David Sirota, who is an American political commentator, radio host, a nationally syndicated newspaper columnist, a blogger, and from time to time a Democratic Party spokesperson, tweeted this yesterday:

That’s pretty straight-forward, don’t you think? Res ipsa loquitur, I would say. To be fair, Hillary would have to turn the clock back for her to be “talking about building walls,” but only four months back

The question really isn’t whether Hillary Clinton is trustworthy, but how anyone can think she is, or more pointedly, how anyone can claim she is and look at themselves in the mirror without gagging.

Observations On The Democratic Candidates Debate In Flint, MI.

Here’s the transcript.

1. The smug comments from Democratic pundits and operatives about how “substantive” the Democratic debates have been and how “ugly” and “childish” the GOP debates have been is really nauseating, and the news media should flag it as such. When one candidate is ugly and childish, as well as shameless about being so, the other candidates have little choice but to get down in the mud. That’s the situation in the Republican debates, and that is entirely due to Donald Trump. When, meanwhile, one candidate is notable for lack of trustworthiness and dishonesty, and her only opposition refuses to reference the major reason the public (accurately) believes her to be so, the resulting debate will be muted. Sanders, in short, isn’t doing his job. That’s nothing for Democrats to be smug about.

2. Last week it was learned that at least 2,079 emails Clinton sent or received on her unsecured, private server contained classified material, though she initially said that she handled no classified material whatsoever. That’s at least 2,079 lies. We learned that she received those emails on two devices , a BlackBerry and an iPad that she received in June 2010, despite the fact that she said, after news broke about her personal email account, she’d done this as a matter of convenience so she would not have to carry two devices, saying, “I thought it would be easier to carry just one device for my work and for my personal emails instead of two.” This was also a lie.

We learned that many, many people, including lobbyists, lawmakers, White House officials, State Department employees, John Kerry and President Obama communicated directly with Clinton using her personal email address. This is just another part of the Obama Administration Ethics Train Wreck, Outrageous Arrogance and Incompetence Division. That so many should have reported it and didn’t, as well as stopped it, is no excuse for the corrupted Clinton enablers to latch onto, and it doesn’t make what she did any less outrageous and reckless. It doesn’t excuse her irresponsible conduct at all. It just shows how lazy and amateurish others were as well.

We earlier learned that hackers with ties to Russia tried at least five times to access Clinton’s account over a four hour period on the morning of Aug. 3, 2011, by sending her emails. The Clinton campaign says there is no evidence to suggest she opened them, giving the hackers access to her computer. That is just moral luck.

Finally, we learned this week that Hillary Clinton, as Secretary of State WROTE 104 emails, using her private server, that the State Department has since designated as classified.

Was Clinton asked about anything related to her e-mail lies and incompetence regarding national security last night, or about her incompetent oversight of her own agency, which is supposedly one of the credits that makes her so qualified to be President?

Post-Debate Ethics, Part 2 (of 4): John Kasich’s Opportunity

It is almost too late, but not quite, for Donald Trump to be derailed by a Joseph Welch-Joe McCarthy moment. I called for a qualified and competent GOP candidate to do this seven months ago, but none had the wit or courage to deliver. Since then, Trump has provided one opening after another that could have been exploited to tear away the veil of ignorance from even the eyes of the most deluded Trump supporter. One such opening was September 16, when Trump probably doomed some innocent children by promoting anti-vaxxer myths in a nationally televised debate. A medical doctor, inexplicably running for President, was standing right next to him. Did Ben Carson say, “You know, Donald, your ignorance is stunning. Vaccinations don’t cause autism, and they save lives, but as with every other topic we have talked about, you are shooting from the hip, faking expertise you don’t have, and dangerously misleading millions of trusting Americans by pretending to have expertise you don’t have. You should be ashamed of yourself. Why aren’t you?”? No, Carson, typically, mumbled something accommodating and let Trump get away with more misinformation.

Dr. Carson’s gone now, thankfully, as are many other candidates who might have burnished their own chances and clotheslined Trump with a well-planned “Have you no sense of decency?” sequel. Only one candidate remains who has any chance of pulling off the instant character assassination that Joseph Welch executed so deftly on June 9, 1954. In my post before that September 16 debate, I predicted that one of the non-Trumps would use a variation of Welch’s line, and observed that if I was wrong, none of them “are smart enough to be President.”

As Jeff Goldblum muses in “Jurassic Park,” Boy do I hate being right all the time.” Or being right about why I was wrong.

I don’t have much hope for John Kasich, the one remaining alternative to Trump with a chance to play Welch effectively. Continue reading →

Today, Donald Trump “explained” how he came to tell Jake Tapper that he couldn’t condemn David Duke, white supremacists, or the Klu Klux Klan without some research.

What he said:

“I’m sitting in a house in Florida with a very bad earpiece that they gave me, and you could hardly hear what he was saying. But what I heard was various groups, and I don’t mind disavowing anybody, and I disavowed David Duke and I disavowed him the day before at a major news conference, which is surprising because he was at the major news conference, CNN was at the major news conference, and they heard me very easily disavow David Duke…. Now, I go, and I sit down again, I have a lousy earpiece that is provided by them, and frankly, he talked about groups…. He also talked about groups. And I have no problem with disavowing groups, but I’d at least like to know who they are. It would be very unfair to disavow a group, Matt, if the group shouldn’t be disavowed. I have to know who the groups are. But I disavowed David Duke…. Now, if you look on Facebook, right after that, I also disavowed David Duke. When we looked at it, and looked at the question, I disavowed David Duke. So I disavowed David Duke all weekend long, on Facebook, on Twitter and obviously, it’s never enough. Ridiculous.”

Trump can’t say if anything’s “wrong” with these people because he’s never met them….

Trump is averaging at least one outrageous, unethical statement a day. Either they show incompetence, or they are irresponsible, or they are uncivil, or they are lies, or they show disrespect for the office he is seeking, U.S. citizens and the nation, or all of these.

It’s rather hard to quote The Donald, since he rambles, free associates, and generally talks like someone who is tripping. In this case, one must look at the entire exchange holistically.

CNN’s Jake Tapper asked Trump this morning if he would disavow the endorsement of white supremacist and former KKK leader David Duke,or that of “other white supremacists.”

Trump claimed that he has been living in a cave (Everyone has heard of Duke): “I don’t know anything about David Duke. I don’t know anything about what you are even talking about with white supremacy or white supremacists. So, I don’t know. I mean, did he endorse me or what’s going on? Because I know nothing about David Duke, I know nothing about white supremacists. And so, you are asking me a question that I’m supposed to be talking about people that I know nothing about.”

Tapper obviously didn’t believe that Trump knows nothing about white supremacists, nor do I. He asked again: “Would you just say, unequivocally, you condemn them and you don’t want their support?” Continue reading →

[I will probably do an overview of the entire debate, but this has been straining my skull for hours now, and I have to get it down or die.]

Telmundo open-borders advocate and activist-journalist Maria Celeste Arraras asked this offensive question to tonight’s Republican contenders—well, four contenders and Ben Carson, who has the relevance of a streaker at a baseball game:

After the last presidential election the Republican party realized that in order to win the presidency it needed the support of Latinos. Guidelines as to how to accomplish that were spelled out in an autopsy report that concluded, and I’m going to quote it, “if Hispanic Americans hear that the GOP doesn’t want them in the United States they won’t pay attention to our next sentence.”

So, do you think that your fellow Republican candidates get it?

The question is misleading, assumes an answer, is based on an unethical premise, and is the worst sort of “when did you stop beating your wife?”hackery. It required a rebuke, and a firm rebuttal. Everyone ducked it. Where was Ted Cruz’s quick and precise rhetoric to call the moderator on an outrageous assumption? Where was Donald Trump, who supposedly owns this issue? Trump Goes Rogue, And If The Republican Party Has Any Integrity, Here’s What It Should Do…

Based on his unprofessional outbursts during the last Republican debate, Donald Trump has blown a fuse, and is edging ever closer to that inevitable moment when he loses the crucial brain synapse that leaves him drooling and proclaiming himself Prince of the Pangolins, or something similar. He has continued his meltdown with an anti-Ted Cruz rant released on his website as a press release. He laughably accuses Ted Cruz of being unstable, which is like Charles Manson calling Caligula nuts. He recites a number of what he calls Cruz’s lies, but they are just Cruz’s opinions. He is of the general opinion that Trump is lying about being a conservative. That seems fair and reasonable to me. What Cruz is really doing is pushing Trump’s buttons. The Donald can dish it out, but Cruz, like Megyn Kelly, is proving that he can’t take it. Trump is whining, threatening, bluffing and blustering, and generally acting like the pampered, narcissist he has always been. Finally, poor, abused Donald writes this:

“One of the ways I can fight back is to bring a lawsuit against him relative to the fact that he was born in Canada and therefore cannot be President. If he doesn’t take down his false ads and retract his lies, I will do so immediately. Additionally, the RNC should intervene and if they don’t they are in default of their pledge to me.”

A Tie: Hillary Clinton and Donald Trump. Nobody else is close.

I’m sorry that these two are so dominating the awards. They also dominated the posts last year. If they dominate the awards next year, God Save The United States of America…

Double Standard Of The Year

The deference accorded to anti-white protesters on dozens of college campuses, not just by spineless administrators but much of the news media. Similar protests, conduct and rhetoric by white students would be immediately condemned for what it would be: blatant racism.

Lie of the Year

Hands Up! Don’t shoot! The lie was uttered in 2014, but acquired new status after the Justice Department unexpectedly and definitively determined that the evidence did not support the inflammatory myth that Mike Brown was shot dead in Ferguson while trying to surrender to Officer Wilson. Never mind: the lie is part of the manifesto of Black Lives Matter and similar groups; it is still alluded to by activists and shameless politicians; it still divides the nation and focuses hate on police departments; and it has contributed to getting police officers killed while making communities more vulnerable to crime. It may be the Lie of the Decade.

Uncivil U.S. Official of the Year

Justice Antonin Scalia, who crossed all lines of judicial restraint, collegiality and civility when he excoriated his colleague, Justice Kennedy, who was the fifth vote in the majority of SCOTUS’s ruling that same-sex marriage was a Constitutional right no state could deny, with this comment in a footnote:

“If, even as the price to be paid for a fifth vote, I ever joined an opinion for the Court that began: ‘The Constitution promises liberty to all within its reach, a liberty that includes certain specific rights that allow persons, within a lawful realm, to define and express their identity,’ I would hide my head in a bag. The Supreme Court of the United States has descended from the disciplined legal reasoning of John Marshall and Joseph Story to the mystical aphorisms of the fortune cookie.”

The Jesse Jackson Award

Barack Obama. I know, this is snarkier than I like to be in these awards, but the signature diplomatic measure of the past year, the astounding, one-sided, dangerous and Munich-like deal with Iran, could only be the product of an ideological tyro placing wishes and hopes over diplomatic responsibility, and not for the first time. For most Presidents, trading dangerous terrorists for a deserter would be nadir. History has seen many tragedies seeded by world leaders with no diplomatic skills: the disastrous Treaty of Versailles, Potsdam, and the treaty that this one most resembles, negotiated by the hapless Neville Chamberlain. We can only hope that the worst case scenario doesn’t materialize, but if it does not, it will be moral luck.

Most Unethical Sports League

The NFL, for the third year in a row. “Concussion,” Tom Brady, Deflategate, more evidence that NFL players are slowly killing themselves with brain damage, Johnny Manziel. What a great sport pro football is.

Sports Cheat of the Year

Tom Brady, New England Patriots ball-deflating quarterback. Brady eventually avoided punishment because the NFL botched both its investigation and its imposition of penalties, but his smirking, cynical comments about the incident made it clear that he thinks cheating is no big deal, and most of his fans agree.

Not surprisingly, Brady supports Donald Trump.

Unethical Lawyers of the Year

Law Firm Division: Lawyers Stephen Diaco, Robert Adams and Adam Filthaut of the Florida firm Adams & Diaco were found to have “maliciously” set up the drunken-driving arrest of their opposing counsel in a high-profile defamation trial. The plot involved a comely paralegal and a cooperative DUI cop. Last I checked, it looked like all three lawyers would be disbarred for life.

Scary Lawyer Division: California lawyer Douglas Crawford held a can of pepper spray a yard from the face of the opposing lawyer saying, “I will pepper-spray you if you get out of hand.” Then the lawyer pointed a stun gun at Traver’s head and said, “If that doesn’t quell you, this is a flashlight that turns into a stun gun.” To show he wasn’t kidding, Crawford discharged the stun gun the startled lawyer’s face.

Hard-working Lawyer Division: Massachusetts lawyer, Karen Andrade, was charged with prostitution after a police investigated a report by a suspicious neighbor and found online reviews of both the lawyer’s legal services and her escort services

Celebrity Lawyer Division: Michael Cohen, one of Donald Trump’s lawyers, told the Daily Beast that it was legally impossible for a man to rape his wife. He was only a couple of decades and many court cases behind on his research. That piece of legal scholarship came after he had threatened the website’s staff in language usually associated with loan sharks and pimps.

Ethics Quote Of The Day: Ann Althouse

“What’s to “look into”? Why not a straightforward “yes”? She said “I’ll look into it,” and the, opaquely, “I don’t know the status, but I will certainly look into it.” What “status”? Who even has an idea what that means? Does she not own the rights to her speeches?”

—-Law prof. and eccentric blogger Ann Althouse, reacting to Hillary Clinton’s evasive response “I will look into it,” when asked during the recent debate if she would release transcripts of her high-priced speeches to various corporations, like Goldman Sachs.

Two points before I discuss Althouse’s analysis:

1. Somehow I missed this in my review of the debate. I shouldn’t have, but I was so pummeled by the sheer awfulness of it all that my observation skills were obviously impaired. Not as badly as most, however: the number of journalists who have praised that festival of platitudes and lies as “the best debate so far” are every bit as pathetic as Donald Trump’s throng. There is no excuse for being that estranged from reality.

2. To anticipate the complaints: I’ll stop posting on Hillary Clinton’s lies, deceits and unethical machinations when she stops engaging in them. That is not only fair and responsible, it is the only way to foil the Clinton game, which consists of making everyone sick and tired of pointing out how corrupt they are.

Prof. Jonathan Turley On The Latest Clinton E-Mail Revelations

“Highly classified Hillary Clinton emails that the intelligence community and State Department recently deemed too damaging to national security to release contain “operational intelligence” – and their presence on the unsecure, personal email system jeopardized “sources, methods and lives,” a U.S. government official who has reviewed the documents told Fox News.”

The mainstream media is dutifully ignoring this while they can, so you may well say, “Oh, well that’s just Fox News.” However, this bit of leaked information should not be surprising, and assuming that it is accurate, it follows the pattern of each bit of new data further discrediting Clinton’s various defenses for her indefensible handling of communications.

I point you to the analysis of George Washington law professor and blogger Jonathan Turley, who is that rarity in academia, a non-partisan, fair and unbiased commentator. Here, in part, are his recent comments on this matter. Please send it to the unshakable Clinton enablers in your life: a mind is a terrible thing to waste. (The emphasis is mine.)

While I agree with the Clinton campaign that these leaks are themselves problematic (both in terms of their timing and their disclosures from an ongoing investigation), I have long maintained that this was a serious scandal and that Clinton’s evolving defense does not track with national security rules or procedures. I consider the decision to use exclusively an unsecure server for “convenience” to be a breathtakingly reckless act for one of the top officials in our government. I am also deeply concerned about the level of “spin” coming from the campaign that is misrepresenting the governing standards and practices in the field. Much of what has been said in defense of Clinton’s use of the email system is knowingly misleading in my view.

In addition, Rep. Mike Pompeo, R-Kan., who sits on the House intelligence committee, “suggested the military and intelligence communities have had to change operations” due to the presumption that Clinton’s emails were compromised.

… I have previously noted that the decision of Clinton to use a personal server showed incredibly bad judgment that put classified information at risk. The defense that the information was not marked, which the campaign has been using recently, does not address the fundamental issues in the scandal. Clinton has insisted that “I never sent classified material on my email, and I never received any that was marked classified.” The key of this spin is again the word “marked.” I have previously discussed why that explanation is less than compelling, particularly for anyone who has handled sensitive or classified material.
