began taking children away from their criminal families after seeing children as young as 11 or 12 serving as lookouts during murders, participating in drug deals and mob strategy sessions, and learning how to shoot an assault rifle. “Sons follow their fathers,” he told New York Times reporter Gaia Piani Giani. “The state can’t allow that children are educated to be criminals.”

Di Bella began taking children away from parents convicted of mob ties five years ago,  separating about 40 boys and girls, ages 12 to 16, from their families. Sometimes the children’s mothers accompany them to the new locales. The rest of the embryonic mafiosi  go into foster care.Di Bella says that none of the children he has taken away from their families have committed a crime since, and impressed with his results,  Italy recently passed statutes that legalize the strategy as a way to destroy crime families.

Of course the program is controversial.  Di Bella, however, believes that it is a utilitarian necessity. He told the Times that mafia fathers have written to him to thank him for for giving their children a chance at a normal life, their children have told him they feel liberated, and mothers ask if he will do it for their children.

Self-Driving Car Ethics: Who Do They Decide To Kill? You?

CBS’s “Bull,” a drama about a jury consultant (played by “NCIS” alum Michael Weatherly) is an ethics mess…but then, so is the former jury consultant Weatherly’s  character is loosely  based on: “Dr.” Phil McGraw. The show does find some interesting ethics issues, however. A couple of weeks ago the story involved the programming in an experimental self-driving car. The issue: is it ethical for such a car to be programmed to kill its passenger if it has to make a life or death choice?

The ethical conflict involved is the so-called “trolley problem,” which is, as the name suggests, over a hundred years old. British philosopher Philippa Foot developed it into series of hypotheticals in 1967. In 1985, American philosopher Judith Jarvis Thomson scrutinized and expanded on Foot’s ideas in The Yale Law Journal. Here is one of Thompson’s scenarios:

“Suppose you are the driver of a trolley. The trolley rounds a bend, and there come into view ahead five track workmen, who have been repairing the track. The track goes through a bit of a valley at that point, and the sides are steep, so you must stop the trolley if you are to avoid running the five men down. You step on the brakes, but alas they don’t work. Now you suddenly see a spur of track leading off to the right. You can turn the trolley onto it, and thus save the five men on the straight track ahead. Unfortunately,…there is one track workman on that spur of track. He can no more get off the track in time than the five can, so you will kill him if you turn the trolley onto him.”

The problem: Now what, and why?

A. Throw the switch in order to maximize well-being (five people surviving is greater than one).
B. Throw the switch because you are a virtuous person, and saving five lives is the type of charitable and compassionate act a virtuous person performs.
C. Do not throw the switch because that would be a form of killing, and killing is inherently wrong.
D. Do not throw the switch because you are a Christian, and the Ten Commandments teach that killing is against the will of God.
E. Do not throw the switch because you feel aiding in a person’s death would be culturally inappropriate and illegal. Continue reading

A New Poll Shows That President Elect Trump’s Popularity Is “Soaring”…GOOD!

Yes, it’s that cognitive dissonance scale again! See, if the nation and the U.S. Presidency is +10, and a newly elected POTUS was -3 before being elected, what happens?

Ann Althouse, who blogged about the poll, seemed surprised. “Why do you think this happened?” asks the astute, well-educated, presumably historically informed law professor.

Why? Because that’s the way it’s supposed to work, and that’s the way it has always worked, that’s why. I explained this phenomenon here, to the jeers of skeptics. I also wrote, “Most people don’t understand the Presidency or their own culture,” though I’m a bit surprised that it applies to Ann. In the original post about the vicious attempts on the Left to undermine the new President before he has even taken office, I explained,

“Americans have always realized that the slate is cleared when someone becomes President, and that the individual inherits the office and the legitimacy of that office as it has been built and maintained by it previous occupants. He (no “he or she” yet, sorry: not my fault) becomes the symbol of the nation, the government and its people, a unique amalgam of prime minister, king and flag in human and civilian form. That immediate good will, respect for the Presidency, and forgiveness of all that went before has made the transfer of power in the US the marvel of the world, and has kept the nation from violence and division. It is part of our strength as a society. It is part of the election process, and a vital one.”

Let me quote the Gallup piece I cited before, backing this up:

“In general, the American public rates all new presidents positively — all have received majority approval in their debut ratings — though Obama is clearly near the top of the list. The three presidents who took office after the death or resignation of their predecessors tended to start out with even greater public support, as the nation rallied around the new chief executive in times of crisis. These include Harry Truman in 1945 with an 87% approval rating, Lyndon Johnson with 78% in 1963, and Gerald Ford with 71% in 1974.”

The new POLITICO/Morning Consult poll of registered voters found that 46% of voters now have a very favorable or somewhat favorable opinion of the previously reviled Trump.  Now only 34%  have a very unfavorable opinion of him, with 12% somewhat unfavorable. Continue reading

Ethics Dunce Collective: The American Music Awards

I can make this uncharacteristically short. Just re-read the post on John Oliver’s nasty full-show, post-election anti-Trump rant, and substitute “American Music Awards.” Also worth reviewing is the list of rationalizations used to justify Oliver, which I posted here, especially since so many of them are also being trotted out to excuse the ambushing of Mile Pence when he dared to exercise his right to enjoy “Hamilton” on Broadway without being personally called out and attacked by the cast.

It can be argued that the American Music Awards’ insults to the duly and lawfully elected POTUS—who has yet to do anything as President— last night were even worse than Oliver’s disrespectful ad hominem barrage. At least Oliver, a skilled satirist, was occasionally amusing. The two AMA hosts from Saturday Night Live were juvenile, desperate and amateurish, counting on their Trump-hating demographic for laughs they didn’t earn. If we ever see a more inept impression of Donald Trump than Jay Pharoah’s, be it in four years or a century, I’ll be shocked. Worst of all, however, was Gigi Hadid’s unfunny, mean and hypocritical imitation of Melania Trump, for the crime of existing.  The principle, just for application to Republican First Ladies, now, is apparently that having an accent  makes you ridiculous and an idiot.

If anyone, anywhere, on a live television show had dared to do such a grotesque mockery of Michelle Obama when she was the incoming First Lady, they would have been tarred a boor, a racist, and a virtual traitor.

I wonder which of the rationalizations will be used to defend Hadid? Whatever they are, the real defense is just this, the same that is being used to defend “Hamilton”: We hate these people, and they don’t deserve to be treated fairly.

Got it.

One clarification: Green Day is a political band, and their decision to shout No Trump / No KKK” during their performance of the catchy and tuneful  “Bang Bang” is as fair as it was predictable…also moronic, but what do you expect? It’s a band.

Revelations From The John Oliver Video Post: What I Have Learned

light-bulb PREFACE: I have just returned from a crazy three day odyssey that had me lecturing on Massachusetts legal ethics in Boston, Washington, D.C. legal ethics in the nation’s capital, and, professional ethics, legal ethics and accounting ethics in Tucson, Arizona. Keeping pace with ethics developments was even more difficult than it usually is when I’m on the road, because I had almost no time in between flights, meetings and various hassles to get to a newspaper, surf the web, or watch TV. And my browser kept crashing.

I wrote the John Oliver post, frankly, as low-hanging fruit. His performance was vile and hateful, barely funny, self-indulgent, and disrespectful in a damaging way, and I didn’t think, and still don’t, that there should be much disagreement on that assessment. I expected the usual “lighten up,” “he was only joking “[he was NOT only joking], and “he has right to free speech” comments, because I always get those any time I point out that a comedian has been unfair and irresponsible. I did not expect,for the post to get more single day traffic than all but one previous Ethics Alarms entry, and so many comments, many of which with troubling social and political significance. I returned to my office to find more comments waiting for moderation than have ever been there at one time, and I apologize for that: I try to get them cleared withing hours if not minutes. Of course, a disproportionate number of them were garbled nonsense, or just invective with no point whatsoever. They didn’t make it.

I also had some tough calls, with repetitious comments that misrepresented the post, made irrelevant or factually mistaken assertions, and also were abusive. I fear that I may have been inconsistent, and perhaps less tolerant than usual, and I’m not referring to the occasional comment I allowed to be published just to show the kind of comments that weren’t being posted. The problem is that this site is a intended to be a colloquy, and poor quality comments just make the threads hard to read, and also undermine the site.

I may have to be more ruthless in moderating comments in the future. I’m thinking about it.

“The Ethicist” Endorses Vigilantism

No, you can’t scam the scammers….

I haven’t been monitoring the New York Times’ “The Ethicist” column as much as I once did. After the original author of the feature, Randy Cohen, was jettisoned, the various ethicists, pseudo-ethicists and imaginary ethicists the Times recruited to fill his  slot have ranged from inconsistent to incompetent, and I stopped checking regularly until recently. Now the column has a real ethicist, for once: Kwame Anthony Appiah teaches philosophy at N.Y.U., and wrote “The Honor Code: How Moral Revolutions Happen.”  He seems to be thorough and explains his analysis using valid ethical systems. He’s a vast improvement over his immediate predecessors, but he goofs too.

A questioner asked about how he should handle scammers who tricked his father out a check. He wrote offering a threat and a settlement. They were to  return half the money, or he would report them to the consumer-affairs division of their state’s attorney general’s office and the Consumer Financial Protection Bureau, register complaints on websites and generally see that they suffered for their fraud.  His demand: send  a certified check, made out to his father, by the deadline. It worked; he got the amount requested, and the check cleared.

“But it was not certified, and it arrived after the due date,” he wrote. “Do I have an obligation to uphold my end of the deal, by not registering complaints about an outfit that is clearly scamming elderly people?”  Continue reading
