[I am tired, having engaged in a knockdown, drag-out session on legal ethics with a lively group of Federal bar practitioners. This was not the issue I wanted to come home to for the last post of the day. In fact, I gave up and am posting it this morning. Funny, the issue isn’t any easier now than it was yesterday.]

A pregnant woman who was a Jehovah’s Witness checked into a Sydney, Australia hospital suffering from leukemia. She directed the staff that her treatment could not include blood transfusions, as her religious beliefs forbade them. She suffered from acute promyelocytic leukemia (APL), which is treatable, and often successfully. According to The American Cancer Society, “more than 90% of patients with APL go into remission with standard induction treatment.” Pregnant women with the cancer have an 83 percent remission rate, and their babies have a high rate of survival when their mothers are diagnosed in their second or third trimesters.

In the end, the fetus and the mother died for want of proper treatment.  “Staff were distressed, grappling with what was perceived as two ‘avoidable’ deaths,” doctors at the Prince of Wales Hospital in Australia wrote in a letter published this month in the Internal Medicine Journal.

Well, they should be distressed: they aided and abetted negligent homicide.  Continue reading →

Thanks to three related factors…

1. The uncritical acceptance of Dorian Johnson’s false characterization of Mike Brown’s shooting by Ferguson Police Officer Darren Wilson, leading to a society-wide condemnation not only of Wilson but police departments across the country and white Americans as racially hostile to young black men, and

2. The fact that police officers have been shooting and killing an awful lot of unarmed black men, young or not, and

3. Inflammatory and irresponsible rhetoric from national and local leaders and elected officials

….we are in a dangerously unstable environment of virulent racial distrust, where the police are regarded as immediately suspect and placed in a defensive posture with a presumption of racism and excessive violence virtually any time an African American is the object of police action, regardless of the circumstances or justification. This is being exploited by those arrested, their families, civil rights activists, elected officials, protest organizers and the news media.

A Single Mother’s Irresponsible Defense of Single Motherhood

Allow me to stipulate:

1. Katy Chatel has every right to have a child if she wants to.

2. I accept her assertion that she is able to be, and will be, an exemplary parent, and that her child will not suffer in any way for want of a father.

3. Everything in her Washington Post essay “I’m a single mother by choice. One parent can be better than two” may be accurate and correct from her point of view, which as far as her own life is concerned, is all that matters. I will accept, for the purpose of this post, that it is correct.

4. This is a free country, and she can express any opinion that she chooses.

Stefano Gabbana and Domenico Dolce are Italian fashion design superstars, meaning that I pay no attention to them whatsoever, and don’t understand the priorities of anyone who does. Nonetheless, they have a rich and famous international clientele.. The two men were once romantic partners, but no longer; how they are just business and artistic partners, and continue to thrive.

Their thriving, however, has suffered from a self-inflicted setback. In an interview with the Italian magazine Panorama, the pair declared their lack of support for same-sex families with children created by in vitro fertilization.  “I am not convinced by those I call children of chemicals, synthetic children,” Dolce told the magazine. “Rented uterus, semen chosen from a catalog.” Gabbana added, “The family is not a fad. In it there is a supernatural sense of belonging.”

The Horror: a non-conforming opinion from prominent gay fashion icons! Can’t have that! Lapsed pop superstar Elton John, who has two sons through in vitro fertilization with his husband, David Furnish, took the remarks as a personal attack and proclaimed a boycott of the Gabbana & Dolce label. “How dare you refer to my beautiful children as ‘synthetic,’ ” Mr. John wrote on social media. “Shame on you for wagging your judgmental little fingers at I.V.F. Your archaic thinking is out of step with the times, just like your fashions. I shall never wear Dolce & Gabbana ever again.” Thus was born the hashtag #BoycottDolceGabbana.”

Hillary’s Defense: An Ethics Mess

  • I’m going to go rely heavily on links here. I have written a lot about this story already, and there are many other issues to cover. I’ll summarize the content in the pieces linked to, but the thrust is this: Hillary’s explanation in her 20 minute press conference was deceitful, dishonest, and unbelievable. Of course it was.
  • I would declare Hillary’s e-mail fiasco an Ethics Train Wreck, and still might, except that so many are refusing to buy a ticket. Even Bill is afraid to go near the tracks.
  • There are a few who are disgracing themselves—I don’t count paid Clinton cleaners like Lanny Davis, or Media Matters—but one head-exploding performance I saw today was that of Van Jones, the former White House Czar turned CNN pundit, in a “New Day” discussion this morning paired with CNN’s resident conservative pundit—because heaven forbid we examine Clinton’s conduct based on truth, honesty, and principles rather than as political gamesmanship. The two (Ann Navarro for some reason is the only Republican CNN can usually find in the morning) were asked about the phony “Colin Powell did it!” defense dreamed up in the Clinton bunker. Navarro, like anyone else who has examined that argument, found it to be bunkum, simply because the use of e-mail, its regulation in government and what we know about e-mail security has changed so much since Powell referred to it as “new-fangled.” Here’s what Jones said, after first saying that he couldn’t argue with Navarro on her reasoning, emphasis mine:

“Again, she’s playing to the heartland. If you say, listen, I did what Colin Powell did. I’m trying to do a good job. I want convenience. You know, the average person in the heartland, if you hate the Clintons, no answer is good enough. But if you’re — if you’re an honest person, well, geez, maybe this makes sense. I actually do agree, though, that we are in a different world from the Colin Powell days. I think the Colin Powell excuse sounds really good from a press point of view. I hope she keeps saying it. But I do think that, at the end of the day, we are in a different world.”

That’s Jones; that’s the Democratic spin machine, that’s the “the ends justify the means” crowd, and that’s who the networks are asking for analysis: ‘Yes, it’s just designed to confuse the yokels, and it’s not true, but it works,and I hope she keeps saying it.’

Kaboom.

Ethics Quiz: The Controversial Photo

Sometimes cheating isn’t cheating at all, but a just a different interpretation of the rules. And sometimes, it’s just cheating.

The World Press Photo contest just stripped “The Dark Heart of Europe,” a 10-photo series by Giovanni Troilo about life in Charleroi, Belgium, of a first prize after the judges decided that he had misrepresented the location of one of the  images. But before proof of the mislabeling of one of the photos settled the matter—Troilo had taken one of the images in the artist’s studio outside Brussels and not in Charleroi as the series titles had represented—another of the images in his entry had caused a rules dispute.

 Troilo had photographed his cousin having sex with a woman in the back of a car, using a remote-control flash to illuminate the steamy back seat. By putting a flash in the car, the stickers said, Troilo had effectively staged the photo, violating the ethics of  photojournalism and the rules of the contest.

The original caption on the photo posted on the World Press Photo website was, “locals know of parking lots popular for sexual liaisons.” The photographer said he had made it clear to World Press Photo that he had followed his cousin on a night when his cousin had planned to have sex, and had his cousin’s consent to place the flash device in the car. World Press Photo rules state that “staging is defined as something that would not have happened without the photographer’s involvement.”

Troilo argues that his photo of the sexual liaison qualified under this definition. He didn’t tell his cousin to have sex in the car, and it would have happened whether he photographed it or not. “This is not a stolen photo of a couple caught unawares,” the photographer said, explaining that his goal was “to show voyeurism through voyeurism. The camera becomes active; it becomes the sense of shame.”

Other photojournalists argue that by conspiring with one of his subjects to illuminate the event, Troilo left the realm of photojournalism and entered that of .  portraiture. One of the harsher critics wrote on Facebook, “The photojournalists we want to represent do not call upon their cousins to fornicate in a car.”

Ethics Hero: Former Red Sox Pitcher Curt Schilling

No, this isn’t about “the bloody sock.”

When Curt Schilling found his teenage daughter the target of obscene tweets from anonymous Schilling haters —he annoys vengeful Yankee fans because he led the historic Boston comeback from a 0-3 deficit that humiliated their team in 2004, deranged Democrats because he is a Republican, anti-Christian bigots because he is openly devout, and there was that scandal involving his game company blowing through millions of taxpayer dollars bestowed on it by Rhode Island —he got both mad and even, tracking down their identities, and exposing them and their filthy cyber-bullying on his personal blog.  He apologized to his daughter for prolonging her embarrassment, saying,

P.S. Gabby I know you’re likely embarrassed and for that I apologize,” he wrote. “But as we have talked about, there is no situation ever in your life, where it’s ok for any ‘man’ to talk about you, or any other woman this way (and truth be told no real man would ever talk this way anyway). It truly is time this stopped.”

Several of Gabby’s tormenters felt her famous father’s wrath in substantive ways. In the aftermath of Schilling’s counterattack,  Adam Nagel  was suspended by Brookdale Community College, where he’s a student and a disc jockey, and Sean MacDonald was terminated by the Yankees, where he worked as a part-time ticket seller. The ex-pitcher noted that several athletes who slimed Gabby Schilling were punished by their coaches.

“Making life easy for the Clinton family, and ethics be damned”

I apologize for taking such a long time to figure this out. Upon reflection, it’s been obvious for a long time. I wonder if the Clintons’ fans and supporters understand that their heroes have no respect for ethics? Perhaps they don’t care.

The lightbulb went off for me when it was revealed that the Bill, Hillary & Chelsea Clinton Foundation has changed its policy on soliciting and accepting contributions from foreign governments and has now received millions from foreign governments including Qatar, a prominent backer of Hamas.

Playing stupid (and protecting the Clinton’s flanks the best they can, as is their nature), the Washington Post and other media outlets have written that this raises “ethical questions as Hillary Clinton ramps up her expected bid for the presidency.” No, it doesn’t raise any ethical questions at all. This is unethical. It’s blatantly unethical. The Clintons know it’s unethical, but because they are themselves unethical, they are doing it anyway. What’s the question?

At the National Journal, that Passenger Pigeon of journalists, Ron Fournier, correctly calls the decision “sleazy and stupid.” I’m not so sure about stupid, if the only objective is to elect Hillary Clinton, and it is reasonable that Bill and Hillary have concluded that anyone who still supports them care as little about ethics as they doe. Besides, ethics schmethics, LOOK AT ALL THIS MONEY, BILL!

Note To Dr. Vesna Roi: Homophobes Can’t Be Doctors….Ethical Ones, Anyway

Jami and Krista Contreras waited in the exam room for their newborn child’s first checkup. Then they were informed that the doctor they had asked to see had decided, after “much prayer,” that she could not treat the baby because its parents are lesbians.

Presumably the doctor,Vesna Roi, does not habitually require her patients’ parents to fill out a questionnaire to prove the are sufficiently morally worthy to have their infant receive medical care. Nonetheless, so vile does she consider this couple that she feels it is the Lord’s will that she withhold her services from the innocent child they have undertaken to love and raise.

I probably do not need to tell you, and I certainly should not have to remind “Dr”–and I use the title advisedly–Roi that this cruel and hateful conduct is a flaming breach of medical ethics, though no rules should be necessary to persuade a medical professional to have a heart and a soul.
