“On “The Weekend” this week, [Jonathan]Capehart set a new low even for him. He was so horrified by the President making the quip about surprise and Pearl Harbor in front of the Japanese Prime Minister—standard fare for Trump, who enjoys doing and saying quiet parts out loud and doesn’t care who is offended—that he railed,
“I sometimes wonder, why are we not having a 25th Amendment conversation about this president?Because a comment like that, if it had come out of the mouth of President Biden, we would have been in rolling coverage about how Republicans on the Hill think that he should be removed from office for talking to an ally like that, and making that comment in response to a question from a Japanese journalist.”
“I know I could spend all my time on Ethics Alarms pointing out the astoundingly flagrant bias and Trump Derangement displayed by members of the Axis media, but Capehart’s idiocy in this instance is epic. Let’s see…
1. As I noted during Trump’s first term, the Democrats’ Presidential Removal Plan E, ”Trump is mentally ill so this should trigger the 25th Amendment,” surfaced repeatedly in his first term, “supported” by now fired Yale psychologist Bandy Lee, who violated her profession’s ethics code by pronouncing a diagnosis of a “patient” she had never met. I described this particularly unethical tactic as based on “the old Soviet theory that anyone who disagrees with the authority, in this case, progressives, must be crazy.”
“As soon as Trump was nominated again in 2024, the Trump Deranged began claiming that he was just as demented as Biden, whom they had insisted was “sharp as a tack” in defiance of almost daily evidence to the contrary. How can Capehart say “we” (as in “other Axis tools”) are not having the discussion that they have never stopped having for a decade? Easy answer: because Jonathan is a shameless hack, that’s how.
“2. A “comment like that” coming from Biden would have convinced me that he had more remaining brain cells than I thought. The kinds of comments that demonstrated to anyone with a clear mind and receptiveness to reality that poor Joe was mentally unfit for the Presidency were his babbling, “Look, I wouldn’t have picked Vice-President Trump to be vice-president if I didn’t think she was qualified to be President,” or “We finally beat Medicare.” Arguably bad taste jokes are not evidence of cognitive disability.
“3. Columnist Matt Margolis accurately explains how foolish Capehart’s argument is:
“…Joe Biden spent three and a half years in the White House with the mainstream media doing everything possible to cover for his cognitive decline. It wasn’t until his disastrous debate that they finally admitted he had problems.
“In fact, MSNOW (then MSNBC) spent years assuring viewers that Joe Biden was sharper than ever. In March 2024, Joe Scarborough infamously delivered one of the most embarrassing media monologues in cable news history. “I’ve said it for years now: he’s cogent,” Scarborough insisted. Then he decided that wasn’t enough. “But I undersold him when I said he was cogent. He’s far beyond cogent. In fact, I think he’s better than he’s ever been intellectually, analytically.”
“Scarborough wasn’t done. “Start your tape right now, because I’m about to tell you the truth,” he ranted. “And eff you if you can’t handle the truth. This version of Biden, intellectually, analytically, is the best Biden ever. Not a close second. And I’ve known him for years. The Brzezinskis have known him for 50 years. If it weren’t the truth, I wouldn’t say it.”
“Of course, it was a total lie. And it wasn’t just MSNBC either. The entire left-wing media apparatus spent years running interference for Biden, whose decline was visible to anyone paying attention. They mocked concerns, dismissed critics, and kept the blinders firmly in place. Now, the moment Trump cracks a historically grounded joke in a diplomatic setting Capehart wants to dust off the 25th Amendment?
“Democrats and the liberal media have been floating the idea of invoking the 25th Amendment against Trump since his first term, and it’s as laughable today as it was eight years ago. They’re not serious people; they just hate President Trump.”
… Indeed. Do you know who else never uttered a word about Joe Biden’s obvious mental decline? Kim Wehle, though she is ABC’s official legal expert! But she wrote this last week in The Hill, and the headline there is pure deceit. The “legal expert” whose niche is explaining Constitutional Law for people who couldn’t get through law school somehow manages to argue that “Trump must be removed” when if she fairly explained the 25th Amendment (she doesn’t) it would be clear that it does not apply, and that exercising it on Trump would be impossible. See, I explained this regarding Joe Biden even though he had as much business working in the Oval Office as Spuds because I do have integrity, writing,
“Jonathan Turley issued an excellent blog post explaining why the 25th Amendment is highly unlikely to be successfully employed to send our declining President into retirement. Do read it, but the short version is that if a President is sufficiently compos mentis to object to his removal for being incapacitated (or has staff acting on his behalf to do it), the 25th Amendment’s elaborate procedures all but guarantee that the effort will fail because going forward would require a 2/3 majority in both Houses of Congress. The amendment contains significant safeguards against the 25th Amendment coup scenario that “the resistance” and Democrats were pushing when Trump was President.(I should have made this point back when Ethics Alarms was analyzing the dishonesty of 25th Amendment arguments by the Trump-Deranged during his term.) One particularly significant statement by Turley: “The various experts and pundits who called for Trump’s removal under the 25th Amendment are notably silent this week, even after [Biden’s] own Justice Department cited his diminished faculties as a reason for not charging him.”
The Amendment was drafted to deal with a President who literally couldn’t function, like Reagan immediately after his assassination attempt, Woodrow Wilson after his stroke, and the fake President played by Harrison Ford in “Air Force One,” when his Cabinet believes he is being held hostage. Why then does Wehle, a constitutional expert, write in the Hill and her substack that something must happen that can’t happen? Easy: she does it because she wants to undermine Trump. The evidence is right on her resume: she writes for The Bulwark, the NeverTrump cabal of bitter Republicans like George Conway. A President who can handle interviews with angry journalist propagandists like Kristin Welker is simply not “disabled” within the meaning of the 25th, and Trump wouldn’t have crossed that line even if he said “We beat Medicare.”
Wehle’s substack piece is self-rebutting. Her central argument is that the “thirty-six medical professionals whose statement was entered into the congressional record by Democratic Senators Sheldon Whitehouse and Jack Reed called for use of the 25th Amendment, citing Trump’s access to the nuclear codes. We should pay attention.”
To those guys? Whitehouse is beneath contempt—his shameless perfidy just came out again as he endorsed The Maine Nazi.[See here, item 5] Reed claimed President Trump was “crazy” in July of 2017!
Of course, we know that 36 members of any profession Democrats usesin their appeal to authority are suspect: remember those unimpeachable 51 former intelligence and national security officials who signed a 2020 open letter stating that the publication of emails from Hunter Biden’s laptop had “all the classic earmarks of a Russian information operation”? Sure you do. Wehle’s list had a human smoking gun on it, and if the lawyer knew what she was talking about, she would never appeal to a group that included the infamous, thoroughly discredited Bandy Lee, who was fired by Yale for being unethical.
But it did.
