Ethics Dunce: ESPN

protest-mizzou

ESPN has announced it will give the University of Missouri (MU), a.k.a Mizzou, football team a special humanitarian award in July to honor the team for its strike  in 2015. You know the one, right?  If you did, then you are probably retching.

This was the Black Lives Matter-esque fuse that caused over a hundred universities to explode in racial unrest and cave in to pressure from black student groups to yield to demands supposedly addressing various imagined, concocted or politically exploited race-related problems on campuses, ranging from microagressions, to inadequate race-consciousness, to unidentified people saying mean things.

That last, in fact, was what caused the Mizzou foolishness. There, three unrelated episodes caused the “crisis”:

  • Payton Head, MU senior and president of MSA,  published a Facebook saying that he was walking around campus when the passenger of a pickup repeatedly shouted the “nigger at him.

No one confirmed his claim.

  • The Legion of Black Collegians posted on social media that the group was rehearsing for a performance at the University’s Traditions Plaza when a “young man” talking on his cellphone walked up to the group, was politely asked to leave, and hurled “racial slurs” at LBC members.

Was he a student? Nobody knows.

  • Someone draw a swastika using human feces inside Mizzou’s Gateway Hall.

Funny, I think of the swastika as an anti-Semitic symbol, not anti-black one, but hey, whatever it takes, right?

None of these involved perpetrators who were identified, or who were shown to be students. None of them  were remotely within the control of the University; nor were they coordinated in any way.  Black groups on campus, however, harassed the school’s president, Tim Wolfe,  and demanded that he resign. A black graduate student began a hunger strike, promising to forgo all food and nutrition until Wolfe was ousted. Finally, black University of Missouri football players announced that they would not participate in team activities or games until the university yielded to various demands, including Wolfe’s dismissal. The coach and the rest of the team backed the black players, and the university caved.

In addition to sparking many other conflicts on other campuses, disrupting students’ education, making U.S. ccolleges look like the inmates were running the asylums (because they were) and increasing racial tensions, the episode had the effect of  causing a huge drop in enrollment that has cost Mizzou about $32 million.

Isn’t that great?

Good job, everybody!

Apparently ESPN think so, anyway. Continue reading

From The Man Who Would Be President, And Who Thinks That Rationalizations Are Cogent Arguments, A Perfect #22

22

Just two weeks ago, I breathlessly announced that Former Secretary of State Madeleine Albright, against all odds. had pulled into a lead over Donald Trump for the 2016 Unethical Rationalizations Championship by giving us a perfect #22, the worst rationalization of them all. That’s this one:

22. The Comparative Virtue Excuse: “There are worse things.”

If “Everybody does it” is the Golden Rationalization, this is the bottom of the barrel. … It is true that for most ethical misconduct, there are indeed “worse things.” Lying to your boss in order to goof off at the golf course isn’t as bad as stealing a ham, and stealing a ham is nothing compared selling military secrets to North Korea. So what? We judge human conduct against ideals of good behavior that we aspire to, not by the bad behavior of others. One’s objective is to be the best human being that we can be, not to just avoid being the worst rotter anyone has ever met.

Behavior has to be assessed on its own terms, not according to some imaginary comparative scale. The fact that someone’s act is more or less ethical than yours has no effect on the ethical nature of your conduct. “There are worse things” is not an argument; it’s the desperate cry of someone who has run out of rationalizations.

Now, Donald Trump never runs out of rationalizations; as I wrote in the Albright post, “Trump is capable of hitting the entire list of rationalizations, all 68 of them (including the sub-rationalizations) given the opportunity.” He also rose to the challenge posed by Albright quickly, for he not only gave America a Full 22, he did so in the context of arguing for an unconstitutional government breach of First, Second, and Fifth Amendment rights on a massive scale! Bravo!

On Face the Nation  yesterday, talking about the Orlando shooting,  this idiot—sorry, sorry!—Mr. Trump said..

“Well I think profiling is something that we’re going to have to start thinking about as a country.Other countries do it, you look at Israel and you look at others, they do it and they do it successfully. [DINDINGDINGDINGDING! There are two more rationalizations right there:#1, Everybody Does It, and  #3, Consequentialism, or  “It Worked Out for the Best”! I mean, this guy is a rationalization machine! ] And I hate the concept of profiling but we have to start using common sense and we have to use our heads. It’s not the worst thing to do.” Continue reading

Ethics Quote Of The Week: Popehat Lawyer/Blogger/Individual Rights Defender Ken White, Saving My Head

Duct tape doesn't work. Ken White's candor does.

Duct tape doesn’t work. Ken White’s candor does.

“What the Democrats are really saying is, ‘Because this restricts gun rights, we don’t give a shit. And before, to be honest, the Republicans and most of the Democrats would say, ‘Because this is related to terrorism, we don’t give a shit.’ I’m disgusted with them all.”

California lawyer and former federal prosecutor Ken White, the erudite, occasionally vulgar, clear-eyed and courageous head blogger at Popehat, sparing no venom in describing the current push by Democrats to allow the government to remove a citizen’s Second Amendment rights based on suspicion only.

Thank heaven, not for the first time, for the great Ken White. I had just turned off CNN this morning in an effort (successful!) to keep my head from exploding after watching CNN’s Alisyn Camerota, David Gregory and others disgrace themselves; they were all calling the unconstitutional bill allowing the Feds to take away the right to purchase a gun of those the FBI has placed on the “no-fly list,” now being supported by Democratic Senators Diane Feinstein of California, Chris Murphy of Connecticut and Joe Manchin of West Virginia, “mild,” and “reasonable,” while noting that “some conservatives” had raised “due process concerns.” Really? Those bloodthirsty, gay-hating, child-hating, gun-worshiping conservatives think that allowing the government to remove Constitutional right unilaterally based on their suspicion alone violates the Fifth Amendment? What’s the matter with them?

Then, just in time, as I felt a deep ominous, rumbling inside my skull that reminded me of Sensurround, I read Ken’s bullseye of a quote, which came in an interview and not in a Popehat blog post, here. Continue reading

Seven Facts About News Media Bias, And Yet Another Smoking Gun That Reaffirms Them

smoking gun

Here are seven facts about mains stream news media bias. People deny them, some even sincerely, but they have been well proven over many decades.

FACT: The U.S. mainstream news media is partisan and biased.

FACT: It is shockingly shameless about this.

FACT: The results of this bias include slanted news, withheld information, warped priorities, and discrediting new sources that cover stories thye intentionally ignore, all with the collective and intentional result of misleading the U.S. public.

FACT: This is arrogant, unfair, incompetent, unethical, and harmful to the proper functioning of democracy.

FACT: The news media employed this bias to make certain that Barack Obama was elected President in 2008, and has already made it obvious that it intends to be at least equally biased in its efforts to make certain that Donald Trump is not elected in 2016.

FACT: Among the techniques the news media employ is holding Republican candidates and elected officials to different standards than what it applies to Democratic candidates and officials.

FACT: Journalists, pundits, and Ethics Alarms readers who continue to deny that there is a mainstream media bias favoring Democrats and progressive policies are either lying, not paying attention, or in denial.

I must say, the last is very frustrating, and often infuriating. I have a good friend who really does believe that the mainstream news media is outrageously biased toward conservatives, because he is so far at the end of the ideological spectrum that everything is too far right for him. I have a business and a life-style that both compels me to follow many news sources on all sides of the political spectrum, and my profession and training requires me to work hard at achieving objective analysis. (I know I don’t always succeed.) I know my biases and preferences, and have to say that all seven of the facts I presented above are facts, not opinions, and because they describe a very dangerous situation, the fact that so many progressives refuse to acknowledge them makes me wonder if their ideology is inconsistent with basic integrity.

All American citizens should want and demand as objective, unbiased and fair a national news media as possible. We won’t get one until progressives admit that even though their President, elected officials, candidates and policies are the beneficiaries of unethical journalism, it is still wrong, still unhealthy, and still has to stop.

This is why I must salute Joe Concha, Mediaite’s thoughtful conservative reporter, for his excellent work in finding one of the most powerful smoking gun proofs of this bias I have ever seen.

Last week, Donald Trump horrified the pundit class when he announced that he was stripping The Washington Post of access to his campaign, announcing,

“Based on the incredibly inaccurate coverage and reporting of the record setting Trump campaign, we are hereby revoking the press credentials of the phony and dishonest Washington Post.”

Of course this was a petty, cowardly and anti-democratic move by Trump. I didn’t post on it because the ethics  position here on Trump is clear and immutable, and because if I covered all of the unethical things this crude, reckless idiot says and does, I’d have no time for anything else. The man has little judgment, few values, no restraint, and an arrested (at about age 10) ability to distinguish right from wrong. We know this, or should. Nobody should be surprised, and this incident should not change anyone’s opinion of him.

The news media, however, reacted to it as if Trump had leaned in to kiss a baby and bitten its head off:

The Post’s Chris Cillizza “Barring reporters from public events because you disagree with what they write is a dangerous precedent.”

Slate: on Trump’s decision: The revocation “marks an unprecedented escalation in his war” against media.

WaPo executive editor Marty Baron: Trump’s decision is “nothing less than a repudiation of the role of a free and independent press.”

CNN Contributor Bakari Sellers: It was “fascism at its worst.”  Also on CNN, Sara Murray opined that Trump’s revocation of The Washington Post’s press credentials was “alarming.”

Give Concha credit. Although his own opinion of Trump’s actions were as low as those of his Trump-hating colleagues, the spark of a memory stirred. He went back into the archives. What’s this? In 2008, candidate Barack Obama kicked reporters from three papers that had endorsed Republican John McCain off his campaign plane! Continue reading

From The Ethics Alarms Double Standard Files: A Brock Turner Sentence For A Predator Teacher, And Everyone Shrugs

The predator teacher, who is much more deserving of a light sentence than Brock Turner, who should be killed, and the judge too, come to think of it...

The predator teacher, who is much more deserving of a light sentence than Brock Turner, who should be killed, and that judge too, come to think of it…

The lenient sentence Judge Aaron Persky handed to Stanford student Brock Turner for raping a drunken co-ed  enraged the social media and the public conscience, resulting in thousands of op-eds, protests from feminists and rape-culture activists, petitions, a recall effort, and most devastating of all, an Ethics Alarms post.

Last week, a 33-year old high school teacher named Lindsay Himmelspach pleaded guilty to repeatedly having sex with two minor students at the high school, and received the almost the identical sentence, from another California judge, as Turner. Himmelspach recieved three years probation and four months in jail.

I’m listening, but I hear no screams of outrage.

Huh.

The judge, Butte County Superior Court Judge James Reilley, administered the equivalent rap on the wrist that her Santa Clara colleague did on Turner because Himmelspach had no prior criminal record, she expressed remorse, and somehow he concluded that she’d never do such a thing again. (I’m sure it had nothing to do with the fact the she is hot, and the judge was thinking, “Those lucky bastards!”) Indeed, the judge didn’t even require the predator teacher to register as a sex offender, at least not yet. He’s keeping an open mind, and will decide after a separate hearing.

Now THIS Is An Unethical Candidate…And An Incompetent Liar!

Diploma scam

I love this story, and salute Tim Levier for bringing it to my attention. As Tim suggested, it’s got everything. Dishonesty, incompetence, a window on the utter ineptitude of our educational system, the arrogance of unqualified officials believing that they can lie their way to power while having complete contempt for the public…and more, including a journalist actually doing his job and vetting the legitimacy of a Democrat!  A black Democrat, even!

Behold and prepare to be amazed…

Aurora School Board member and Democrat Eric Nelson is running for State Representative in Aurora’s District 42. Unfortunately for him,  a Denver7 reporter decided to check on his claimed credentials, and the hilarious result has his embarrassed party calling on Nelson to stop running for office,  and urging voter to support his opponent.

Nelson’s campaign website and his Aurora School Board biography states that he earned “a Master of Social Work from Northwest Nazarene University.” So Denver7 contacted the school, which said it had no record of Nelson attending. Nelson responded by sending what he said was a copy of his diploma via text message to two local newspapers, The Aurora Sentinel and The Colorado Statesman.

Denver7 Reporter Marshall Zelinger decided to examine the document (above) , and found several, er, problems: Continue reading

Ethics Observations On The Unethical Quote Of The Week, By Senator Joe Manshin (D-WV)

Manshin

“But due process is what’s killing us now.”

—- Democratic Senator Joe Manshin, of West Virginia, on MSNBC bemoaning the fact that the government can’t take away your rights based on “suspicion.”

Naturally, nobody on the network immediately responded, “WHAT???” I wonder if there are any broadcast journalists who would have challenged that crypto-fascist statement by a U.S. Senator. Think about that for a minute.

Just so you are clear that the quote isn’t out of context, here is what Manshin said (you can also watch the video here)

“The problem we have and really the firewall that we have right now is due process. It’s all due process. So we can all say, yeah, we want the same thing but how do we get there?” If a person is on the terrorist watch list like the gentleman, the shooter in Orlando, he was twice by the FBI, we were briefed yesterday about what happened, but that man was brought in twice. They did everything they could. The FBI did everything they were supposed to do, but there was no way for them to keep him on the nix list or keep him off the gun buy list. There was no way to do that. So can’t we say that if a person’s under suspicion,  there should be a five-year period of time of time that we have to see if good behavior, if this person continues the same traits, maybe we can come to that type of an agreement? But due process is what’s killing us now.”

Fairness To Incompetent Lawyers?

To be fair, Tamara can blame the fact that she thinks this is a good law suit on her cognitive problems..

To be fair, Tamara can blame the fact that she thinks this is a valid law suit on her cognitive problems…

Why this story didn’t make my head explode, thus rating the KABOOM! label, is a mystery. My theory is that the truly idiotic and ignorant exclamations on Facebook by my usually rational friends about guns in the wake of the Orlando terrorist attack have gradually strengthened my skull’s tolerance to internal pressure.

Once again, I have encountered a news story that required me to check and see if it was a hoax.

Tamara Wyche is a 2013 Harvard Law School graduate who is suing the New York State Board of Law Examiners. She claims she twice failed the bar exam because it refused to provide the same kind of testing accommodations that the law school did for her in her exams there, in recognition of her various cognitive problems. The fact that she flunked while being forced to take the exam under the same rules as everyone else resulted in the large Boston law firm Ropes & Gray terminating her employment. You can read her complaint here.

I confess that I didn’t read all of it: I didn’t want to press my luck with the old cranium.

The 29-year-old Wyche says she was diagnosed with depression and anxiety as a first-year law student at Harvard, and also  suffered several head injuries (?) that resulted in permanent memory problems and cognitive issues, requiring her to take several leaves of absence from her studies. She finally earned her law degree in 2013 thanks to Harvard granting her several doctor-recommended accommodations, including 50% extra time on tests, a separate testing room, and extra break time. She also was exempt from being called on in class, because of a propensity for anxiety and panic attacks.

Allow me to cut to the chase for a second, again in the interest of my dangerously bubbling brains, and perhaps yours. Continue reading

When Big Corporations Act Exactly As Bad As Bernie Sanders Says They Are..

Thank you city

Banking behemoth Citigroup is suing AT&T for using  “Thank You” in ads, because Citigroup claims that it owns the trademark on “THANKYOU.” See, it’s not enough that corporations want us to think of them when we go to a baseball game or maybe when we are wishing that our children never existed. They want us to think of them when we are being nice, too

No, this is not a hoax. I wish it were.

Law professor/blogger Jonathan Turley, who hates this as much as I do, has kindly provided links to other examples of this nauseating phenomenon (this , and this, yes, and this , don’t forget this, oh, and this nonsense , this ,this too ,here ,here ,another one here, here as well, and this), but this is really the last straw, or should be. Ethics (and Legal) Dunces: Hillary Clinton And Everyone Else Who Is Suggesting That The Government Should Be Able To Keep Someone From Buying A Gun By Placing Them On A “No-Fly List””

This post would be barely worth writing, except that I have just listened to several cable channels state with great urgency that it is a “controversy.”

It’s no controversy. The government cannot take away a citizen’s rights without due process. Currently, as explained in an ACLU lawsuit, the No-Fly List procedure itself appears to lack due process, so linking it to Second Amendment rights would be similarly unconstitutional:

“There is no constitutional bar to reasonable regulation of guns, and the No Fly List could serve as one tool for it, but only with major reform…. the standards for inclusion on the No Fly List are unconstitutionally vague, and innocent people are blacklisted without a fair process to correct government error. Our lawsuit seeks a meaningful opportunity for our clients to challenge their placement on the No Fly List because it is so error-prone and the consequences for their lives have been devastating.  Over the years since we filed our suit — and in response to it — the government has made some reforms, but they are not enough.”
