Major Ethics Alarm: American Journalism Is Crumbling Before Our Eyes [Part 2: Sounding The Alarm]

The analysis below was preceded by Part I: Signature Significance. I suggest reading it first. After listing and commenting on several recent examples of news media bias and incompetence, the post ends with the Ethics Alarms starting point for ethical analysis:

What’s going on here?

What’s going on is pretty terrifying. There is literally no major news media outlet that isn’t biased and untrustworthy, and the profession does not appear to care. Is it denial? Is it terrible training? Is it a misguided sense of mission? Arrogance? Whatever it is, it is res ipsa loquitur–it speaks for itself.

Don’t argue that the news media isn’t always wrong or constantly allowing partisan bias to skew its reporting: the point is the same as what Ethics Alarms explained in its Snopes post.  Once bias is manifest, the reliable reporting must occuring spite of that pollution, and there is no way for the public to know when it is being informed according to proper journalism ethics, and when it is being manipulated. The examples above are egregious. They would not have been permitted even 20 years ago, and yet now they are.

This doesn’t require much acumen to spot the problem, or elaborate measures to address. Look at the examples in Part I. How hard is it to figure out that once a reporter has been shown to be colluding with one party over another, it’s “Bye-bye and welcome to the baby zoo animal beat!” If it is so impossible for a Sunday news show to find four expert commentators who aren’t in Trump-freak-out mode, it’s time to upgrade the potential guest pundit list. When an anchor wildly mistates a fact like the McConnell quote that has been repeatedly debunked, 1) correct it, 2) apologize, and 3) give her a few days off without pay. How hard is that? It’s not hard, unless the entire profession is so devoid of ethical training and habits that it literally doesn’t know how to be honest, objective, fair, competent and responsible…you know, as in trustworthy.

Professions are obligated to police themselves. It shouldn’t be a conservative media watchdog site like Newsbusters that reveals Camerota’s unconscionable repetition of the long-debunked claim that Republicans vowed to obstruct Obama “from Day One”, it should be CNN’s competitors, or CNN. Brian Stelter, CNN’s own media watchdog, didn’t report on any of these episodes, because he has been dedicated to playing defense for his network, denying that news media bias exists. Major Ethics Alarm: American Journalism Is Crumbling Before Our Eyes [Part 1: Signature Significance]

…and without trustworthy journalism, democracy cannot survive.

There was reason to hope that following its beyond miserable performance in its coverage of the campaign and election just concluded, American journalism would respond to reality and dedicate itself to repairing its broken relationship with traditional professional ethics. Poll after poll shows that the news media’s standing with the public has never been lower. Because the profession itself ought to be more keenly aware than anyone of how vital honest, fair and competent journalism is to the health of a democracy, one would expect that this would be a moment demanding brutal self-examination and rapid reform.

This is not what we are seeing, however. Consider:

  • Last weekend, ABC’s Jonathan Karl interviewed Donna Brazile in a New Year’s Day review of the election. I couldn’t believe it. She was introduced as a respectable commentator with no acknowledgment of her role in the Clinton fiasco and the news media’s disgrace. As Ed Morrissey wrote,

Why is Jonathan Karl interviewing Brazile in the first place? …It has been 62 days since CNN severed their ties with Donna Brazile over the fact (no longer an “allegation”) that she cheated during one of the Democratic presidential primary debates and attempted to cheat during a second one in Flint, Michigan. And yet ABC News is inviting her to sit down for a casual New Years Day chat like any other political analyst.

CNN shouldn’t have allowed her to be a staff member to begin with, since she was a partisan political operative. She used that relationship and exploited her conflict of interest to try to do what she could to  rig the election. She was exposed, lied by denying it, and fired. Now, after the election, she behaves as if nothing has changed, and ABC again presents her as a reliable analyst.

  • After WikiLeaks’ publication of emails from the Democratic National Committee and Hillary Clinton campaign chair John Podesta revealed collusion and shockingly unethical ties between prominent journalists and the Clinton campaign, as well as the campaign openly referring to such journalists as allies, none of the journalists so exposed have been disciplined, nor have any of the news organization employing them indicated that they were so much as troubled by the revelation.

“If That Was Transparency, Then I’m A Kumquat” And Other Reactions To Josh Earnest’s Multiple Unethical Christmas Quotes

This morning, Obama Administration paid liar Josh Earnest spoiled my Christmas mellow by telling CNN’s alleged news media ethics watchdog Brian Stelter that there’s really “no constituency in American politics for transparency in government beyond journalists,” as he deflected Stelter’s accounts of journalists complaining about administration foot-dragging on Freedom of Information Act requests. Then he really curdled the ethicist’s eggnog by saying,

“If this constituency of journalists are gonna be effective advocates for the issue that they care about, they need to remember that they have a responsibility not just to criticize those who are not living up to their expectations. Any activist will tell you that the way that you get people to support you and to support your cause is to give them credit when the credit is due, to applaud them when they do the thing that you want them to be doing.”

Finally, Earnest molded my mistletoe by claiming,  “President Obama has been the most transparent president in American history.”

Stelter, of course, being an incompetent, biased and unethical news media ethics watchdog, did not interjection with the mandatory, “WHAT??? You’ve got to be kidding! HAHAHAHAHAHAHAHAHA ACK! ACK! ARRRGH! and drop dead in shock.

That statement is fake news if anything is, rivaling the news media lie that that the Obama years were devoid of major scandals. Before we begin shooting fish in a barrel and deal with that brazen-beyond-belief spin, let’s pause to consider the other stunner in Earnest’s Christmas morning performance:

1. What does Earnest mean that journalists are the only constituency for transparency? Does the Obama administration, and by extension Democrats, really believe that the public doesn’t mind being lied to? If so, that explains a lot, including the nomination of Hillary Clinton.

2. Journalists are not supposed to advocates and activists at all. They are supposed to be devoted to communicating facts and the truth.

3. Is Earnest saying that when a President generally defies a pledge of ethical conduct, he should nonetheless be praised when he doesn’t defy that pledge, and that journalists should highlight the Administration’s rare examples of  transparency while ignoring the overwhelmingly more copious breaches? It sure sounded like it.

That brings us back to the mind-melting quote that this has been a transparent administration by any definition of the word other than “not transparent at all.”

This episode from 2011 nicely encapsulates the issue:

“President Obama was scheduled to receive an award from the organizers of the Freedom of Information Day Conference, to be presented at the White House by “five transparency advocates.” The White House postponed that meeting because of events in Libya and Japan, and it was rescheduled…That meeting did take place – behind closed doors. The press was not invited to the private transparency meeting, and no photos from or transcript of the meeting have been made available. The event was not listed on the president’s calendar…Nor is the award mentioned anywhere on the White House website, including on the page devoted to transparency and good government. Were it not for the testimony of the transparency advocates who met secretly with the president, there wouldn’t seem to be any evidence that the meeting actually took place.”

That’s right: Obama wasn’t transparent about a transparency meeting. That same day, Obama went on TV  and tried to explain why he hadn’t been transparent to the U.S. Congress about his military plans in Libya.  Shortly after that, news leaked that the Fed had secretly sent billions in loans to foreign banks during the financial crisis.

Ah, memories! On his second day on the job, January 21, 2009, that…President Obama famously pledged, in one of his first memos to federal agencies

“We will work together to ensure the public trust and establish a system of transparency, public participation, and collaboration. Openness will strengthen our democracy and promote efficiency and effectiveness in Government.”

He may be right about that last part, or maybe he discovered that it was naive and impractical dream. Under no circumstances, however, can it be said that Obama’s administration was transparent. “Fake News” Friday Continues! Episode II: The CIA Says Russia Was Helping Trump [UPDATED]

Yes, those emails.

(No, it wasn’t illegal, just incredibly unethical.)

It all began with this story in the Washington Post:

“The CIA has concluded in a secret assessment that Russia intervened in the 2016 election to help Donald Trump win the presidency, rather than just to undermine confidence in the U.S. electoral system, according to officials briefed on the matter.

Intelligence agencies have identified individuals with connections to the Russian government who provided WikiLeaks with thousands of hacked emails from the Democratic National Committee and others, including Hillary Clinton’s campaign chairman, according to U.S. officials. Those officials described the individuals as actors known to the intelligence community and part of a wider Russian operation to boost Trump and hurt Clinton’s chances.”

When the New York Times later came out with a story headlined  “C.I.A. Judgment on Russia Built on Swell of Evidence,” non-partisan law prof/blogger/ skeptic Ann Althouse inquired, as the mainstream news media did not, whether the content of the article supported that headline “because there’s so much fake news these days.” (Ann is funny.)

She wrote in part,

“There’s a lot of material in the article that is not about [ Russia helping Donald Trump win]  at all. I’m excluding that, which is padding if the headline is the correct headline. Go to the link if you want to see what it is. The first relevant material comes in the 16th paragraph: The DNC’s servers and John Podesta’s email account were hacked and a lot of damaging and embarrassing material was released onto the internet.

“Next:

American intelligence officials believe that Russia also penetrated databases housing Republican National Committee data, but chose to release documents only on the Democrats. The committee has denied that it was hacked.

“So here’s the crucial disputed question of fact: Were the GOP servers also hacked? We’re not told what evidence supports the belief that the GOP servers were also hacked, but the GOP says they were not. Yet some “intelligence officials believe” it was. Why? Where’s the “swell of evidence” you were going to tell me about?

“Even if that fact were nailed down, there would still be more leaps needed to get to the conclusion. First: Was there any embarrassing material? What? If I knew what, I could begin to think about the next question: Why would embarrassing material be withheld? All I can see from the supposed “swell of evidence” here is an assumption that if the DNC was hacked, the GOP committee was also hacked, and that if bad material was found in the DNC server, bad material would also be found in the GOP server, and since we only saw the DNC material, there must have been a conscious decision — by whom?! — to leak only the DNC things and that decision must have been made to help Trump win. That’s not evidence itself, only inference based on evidence.

“Finally, there are a few paragraphs about why “Putin and the Russian government” might be thought to prefer a Trump presidency to a Clinton presidency. Trump and Putin have given each other some compliments.

“That’s no swell of evidence! That’s a lot of leaping guesswork. And this is nothing more than I already read in the article the NYT put out on December 9th, which I put effort into combing through and rejected for the same reasons I’m putting in this new post.

Sanctioned Race And Gender Bias In Tort Compensation?

I was going to make this an ethics quiz, but there really is only one answer. The practice is ethically indefensible, and noxious too. The only question is how and why it is still occurring.

One reason may be that not enough people know about it. I certainly didn’t. Kudos to the Washington Post for shining light on a terrible, and terribly unethical, practice.

The American tort system frequently uses race and gender statistics to calculate the damages victims or their families should receive in compensation after someone is catastrophically injured or killed by another individual’s negligence or misconduct. Experts are allowed to testify regarding what a particular victim might have achieved and earned during their lives, were they not dead, or brain-damaged, or paralyzed. Race and gender are among the factors allowed into that calculation.

Writes the Post:

As a result, white and male victims often receive larger awards than people of color and women in similar cases, according to more than two dozen lawyers and forensic economists, the experts who make the calculations. These differences largely derive from projections of  how much more money individuals would have earned over their lifetimes had they not been injured – projections that take into account average earnings and employment levels by race and gender.

Debate Ethics: Trump’s “Breathtaking Repudiation Of American Democracy”

Substance, of course, is officially irrelevant to the 2016 Presidential election. This is a bitter “be careful what you wish for” realization for Ethics Alarms and its author, as I have long argued that leaders’ values and character are more important and should be given more weight in any choice of candidates than their political affiliations or official policy positions. I did not foresee  a race in which both candidates have definitively proven that they are unfit for office and corrupt beyond repair or redemption, and one of those candidates is so unfit that even the epic dishonesty and democracy-corroding conduct of his opponent cannot begin to justify a vote for him by anyone with the sense of a bivalve mollusk.

Thus, once again as in the first two debates, the leading story coming out of last night’s snark-fest relates to character, not substance. In this case, it doesn’t even relate to practical reality. Donald Trump was asked by debate moderator Chris Wallace,

Your running mate Governor Pence pledged on Sunday that he and you, his words, will absolutely accept the result of this election. Today your daughter Ivanka said the same thing. I want to ask you here on the stage tonight, do you make the same commitment that you’ll absolutely accept the result of the election?

..and after talking around the question interminable, as usual, Trump finally answered,

What I’m saying is that I will tell you at the time. I’ll keep you in suspense, okay?

Hillary Clinton immediately pronounced the answer “horrifying,” and her assessment is currently being echoed on editorial pages and by pundits and analysts as if Trump announced that he was raising an army of NRA members to take the White House by force. Gasped the Washington Post this morning, in an editorial titled, “Trump’s Breathtaking Repudiation of American Democracy,” “Respecting the will of the voters has since the end of the Civil War allowed for a peaceful transition of power that has made this country the envy of the world….[Clinton’s flaws] fade to the status of trivia in the face of an opponent who will not accept the basic rules of American democracy.”The New York Times, in its editorial titled “Donald Trump’s Contempt for Democracy,” pontificated,

Mr. Trump’s meltdown in the closing weeks could be dismissed as a sore loser’s bizarre attempt at rationalizing his likely defeat. But his trashing of the democratic process, in service of his own ego, risks lasting damage to the country, and politicians of both parties should recoil from him and his cynical example.

It in no way excuses Donald Trump to take notice of the “breathtaking” dishonesty here.

Collusion…But Then, As The Times Reminded Us, “These Are Not Ordinary Times,” So It’s OK

Over the weekend as the  2016 campaign’s first Presidential debate loomed, four news organizations published major stories pronouncing Donald Trump a liar, and essentially conferring on the Rationalization #22-ish Hillary “She’s not the Worst Liar” endorsement.

This was a new maneuver in the mainstream news medias full and open opposition of Trump that has left objectivity, neutrality and American journalism ethics in the dust. First came the The New York Times attack—the Times, as the flagship of U.S. journalism, had already given its blessing to biased coverage—with its “A Week of Whoppers“on Saturday. Politico, The Washington Post and The Los Angeles Times all followed the leader in short order. (Or followed orders in short…never mind, that doesn’t quite work.)

Contacted by a curious but gullible Brian Stelter, CNN’s biased but maybe a little less biased than he might be “media watchdog,” publication editors who were involved swore the timing was, as John Travolta says in “Face-Off,” “a  coinkydink!” Marty Baron, the executive editor of The Washington Post, told Stelter indignantly, “We don’t coordinate coverage with anyone else!”

“The four stories were welcomed by the Clinton campaign,” Stelter wrote.  “Aides cited the statistics in television interviews on Sunday.  However, there is no indication that the Clinton campaign was involved.” (That’s my emphasis, if you couldn’t tell.) Continue reading →

No, Washington Post, This Isn’t The Unethical Lawyer’s Statement You Falsely Suggested It Was

Lyle Jeffs, the polygamist religious leader indicted in a huge food stamp fraud, violated his house arrest this summer by coating his ankle monitor in olive oil, sliding it off, and vanishing. As his lawyer, Jeffs’s  public defender attorney cannot help authorities find her missing client (nor can she assist Jeffs in eluding the police). Thus Kathryn Nester filed court documents last week asking for a continuance, writing,

“As this Court is well aware, Mr. Jeffs is currently not available to inform his counsel whether or not he agrees to the Continuance. Whether his absence is based on absconding, as oft alleged by the Government in their filings, or whether he was taken and secreted against his will, or whether he experienced the miracle of rapture is unknown to counsel.”

Washington Post reporter Cleve R. Wootson Jr. describes this development as follows:

“Jeffs’s attorney has put forth a divine reason for his disappearance — the miracle of rapture..”

If  Nester really did claim that the Rapture was the reason Jeffs vanished, she would be engaging in sanctionable dishonesty and a misrepresentation to the court. The one who is lying, however, is Wootson and, as his editors let him do it, the Post. All Nester said was that she did not know why Jeffs was missing, and mentioned three of many alternative fates that she had no knowledge of whatsoever. Her job is to try to defend him from additional criminal charges, and at this point, that means arguing that nobody can say with certainly that he is a fugitive from justice. That is the opposite of saying “one of these things happened.” It is saying “I don’t know what is behind his disappearance, and neither does the FBI. Here are three of many explanation that I cannot, based on my knowledge, rule out.” Continue reading →

KABOOM! The Washington Post Really Lets A Reporter Publish A Story Saying That Bill Clinton “Allegedly” Cheated On His Wife.

Unbelievable.

UNBELIEVABLE!

Here is the quote, from today’s Washington Post Magazine. I’m looking at it right now, wiping pieces of my brain and skull off the pages. (And the Marshall household just cancelled its subscription to the Post, after 35 years):

In a puff piece by by reporter Neely Tucker called From Wild Bill to Supportive Spouse: Can Clinton stick to his script?, we see this, in reference to poor, misunderstood, underappreciated Bill Clinton:

“He allegedly cheated on his wife, repeatedly, even in the Oval Office, and with a young woman who wasn’t that much older than their daughter.”

“Allegedly”?

“Allegedly”??

“Allegedly”???

“Allegedly” means claimed but unproven. The claims of Paul Jones, Kathleen Willey, and Juanita Broaddrick of, respectively, sexual harassment, sexual  assault and rape are indeed unproven and alleged only. Not the affair with Lewinsky, however. Clinton admitted it. Lewinsky confirmed it. An investigation documented it in nauseating detail. Clinton refers to it in his autobiography. There is DNA evidence, for God’s sake!

Using “allegedly” at this stage has no possible effect but to cast unwarranted doubts on the truth. What else can it be but a dishonest effort to try to mitigate the undeniable sleaziness of Bill Clinton, and the hypocrisy of his wife, who has enabled and facilitated his sexual compulsions throughout his political career, all while posing as a feminist champion? There are many young voters who are both ignorant and naive, who Clinton needs to have going to the polls for her. Such outrageous dishonesty by the Post can only be designed to make them disregard the ugly facts about Clinton’s despicable use and abuse of Lewinsky as just typical right wing rumors.

Post editors allowed this. They allowed it! When is the use of “alleged” the same as a lie?

Incredibly, the damning phrase links to a column by the Post’s own Factchecker, in which he describes the Lewinsky affair as documented ( along with FIVE others!)

The  corruption of American journalism is complete. Democracy has no chance, when journalists feel they can lie and deceive to make certain that their candidates win and their candidates prevail. All I can do is cancel this once-great newspaper that cannot be trusted to tell the truth about anything at this point. That’s not nearly enough.

Of course, this smoking gun proof of journalism’s betrayal of the public trust comes to us through the efforts of Bill and Hillary Clinton, and the party they have thoroughly corrupted.

Of course.

 

Update: Unethical Research, Unethical Headline, Unethical Media Report: “Many Parents Will Say Kids Made Them Happier. They’re Probably Lying”

Reader and commenter Alexander Cheezem issued an energetic objection to my post about another happiness study, which you can read, along with my rebuttal, in the comment threads to the post, here. His main two complaints were that I didn’t read the study itself, and that I unfairly called it  policy advocacy disguised as objective social science research.

I didn’t read the study itself because the only link the Post provided was not accessible without joining a service I didn’t care to join, or take the time trying. Alexander kept referring to a “direct link,” an unfortunate and misleading description of a link that goes to a page with a link to the study that doesn’t respond when you click on it, and are directed to “register.” [ CORRECTION: This is what I thought at the time. It has been pointed out to me that the first time the reporter linked to “research,” it wasn’t the study she was writing about, but another, behind a paywall. The second link on “research” did go to a live link to the actual study. Having been frustrated once, I assumed that the second link would also be to the same  inaccessible link. My error—though I’m furious at the Posts’s incompetence—and I apologize to Alexander.]

I am relieved to find that reading the entire study revealed nothing that I didn’t discern from what the Post reporter wrote, and checking the accessible links she provided. (Obviously, it would have been preferable to read the whole study initially, and I would have, if a functioning link was provided, as it should have been.). Let me take that back a bit: the study itself was worse than I thought.
