Paul Newton Jr., a lawyer in Gulfport, Mississippi, sued Popeye’s after he required emergency surgery to remove a chunk of fried chicken from his throat last November. He claims the fast-food restaurant was negligent and caused his near fatal accident because it didn’t include a plastic knife along with the “spork” in his drive-through order.

Newton says he consumed  the meal (two chicken breasts, an order of red beans and rice, a biscuit and a soft drink…YUM!) in his office, and had to “hold a chicken breast in his hands and to tear off pieces thereof with his teeth.”In the  lawsuit , the lawyer maintains Popeyes had a duty to provide the appropriate utensils so customers will be able “to cut their purchased food orders into appropriate portions.”

Newton abandoned his chicken suit–well, not his chicken suit, but his chicken lawsuit— the Huffington Post reported, after receiving “extreme comments directed to me and my family.”

Ethics Dunce: Mediaite

Mediaite is a frequent source here. The news and opinion website actively strives for balance by maintaining a stable of ideologically diverse reporters. It also received a big boost in credibility recently by finally dumping the embarrassing Tommie Christopher, whose left-wing bias was so extreme that it bordered on parody.

However, the site grossly abandoned ethics and accountability this time.

Yesterday I cited a Mediaite story about how Twitter dolts thought they saw a KKK sign in the stands during the World Series, a mistake caused by a bad hybrid of race-obsessed derangement and utter ignorance of the National pastime. What I did not know, because Mediaite was engaged in a cover-up, was that reporter Josh Feldman had filed the original post in which HE accused Cleveland fans of promoting the Klan. As you can see above, the original Mediaite story was not about Twitter morons mistaking the cards representing three strikeouts for Cleveland starter Corey Kluber, but a “scoop” by an ignorant and irresponsible reporter who made that mistake.

After Feldman was quickly schooled  on Twitter, Mediaite cleaned up the embarrassing story, removed Feldman’s byline, and turned it into a “Boy are some people stupid!” post. Feldman restricted his apology to Twitter, writing, “Apologies for the fuckup. Need to do more reading up on sportsing things.”

No, need to show some responsibility on reportsing things, Josh. Mediaite’s handling of this botch was unethical, and seriously implicates their trustworthiness. In the revamped post, a note was added saying,

UPDATE- This post has been updated to reflect the fact that it was NOT a KKK sign, it was signifying the number of strikeouts,”

Yes, and it was also updated to remove the name of the guilty reporter. Josh Feldman should been named as the one responsible, he should have apologized to Mediaite readers , not Twitter followers, for false reporting, and Mediaite had an obligation to apologize as well for its poor oversight. Instead, the site chose to cover for its reporter.Ethics Verdict: No transparency, no accountability, and an effort to deceive readers rather than admit to incompetent and careless reporting.

How can anyone trust a website that would do that?

Ethics And Sports: Maybe It’s Confirmation Bias, But The TV Ratings Give Me Hope

And these days, when the goal is a more ethical society, I’ll take hope anywhere I can find it.

The big story in the NFL right now is that for the first time ever, its TV ratings are dropping. Through the first seven weeks of the season, ratings were down for every prime-time NFL show: “Sunday Night Football” by 19 percent, “Monday Night Football” by 24 percent and the Thursday night game by 18 percent. For the season as whole, ratings are off in regional games too. The NFL is doing what it always does with bad news: obfuscating and lying. It has blamed the drop on the Presidential race, as if anyone wouldn’t do anything to escape that, and the generational abandonment of network TV and even cable for the internet. Various polling results, however, show that a big factor is the league’s increasingly obvious lack of values.

The concussion issue-–finally—is hurting interest in football, especially as parents try to steer their children toward less risky sports. A recent study that researchers took pains to insist was only troubling, not conclusive, found brain chemistry changes in children who had played one season of junior football. I don’t know about anyone else, but if there is any evidence that a sport might reduce my kid to a brain-damaged invalid by the time he’s 60, that’s plenty for me to limit his recreation choices. The public is also finally reacting to the NFL’s evident cover-up of its responsibility for ex-players who have perished as a consequence of CTE, a brain disease caused by repeated head trauma. I wish this was the main reason that fans are turning off pro-football games, but at least it’s a factor. Continue reading

From The Ethics Alarms Mail Bag: A Reader Asks, “Is The Verizon Wireless “Can You Hear Me Now?” Guy Unethical For Going Over To Sprint?

Question: Is the former Verizon Wireless spokes-character  whose tag line was “Can you hear me now?” unethical to star in commercials for Verizon competitor Sprint?

Answer: No, because that character, “the Test Man,” wasn’t real.

The real actor who played him, Paul Marcarelli, was playing a character and reading a script. He was acting the role of someone who told the audience how good the Verizon Wireless network was. He didn’t have to believe what he said was true. His loyalty extended no farther than his contractual obligations. The actor wasn’t ethically obligated to use Verizon Wireless, like it, understand it or believe in it, any more than Dos Equis’s “most interesting man in the world” has to really be interesting. Once the first ad series was dropped, he was a free agent.

Verizon could have included some kind of non-compete provision in the contract, forbidding Marcarelli from doing ads for a competitor, at least for a while.  It definitely could have prevented him from playing the same character as he played in the Verizon commercials, because that character is owned by Verizon. However,  Marcarelli uses his real name, Paul, in those Sprint ads, so he can argue that he’s not playing the Verizon character, but himself, and he owns the rights to “Paul Marcarelli.”

However, I do think the Sprint ads are unethical, and so obviously dishonest that they reflect poorly on Sprint. Continue reading

Ethics Hero: The Daily Commercial’s Editorial Board

The Daily Commercial, a local paper serving Leesburg, Florida, issued a striking editorial apology for its biased coverage of the Presidential race.

In an open letter titled “The media, the election and bias,” the editors apologized to its readers and observed that the paper “hasn’t done enough to mitigate the anti-Trump wave in the pages of this paper….You deserve a more balanced approach to the coverage of elections and other weighty issues.”

Why The World Doesn’t Work: The Case Of Jackie Kennedy’s Chef

hustebookThe world doesn’t work, and Ethics is always struggling to avoid losing ground. I collect stories that show why this is. Here is one from the obituary page, the saga of  the departed Annemarie Huste, who was Jacqueline Kennedy’s private chef.

In 1966, the former First Lady moved to New York from Washington, D.C., and in need of a private chef—rich person, you know— hired Huste, a young German immigrant whose previous employer, theater impresario Billy Rose (of “Jumbo” fame!), who had just died, rendering her skills superfluous. Huste did the job to Mrs. Kennedy’s satisfaction,  feeding the occasional hoards of family members who came to visit,  accompanying the Jackie, Caroline and John-John to the Kennedy compound Hyannis Port,  in the summers and playing with the children of JFK.

Then, in 1968, Weight Watchers Magazine approached her about cooperating in a feature called “Jackie Kennedy’s Gourmet Chef Presents Her Weight Watchers Recipes.” Huste dished about Jackie’s diets and dress sizes in the article, never asking for her famous employer’s permission or consent. Jackie Kennedy was horrified, and even tried to stop publication, something the Kennedy family was and is very good at. This time, it didn’t work.

A few weeks later,  Huste gave an interview to Maxine Cheshire, then the “beautiful people” gossip columnist for The Washington Post and syndicated nationally. In return for  inside-the-Kennedy-home details, Cheshire made Huste sound like the coming star of gourmet cookery, hinting that a television show, a cookbook, wealth and fame were just around the corner. Ethics Alarms covered the problem way back in 2011, in a post called “Getting Scrod in Boston: The Ravages of Seafood Fraud. I just checked: almost nobody has read it, and those who have almost certainly have 1) forgotten about it and 2) been ripped off buying seafood since.

Now the guys at “Stuff You Should Know” have done an excellent  podcast about the issue. It really is infuriating that with all the regulations we pay for, and all the attention the government focuses on fads, politically correct crusades (how many Americans are affected by limitations on which public rest rooms can be openly used by transgender citizens?) , and out-and-out trivia, something like this goes not only unaddressed by officials, but ignored as well. The news media, meanwhile, would rather use its limited daily space to tell us how Stephen Colbert just skewered Donald Trump last night than to warn us about our pockets being picked.

Well, not me: I almost never buy seafood unless it’s raw oysters, whole shrimp or crab,  and if I’m in New England, Ipswich clams and lobster, all hard to fake. Continue reading

Don’t Feel Too Bad, Americans: Ethics Alarms Aren’t Ringing In Canada, North Korea Or Japan, Either

The Windsor-Essex County Humane Society in Ontario thought it would be really clever to use the Donald Trump phrase that many believe disqualify him to be President in an ad to adopt kitty-cats. It featured a photo of Trump and said, “You don’t have to be a star to grab a pussy … cat.”

Amazing. Not one person in the chain of custody of this—I would say obviously, but when so many people miss it, I guess it’s not—offensive ad had an ethics alarm sound.  Nobody had the sense, prudence or guts to say,

“Uh, guys? Hello? You do realize that this is using a phrase describing sexual assault while alluding to the one who used it to describe sexual assault? You do realize that “pussy” alluding to female genitalia is vulgar and uncivil, right? No? Here, let me explain it to you…or hwo about this: there is no way this won’t spark criticism. Is that what you want?”

Sure enough,  the ad promoting cat adoptions this week for $50, was taken down shortly after it appeared this week.

The society offered a pathetic apology. Melanie Coulter, executive director of the humane society, “explained” it was an attempt to make light of the U.S election campaign, though it also “made light” of sexual assault, contemptuous attitudes toward women,  and obscene rhetoric.

“We are obviously sorry if people are offended by the ad — that wasn’t our attempt in the least,” Coulter said. “Our attempt was to find homes for cats that need them.” She also added that the shelter took in more than a hundred cats in the last week.

For the record, the rationalizations here are…

More Clown Ethics: The County That Banned Bozo

An alternate title was “The County Run By People So Ignorant Of The Constitution That They Think You Can Tell People How To Dress And Who Will Be Easy Pickings When The Democrats Decide To Ban What They Decide Is “Hate Speech,” but I thought it was a little too long.

The mass Ethics Dunce in question is Mississippi’s Kemper County, which in response to the evil clown hysteria embarrassing the nation almost as much as the evil Presidential candidates hysteria, enacted a clown ban this week, forbidding people from dressing as clowns until after Halloween. Anyone caught in public wearing a clown costume, mask or makeup will face a $150 fine.

This is, of course, ironic, since any elected officials voting for such a ban are, by definition, clowns themselves.

County supervisors president Johnny Whitsett justified this overly broad law and per se violation of the Constitution as a matter of public safety because, he said, people “could react badly if they get scared by a clown in their yard.” Wait: how does my wearing clown shoes and a red nose in my yard scare someone in their yard?

Boy, I can’t wait until I am retired, rich, and at leisure to go down to future Kember Counties and get arrested for being dressed like Bozo.

In these tiny, trivial, stupid examples of elected officials proving themselves ignorant of our rights and protections are the seeds of the destruction of American liberty.

Meanwhile, non-government entities, which are legally free to reject the principle of free expression but not ethically free to get away with it, at least on this little corner of the Internet, have revealed their own censorious clown DNA. Target, for example, has removed clown masks from its stores and website. “Given the current environment, we have made the decision to remove a variety of clown masks from our assortment, both in stores and online,” the Big Box chain announced through a spokesman.

This is consistent with the current reasoning of the increasingly totalitarian left on guns and other commodities, that if a small minority of citizens abuse a product or right, the rest of us have to do without. Again, I look forward to my future career as the Ethics George Soros, funding nation-wide Scary Hair Dryer User  hoaxes to see if Target will ban hair dryers too.
