I decided to start with the Best in Ethics this year, in contrast to other years, on the theory that it would get things off to a positive start in 2014. What it did, instead, was make me realize how negative Ethics Alarms was in 2013. Either there wasn’t much positive going on in ethics, or I wasn’t seeing it. My thanks to those of you who send me nominations for Ethics Heroes (and other stories); even when I don’t write about them, they are valuable. Please keep them coming. In the meantime, I pledge to try to keep the jaundice out of my eye in 2014. Things just can’t be as dire as they seemed last year.

Most Important Ethical Act of the Year:

The U.S. Supreme Court declared the Defense of Marriage Act unconstitutional, paving the way for the universal legalization of gay marriage. Yes, it was a legal decision, but it was also based, as all such culturally important decisions are, on a societal recognition that what was once thought to be wrong and immoral was, in fact, not. This is ethics, an ongoing process of enlightenment and wisdom about what is right and wrong, and the U.S. Supreme Court did its part. Continue reading

The White House Scores A 2013 Jumbo Jumbo

There’s no elephant. Do you see an elephant?

Just in time to make the 2013 cut-off, the White House achieved the Jumbo of the year, and simultaneously made me wonder if I am going to have to jettison all respect for my loyal Obama-supporting friends.

The Jumbo is an Ethics Alarms category lunched in 2013, designed to recognize individuals who engage in spectacular examples of unethical conduct I have always detested with a special passion: trying to wiggle out of a tight spot by stubbornly insisting that what is obviously the case isn’t really, a brazen exercise resting on the presumption that everyone else is either a dimwit or as corrupt as the speaker. The name derives from an iconic moment in Billy Rose’s 1936 Broadway musical extravaganza “Jumbo,” named after P.T. Barnum’s famous giant elephant, that starred Jimmy Durante. Caught red-handed as he tried to sneak his dying bankrupt circus’s major asset off the premises and away from creditors, the “Old Shnozzola” was confronted with a sheriff who belligerently inquired, “Just where do you think you’re going with that elephant?” Jimmy’s response, acting for all the world as if the massive pachyderm at the end of the rope he was holding didn’t exist: “Elephant? What elephant?” Another apocryphal equivalent is the old burlesque joke about the philandering husband caught by his wife as he frolics in their bed with a naked and luscious bimbo. The rake still denies anything untoward is going on, pleading, “Who are you going to believe, me, or your own eyes?” . In real life, the gold standard might be actress Lindsay Lohan’s insistence to police, when she was arrested for reckless driving and cocaine was found in her pocket, that she was wearing someone else’s pants.

The White House’s entry into the Jumbo Hall of Fame is pretty impressive, though. As figures showed that a million Americans had registered for Obamacare in December, bringing the total number to 2.1 million, well short of the 3 million goal, White House White House health care adviser Phil Schiliro told MSNBC yesterday that the frequently stated Administration goal of  7 million enrolled by the end of March, when the individual mandate (penalty, according to Democrats; tax, according to the U.S. Supreme Court) kicks in, was not really the goal after all. Several readers have asked for the Ethics Alarms Apology Scale scores for the three MSNBC creeps who decided to use a loving, non-political family photo featuring Mitt Romney’s newly adopted grandchild as an opportunity to sneer at the family, Mitt and the GOP, and engage in some unprovoked race-baiting. It was such an ugly display that decent human beings a) would never have engaged in it at all and b) wouldn’t have required a wave of criticism to wash over them to realize apologies were in order, but they did. Why? Because they are hateful people, unsavory and loathsome. As such, I really had decided that mucking around in MSNBC swill wasn’t worth a second post, but since you asked, here are the scores. “On Sunday’s Melissa Harris-Perry (MSMBC) show, the eponymous host led a panel of entertainers in a rundown of the “photos of the year,” which somehow included a Romney family picture that “a lot of people had emotions about,” according to MHP….“Everybody loves a baby picture,” Harris-Perry said, “and this was one that really, a lot of people had emotions about this baby picture this year. This is the Romney family. And, of course, there on Governor Romney’s knee is his adopted grandson, who is an African-American, adopted African-American child, Kieran Romney.” As Harris-Perry made the introduction, panelist Pia Glenn sang “One of these things is not like the others, one of these things just isn’t the same,” a tune whose original lyrics read “one of these things doesn’t belong.” “And that little baby, front and center, would be the one,” she added. …Comedian Dean Obeidallah chimed in by reducing the baby to a token. “I think this picture is great,” he said. “It really sums up the diversity of the Republican party, the RNC. At the convention, they find the one black person.”

Actress Erin Wotherspoon, 24, lives in Toronto and has an unusual avocation. As she describes it on “A Penniless Girl, Bad Dates and Plenty of Oysters”,

“I’ve got a pretty face & a pretty extensive urban spoon wish list…We all know that getting what you want in life can be tough. Which is why I’ve decided to let someone else finance my dreams. My dream? To eat in pretty restaurants without costing me a penny. You had me at Elk Tartare, lost me at chin strap. Follow me to learn who I screw over, bang and love as I navigate Toronto’s diners, drive-ins & dives.”

Yes, as breezily chronicled on the Tumblr blog, Erin entices unenticing, lonely and hopeful men to feed her at Toronto’s best eateries, then dumps them unceremoniously once the bill has been paid. As her mission statement above demonstrates, she doesn’t see anything wrong with this, despite the fact that it is dishonest, cruel, manipulative and a straight-up violation of both Kantian ethics (don’t use people) and the Golden Rule, as well as a pure as crap example of an ends justifies the means life philosophy. Are some of Erin’s escorts using her as well, essentially buying faux affectionate companionship for the cost of some elk tartare? Oh, surely. Such individuals use their affluence to sully the dignity and integrity of others for a price. The fact that one is being unethical in his dealings with another who is also unethical—mutual users, mutual corrupters—is no justification.

Now, as someone—maybe even Erin—could have predicted, a U.S. reality show producer wants to make a star out of her, and it appears that we may soon be able to watch Ellen dupe wannabe sugar daddies into delicious and free meals weekly.Then she can give an interview to GQ and explain why gays are sinners.

Who is more unethical: “the Penniless Girl” or the TV executives who want to make her rich and famous?

For me, it’s an easy call: the reality show purveyors are much worse than Erin. Selfish, deceptive, exploitive conduct is wrong and more harmful to society the more of it we get. Reality shows and the other ways the United States and its media reward terrible conduct—CNN giving Eliot Spitzer his own show, MSNBC doing the same with Al Sharpton, Fox employing sleazy (but famously sleazy!) Dick Morris, and the radio shows for the likes of Ollie North and G. Gordon Liddy come to mind, and now I’m nauseous again—make being unethical (or drunk, or stupid, or pathetic) a ticket to stardom, and even a desirable career path. It isn’t only reality shows, of course. It’s Republicans cheering Phil Robertson as if what he said wasn’t offensive; it’s Joe Wilson getting boat-loads of contributions off of shouting “You Lie!” at the President of the United States; it’s Tom Delay and Kim Kardashian getting gigs on “Dancing With The Stars” for being indicted and making a sex tape, respectively; it’s Kanye West, Miley Cyrus and other pop “sensations” receiving dawn to dusk publicity and inflated recording sales by behaving badly. We stifle liberty and expression by organizing boycotts against those whose conduct is objectively or subjectively offensive, but to reward them for it is courting cultural suicide, and turning the usual process of establishing healthy societal standards upside-down and inside out.

Cartoon Ethics: The Washington Post’s Stupid Elephant Trick

The above cartoon, by reliably liberal op-ed cartoonist Mike Luckovich, who draws cartoons for The Atlanta Journal-Constitution, was run in the Washington Post this Saturday. It immediately reminded me of why, in a previous post, I suggested that the simple-minded, factually misleading art of editorial cartoonists needed to be retired. I wrote:

“Cartoons, by their very nature, deal in caricature, exaggeration and extremes for metaphorical and humorous effect. The practical effect of this, however, is that the opinions expressed through cartoons are also “supported” in a manner that would be outrageous in a written opinion piece. I know: you can’t hold a cartoon to the same standard as an op-ed. Fine—then don’t put it on the editorial pages.”

This, if anything, was worse than the Tom Toles cartoon that provoked that commentary. This Democratic talking point—more like ducking point–got graphic representation the day following another wave of bad news about the dysfunctional Affordable Care Act and how thoroughly it has been botched by the Administration. Right before Christmas, the Post’s front page carried an infuriating story about how, after waiting two years before considering how to set up the Obamacare website, the Administration chose a company that even cursory due diligence would have revealed as untrustworthy and incompetent:

“Not considered in the 2011 selection process was the history of numerous executives at CGI Federal, who had come from another company that had mishandled at least 20 other government ­information technology projects more than a decade ago. But federal officials were not required to examine that long-term track record, which included a highly publicized failure to automate retirement benefits for millions of federal workers.”

Republicans caused that trainwreck? The same day the cartoon ran, this was in the news:

The Iowa Department of Human Services says problems with the federal healthcare website has led to a delay in processing policyholder information and is asking 16,000 Iowans to reapply for Obamacare using the state website or call center.”

And did Republicans force the President to lie repeatedly about how the law wouldn’t take away anyone’s current plan or doctor? Indeed, they warned that what happened would happen, and were attacked and ridiculed while the media bolstered the President’s disinformation campaign. That, as much as the website, has made the public perceive Obamacare as a trainwreck. The mean old GOP elephant is to blame for that? As I noted in the earlier post, an editorial cartoon shouldn’t be permitted to spread falsehood and misunderstanding, and a respectable newspaper shouldn’t actively engage in the blame-shifting and denial process, which is the full-time occupation of Affordable Care Act defenders these days.

Then I searched for the cartoon on line, to determine who drew it (his signature was illegible in the size published), and for the first time, was able to read the date. The cartoon was drawn on July 29, 2013! This was after the “trainwreck” label was being wielded by Republicans because Democratic Senator Max Baucus used that term to describe his—as it turned out, accurate—assessment of how the Administration’s public information campaign was going, not the law itself. Yes, the Republicans were working to impede the progress of the ACA then, because they were convinced the law would lead to disaster. Still, Luckovich’s cartoon, while partisan, was hardly unfair or misleading—in July.

Now, however, it assumed a different meaning. The date wasn’t noted by the Post: I thought it was a new cartoon, which means I thought Luckovich was engaging in MSMNC-style historical air-brushing. The cartoonist wasn’t, however.

Was the Post? Was it deliberately using Luckovich’s dated cartoon to bolster its desperate Obama-defending readership with the baseless accusation that the GOP was really behind the law’s current travails? Or was it just being careless, reckless, inattentive and unprofessional–you know, like most of the news media. most of the time?

I don’t know. I do know that the Post owes its readers and Luckovich an apology, the former for treating them like idiots, and the latter for making him look like one.

A&E Does A Cracker Barrel

The fecklessness and lack of core principles exhibited by our corporations is often breathtaking.

A&E has now, like Cracker Barrel, stuck its pusillanimous finger in the air and  decided that their “strong sense of integrity and deep commitment” to principle means that they do what whatever interest group has the most profit potential for them down the line wants them to do. Thus Phil Robertson is back on “Duck Dynasty,” and his “indefinite suspension” has been disclaimed by his employers. You can read A&E’s nauseating statement here…I considered posting it, but I don’t have the heart.

Everything I wrote previously about Cracker Barrel’s reversal on this same incident applies to A&E, but let me add this.

An organization with no core principles distinct from the profit motive is capable of anything, including outright evil. It is not worthy of trust. I would not and could not work for such an organization, and this episode makes me wonder if the entire concept of corporate ethics is a lie.

Bob Newhart, Legatus And GLAAD: “What’s Going On Here?” Is Tricky To Answer

The news item about comedian Bob Newhart cancelling an appearance for the Catholic executives networking group Legatus under pressure from GLAAD is fascinating.

From the perspective of Ethics Alarms, it illustrates a peculiar phenomenon I experience often, where a prominent story seems to have been designed by the Ethics Gods specifically to combine and coalesce several issues that have been discussed here recently. For Bob’s travails neatly touch on the issues of pro-gay  advocacy groups attempting to restrict expression they disagree with( The Phil Robertson-A&E Affair, Dec. 19), a comedian being pressured to alter the course of his comedy (Steve Martin’s Tweet Retreat, Dec. 23) and an entertainment figure being criticized for the activities of his audience (Mariah’s Dirty Money, Dec. 23). You would think I could analyze the Newhart controversy by just sticking my conclusions from those recent posts, plus some of the more illuminating reader comments, into my Ethics-O-Tron, and it would spit out the verdict promptly.

It doesn’t work that way, at least in this instance, and that prompts the other observation. In most ethics problems, the starting point is the question, “What’s going on here?”, which forces us to determine the factual and ethical context of the choices made by the participants. Here, the question can be framed  several diverging ways, leading to different assessments of the ethics involved. There May Not Be A War On Christmas, But Whatever It Is, Christmas Is Losing

I don’t think it’s my imagination, or that I’m watching too much Bill O’Reilly (since I almost never watch Bill O’Reilly), but it became very clear to me this year that Christmas, as a society-wide cultural convergence in America, is losing its grip.

The reasons are varied and many, and to pick out any in particular one would betray my own biases. But I am a fairly obsessive observer of the popular culture, and there was markedly less Christmas this year in every way. Religious references to the Christmas story—the manger, the Wise Men, the Star of Bethlehem and the rest, are almost invisible outside of church. On television, that part of Christmas is taboo, apparently; on radio too, traditional carols, which once were standard fare, whether sung by pop singers like Bing Crosby or classical artists, are mostly relegated to the classical music channels. On the other stations, there was less Christmas music than I can ever recall, and perhaps because of that, I was very conscious of how dated virtually all of it is. The last non-frivolous Christmas standard to enter the playlist was 1962’s “Do You Hear What I Hear?, ” and the other newer ones  are either songs about romance using Christmas as a backdrop, anti-Christmas novelties (“Grandma Got Run Over By  A Reindeer”), or just lousy.

Meanwhile, listening to the parade of pop yule classics is an exercise in morbidity. Almost all of them are sung by dead artists that no one under the age of thirty (or forty?) could have ever heard or seen perform live. Bing, Dean Martin, Karen Carpenter, Andy Williams, Burl Ives, Gene Autry, Judy Garland, Nat King Cole, Mel Torme, Frank Sinatra—Andy just left us, but most of the rest, with the lingering exceptions of Johnny Mathis and Harry Belafonte, are not merely dead, but long dead, like Marley. No one has taken their place in this genre, and that means that it’s a dying genre.

It is obvious that Christmas movies are being run on television less than ever before, too. It was once impossible to avoid encountering several versions of “A Christmas Carol,” and sometimes the same one would keep popping up, annoyingly so. Not any more. “It’s A Wonderful Life” had its annual showing, and I stumbled upon “White Christmas” a couple of times, but the pickings were slim.   The lousy Richard Attenborough “Miracle on 34th Street’ turned up; Turner Classics ran through most of the old Christmas classics once, but you had to look for them. There haven’t been any new Christmas movies from Hollywood that have made the grade for a very long time: with the exception of the first “The Santa Clause,” what Hollywood has been churning out are more or less bitter comedies (“Christmas With The Kranks,” “Jingle All The Way,” “Bad Santa,” “Christmas Vacation”–even the “Home Alone” films) that portray Christmas as suburban hell.

Then there are the wan or missing town hall and town center Christmas displays (Gotta watch out for those law suits), the tasteless Christmas TV commercials (the men in boxers jingling their “bells” is gross, in my opinion), and the hesitation you hear in strangers’ voices as they try to guess whether “Merry Christmas” will offend you or not.  I used to encounter carolers several times every Christmas, in shopping malls if nowhere else. The malls are disappearing, and kids don’t go caroling any more. They don’t know carols any more, because if their school teaches them one (because it’s a lovely song) some fanatic will raise a stink and claim its religious indoctrination.  Children, in a more innocent, less cynical age, were allowed to believe in Santa Claus well past the age of 5. (I was 26 before I knew the truth.) No longer. Christmas just feels half-hearted, uncertain, unenthusiastic now. Forced. Dying.

It was a season culminating in a day in which a whole culture, or most of it, engaged in loving deeds, celebrated ethical values, thought the best of their neighbors and species, and tried to make each other happy and hopeful, and perhaps reverent and whimsical too.  I think it was a healthy phenomenon, and I think we will be the worse for its demise. All of us…even those who have worked so diligently and self-righteously to bring it to this diminished state.

But anyway,

Merry Christmas.

Ethics Dunce: Steve Martin (Coward, Too)

Life imitates art.

Shame on Steve Martin. He is a comedian. He tweets jokes. He tweeted a joke that was not racist in the least. (Everything that comments humorously on cultural quirks isn’t racist.) The political correctness bullies jumped on him too, because they nailed Phil Robertson and destroyed Justine Sacco. Martin, a novelist, a playwright, a TV writer, a comic and an actor, should have the integrity to stand up to this suffocating and unethical phenomenon. He has the stature to make a difference. He doesn’t have that integrity. He took the path of least resistance. He is a coward. He groveled. He apologized. The Blaze headlined that he “had to apologize,” No he didn’t. What he had to do was show some principle and strength of character when being manipulated and unfairly attacked, and he wasn’t up to the task.

By giving them what they crave, Steve Martin made the censors, bullies, cyber mobs and political correctness dictators more powerful, and hungrier still.

Without champions who will fight for free thought and expression, we will lose them. Martin and people of his intelligence and credibility have an obligation to be such champions, and he failed us all.
