Minnesota’s Religious Freedom Pharmacist Case

In  2019, Andrea Anderson’s primary birth control method had failed, so she called her health care provider to ask for a prescription to Ella, an emergency contraceptive tablet. But when she went to  the local McGregor Thrifty White pharmacy in Aitkin County, Minnesota, pharmacist and local pastor George Badeaux refused to fill the prescription, citing his religious beliefs. He told her that a pharmacist working the following day could fill her needs if a snowstorm didn’t prevent the pharmacist from getting to work.The desperate woman ended up driving three hours round trip to Brainerd during a snowstorm to get her pregnancy-terminating pills.

Anderson sued under the Minnesota Human Rights Act, alleging sexual discrimination. The jury ruled against her.

How Much Sympathy Is Owed To Brittany Griner?

Brittany Griner, the WNBA superstar, has finally been sentenced by a Russian court for illegal drug possession. Absent the intervention of other agents and factors, she will serve nine years and six months in a Russian prison. She’s already been detained in the country since her arrest in February. It is obvious, however, that the tale is far from over.

The announcement of the tought sentence prompted President Biden to emit a typical bit of futile grandstanding, as he tweeted, “…Russia is wrongfully detaining Brittney. It’s unacceptable, and I call on Russia to release her immediately so she can be with her wife, loved ones, friends, and teammates.” It is pretty hard to be more blatantly futile, disingenuous and incompetent in a tweet than that. Biden doesn’t know that she was “wrongfully detained;” all indications are that she violated Russian law. “It’s unacceptable” implies that the United States won’t accept it, but as Biden well knows, the U.S. can’t and won’t do anything to force Griner’s release. Calling on a foreign nation to ignore its laws and law enforcement system to give an arrogant foreign violator a Get Out of Jail Free card is about as serious as ordering a foreign country to use Pig Latin, but that’s our Joe: talks tough, looks pathetic. The last part of the manifesto is especially silly. If being reunited with friends and family were a justification for releasing convicted criminals, then we should empty our own prisons. (To be fair, that is what a lot of Joe’s supporters want to see happen…a lot of Democratic district attorneys, too.)

Last-Ditch Ethics Catch-Up, 8/1/2022: Strange Questions And Answers

This was a strange day that kept me out of the office and Ethics Alarms from morn til dusk. Sorry: couldn’t be helped. It will stand in my memory as the day I was asked, in an official appearance as an ethicist in a bar deliberation over the fitness of a young man to be allowed into the august profession of “lawyer,” this question: “Do you believe character should be taught in law school?”

It might be the most bizarre question I have been asked by anyone over the age of 9 in my life. “Character” isn’t a subject or even a definable feature. If someone hasn’t developed character by the age of 21, I cannot imagine how a law school would teach it.

1. Quickly approaching “Julie Principle” territory is The Nation’s Elie Mystal, who has a long dossier at Ethics Alarms from the days before his mind snapped like a dry twig in the wind, leaving him a perpetually furious, racist, hatemongering fool. Yet that’s good enough for MSNBC, which would feature a drooling lunatic in a straitjacket if he or she spouted sufficiently venomous insults about Republicans (and Donald Trump, of course).

Here’s what poor, mad Elie said on MSNBC today:

“It’s going to be a close election in Georgia because Walker has the backing of the Republicans. You ask why are Republicans backing this man who’s so clearly unintelligent, who so clearly doesn’t have independent thoughts, but that’s actually the reason. Walker is going do what he’s told, and that is what Republicans like. That’s what Republicans want from their Negroes: to do what they were told. And Walker presents exactly as a person who lacks independent thoughts, lacks an independent agenda, lacks an independent ability to grasp policies, and he’s just going to go in there and vote like Mitch McConnell tells them to vote.”

I am definitely not a Walker fan, but the denigrating “Negro” slur should have been flagged and reprimanded by the MSNBC host, except that it was Tiffany Cross, who is almost a female version of Elie. Moreover, it is hilarious for a Democrat to mock any Republican for “doing what he is told,” when the current Democrats in the House and Senate have voted in lockstep with their leaders’ demands almost without exception.

When Ethics Alarms Don’t Ring: The Self-Disqualification Of Rep. Louise Frankel (D-Fla.)

Now THAT was a freak-out…and a particularly telling one.

Richard Kline, owner of City Diner in West Palm Beach, Florida, dared to display the campaign poster above, promoting Rep. Louise Frankel’s Republican opponent in the upcoming November election. Frankel has eaten at the diner for many years, and made it clear that this obligated the owner to support her re-election campaign, or at least not to oppose it. When someone told her about the presence of the poster in the diner, she stormed into Kline’s establishment and began berating and threatening him. Of course someone caught it all on cell phone video, and posted the scene on YouTube.

What did she think would happen? In addition to indicating that the Congresswoman has no self-control, believes she is entitled to power, and has no respect for a constituent’s right to support whatever candidate he or she chooses, the outburst demonstrates that she’s not smart enough to be entrusted with lawmaking.

“A Nation Of Assholes,” Congressional Division

Nice! There has been a recent outbreak of further uncivil, undignified speech and communication from members of Congress, who are, unfortunately role models and set help societal standards. The recent outburst have come from Democrats, though the phenomenon is not limited to that more rapidly rotting party….on the other hand, no Republican House member has yet said, in reference to President Biden, “Let’s impeach the motherfucker!” as Rep. Rashida Tlaib  did regarding President Trump. On the other hand, two Republican House members, Bill Posey and Jeff Duncan, evoked “Let’s go Brandon!” during House, which is the equivalent of  “Fuck Joe Biden.”

Chuy Garcia’s tweet is special, though. The Cook County House rep’s deep dive into vulgarity against  a random critic on Twitter was in print (though he deleted it eventually) and was unethical, unprofessional and unseemly in many ways. “Retarded,” of course, is a banned word in Progressive World. “Dipshit” is not acceptable discourse by an elected official, nor is “fucking” and its variations, though Rep. Talaib would doubtless argue that the normal rules don’t apply when the target is Donald Trump, just like “journalists” now argue that his existence justifies their routinely—but righteous!—biased and misleading reporting. —-Disgraced CNN star Chris Cuomo, celebrating himself and CNN for slanting new reports in order to oppose Donald Trump.

Cuomo could not have made a stronger case against the left-biased news media if that had been his objective. The Incredible Sabrina Caldwell Ethics Train Wreck, Part 2

Now for the rest of the story begun in Part I.

The story of the rejected and abandoned Russian orphan haunted “48 Hours” reporter Troy Roberts after he bid the girl farewell  in the Russian hospital. He wanted to know what had become of her, and tried to track her down over the years, with no success. Then, after more than two decades had passed, Caralee reached out to him and they arranged to meet once again.

That supposedly homicidal little girl who was diagnosed as incapable of love now lives in North Carolina as Sabrina Caldwell. She is 33, happily married and has four young children. Roberts met with her near Sabrina’s home, and he spoke with her husband as well. Sabrina explained that she was depressed and even suicidal when she was with Crystal and Jesse, who she felt were more interested in her younger brother than her. When she was falsely accused of trying to kill Joshua, whom she says she loved, she told Roberts she “wanted out.” She agreed that she tried to kill him. She made up the claims that she was hallucinating. When she was abandoned by her adoptive parents in Moscow, she said she  felt like she was in jail, but now believes she was partially responsible, since she had agreed to her parents’ version of events and lied about hallucinating.

Then again, she was just a child at the time.

After two months in the mental hospital, Nina Kostina, who had helped arrange her adoption, rescued Sabrina and brought her back to the United States. Three years later she adopted by another family in North Carolina.  n 2008, Sabrina volunteered for the non profit Mercy Ships, spending two years providing medical care to the poor in Africa. That led to a job at a hospital when she returned to North Carolina. Two years later, she fell in love with  fifth grade teacher Phil Caldwell, whom she met through her church. Before she would agree to marry him, she made him watch the “48 Hours” episode about her first adoptive parents. He told Roberts that he was stunned at what she had gone through. They were married in 2014, and now have three daughters and an infant son.  Sabrina Caldwell has never been diagnosed with any mental or emotional illness, and takes no medication for such disorders. The Incredible Sabrina Caldwell Ethics Train Wreck, Part I

At the end of last year, CBS’s “48 Hours” broadcast an update of a horrifying episode from two decades ago. I missed both programs, but I stumbled upon a rerun of the December 2021 follow-up last night. The tale is a true ethics train wreck that, incredibly, had a happy ending, making it also an abject lesson in moral luck.

The story had special resonance for me because it involved the aftermath of an American couple adopting of a Russian orphan, a process my wife and I went through as well.  In 1997, Crystal and Jesse were a young married couple who had tried and failed to conceive. They fund Russian adoption agency’s website and were smitten by a photo of a beautiful 9-year-old girl. The couple began the adoption process.  The child’s medical records from the adoption agency, were concerning, though: they described developmental problems.

CBS made a big deal about this, but essentially all older Russian orphans have developmental issues. Crystal told CBS that the “were assured that this child was healthy and that in a good home … with the best doctors in America helping her with the developmental issues, that she should be fine.” That was accurate advice (and she and her husband should have known that by doing responsible research before deciding to adopt a Russian orphan). I should also mention here that Russian medical records regarding orphans are notoriously unreliable. Our son, who has been freakishly healthy, came with ten pages of supposedly serious medical problems. Our pediatrician literally laughed at the document. Continue reading

Ethics Villain: Surprise! (Not Really…) It’s Cassidy Hutchinson!

Even for the rarefied, rank air of Ethics Villains, Cassidy Hutchinson, the January 6 Witch Hunt “star witness,” reeks.

Hutchinson became a goddess of the Trump Deranged when  she testified in Speaker of the House Nancy Pelosi’s prime time TV show-trial in June. The former White House aide to Chief of Staff Mark Meadows dramatically claimed that she “still struggle[s] to work through the emotions” of that admittedly ugly day. “As an American, I was disgusted. It was unpatriotic,” Hutchinson said. “We were watching the Capitol building get defaced over a lie, and it was something that was really hard in that moment to digest.”

Sure, Cassidy.

Incompetent Elected Official Of The Month (And Unethical Quote Of The Month Too!): Matt Gaetz (R-Fla.)

Really…what an idiot. There is no excuse for a political party allowing someone this obnoxious and stupid to run under its banner for Congress. After all, stupid people have a strong majority in many districts, and parties have an obligation to mitigate this democracy-mocking problem by at least trying not to nominate candidates like Matt Gaetz. Ethics Alarms didn’t need his latest embarrassment to make this observation about Gaetz: he already earned it several times over. Just peruse his EA dossier. Gaetz’s most recent mention here for being like he is was in April, and a year earlier I expounded on his creepiness at length, concluding in part,

I have seen enough to conclude that Rep. Gaetz is a creep. I don’t like creeps, and as a general proposition I don’t think creeps should be in positions of influence and power, because you can’t trust creeps. They are ethically “bent”….I know that Gaetz is a creep because he screams creepiness, like his stunt of wearing a gas mask on the floor of the House of Representatives during debate over the first pandemic aid bill, and joining a group of Republicans who forced their way into a closed congressional witness deposition during the run-up to Trump’s first impeachment in 2019. ...Then there’s his revelation last year that he has been living with a 19-year-old non-biological male, un-adopted “son”, Cuban immigrant Nestor Galban, whom he met when Galban was 12 and Gaetz was dating his older sister.

Or just listen to the guy.

As in so many other cases, the fact that someone like him could be elected speaks horribly about the voters in his district, the party that nominated him, and the state of democracy generally. His various statements show him to have a scarlet “C” on his forehead.

All of which is a prelude to his most recent episode: saying this to a crowd of Turning Point conservatives yesterday:

“Why is it that the women with the least likelihood of getting pregnant are the ones most worried about having abortions? Nobody wants to impregnate you if you look like a thumb.”

But that’s Matt!
