“Fake News” Ethics: Top Ten Culprits (And Facebook Isn’t One Of Them)

“Fake News” is now a big topic in the news media, as it tries to lead public attention away from legitimate scrutiny of its own bias and incompetence, Facebook, in particular, is the target of this outcry, because the false narrative (should Facebook also be helped responsible for policing false narratives?) that fake news drove Donald Trump’s shocking victory is more palatable than the accurate narrative that Trump was opposed by the only candidate so corrupt, dishonest and inept that he had a chance of winning.

Here’s an interesting study of how Facebook’s algorithms circulates news stories that are made up. The focus on this kind of fake news, however, creates a fake picture of the problem that over-emphasizes hoax stories, many of which, apparently, come from teens in Macedonia exploiting American online gullibility for profit. The problem is that Americans are so ignorant that when some of them read a story that says  the Pope endorsed Donald Trump, they believe it. (Popes don’t endorse presidential candidates, and if anyone conscious thinks about it for five minutes, they should be able to figure out why.) The problem is that 40% of Americans are so lazy that they get their news from social media (and another chunk gets its news from comedy shows.)

The Blame Facebook theory is that because Facebook is foolishly relied upon by inept and gullible citizens to get their information about the world, Facebook has to take on the impossible task of vetting news items.

Facebook, however, is neither trustworthy nor competent to do this. Facebook is biased. Facebook is overrun with social justice warriors whose idea of what Facebook should censor is anything that offends them. For example:

Mark Zuckerberg had to fend off employees during the U.S. presidential campaign who wanted to censor billionaire Donald Trump’s posts due to alleged hate speech. Controversial statements by Mr. Trump’s presidential campaign in December forced Mr. Zuckerberg to quash a mini-mutiny of staffers who threatened to quit if they could not delete the candidate’s posts. Sources close to the matter told The Wall Street Journal that some of the comments in question involved a plan to ban Muslim immigrants while the U.S. determines how to best combat the Islamic State group.

Biased selections regarding which news to print while censoring the statements of a Presidential candidate are at least as misleading as fake news.

Presumably Facebook won’t try vet the misleading, dishonest news stories, commentary, links and memes I see flooding Facebook every day, courtesy of my nice, friendly, smart, educated, completely left-biased and right-biased friends who throw absolute garbage out as truth and immediately receive dozens of “Likes” for doing so. These are a lot more visible and just as brain-muddling as any Macedonian fiction. Here’s one example from yesterday, and to the good friend who posted it, I love you dearly but you are gullible and irresponsible:

BREAKING: Trump Announces Plan To ELIMINATE Overtime Pay For 20,000,000 Americans

This is completely false, as one would learn, sort of, by reading the story. Republicans are going to review regulations established in the last 60 days and kill the ones they think are ill-advised, as the law allows Congress to do. One that might be in jeopardy is a recent  rule that requires companies to pay time-and-a-half overtime to employees who make under roughly $47,000. The article also eventually says that it is House Republicans who say they are targeting the rule. So, to summarize:

  • Trump announced no such plan.
  • Nothing is being eliminated, since nobody has received any extra pay to be eliminated.
  • The alleged regulation cancellation wouldn’t take away overtime pay, as the headline states, but the requirement of paying overtime plus 50%.
  • Killing the rule wouldn’t take away such overtime or ban it; employers would still be free to pay time and a half at their discretion.

In short, the headline is fake news, designed to attack Trump. This kind of fake news isn’t included in the linked study, and for good reason. If we fairly call misleading headlines fake news, Facebook would be charged with vetting the mainstream media constantly. What about real quotes, from supposedly reliable people, that falsely spread rumors or specious accusations? Jim Comey did not violate the Hatch Act, as Harry Reid claimed. Trump is not a Nazi, as Howard Dean just claimed. Those quotes are just as misleading than nonsense about the Pope endorsing Donald Trump, but they are real quotes, from well-respected people who are being irresponsible. Continue reading

Ethics Quiz: Dr. Phil, Shelley Duvall, And Exploitation

A 30-second promotional clip for today’s episode of “Dr. Phil” is disturbing, beyond question. It shows Shelley Duvall, from “The Shining,” “Popeye,” “Nashville” and other well-known films talking to the fake doctor about her mental illness.The syndicated advice show’s promo shows Duvall, almost unrecognizable, talking about how her “Popeye” co-star, the late Robin Williams, is alive and “shape-shifting.” She says she is being threatened by Robin Hood’s Sheriff of Nottingham, and that a “whirring disc” is inside her.

The ad ends with Duvall, 67, telling Phil McGraw, “I’m very sick. I need help.”

She certainly sounded like it, and looked like it too.

Now Dr. Phil is being criticized for exploiting a vulnerable mentally ill woman for her audience drawing powers. The daughter of Stanley Kubrick, who directed Duvall in her most famous role as Jack Nicholson’s terrorized wife in “The Shining,” is leading the charge. Vivian Kubrick called for a boycott of the popular daytime program, tweeting, “You are putting Shelley Duvall ‘on show’ while she is suffering from a pitiable state of ill health. Unquestionably, this is purely a form of lurid and exploitative entertainment — it’s appallingly cruel.”

Ethics And The Broadway Star’s “Accidental” Pregnancy

In July, just four months after the show opened to rave reviews, producers closed the hit Broadway musical, “Shuffle Along, Or The Making of the Musical Sensation of 1921 and All That Followed.” “Shuffle Along,” with 10 Tony nominations this year, had the makings of a long-running bonanza, but producers decided that when its acclaimed star, multiple past Tony Award winner (six!) Audra McDonald, had to leave the cast due to a surprising pregnancy (the actress was 45), it was too risky to continue. As soon as a replacement was named, ticket sales plummeted.

The show, which was capitalized for up to $12 million, had purchased a $14 million insurance policy from Lloyd’s of London to cover any damages arising if McDonald “was unable to perform because of an accident or illness.” Now producers are asking Lloyd’s to pay up, covering losses created by the pre-mature closing of the musical and by the  effects on the production occasioned by other health issues related to McDonald’s pregnancy while she was still performing.  “Since the beginning of previews of the Show, Ms. McDonald was unable to appear in numerous performances of the Show due to circumstances related to illness, a knee injury, and her pregnancy,” a lawsuit says. Her role was a strenuous one, requiring, among other things, a lot of tap-dancing.

Why the lawsuit, you ask? Lloyd’s says that the policy’s terms haven’t been met, arguing that the actress’s pregnancy and the associated medical conditions were neither due to an ‘accident’ nor an ‘illness’ under the policies.” The show’s position, as articulated by a lawyer representing the show, is that”‘Shuffle Along’ bought an insurance policy to cover it in the event that Ms. McDonald was unable to perform, and she was unable to perform.”

I love this story! It has everything—cold-eyed insurance executives, a perhaps manipulative diva, the sanctity of pregnancy, buck-passing, Hail Marys, feminist taboos, and Broadway!

Meltdown At Gate 43

As you probably have discerned, I am not having a good week on the road.

Today I am in Tucson, Arizona for less that 24 hours at a lovely resort that I will get to enjoy essentially not at all. Getting here, however, was the ethics adventure, or perhaps ethics breakdown is the better term.

My flight was supposed to start boarding at 4:30, but for some reason unclear to the assembled, did not. It was a real mob, a full flight, and as always at Reagan National , people were jockeying for position. They were also confused; a neighboring American gate was also boarding, and the announcements sounded like they were coming from our gate. Suddenly a gate attendant—is that what they are called?—came running up, and pushed through the crowd, sporting a big grin, why, I have no idea.

He grabbed the microphone and said, “All right, everybody, we’re ready to board American flight 2766 to Phoenix!” and nothing else.  “I guess they’re boarding everyone!” someone said, and there was a mad rush for the lane. “No no no!” the new arrival said. “First class only!” ” Did he say ‘first class only’ before?” I asked the young women standing next to me. “No,” she said, confirming my belief, “but then I can’t tell what he’s saying anyway.” True enough: the guy mumbled and didn’t seem to know how to use a mic. Then the VERY CLEAR announcement from the adjoining gate boomed out: “Now boarding Group 2!”

Again a mob of my flight’s passengers rushed the gate, and the young man with the grin shouted “NO! Get back! Now we are boarding the Platinum, Gold, Silver, American Plus, Bronze Bonus, Flying Potato passengers only!” Or something like that. He was barely heard, and the announcement from the nearby gate washed over it. “Now boarding groups 1,2 and 3!” More confusion. Another American employee at the our gate took the mic, a young woman. “AH!” I thought. “She obviously knows how to do this.”

No, she didn’t. You know that woman in “Jaws” who sees the shark in the lagoon and shouts “Shark! A shark!” so weakly that I have never been able to figure out why Spielberg cast her? The American lady made THAT woman seem like Ethel Merman by comparison. Her mouth moved, but nothing came out. “What did she say?” “What was that?” Everybody was asking everyone else if they could figure out who was supposed to go next. Then the guy who arrived late started shouting at us!

“We have not called the priority levels or group 1 yet! You are blocking passengers from accessing the gate! Move out of the lane.” From next door: “NOW BOARDING ALL GROUPS!!”

More chaos and confusion. Eventually I moved through to the jetway; I have no idea if they called my group or not. There were four attendants at the gate, an older man checking the boarding passes, the mute, the jerk who shouted at us (Rule: if crowd gets out of control, it’s the crowd controllers who usually are at fault), and a women in a uniform who was standing to the side looking like this was funny to her and otherwise doing nothing. I assumed she was a supervisor…a bad one. So I went up to her, and said, not entirely pleasantly, “This is the most incompetent boarding process I have ever seen. It’s inexcusable.”

She looked at me indignantly and said, in some kind of Hispanic accent, “This is America, sir! If you want to make a complaint, contact management. I’m just an employee,”

Wait..WHAT? Now I have to deal with an arrogant Hispanic American with a chip on her shoulder? Is she going to lecture me on white privilege? “This is America”? What the hell does that have to do with anything? Continue reading

Four Unethical Dispatches From The 2016 Post Election Ethics Train Wreck: #4

The last of our four unethical missives (the previous ones are here, here, and here) comes from the CEO of Grubhub. But first, consider the election night Facebook discourse above, by the chief executive of San Diego cybersecurity start-up PacketSled, Matt Harrigan. The key tweets are a bit hard to read. The top left one says he’s going to kill the President-Elect. The bottom left says he’s getting a sniper rifle.

He has been placed on leave by his board.

Good move.

GrubHub Inc. CEO Matt Maloney was a bit more genteel, writing to his employees The Day After:

SUBJECT: So… that happened… what’s next?

I’m still trying to reconcile my own worldview with the overwhelming message that was delivered last night. Clearly there are a lot of people angry and scared as the antithesis of every modern presidential candidate won and will be our next president.  While demeaning, insulting and ridiculing minorities, immigrants and the physically/mentally disabled worked for Mr. Trump, I want to be clear that this behavior – and these views, have no place at Grubhub. Had he worked here, many of his comments would have resulted in his immediate termination. 

We have worked for years cultivating a culture of support and inclusiveness. I firmly believe that we must bring together different perspectives to continue innovating – including all genders, races, ethnicities and sexual, cultural or ideological preferences. We are better, faster and stronger together.  Further I absolutely reject the nationalist, anti-immigrant and hateful politics of Donald Trump and will work to shield our community from this movement as best as I can.As we all try to understand what this vote means to us, I want to affirm to anyone on our team that is scared or feels personally exposed, that I and everyone else here at Grubhub will fight for your dignity and your right to make a better life for yourself and your family here in the United States. 

If you do not agree with this statement then please reply to this email with your resignation because you have no place here. We do not tolerate hateful attitudes on our team.I want to repeat what Hillary said this morning, that the new administration deserves our open minds and a chance to lead, but never stop believing that the fight for what’s right is worth it.

“I absolutely reject the nationalist, anti-immigrant and hateful politics of Donald Trump and will work to shield our community from this movement as best as I can….If you do not agree with this statement then please reply to this email with your resignation because you have no place here.”

There’s nothing wrong with nationalism, in moderation. Trump isn’t anti-immigrant, he’s anti-illegal immigrant. What constitutes the politics of Donald Trump and whether or not it is hateful is open to interpretation. Nonetheless, Maloney is clearly saying that his employees must agree with his partisan views (and selective sense of diversity or inclusion), or they forfeit their jobs.

After it was pointed out to Maloney that the e-mail demanded ideological conformity, was probably illegal under some state laws (like California) and was gallactically stupid, he tried to explain with a deceitful apology, writing in part, Continue reading

I arrived at the hotel after a late flight tired, with a headache. The door was locked, which is sometimes the case after 10 or so at small hotels; it was 11:30 PM. So I rang the bell. Nobody. I rang it again. And again. I knocked. Then I rang again. Finally, I went into the pub next door, which was also closed, but the door was ajar. “Does anyone know how I’m supposed to get checked into the hotel?” I asked>

Someone did know: the hotel night clerk, who had gone next door to watch TV.

President Trump’s Massive, Unfixable, Unwaivable Conflict Of Interest…And Why Weren’t We Worrying About This BEFORE The Election?

Donald Trump, as President of the United States, will have an unprecedented conflict of interest—many, actually—that realistically cannot be fixed and never could. He will be President, and he will own a global set of businesses worth billions of dollars that his policies and decisions will unavoidably affect for better or worse, usually to his long term benefit or disadvantage.

Almost nobody, including me, and it’s my business to do so, focused substantially on the problem during the campaign. Trump, as  usually, airily dismissed the issue when it came up as if it was nothing, saying, “If I become president, I couldn’t care less about my company. It’s peanuts,” during one debate. “Run the company, kids. Have a good time.” Typical, stupid, and neither Clinton nor the moderator had the wit or information to follow up with the required, “Wait a minute, that doesn’t deal with the problem. Will you also not care about your kids, Mr. Trump? Your companies’ stockholders? Business partners? Employees?”

At least we know why Hillary was reluctant to pursue this issue, don’t we?

The Trump Organization’s executive vice president, Alan Garten, similarly brushed the problem away, saying in September, “His focus is going to be solely on improving the country. The business is not going to be a factor or an interest at that point.” That’s an incredible statement, naive at best, dishonest at worse. Of course it will be an interest. How could it not be? The question is whether it will be a factor. Human nature, and Trump’s nature, strongly suggest that it will be.

Who can tell with Trump? Maybe he really believes there’s no problem. After all, as I have written repeatedly and all evidence proves, the man doesn’t know ethics from ambergris. Whether he knows it or not, however, this is a massive  and potentially crippling problem for him and his administration, not to mention his children and his businesses. It is especially a problem because the same journalists who dismissed Hillary’s family foundation’s influence peddling while she was Secretary of State and after as another overblown conservative attack (after all, why should venality and hidden conflicts of interest interfere with electing the First Woman President?) have the long knives out to eviscerate Trump on any hint of impropriety, real or not, they can find.  This is real. When Ethics Alarms Don’t Ring Dept: Planet Fitness

There’s nothing substantively wrong with the fitness chain Planet Fitness’s new philanthropic program to combat bullying. However, one has to question the ethics alarms and basic English comprehension of a company that sees nothing wrong with naming a campaign “The Judgement Free Generation.” I just saw a TV ad that was a teaser for the program. The announcer ended by saying “Now Planet Fitness is creating a Judgement Free Generation.”

Judgement is not a bad thing. Judgement is a good thing. So is making judgements. Society without constant judgements of all kinds cannot possibly have or maintain standards. Without standards, there can be no ethical guidelines and boundaries.Nobody with any concept of what ethics are and why they are essential to civilization would every want to eliminate judgement. Judgement and bullying are not synonymous, not even close.

What some copywriter at Planet Fitness has done is to launch a national campaign that frames “judgement” as something to be avoided. Nobody in the hierarchy there perceived anything wrong with that. This isn’t being “judgement free,” this is just bad judgement, as in incompetent.. To the extent that it advances the culture’s increasing tendency to discourage negative judgements against any conduct, even objectively destructive conduct, leading to purely subjective ethics (that is, no ethics at all), the campaign’s message is irresponsible.

Besides, based on what I’ve seen of late on college campuses, Bernie rallies and anti-Trump freakouts, we may already have a judgement-free generation.

At least one.

1. Ugliest moment of election night: Trump’s assembled chanting “Lock her up!” as the electoral victory approached.

2. Anti-Trump bias made the entire journalism profession and punditry class incompetent, forming an almost impenetrable echo chamber that assured its smug occupants and Democrats that Hillary Clinton literally couldn’t lose. “Bias makes you stupid” is a frequent refrain here, and I cannot think of a more powerful example.

In a terrific if rueful article in Slate, Jim Newell writes of how the whole Democratic establishment convinced itself that Hillary couldn’t lose:

I think of the lawmakers, the consultants, the operatives, and—yes—the center-left media, and how everything said over the past few years leading up to this night was bullshit…Think of how wrong the entire national media conversation was—and yes, I contributed my fair share—about how the Republicans were being torn apart as a party. I prewrote a piece Tuesday afternoon, to be published in the event of the expected Clinton win, pushing back against both myself and other members of the media, arguing that Democrats and Republicans were both in existential trouble and that, in the short-term context of a decaying political system, Republicans might even have the edge…This was wrong. Republicans don’t have a slight edge over Democrats in a decaying political system. Republicans are ascendant.

The whole point of experts and analysts is that they use facts and objectivity to cut through rationalizations and bias. If they can’t or won’t do that, they are useless. They are frauds. Here’s the Washington Post’s media columnist, Margaret Sullivan, who proves elsewhere in the essay, even as she writes about bias, that she is still a partisan to her core:

To put it bluntly, the media missed the story. In the end, a huge number of American voters wanted something different. And although these voters shouted and screamed it, most journalists just weren’t listening. They didn’t get it.They didn’t get that the huge, enthusiastic crowds at Donald Trump’s rallies would really translate into that many votes. …It would be too horrible. So, therefore, according to some kind of magical thinking, it couldn’t happen.

Journalists — college-educated, urban and, for the most part, liberal — are more likely than ever before to live and work in New York City and Washington, D.C., or on the West Coast. And although we touched down in the big red states for a few days, or interviewed some coal miners or unemployed autoworkers in the Rust Belt, we didn’t take them seriously. Or not seriously enough….We just kept checking our favorite prognosticating sites and feeling reassured, even though everyone knows that poll results are not votes.

The news media anti-Trump bias might have even lost Hillary the election, not just by outraging the public–it was so, so blatant–but by deceiving the Democrats. Clinton didn’t bother to campaign in Wisconsin, so convinced was she that voters there would blindly follow the party, as usual. The state was one of the big victories for Trump.

Yes, bias has made U.S. journalism incompetent, stupid, self-satisfied and useless. It will take more than one fiasco to reform it—if it can be reformed. I hope it can because democracy doesn’t function well with an untrustworthy newsmedia, Continue reading

“The Ethicist” Endorses Vigilantism

No, you can’t scam the scammers….

I haven’t been monitoring the New York Times’ “The Ethicist” column as much as I once did. After the original author of the feature, Randy Cohen, was jettisoned, the various ethicists, pseudo-ethicists and imaginary ethicists the Times recruited to fill his  slot have ranged from inconsistent to incompetent, and I stopped checking regularly until recently. Now the column has a real ethicist, for once: Kwame Anthony Appiah teaches philosophy at N.Y.U., and wrote “The Honor Code: How Moral Revolutions Happen.”  He seems to be thorough and explains his analysis using valid ethical systems. He’s a vast improvement over his immediate predecessors, but he goofs too.

A questioner asked about how he should handle scammers who tricked his father out a check. He wrote offering a threat and a settlement. They were to  return half the money, or he would report them to the consumer-affairs division of their state’s attorney general’s office and the Consumer Financial Protection Bureau, register complaints on websites and generally see that they suffered for their fraud.  His demand: send  a certified check, made out to his father, by the deadline. It worked; he got the amount requested, and the check cleared.

“But it was not certified, and it arrived after the due date,” he wrote. “Do I have an obligation to uphold my end of the deal, by not registering complaints about an outfit that is clearly scamming elderly people?”  Continue reading
