Major Ethics Alarm: American Journalism Is Crumbling Before Our Eyes [Part 2: Sounding The Alarm]

The analysis below was preceded by Part I: Signature Significance. I suggest reading it first. After listing and commenting on several recent examples of news media bias and incompetence, the post ends with the Ethics Alarms starting point for ethical analysis:

What’s going on here?

What’s going on is pretty terrifying. There is literally no major news media outlet that isn’t biased and untrustworthy, and the profession does not appear to care. Is it denial? Is it terrible training? Is it a misguided sense of mission? Arrogance? Whatever it is, it is res ipsa loquitur–it speaks for itself.

Don’t argue that the news media isn’t always wrong or constantly allowing partisan bias to skew its reporting: the point is the same as what Ethics Alarms explained in its Snopes post.  Once bias is manifest, the reliable reporting must occuring spite of that pollution, and there is no way for the public to know when it is being informed according to proper journalism ethics, and when it is being manipulated. The examples above are egregious. They would not have been permitted even 20 years ago, and yet now they are.

This doesn’t require much acumen to spot the problem, or elaborate measures to address. Look at the examples in Part I. How hard is it to figure out that once a reporter has been shown to be colluding with one party over another, it’s “Bye-bye and welcome to the baby zoo animal beat!” If it is so impossible for a Sunday news show to find four expert commentators who aren’t in Trump-freak-out mode, it’s time to upgrade the potential guest pundit list. When an anchor wildly mistates a fact like the McConnell quote that has been repeatedly debunked, 1) correct it, 2) apologize, and 3) give her a few days off without pay. How hard is that? It’s not hard, unless the entire profession is so devoid of ethical training and habits that it literally doesn’t know how to be honest, objective, fair, competent and responsible…you know, as in trustworthy.

Professions are obligated to police themselves. It shouldn’t be a conservative media watchdog site like Newsbusters that reveals Camerota’s unconscionable repetition of the long-debunked claim that Republicans vowed to obstruct Obama “from Day One”, it should be CNN’s competitors, or CNN. Brian Stelter, CNN’s own media watchdog, didn’t report on any of these episodes, because he has been dedicated to playing defense for his network, denying that news media bias exists. On October 16, just before another Wikileaks dump showed how many mainstream media journalists were regarded by the Clinton campaign as allies, Stelter engaged in a long sneerfest mocking the idea, which he attributed to Trump, that the news media was biased against Trump and trying to elect Clinton, beginning with… Continue reading →

Major Ethics Alarm: American Journalism Is Crumbling Before Our Eyes [Part 1: Signature Significance]

…and without trustworthy journalism, democracy cannot survive.

There was reason to hope that following its beyond miserable performance in its coverage of the campaign and election just concluded, American journalism would respond to reality and dedicate itself to repairing its broken relationship with traditional professional ethics. Poll after poll shows that the news media’s standing with the public has never been lower. Because the profession itself ought to be more keenly aware than anyone of how vital honest, fair and competent journalism is to the health of a democracy, one would expect that this would be a moment demanding brutal self-examination and rapid reform.

This is not what we are seeing, however. Consider:

  • Last weekend, ABC’s Jonathan Karl interviewed Donna Brazile in a New Year’s Day review of the election. I couldn’t believe it. She was introduced as a respectable commentator with no acknowledgment of her role in the Clinton fiasco and the news media’s disgrace. As Ed Morrissey wrote,

Why is Jonathan Karl interviewing Brazile in the first place? …It has been 62 days since CNN severed their ties with Donna Brazile over the fact (no longer an “allegation”) that she cheated during one of the Democratic presidential primary debates and attempted to cheat during a second one in Flint, Michigan. And yet ABC News is inviting her to sit down for a casual New Years Day chat like any other political analyst.

CNN shouldn’t have allowed her to be a staff member to begin with, since she was a partisan political operative. She used that relationship and exploited her conflict of interest to try to do what she could to  rig the election. She was exposed, lied by denying it, and fired. Now, after the election, she behaves as if nothing has changed, and ABC again presents her as a reliable analyst.

  • After WikiLeaks’ publication of emails from the Democratic National Committee and Hillary Clinton campaign chair John Podesta revealed collusion and shockingly unethical ties between prominent journalists and the Clinton campaign, as well as the campaign openly referring to such journalists as allies, none of the journalists so exposed have been disciplined, nor have any of the news organization employing them indicated that they were so much as troubled by the revelation.

Obamacare’s Epitaph: “Live By The Rationalization, Die By The Rationalization”

obamacare-gravestoneRemember in 2010, when the Democrats ensured that the Affordable Care Act would clear its final hurdle to passage this way?

Democrats will finish their health reform efforts within the next two months by using a majority-vote maneuver in the Senate, Majority Leader Harry Reid (D-Nev.) said. Reid said that congressional Democrats would likely opt for a procedural tactic in the Senate allowing the upper chamber to make final changes to its healthcare bill with only a simple majority of senators, instead of the 60 it takes to normally end a filibuster.The move would allow Democrats to essentially go it alone on health reform, especially after losing their fillibuster-proof majority in the Senate after Sen. Scott Brown’s (R) special election victory in Massachusetts.

Republicans have protested the maneuver as a hyperpartisan tactic to ram through a health bill, and have said that plans to use the reconciliation process make moot a bipartisan summit at the White House this week, where both GOP and Democratic leaders are supposed to present their ideas on healthcare.

At the time, Republicans, as is their wont, over-stated their objections to the maneuver, calling it unconstitutional and a breach of rules. No, it wasn’t quite that, nor was it as unusual as the GOP claimed. It was within Senate rules, but still the first time it was ever used to amend a bill that had already passed the Senate via cloture, and under such contentious circumstances.  Reconciliation was legal, all right, but since the Affordable Care Act was so revolutionary and controversial, its passage needed to be seen as democratic, and it wasn’t. Democrats ignored the Golden Rule, and extended the acceptable use of reconciliation by using a number of rationalizations, as well as “the ends justify the means.”

Let’s see: “Everybody Does It” wouldn’t work, because the problem with using reconciliation was that everybody didn’t do it, at least not very often.  So Democrats opted for 13. The Saint’s Excuse: “It’s for a good cause”…23. Woody’s Excuse: “The heart wants what the heart wants”…#24. Juror 3’s Stand (“It’s My Right!”)…25. The Coercion Myth: “I have no choice!”…28. The Revolutionary’s Excuse: “These are not ordinary times.”…31. The Troublesome Luxury: “Ethics is a luxury we can’t afford right now” …40. The Desperation Dodge or “I’ll do anything!”…59. The Ironic Rationalization, or “It’s The Right Thing To Do”…and perhaps a few other rationalizations on the list. Continue reading →

From The “Law vs. Ethics” Files: A Westin Hotel Comes To The Nuisance

The photo says it all.

In Austin Texas, Westin  opened a large hotel next to the Nook Amphitheater, which is famous venue for live music in a city with a strong music culture  Westin is now suing the Nook because its music is disturbing the guests. The complaint states that the Nook plays “chest thumping bass” seven nights a week until 2 a.m. making some rooms uninhabitable.and thus harming the hotel’s business.

Law professor and invaluable ethics story source Jonathan Turley notes that the case recalls the now defunct “coming to the nuisance” doctrine.  The defendant in such a case once could move to dismiss a nuisance claim on grounds that the plaintiff moved next door only to challenge the activities, business and even the existence of it neighbor in court.  Turley writes,

The doctrine originated in early common law with cases like Rex v. Cross, 172 Eng. Rep. 219 (1826).  The Court held:

“if a certain noxious trade is already established in a place remote from habitations and public roads, and persons afterwards come and build houses within the reach of its noxious effects; or if a public road be made so near to it that the carrying on of the trade becomes a nuisance to the persons using the road; in those cases the party would be entitled to continue his trade, because his trade was legal before the erection of the houses in the one case, and the making of the road in the other.”

American courts found the doctrine to hinder growth and work against the common good, particularly as populations in cities expanded into rural areas.

Ethics Quiz And Analysis Exercise : The Congressional Art Competition Winner’s Painting

The painting above, by high school senior David Pulphus, is now hanging in the U.S. Capitol complex, its award for being selected as the first place prize-winner in Missouri Democrat Rep. Lacy Clay’s annual Congressional Art Competition last May.  It is not clear whether Clay personally selected “Untitled #1” as the winner or had a part in the section, but the African American congressman  praised the work according to a press release:

His visually stunning acrylic painting on canvas entitled, “Untitled #1” will be displayed at the U.S. Capitol Complex.  Pulphus will travel to Washington, DC, courtesy of Southwest Airlines, to unveil his winning entry.  The painting portrays a colorful landscape of symbolic characters representing social injustice, the tragic events in Ferguson, Missouri and the lingering elements of inequality in modern American society….

In his remarks to the overflow crowd of young artists, parents and teachers who gathered at Webster University’s new downtown St. Louis campus in the historic Arcade Building, Congressman Clay said, “Tonight, we are celebrating our sixteenth year of recognizing outstanding young artistic talent. As you can see from the artwork on display here, the level of talent is truly impressive. Your work is inspiring, and I encourage all of you to continue to develop your creative abilities.”

Ethics Hero: Humorist Dave Barry

Humorist Dave Barry managed to find sufficient humor in 2016 to write his annual satirical year-end review and not fail to reach the high standards he has set for himself in this endeavor for about four decades. That would be justification enough for making the 69-year-old writer 2017’s first ethics hero, but there is more.

Most striking, perhaps, is that the column is both funny and fair. Unlike virtual all topical satire today, it does not take sides, nor show partisan bias. Some of this may be related to the fact that Barry is a self-proclaimed libertarian (perhaps explaining why his long piece did not exploit the humor potential in the campaign of the ridiculous Gary Johnson, or even more, surprising, the fat naked guy running around the podium at the Libertarian convention), but most of it springs from his possession of basic integrity as well as an impressive absence of bias. This distinguishes Dave Barry from such alleged comics and satirists as Samantha Bee, Jon Stewart, Jimmy Kimmel, Stephen Colbert, Amy Shumer, Chelsea Handler, Chris Rock, Seth Myers, Sarah Silverman, Bill Maher, John Oliver, Larry Wilmore, Trevor Noah, and the Saturday Night Live writers, all of whose point of view can be fairly summarized as the belief that if a Democrat, progressive or President Obama has ever done anything foolish or ridiculous, there’s probably a good reason for it.

This remarkable trait, now almost extinct but once known as “an open mind,” allows Barry to write such passages as..

And we voters did our part, passing judgment on the candidates, thinning the herd, rejecting them one by one. Sometimes we had to reject them more than once; John Kasich didn’t get the message until his own staff felled him with tranquilizer darts. But eventually we eliminated the contenders whom we considered to be unqualified or disagreeable, whittling our choices down until only two major candidates were left. And out of all the possibilities, the two that We, the People, in our collective wisdom, deemed worthy of competing for the most important job on Earth, turned out to be …

… drum roll …

… the most flawed, sketchy and generally disliked duo of presidential candidates ever!

Yes. After all that, the American people, looking for a leader, ended up with a choice between ointment and suppository…

I LOVE this story! I wish it WERE true!!!

Yesterday’s New York Times included a story headlined  Free Market For Education: Economists Generally Don’t Buy It, and it stated,

The odds are good that privatizing education will be part of the agenda for President-elect Donald J. Trump’s administration. […] You might think that most economists agree with this overall approach, because economists generally like free markets. For example, over 90 percent of the members of the University of Chicago’s panel of leading economists thought that ride-hailing services like Uber and Lyft made consumers better off by providing competition for the highly regulated taxi industry.But economists are far less optimistic about what an unfettered market can achieve in education. Only a third of economists on the Chicago panel agreed that students would be better off if they all had access to vouchers to use at any private (or public) school of their choice.

While economists are trained about the value of free markets, they are also trained to spot when markets can’t work alone and government intervention is required.

That summation, however, was misleading to the point of falsehood. As the Scott Alexander points out at his blog Slate Star Codex,  the source for the story indicated something quite different—materially different:

Oh, Great…CNN’s Don Lemon Was Stinking Drunk On The Air Again This Year

How professional.

Clearly, the news media, after its disgraceful performance in 2016, is determined to win back the public’s trust.

I have nothing to add to last year’s post about this. Here’s the main point…

Naturally, lots of tweeters and bloggers thought this was just hilarious and endearing, just as they would probably react with admiration if President Obama turned up stoned for his State of the Union address. The fact that too many Americans are juvenile dummies who don’t care about proper deportment, responsibility and professionalism, and who think impairment is cool, doesn’t excuse a supposed news network from validating their stupidity, or allowing an anchor to debase journalism and to send the message that being smashed on the job is acceptable. Drunks on the job cost businesses millions and occasionally get people killed. Being drunk on the job is always wrong, unless you are a paid drunk. I don’t know any of those.

It does not mitigate this display of vulgarity and lack of responsibility by CNN’s star talking head that he decided to toss all restraint and proper on-the-air conduct to the winds the second he had a colorable excuse. CNN is as irresponsible as Lemon: once he started misbehaving and embarrassing the network (assuming they know what embarrassment in broadcast journalism is, which I now doubt), someone should have ordered him off the air….An ethical news organization would at least suspend Lemon and require an on-air apology. An ethical journalist would, in fact, apologize without being forced. But an ethical journalist wouldn’t get bombed on the job.

It’s hard to know whether to laugh or cry.

The reactions to Donald Trump’s tweet above were so predictable.  Trump-haters are continuing their meltdown, because he used that scary word “enemies,” and imagining political foes being hung by piano wire and shot against a wall…maybe even THE wall. Trump’s fans are cheering, “That’s our guy!” Predictable or not, here is the official Ethics Alarms reaction to what may be Trump’s first tweet destined for the Yale Book of Quotations:

1. Get used to this. He’s not going to stop. I recommend re-reading this post from last year, on the Julie Principle. In fact, heeeeere’s Julie!

2. Oh, let’s get this out of the way: it’s a juvenile, undignified, un-Presidential message, and a deliberately provocative thing to do. It also  made me laugh out loud, I have to admit. Really, if you’re going to let this sort of thing drive you crazy, you’re not going to make it through four years. You’re not even going to make it through one. Reserve a padded room. I’m serious. Think about this song, because this is where you’re headed…

2016 Post Election Ethics Train Wreck Ethics Dunce: Jan Chamberlin…It’s The Golden Age For Irrelevant Grandstanding Jerks!

“Pssst…is that HITLER in the audience?”

Jan Chamberlin, a singer for the 360 member Mormon Tabernacle Choir, sent a resignation letter to the choir president and choir members. Who is Jan Chamberlin, and why is this by any stretch of the imagination news?  She is no one of special note, except that she crafted her resignation an insult to the President Elect of the United States, ignorantly and absurdly. That, according to the news media, and that alone, makes her today’s 15 minute star. She wrote in part:

“Since ‘the announcement,’ [ that is, the cataclysmic announcement that the Mormon Tabernacle Choir would perform as part of America’s celebration of Inauguration Day on January 20 ] I have spent several sleepless nights and days in turmoil and agony. I have reflected carefully on both sides of the issue, prayed a lot, talked with family and friends, and searched my soul . I’ve tried to tell myself that by not going to the inauguration, that I would be able to stay in the choir for all the other good reasons. I’ve tried to tell myself that it will be all right and that I can continue in good conscience before God and man.”

But Jan is thoroughly infected by whatever virus it is that has led so many left-leaning Americans to conclude that all previous standards of respect, honesty, decorum, fairness, civility, common sense and civic duty have been suspended because a manipulative, corrupt and incompetent Democratic Party nominee for President defending the awful record of the current Democratic President somehow managed to lose an election.  Thus the singer concluded that a sensible course was to make a play for historical footnote status, and metaphorically spit on the country, the public and its chosen leader before he has spent a second in the Oval Office.

Naturally, the news media, bidding to be even more roundly distrusted and reviled than its performance during the last year has  made it, responds like Sea World seals. Continue reading →
