How To Get Banned From Ethics Alarms: A Case Study

I just spammed nine attempted comments from a would-be participant here calling himself by the confidence-inspiring name of “Muh.” As sometimes happens, he discovered us and began posting comments everywhere. Here is a representative sample:

1. On the “Frontrunners” post: “The funniest part about Ted Cruz is that he pretends he’s an outsider and the rubes fall for it. But one look at his resume and you can see this guy is as well connected as anyone. If only everyone who ever met him didn’t hate him, he’d probably already be President!”

Why it was rejected: This is a pure political comment, with no ethics content whatsoever. That’s not what this blog is here for. Go to Mediaite, the Daily Kos, or Politico for gratuitous, cynical, fact-free candidate-bashing.

2. Comment on the same post: “This article, well you can see where the author seems to be. You want to talk about these three, and you leave off Ted Cruz who’s basically talked about nuking the Middle East? Give me a break.”

Why it was rejected: Accusing me of pro-Cruz bias, or pro-anyone bias, based on this or any post is unjustified. I chose those three because they are far and away the front-runners, and for no other reason. I have not shied away from ctiticizing Ted Cruz. If a commenter is going to accuse me of bias, he or she had better check the blog archive first. And Cruz said no such thing.

Ethics Dunces: Professor Robert Donald Weide, And Any University That Employs Him

crushing dissentThe results of the Curmie Award vote are up at Curmudgeon Central, where blogger Rick Jones tracks episodes of supreme embarrassment for his profession, education. I think next year’s winner may have already arrived. It’s not that I can’t imagine worse conduct by an educator—I have a lively imagination—it’s just that the conduct California State University, Los Angeles (CSULA) professor Robert Donald Weide is an apt symbol of why U.S. higher education is no longer a solution to anything, but a tragic problem in itself. There is no reason, none, why any school shouldn’t immediately sack a faculty member who behaves like this. If the issue is tenure, then tenure needs to be abolished. Tenure should not shield campus fascists.

What did Weide do? CSULA’s branch of Young Americans for Freedom, a conservative political organization, dared to invite Ben Shapiro to give a lecture called “When Diversity Becomes a Problem” about such emerging issues as Black Lives Matter, “microaggressions,” “safe spaces,”  trigger warnings and other assaults on free speech on campuses and elsewhere. Naturally, since the topic is an important and legitimate one, many at CSULA are attacking the event and arguing it should be blocked by the university, citing trigger warnings, safe spaces,  microaggressions, and, of course, the ever-useful censorship concept of “hate speech.”

Perhaps here is as good a place as any to note that I wouldn’t cross the street to listen to Ben Shapiro, and wouldn’t do so even before his website, Breitbart, decided to shill for Donald Trump. That, however, doesn’t alter the fact that he is every bit as worthy of a campus speaking gig as Lena Dunham, Bernie Sanders, Sean Penn, or the Pope. Continue reading →

There was ample evidence over the past week that all three of the candidates currently leading their respective party’s races for the presidential nomination are unqualified for the office by virtue of their deficiencies of competence, character, and principles. Hillary Clinton had the most spectacularly revealing week, but first, the other two….

Donald Trump: Hubris, incompetence, disrespect and unfairness

1. “I could stand in the middle of 5th Avenue and shoot somebody and I wouldn’t lose voters,” Trump boasted at a campaign rally yesterday. I know, it’s a joke. It’s also an astoundingly stupid thing to say, even in jest, and reveals massive hubris, the quality that brought down many a Greek king and the worst and most dangerous of all Trump flaws. This is what will get him, sooner or later. 3000 years of history and literature teach us that. The comment also reveals utter contempt for his supporters; he is essentially calling them blind morons. The crowd in Iowa laughed….because they are.

2.“Our great veterans are being treated terribly,” Trump says in a new campaign video. “The corruption in the Veteran’s administration, the incompetence is beyond. We will stop that.” Then critics pointed out that the clips used showed Russian veterans, not Americans, and he pulled the ad.

This is the man whose only claim to legitimacy is his management wizardry. Such an error, however, is proof of sloppy oversight and incompetent delegation. Moreover, this is the second time a Trump campaign ad  included mislabeled material: his illegal immigration ad earlier this month used footage of people crossing the Moroccan border to represent the U.S.-Mexico border. Conclusion: he’s faking it, “it” meaning everything. This is all posturing and bluffing, like a student taking an exam for a course he never studied for. Continue reading →

Ethics Observations On The Academy’s Pro-Diversity “Fix”

Apparently panicked by the negative reaction to its all-white 2016 Oscar nominations,  and determined not to give MC Chris Rock more ammunition than he already has, the Academy of Motion Picture Arts and Scientists has rushed into place new voter qualifications for next year’s awards. Under the new rules, members who have not worked over the past 30 years  will lose the right to cast Oscar ballots unless they have been nominated for an Oscar themselves.

What’s going on here?

1. Is this substituting real bias for unfairly assumed bias?

Sure it is.

As one soon to be disenfranchised voter told the Hollywood Reporter, “The Motion Picture Academy, in the spirit of Affirmative Action (which has worked so well in our universities), is determined to take the Oscar vote away from the Old White Guys…Personally, I wish they’d examine their complex preferential ballot procedure which clearly isn’t working right. But no, blame the Old White Guys.” Others noted that to assume older voters, many who were at their peak during the rebellious Sixties and the Civil Rights Era, weren’t voting for black artists was foolish. The new rules seem to be an obvious attempt to stigmatize and penalize older voters.  The seniors, said one dissenting Academy member, are often “perfectly vibrant and very much with it and, while they may be retired, it doesn’t mean they aren’t functioning on all cylinders. They have earned the privilege of being in the Academy through their work and just because they’re no longer active doesn’t mean that they can’t be a good judge of what they’re looking at.” Former actress Delores Hart, who gave Elvis Presley his first screen kiss and who was the top-billed star of “Where the Boys Are?,” was direct, saying,  “It’s age discrimination.”

Of course, Hollywood has long-accepted age-discrimination, and Saturday Night Live would never skewer the Oscars for that. Continue reading →

X-Files Ethics: There Is Nothing Weird About Offering Scully One-Half Mulder’s Contract

Gillian Anderson reported that when the producers approached the actress about reprising her co-starring role in the re-boot of “The X-Files,” she was offered only one-half of the salary that her male partner, David Duchovny, had agreed to. From the Daily Beast’s shocking account:

The work Anderson put into securing equal pay back in the ’90s seemingly came undone when it came time to negotiate pay for this year’s event series. Once again, Anderson was being offered “half” of what they would pay Duchovny.“I’m surprised that more [interviewers] haven’t brought that up because it’s the truth,” Anderson says of the pay disparity, first disclosed in the Hollywood Reporter. “Especially in this climate of women talking about the reality of [unequal pay] in this business, I think it’s important that it gets heard and voiced. It was shocking to me, given all the work that I had done in the past to get us to be paid fairly. I worked really hard toward that and finally got somewhere with it.

“Even in interviews in the last few years, people have said to me, ‘I can’t believe that happened, how did you feel about it, that is insane.’ And my response always was, ‘That was then, this is now.’ And then it happened again! I don’t even know what to say about it.”

That’s all right, Gillian. I know what to say about it. This was not unfair, disrespectful. or an example of discrimination against women in the workplace. This is called negotiation, and there is nothing unethical about it at all.

From The “Ethics Isn’t Easy” Files: The FBI, Child Porn, And “Playpen”

key-computerIn order to probe “the dark web” and to apprehend those partaking of the pleasures of child pornography, the FBI emulated the illegal conduct of hackers, using a warrant to surreptitiously place malware on all computers that logged into a site called Playpen. When a user connected, the malware forced his computer to reveal its  Internet protocol address. Next a subpoena to the ISP  yielded his real name and address, and a another warrant allowed a subsequent search of the user’s home. Incriminating evidence, indictments and trials followed.

The problem of tracking computer related crime is far ahead of the law, and in the vacuum, ethical principles are being nicked, mashed, or ignored. Ahmed Ghappour, a professor at the University of California’s Hastings College of the Law, says, “It’s imperative that Congress step in to regulate exactly who and how law enforcement may hack.” If hacking is illegal, and wrong as an uncontested intrusion on privacy, when is it ethical, and thus legal, for law enforcement to do it? No, I’m Not Angry, And No, I Don’t Hate The Clintons, And Yes, I Know What You’re Doing By Claiming Otherwise

A website linked to Ethics Alarms last week, and inadvertently exposed me to some nasty critics*, one of whom wrote  that among other transgressions, I “really hate the Clintons” and am “a very angry person.”

I know what this is, and I enshrined the technique as Rationalization #48. Ethics Jiu Jitsu, or “Haters Gonna Hate!”:

This vintage of obnoxious rationalization is recently pressed. Its objective is to turn the tables on legitimate critics of unethical conduct by asserting that it is the act of criticism itself that is wrong, thus allowing the object of the criticism to not only escape unscathed, but to claim victim status... The politically-motivated legal monstrosities known as “hate crimes”  have inspired this rationalization by making it plausible to argue that dislike itself is wrong, even when what is being disliked, criticized or hated is objectively wrongful conduct. All “haters” are lumped together, whether the object of hate is Lance Armstrong’s cheating, the NFL’s conspiracy to hide the effects of concussions, or Barack Obama’s ineptitude, in a linguistic trick that suggests that sincere critics are no different from people who hate the United States, minorities, decency, true love and puppies. They are all haters, hate is bad, and it’s the haters who are the problem, not the corruption, dishonesty, and betrayals they criticize…

I don’t hate the Clintons. I have no emotional investment in the Clintons at all, any more than I am filled with hatred for Donald Trump, Melissa Harris-Perry, Bill O’Reilly, Kim Davis, Nancy Pelosi, Harry Reid, Mitch McConnell, Michele Bachmann, Debbie Wasserman Schultz, Carol Costello, Barry Bonds, Tom Brady, the NFL, PETA or any of the targets of intense criticism here. Hate is a powerful emotion, and it leads to irrational decision-making. This is a blog dedicated to ethics, which requires rational decision-making. Hatred leads to bias, and bias makes us stupid. The Academy Awards nominations flap has been gradually acquiring Ethics Train Wreck Status. Naturally, since it involves race (black artists didn’t get their quota this year, whatever that quota is–it’s a secret quota, but clearly zero isn’t it) and thus an opportunity for him to get some publicity, Al Sharpton weighed in with sputtering outrage, calling for a boycott of the Oscars. Then Spike Lee announced a personal boycott, making no sense in the process, rapidlly followed by Jada Pinkett Smith, who really made no sense, writing,

“Begging for acknowledgment or even asking diminishes dignity and diminishes power. And we are a dignified people. And we are powerful. Let’s not forget it. So let’s let the Academy do them, with all grace and love. And let’s do us.”

Gibberish. What is throwing a tantrum and boycotting your industry and profession as it honors itself and your colleagues’ art because  the people you really care about—those of the right color, you know— didn’t get a nomination, if it isn’t demanding recognition, which is as pathetic as asking or begging for it, just more obnoxious?

Next her husband, Will Smith, who looks like a poor sport by doing so, followed her lead, muttering inappropriate platitudes. He said, “There is a position that we hold in this community, and if we’re not part of the solution, we’re part of the problem.” If you say so, Will. Causing racial division in your profession and sabotaging its big self-promotion night is part of what solution, now?

In ethics train wrecks, all passengers live to regret it. Over at Fox News, panelist and former “Clueless” actress Stacey Dash suggested that black actors had nothing to complain about as long as they participated in blacks-only honors, like the BET Awards, and the NAACP Image awards. What was that supposed to mean? That Oscar should be all-white, since there are all-black awards? Is this a plug for separate but equal? Her argument was incoherent, so naturally Donald Trump endorsed it, saying, and I quote, “Blah, blah, blah, blah…” Among the blahs, he noted,

“So over there — the whites don’t get any nominations, or don’t get — and I thought it was an amazing interview, actually. I never even thought of it from that standpoint. But with all of that being said, it would certainly be nice if everybody could be represented properly…”

The Crime That Can’t Be Charged: Humiliation And Harm For Money

I hate this topic with a passion. It has come up often: the exploitation of desperate attention-addicts in celebrity reality shows, dwarf-tossing, the ancient pastime of paying geeks and the deformed to present themselves for public ridicule and dehumanizing treatment, and more. The problem is that the phenomenon is indistinguishable from other, societally-approved examples of paying individuals to harm themselves or be humiliated for our entertainment. Pro football, of course, harms more human beings in one game than all the dwarf-tossing since the beginning of time. Child actors are harmed for money, and often they don’t even get the proceeds, or give meaningful consent.

Every example I can imagine feeds directly into the vile Rationalization #22. The Comparative Virtue Excuse: “There are worse things.” The problem is that all of those worse things are legal, and likely to remain so. Yes, there are worse things than paying a drunk to dance like fool in exchange for a few dollars to buy his next drink, like paying young men millions of dollars to pound their brains into jelly. That’s our national pastime!

And yet—how can a society tolerate this? From the AP...

LAKEWOOD, N.J. (AP) — Police in New Jersey say no charges will be filed after a stranger paid a homeless man $5 to pour coffee on himself twice. Police say that’s because Ronald Leggatt consented even though he was embarrassed. The 65-year-old tells the Asbury Park Press he let a stranger videotape him pouring coffee on his head on Monday in Lakewood because he needed the money….

I wish I had a solution. I’d like to know the name of the scum who did this, but then what? Post his name for vigilante justice? I would argue that there is no valid consent when an individual agrees under duress and desperation, but then what is society saying—that a man can’t exchange a humiliating act for money he desperately needs? The Chris Davis Saga: How Much Money Is “Enough”?

I have too many political issues on the runway, and I’m about to be buried in snow. This seems a perfect time to reflect on Chris Davis, the slugging Baltimore Orioles first baseman who just re-signed with the team in a seven-year, $161 million deal. Yes, he’s a baseball player, but the ethics issue here is not confined to baseball, or even professional sports.

Two weeks ago, it looked as if Davis and the Orioles were at an impasse. The team had, we were told, offered a take-it-or-leave-it 150 million dollar package, and Davis and his agent had turned it down. Davis’s manager, Buck Showalter, told the press that he had asked Davis, who by all accounts loves playing in Baltimore,”How much is enough?”:  “I asked Chris during the season, ‘Chris, when you walk into a Target store, can you buy anything you want. So, how much is enough?'”

Sportswriters, not being reflective sorts,  even the smarter ones, who are always taking the players union’s position that the more money a player can squeeze out of fat cat owners the better, jumped on Showalter. Said CBS writer David Brown, “Showalter trying to shame him into taking less — so that ownership can keep more — is shameful in itself. Why isn’t Showalter asking Angelos ‘ How much is enough?'”*

Showalter, who is one of the most intelligent and perceptive people in the game, was not trying to shame Davis. He was trying to get him to think; he was trying to impart some wisdom…and some ethics. Continue reading →
