Gretchen Carlson is suing Fox News Chair Roger Ailes for retaliating against her for refusing his sexual advances. I don’t know whether her allegations, which are disturbing to say the least, are true. The most sensational of them is her claim that Ailes, when she came to him to complain about sexual harassment from her co-hosts on “Fox and Friends,” said, “I think you and I should have had a sexual relationship a long time ago and then you’d be good and better and I’d be good and better.”

Cowabunga.

Ailes denies her account, but then, he would whether it was true or not, for that statement is pure, unadulterated sexual harassment by all by itself.

Indeed, a sexual harassment lawsuit against Fox by Carlson once would be such a slam dunk that it is interesting that she never brought one. I stopped watching “Fox & Friends” in part because Carlson was harassed almost every day by co-hosts Seven Doocy and Brian Kilmead, and it made me angry, and to some extent angry at Carlson for putting up with it.

In 2009, Carlson  complained to a supervisor that Doocy “had created a hostile work environment by regularly treating her in a sexist and condescending way, including by putting his hand on her and pulling down her arm to shush her during a live telecast.”  Indeed he had. You can see examples of this repeated and juvenile conduct here and here. In her suit, Carlson says that her co-hosts had been “mocking [Gretchen] during commercial breaks, shunning her off air, refusing to engage with her on air, belittling her contributions to the show, and generally attempting to put her in her place by refusing to accept and treat her as an intelligent and insightful journalist rather than a blonde female prop.” To this, Ailes reportedly told Carlson that she was a “man hater” and “killer'”and said  that she needed to learn to “get along with the boys.”  Continue reading

Update: CNN Is Doing It Again

On CNN just now, “New Day” interrupted its coverage of the ambush and murder of five police officers last night to go to a Minnesota demonstration in response to the police shooting of Philando Castile . The girl friend and family of Castile were front and center; in the background, along with a throng of African-Americans (exclusively) we heard a woman weeping loudly and uncontrollably. (“Hey, Joe, see if you can make that sobbing as loud as possible. This is great!”)

The segment went on and on, longer, in fact, than any segment previously shown regarding the deaths of the Dallas police officers. We were told by the angry demonstrators that Castile was murdered (undetermined at this time, in fact), that “everything was on the video” (the video began after the shooting) and that local officials were incapable of fairly investigating. We were made to understand that the shooting was racially motivated (there is, at this time, no evidence to support this.) Typical of the whole scene was the statement made and supported by several individuals in the protest, that the coronor had ruled the death of Castile a “homicide,” so this means that the police officer must be charged with murder. Crowd: “Yes!”, “Uh-huh,” “That’s right!”  Interviewer Chris Cuomo: “____” This is how you make all of America more ignorant, CNN. “Homicide” means only that Castile died from being shot: he was killed; he did npt die of accidental or natural causes. It does not mean that he was illegally shot, or murdered. Cuomo had an obligation to correct them, and if he thought that it would be too “insensitive” to correct misinformation being broadcast to millions, then he shouldn’t do the interview, or is in the wrong profession.

I suppose that there is always the chance that Cuomo doesn’t know that homicide and murder are not synonymous. There is a lot he doesn’t know. Continue reading

No, Don’t Fire Jesse Williams; Just Mark Him As The Ignorant, Racist Hate Merchant He Is

African-American actor Jesse Williams attracted national attention at the BET Awards last month as he accepted the  BET Humanitarian Award. Williams launched into the racist black activist version of Authentic Frontier Gibberish, sending out sufficiently loud anti-white dog-whistles that he received a standing ovation from the throng. In response, a petition was placed on Change.org demanding that he be fired from his role on the inexplicably long running ABC medical drama “Grey’s Anatomy”:

“Jesse Williams spewed a racist, hate speech against law enforcement and white people at the BET awards. If this was a white person making the same speech about an African American, they would have been fired and globally chastised, as they should be, but there has been no consequences to Williams’ actions. There’s been no companies making a stand against his racist remarks and no swift action condemning his negative attitude. Why was Burke’s character fired from Grey’s Anatomy after his inappropriate homophobic slur, but nothing for Jesse Williams? Why the one-way street? Why the support for a hater? Why the hypocrisy? #AllLivesMatter All humans bleed the same color. #EqualConsequences4RacistBehavior”

The reference to “Burke’s character” ( Helpful Tip: When you are making a pitch in a petition, take the time to check your facts so people know what the heck you are talking about) was a reference to African-American actor Isaiah Washington, who was fired from his role as Dr. Preston Burke on  “Grey’s Anatomy”  in 2007 for using homophobic slurs in public, including The Golden Globes telecast, and on the show’s set.

Petitioning to have someone fired for their political opinions is an ethically-dubious enterprise at best, but the allegation of a double standard is apt, because it is a double-standard. The culture nourished by Barack Obama and his political-correctness obsessed regime accepts anti-white rants as legitimate and honorable, but holds the expressing of anti-gay sentiment as grounds for shunning and destruction. Writes professional gossip columnist, celebrity worshiper  and silly person Perez Hilton:

“True, Isaiah Washington did ultimately get fired for saying hateful homophobic slurs — but comparing that to Williams’ uplifting speech about equality (that had everything to do with why he was on stage accepting his humanitarian award in the first place) doesn’t make much sense at all.”

Let’s clean that up a bit, shall we? Hilton, who is not only gay but incredibly gay, thinks that homophobic slurs are disgusting and therefore should forfeit the right to make a living, but anti-white diatribes are “uplifting,” so the comparison doesn’t make sense to him.

More Fourth Of July Ethics: PBS Deceives Its Audience, And Calls It A “Patriotic Thing To Do”

I hate writing posts like this. I hate the fact that the culture’s appreciation of the importance of integrity, honesty and transparency has declined so much during the Obama Administration that I have to write posts like this.

PBS’s annual coverage of the nation’s Capital’s Independence Day celebration from U.S. Capitol was handicapped by the overcast and drizzly weather in the area.  At the point in the show where the National Symphony Orchestra plays the 1812 Overture’s finale while a spectacular fireworks display explodes over the Capitol dome, someone in authority decided that the obscured fireworks  partially blocked by clouds weren’t good enough, so  a video compilation of previous years fireworks were interspersed with them without any disclosure.

To be clear, what happened was this: PBS intentionally deceived its audience, and presented old footage while representing what was on the screen as live.

Social media noticed immediately. “PBS Aired Old Fireworks Footage This Year. Did It Make A Difference?” asked various media commentators, in various forms. Gee, that’s a head-scratcher!  Huh. Tough one! Does it make a difference when a government-funded station deliberately sets out to deceive its viewers? Do lies matter? Is it okay for a broadcast of a live event to be secretly altered with film from a different time and event? Does it make a difference if the news media lies to the public?

Of course it makes a difference. It’s wrong. It’s a lie. It makes public trust impossible. What’s the difference between faking a moon landing and faking a fireworks display? Ethically, they are exactly the same, what we in the ethics field refer to as lies. Continue reading

No, Ashleigh, That Isn’t “Libel,” And Why Are You Hosting A CNN Show Called “Legal Affairs” When You Don’t Know That?

In an epic clash of incompetents, CNN’s Ashleigh Banfield challenged Michael Cohen, one of Donald Trump‘s advisers over his retweeting an internet meme that said that Hillary Clinton “murdered” the victims of the Benghazi mission assault.

After the House Benghazi Select Committee released its final report on the 2012 terror attacks, Cohen delivered his tweet featuring this…

It is about as stupid, lazy and inflammatory as most political memes, and the fact that Cohen would think it worth circulating tells us all we need to know about both him and the man who pays him, who would have probably tweeted this junk himself if Cohen hadn’t. Remember Cohen? He’s the Trump lawyer who crudely threatened the Daily Beast and went on to proclaim that spousal rape was legal, when it isn’t. Cohen is, by definition, a thug, a creep, and a crummy lawyer. Naturally, he’s also a Trump advisor. (Tell me again how Trump, that keen judge of legal talent,  can be trusted to appoint better Supreme Court justices than Clinton would. Or that Honey Boo-Boo would.)

Sparring with Cohen on her show “Legal Views,” Ashleigh Banfield lectured the lawyer and told him, “This is libel.” thus making exactly as accurate a statement of law as Cohen’s earlier one about spousal rape. It was not libel. It was inflammatory political speech in a satirical context (would anyone think Clinton actually said this, as the meme suggests?) about a public figure, clearly an opinion rather than a statement intended to be taken literally, and no more libel than “Bush lied and people died.” Banfield’s diagnosis was 100% wrong, and the fervor with which it was delivered is the calling card of a Clinton defender. The “Ghostbusters” Remake Controversy

The fact that I even know about this issue is both my reward and punishment for being a popular culture junkie.

To bring you up to date: Since the stars of the classic movie comedy “Ghostbusters” are now collecting Social Security (and one of them—Harold Ramis— is dead), Hollywood’s only sensible option to try to squeeze some more profit out of the property (and maybe introduce it to a new generation) was to remake the 1984 film. This was a risky enterprise, for even the sequel with the original cast more or less recognizable was a disappointment, and remakes of classics are inherently dicey. If an original film really was special and the stars truly stars, forcing younger contemporary stars to step into iconic shoes is asking for not just trouble, but humiliation. Poor Alex Cord, for example, never recovered from being cast as The Ringo Kid in a misbegotten remake of  1939’s “Stagecoach,” where he was supposed to replace John Wayne. It can work, as with Jeff Bridges’ turn as Rooster Cogburn, not only a Wayne role but the one that got him an Oscar, only if the remake is sufficiently excellent and different enough in tone and purpose that the original and the remake can co-exist without compelling unflattering comparisons. (“True Grit I” is a funny John Wayne valedictory with a great story; “True Grit 2” is more faithful adaptation by the Coen Brothers of a wonderful novel. I still like the original better.)

The best option, though, is often to make the reboot different in appearance and feel by switching race or gender. This is also helpful when everyone over the age of 13 has seen the original on TV about ten times already. The scheme attracts a new audience, ideally—the first “Ghostbusters” had a male teen demographic—and allows the remake to refer to the first version without seeming like pale copy. Almost never are the non-traditional casting versions big hits, but they can be quietly profitable. “Ghostbusters,” moreover, is a merchandising machine. The original spawned cartoon versions and action figures. Why wouldn’t the new movie?

However this is 2016 America, and everything is political as well as partisan. An all-female remake of “Ghostbusters” was launched with feminist swagger. The new version starring Melissa McCarthy (love her) , Kristen Wiig (great)  and Kate McKinnon ( also great), excellent comic actresses, given good material, would show that women can and do everything men can do—fight ghosts, make hilarious supernatural movies, be President of the United States. The July opening in an election year was no coincidence; it is part of the Hollywood effort to join the media’s efforts to make Hillary President despite, well, her lack of fitness to lead.

Although the usual naysayers when a classic is recast were immediately critical, most moviegoers were enthusiastic about the project. I know I was. Then the trailer came out. It is bad (you can watch it above). We are used to seeing great trailers for movies that turn out to be boring and horrible, but good movies with terrible trailers are rare because making previews has become a fine art.

The strikingly unfunny “Ghostbusters” trailer was especially ominous for a comedy. The usual method for hyping a mediocre comedy is to put all the funny bits in the trailer; I hate that, don’t you? Not only is the whole movie an unamusing slog with 6 minutes of laughs in 90 minutes of filler, but you’ve already seen the best gags. What does it say, though, when a trailer for an alleged comedy isn’t funny, and worse, the gags included don’t appear to be as side-splitting as the movie’s makers seem to think they are?

Dear Guy In My Legal Ethics Seminar: No, Gene Autry Was NOT A Pornographer, And Shame On You

In a legal ethics seminar last week, I was talking about ethics codes and referenced Gene Autry’s version of The Cowboy Code as an example of how most ethics codes could be easily adapted to other professions. I noted that Gene had an amazing career for such an unimpressive looking and sounding performer, with five stars on the Hollywood Walk of Fame, the only individual with that many. (Live performance, radio, TV, movies, and recordings).

“He was also a big producer of pornography!” an elderly lawyer in the front row piped up.

“What?” I said. “Gene Autry? Where did you hear that?”

“Oh, it’s true,” he insisted. “Made him a lot of money. He covered it up pretty well, but the truth came out.”

“Well, I’ll check on that. If true, it’s disillusioning. Thanks.”

But it was not true. I have a lot of material–Gene was active in both show business and Westerns, as well as baseball, so his career was and is very interesting to me—and I searched it and the web for any hint of a pornography reference. I can’t even find a web hoax alleging it.

Not only did that unsolicited bit of false biographical information undermine the point I was making about ethics codes, it spread false information about, by every account, a very nice man and an idol to millions. Now almost a hundred people have it in their heads that the guy singing “Rudolph the Red-Nosed Reindeer,” “Here Comes Santa Claus,” and “Back in the Saddle Again” left the studio and filmed orgies.

I don’t know who the guy was that did that to Gene, but it was an irresponsible, reckless thing to do. You can’t make a statement like that in public and smear a great man’s reputation unless you are absolutely certain of your facts.  Obviously he wasn’t sure of them, because they are complete fiction. It’s the kind of thing Donald Trump would say.

A couple hundred famous singers and musicians have banded together to sign a fatuous and misleading “open letter” to Congress dictating U.S. gun policy. The letter which is being used as a publicity gimmick by Billboard (and the stars, of course), reads:

As leading artists and executives in the music industry, we are adding our voices to the chorus of Americans demanding change. Music always has been celebrated communally, on dancefloors and at concert halls. But this life-affirming ritual, like so many other daily experiences—going to school or church or work—now is threatened, because of gun violence in this country. The one thing that connects the recent tragedies in Orlando is that it is far too easy for dangerous people to get their hands on guns.

We call on Congress to do more to prevent the gun violence that kills more than 90 Americans every day and injures hundreds more, including:

  • Require a background check for every gun sale
  • Block suspected terrorists from buying guns

Billboard and the undersigned implore you—the people who are elected to represent us—to close the deadly loopholes that put the lives of so many music fans, and all of us, at risk.

The letter is many things:

1. It is scaremongering nonsense. Gun deaths are way down, and the odds of any citizen being killed in a mass shooting is beyond minuscule. Based on 2015 statistics by the broadest definition, you have a 0.00000143% chance of getting killed in a mass shooting. These wealthy and privileged people, who often have bodyguards (with guns) have much less of a risk than that. Nothing is “now threatened.” We are safer from gun violence now than five years ago, ten years ago or 20 years ago. Continue reading

Calling balls and strikes in major league baseball has to be mechanized. This is obvious and beyond argument, and the only question is what will finally make the bitter-enders abandon their rationalizations and capitulate to reality.

I last wrote about this in 2012 in a post titled “Umpire Accountability, As the Day Of The Robot Approaches,” following a 1-0 game in which a batter in a position to tie the game was called out on strikes by an umpire named Larry Vanover, who rang him up with three balls out of the strike zone for the final 9th inning out. This particular contest was between two teams that had finished the previous season with one of them edging out the other for the play-offs by a single game, on the last day of the schedule. The pitches called strikes in this particular at bat weren’t even close to being over the plate. You could see that all three were wide with the naked eye as they arrived in the catcher’s mitt; you could see it in the computer graphic on the screen, and after the game, the pitches’ locations were charted to show that they were, in fact, balls. Baseball fans invest too much time and emotion into following the games and their teams to just shrug off results warped by obvious incompetence. The kind of atrocious umpiring demonstrated by Vanover…poses a direct challenge to baseball’s integrity. What will baseball’s leaders do about it?

They have only three choices:

1.They can, for the first time, take public and punitive action against umpires whose poor performance exceeds a missed call or a human mistake, and demonstrates inexcusable incompetence or a lack of professionalism. First time: a stiff fine. Second time: a suspension without pay. Third time: dismissal.I know that the umpires union in Major League Baseball protects its incompetents as zealously as the teachers unions, but baseball has its product to protect.

2. Baseball’s leaders can make a commitment to automated strike and out calling, and cut back on crews to one field umpire to keep order and one booth umpire to read the printouts, watch the TV screen, and study the replays.

3. Baseball can reject integrity and credibility, and continue to let the Vanovers on the field wreck the games and alienate fans.

So far, disgracefully, the sport has chosen #3, but the clock is ticking. Continue reading

Signature Significance: Katie Couric “Regrets” The Deceptive Editing Of Her Anti-Gun Documentary, But Isn’t Going To Fix It.

Today Katie Couric made all of her defenders look just as bad as I said they were.

“I can understand the objection of people who did have an issue about it,” Couric said at TheWrap’s Power Women Breakfast in New York this morning, when asked to address the intentionally deceptive editing in “Under the Gun,‘ the anti-gun documentary she produced. “Having said that, I think we have to focus on the big issue of gun violence. It was my hope that, when I approached this topic, that this would be a conversation starter.”

She then said that the documentary will not be re-edited to fix the lie it contains.

This is signature significance: all by itself, it proves beyond a shadow if a doubt that Katie Couric is a dishonest journalist. No more evidence is needed, for an honest journalist would never make this choice. Not once, not ever.

“The objection of people who did have an issue about it” clearly states that Couric herself had no “issue with it,” meaning that, as I wrote, she only regrets the controversy, not the lie. Continue reading
