There Is Gender And Racial Bias In The Legal Profession, But This Study Doesn’t Prove It…Because Of Bias

Incompetent, agenda-driven research leads to warped debates, hyped conclusion and bad policy. It also undermines credibility of those who cite some legitimate problems. The recent report, which proposes strategies for employers to eliminate the alleged barriers to women and minorities in the legal profession, is such research. It was conducted by the Center for  WorkLifeLaw at the University of California, Hastings College of the Law, for the bar association’s Commission on Women in the Profession and the Minority Corporate Counsel Association.

At least the New York Times headline, for once, was accurate., at least the online version: “Lawyers Say They Face Persistent Racial and Gender Bias at Work.” Yup, that’s what the survey showed. What it didn’t show is that there really is such discrimination, how much there is, or how it manifests itself. Here’s part of the executive summary:

Prove-It-Again. Women of color, white women, and men of color reported that they have to go “above and beyond” to get the same recognition and respect as their colleagues.

  • Women of color reported PIA bias at a higher level than any other group, 35 percentage points higher than white men.
  • White women and men of color also reported high levels of PIA bias, 25 percentage points higher than white men.
  • Women of color reported that they are held to higher standards than their colleagues at a level 32 percentage points higher than white men.

This demonstrates, at least within the reliability of the survey,  that minorities and women perceive that they are being discriminated against more than white males. That’s a useless result. We have seen and read, for example, how various African American activists and celebrities like Charles M. Blow and Ta’ nahisi Coates teach their sons that police are racists, and that they must fear them. As a result, they interpret all interactions with police through this prism. One doesn’t have to be a research ethicist to conclude that this warps their perception. Similarly, all women currently in the workplace have been bombarded by the media, activists, peers and the culture for most or all of their working lives about how hostile the workplace is to women.

At least four of the seven most common and insidious biases are at work:

1. Herd mentality: The tendency to adopt the opinions and follow the behaviors of the majority to feel safer and to avoid conflict. Also known as mob psychology, peer pressure, and group-think.

Members of groups seeking political power through maximization of perceived victim status are influenced by the needs, mission and perceptions of that group.

2. Confirmation Bias: the tendency to look for or interpret information in a way that confirms pre-formed beliefs.

If you already believe that you are going to be the target of discrimination, you will interpret events to confirm that belief.

3. Self-Serving Bias: when an individual attributes positive outcomes to internal factors and negative outcomes to external factors.

This is the most tragic phenomenon of both a history of bigotry towards certain groups and the laudable efforts to raise awareness of it to eliminate the conduct. It pushes women and minorities to blame external factors for their failures, and in so doing impedes their chances of success. I have previously written about my personal epiphany in this area, when an African American singer who I rejected for a challenging tenor role accused me outright of not casting him because of his color. He could not hit the notes the role required, and yet he was convinced that bias, and not his own deficiencies as a singer, was what cost him the part.

4. Bias Blindness: the tendency not to acknowledge one’s own thought biases.

I don’t doubt that there is considerable gender and racial bias in law firms. Indeed, I am certain of it. This kind of study, however, is not the way to sound the alarm, and smacks of either incompetence or dishonesty.

1. Serena ethics updates An indignant Facebook friend appeals to authority by telling me that  Chris Evert and Billie Jean King are defending Williams, and that they know more about professional tennis than I do. That’s a classic appeal to authority, and a very lame one. What a surprise that female tennis superstars have each others’ back! Chris and Billie Jean sure aren’t ethicists. I’d love to interview them. “So you believe that coaching from the stands, even though forbidden by the rules, should be allowed? Do you think that an unknown player who behaved like Serena did would have been treated any differently? Do you think that anyone would be supporting her if she were penalized? Since the record shows that Ramos does not treat men any differently than he treats women on the court, doesn’t Serena owe him an apology? Can you comprehend why calling a ref, whose reputtaion depends on being regarded as fair and unbiased, a “thief” is worse that calling him a “four-letter word”?

I can play the biased expert witness game too: here’s Martina Navratilova’s op ed, which is comparatively ethically astute and tracks with my post in many respects.

The polls about Mark Knight’s “racist and sexist” cartoon has these results:

85% side with Knight. I’d love to hear the explanation of the one voter who said the cartoon was sexist but not racist.

The reason I made the issue an ethics quiz is because I’m really torn in the issue. Yes, cartoons of blacks employing exaggerated features naturally evoke Jim Crow and minstrel show racist images. But political cartoons exaggerate features, often in unflattering ways. That’s the art form. Does this mean that blacks are immune from ever being portrayed cruelly in a political cartoon? I think that’s what the anti-Knight contingent is arguing.

My view is that double standards are destructive and unethical. By the by, were Jimmy Carter’s lips that big?

Ethics Quiz: The “Racist, Sexist” Cartoon

Australian sports cartoonist Mark Knight drew the cartoon above criticizing Serena Williams’ tantrum and otherwise unacceptable behavior as she lost the women’s title at the U.S. Open to young Naomi Osaka.

The cartoon was immediately attacked as sexist and racist. Is any criticism of Williams’ conduct racist, since she couched it as justified as a protest against alleged gender discrimination by umpire Carlos Ramos? Is any caricature of an African American celebrity subject to accusations of racism? Here is another tennis cartoon by Knight mocking a white, male player:

The Washington Post claimed that the Williams cartoon employed “facial features reflecting the dehumanizing Jim Crow caricatures so common in the 19th and 20th centuries.”

Tennis Ethics: Spectacular Ethics Train Wreck At The U.S. Open

 

Wow.

And tennis is supposedly one of the most ethical sports.

This weekend’s U.S. Open women’s final opened up so many cans of ethics worms that they should be squiggling for weeks.

Here is the New York Times report in part:

Anger, boos, tears and an accusation of sexism overshadowed a remarkable victory by Naomi Osaka, a rising star who became the first tennis player born in Japan to win a Grand Slam championship.

Osaka soundly defeated her childhood idol, Serena Williams, 6-2, 6-4, in the women’s final of the United States Open on Saturday, blocking Williams from winning a record-tying 24th major singles title. But the match will long be remembered for a series of confrontations between Williams and Carlos Ramos, the match’s chair umpire, who issued three penalties against Williams in the second set, after Osaka had established her dominance.

The first was a warning after Ramos felt Williams was receiving instructions from her coach, Patrick Mouratoglou, from the stands, which is against the rules. Williams was offended by the implication that she was cheating, and she demanded an apology. Later, after losing a game, she smashed her racket on the court, incurring a second penalty and the loss of a point. Finally, after she called Ramos a “thief” for taking the point from her, Ramos cited Williams a third time, resulting in the loss of a game. Williams’s anger intensified, and she pleaded for help from the tournament referee, Brian Earley, and the Grand Slam supervisor, Donna Kelso….

But what should have been a moment of uninhibited joy for Osaka turned into tears of sadness. The postmatch celebration was tarnished by the angry booing from fans upset over what they perceived as Ramos’s unfair treatment of Williams, and amid the cacophony, amplified by the closed roof because of rain, Osaka pulled her visor down over her face and cried….

In the second game, Ramos spotted Mouratoglou urging Williams to move up, and Mouratoglou conceded that he was, in fact, coaching. But he argued that it is done by every coach in every match and that the warning was the cause of what followed. He said Ramos should have quietly told Williams to inform him to cut it out. “That’s what umpires do all year,” the coach said, “and it would have ended there, and we would have avoided a drama that was totally avoidable.”

Williams approached the chair to tell Ramos that it was a “thumbs-up” gesture and that she would never accept coaching on court, which is against the rules of Grand Slam events. “I don’t cheat to win,” she said in a stern tone. “I’d rather lose.”

During the next changeover, tensions seemed to simmer down during a civil exchange when Williams explained to Ramos that she understood he might have interpreted some coaching, but that none actually existed.

Williams went back on court, held her serve in that game, and then broke Osaka’s serve to take a 3-1 lead in the second set. If she could have consolidated that break, it might have turned the flow of the match. But Osaka broke right back, and after the game ended, Williams destroyed her racket by throwing it to the court in anger. That resulted in a racket abuse penalty, a second code violation, for which the penalty is a point. Osaka would start the next game ahead by 15-0. When Williams realized that, she argued more and demanded that Ramos apologize to her and make an announcement to the crowd that she was not receiving any coaching. Ramos, known for his no-nonsense approach, did not relent.

“You owe me an apology,” Williams said. “I have never cheated in my life. I have a daughter and I stand for what’s right for her and I have never cheated.”

When the next changeover came, with Osaka leading, 4-3, Williams, still visibly distraught over what she perceived as unfair treatment, told Ramos that he had stolen a point from her and called him “a thief.” For that, Ramos gave Williams a third code violation, which meant she lost a game. Without swinging her racket, Osaka was now ahead, 5-3, and one game from the championship. Williams did not appear to realize that Osaka had been given the game until she reached the baseline again. Now fuming, she returned to the chair and demanded to speak to Earley and Kelso. Fighting back tears as the crowd yelled, hooted and booed, Williams pleaded her case. She said the treatment was unfair and argued that male players routinely behave in the same manner without facing penalties.

“There are men out here that do a lot worse, but because I’m a woman, because I’m a woman, you’re going to take this away from me? That is not right,” Williams told one official. Later, at a post match news conference, she accused Ramos of sexism for issuing a code violation for her “thief” accusation….

As the players stood next to each other, fans booed and Williams, seeing how upset Osaka was, moved over and put her arm around the new champion and then pleaded with the fans not to boo.

Osaka, in her speech, apologized to the fans, acknowledging that most of the fans were rooting for Williams in her quest to set a career record.

Now this, from the Sporting News:

Patrick Mouratoglou admitted to coaching Serena Williams during the U.S. Open final, but believes she never received his message….Mouratoglou said he had attempted to help Williams, but added coaching was common in almost every match.”I’m honest, I was coaching. I don’t think she looked at me so that’s why she didn’t even think I was,” he told ESPN.

“But I was, like 100 percent of the coaches in 100 percent of the matches so we have to stop this hypocritical thing. Sascha (Bajin, Osaka’s coach) was coaching every point, too. “It’s strange that this chair umpire (Carlos Ramos) was the chair umpire of most of the finals of Rafa (Nadal) and (his uncle) Toni’s coaching every single point and he never gave a warning so I don’t really get it.”

Travel Notes…[UPDATED]

Every trip I take seems to require some ethical clarification…

  • Lose-lose. At our hotel in Ft. Lauderdale, a convention of either transvestites, transgender individuals, or some combination of the two dominated the hotel. The organization was “Himmaher”…I think I’m spelling it right. [Correction: I wasn’t. And that wasn’t the organization; it was the name that was listed for the gathering, and the name was HIMMERSHE. Thanks to Zanshin in the Comments below for the correction.]

I had several illuminating encounters. I don’t know that this is true of all such people, but the members of this association or club all seemed to want to make any non-club member they saw as uncomfortable as possible. Yes, that’s unethical. How you choose to dress, what you choose to have lopped off, and who you want to sleep with could not interest me less, and that is the  attitude a society like ours should strive to encourage. (None of those things should engender and advantages, either.) But what these people seemed to be seeking was imposed ethics zugswang. If you looked directly at them, the response was a chip-on-the-shoulder, “Go ahead and stare, honey: neverf seen a freak before?” If you appeared to be avoiding staring—I regard a six-foot ex-male standing in the middle of a hotel lobby in a  wig, skimpy bathing suit, 6 inch heels and speaking loudly in a base voice as parading a psychological problem or ten, and deserving the same social courtesy I would offer to a Tourette’s victim or a hebephrenic—then the individual decided to make it a project to get you to stare, as if your failure to provide the attention they craved was an insult.

Just flew to Florida on pressing business. Ethics knows no obstacles…

1. From the  “The Ends Justify The Means” Files, Democratic section: Led by Sen. Cory Booker, Democrats are releasing confidential documents willy-nilly, in breach of Senate rules.  The Washington Post calls this “civil disobedience.” Elected officials aren’t allowed to engage in civil disobedience, because their duties include maintaining civil order and the Rule of Law. This isn’t civil disobedience. This is Democrat Senators violating rules when they think it’s to their advantage to do so. Chuch Schumer, whose reputation and level of public trust should be in freefall for anyone paying attention, tweeted,

“I stand w/ Judiciary Committee Democrats who are well within their rights to release these very important documents that a former Kavanaugh deputy designed as “committee confidential.”

This is apparently another convenient Democratic Party rule change: restrictions don’t count if Democrats don’t like the official who has the power to issue them.

2. This is  pure bigotry and discrimination. Why isn’t that obvious? Why isn’t the news media pointing it out? From the LA Times:

Twentieth Century Fox was just days away from locking picture on “The Predator” when an urgent note came in: Delete the scene featuring Steven Wilder Striegel. Striegel, 47, didn’t have a big role in his longtime friend Shane Black’s reboot of the sci-fi thriller — just a three-page scene shared with actress Olivia Munn.But last month, Munn learned that Striegel is a registered sex offender who pleaded guilty in 2010 after facing allegations that he attempted to lure a 14-year-old female into a sexual relationship via the internet. When Munn shared the information with Fox on Aug. 15, studio executives quickly decided to excise him from the movie.

This reminds me of the scene in “Ship of Fools” when a passenger is exiled from the captain’s table on a German ship because a Nazi complains that he is Jewish. Continue reading

Morning Ethics Warm-Up, 9/5/2018: Doppelgangers And Other Weirdness

Oh-oh! It’s a creepy morning…

1. If “there are no coincidences,” then what the hell does THIS mean? The ethics category, if there is one, would be “Nature Incompetence,” or perhaps “deity abuse of power.” Look at minor league baseball pitcher Brady Feigl:

Oh! I’m sorry! I meant “Look at these TWO minor league baseball pitchers who are both named Brady Feigl.” One is in the Texas Rangers system, and the other is in the Oakland A’s system.

A similar example of God fooling around for his own amusement and our confusion had historical significance.

This man is Will West, a convicted criminal who was sent to Leavenworth Prison in 1903…

The fact that the two men were so facially similar helped convince American law enforcement to begin using fingerprints rather than facial measurements for identification.

2. Over-blown conservative news media controversy of the week: In “First Man,” Ryan Gosling plays Neil Armstrong. For some reason, director Damien Chazelle decided to omit the iconic moment when Armstrong planted the American flag on the Moon. The Horror. Fox News can’t stop talking about it. Sunday Morning Ethics Warm-Up, 9/2/18: Talking Rabbits, Giant Ants, And California Progressives

Good Morning!

1. I may start banning commenters who keep saying this. A new, articulate and agenda-driven commenter, Ross Grazier, writes, “But your writing on this blog seems to be all about politics and much less about ethics.” I don’t want to drive Ross off, since the position of Ethics Alarms Knee-jerk Progressive Ratioanalizer And Denier of Mainstream Media Bias seems to be vacant at the moment, but I’m really, really sick of this common smear of my work (Ross’s comment also reminded me that I need to add the “s0 called ethicist” and “self-anointed ethicist” to the magic phrases that can get a commenter banned). Not for the first time, I decided to categorize every topic I wrote about here in the past week as political, non-political, or “mixed,” meaning that the article included substantive relevance to political figures or controversies but that the ethical issues involved were not solely political in scope or relevance. There were 42 distinct topics discussed (I did not include the Comments of the Day). Of these, 26 were non-political. Ten were “mixed.” Exactly six were  “about politics.”

I was surprised, frankly. I expected a bit more emphasis on politics.

I regard Ross’s accusation and others like it as an either an effort to undermine my credibility and the reputation of Ethics Alarms, or as an example of confirmation bias at work. Easily debunked claims that are asserted anyway in print are unethical.

2. Movie Ethics Potpourri! A. I finally saw “Peter Rabbit,” which was the subject of a (Non political, Ross!) post here. You may recall that Sony was pressured into grovelling an apology for a scene in which the animated rabbits shot blackberries into Mr. McGregor’s mouth using sling-shots, provoking an allergic reaction. Seeking its 15 minutes of cheap publicity and social media outrage mongering, Kenneth Mendez, president and chief executive of the Asthma and Allergy Foundation of America, said, “Making light of this condition hurts our members because it encourages the public not to take the risk of allergic reactions seriously, and this cavalier attitude may make them act in ways that could put an allergic person in danger.” Naturally, there was a Change.org petition demanding that the offending sequence be removed. Now that I’ve seen the film—which is pretty good, not quite “Babe” good, but well-done and fun—I can appreciate the full insanity of the complaints.  B. The British film “Calibre,” now playing on Netflix, is a “Deliverance” style ethics movie, in which two reasonable good guys go on a hunting trip in Scotland and are hurled by bad luck and panic into a series of ethical dilemmas, managing to make exactly the wrong decision at every turn. In the end, three people are dead, multiple crimes have been committed, and the lessons are murky. This is an excellent “what would you do?” film for group discussion, though the ultimate answer is “Don’t go hunting, in Scotland or anywhere else.” C. Finally, in the rarified category of giant ant movie ethics, there is “Them!” It is a justly admired 50’s Sci-Fi flick about an alien invasion of giant ants, featuring a surprisingly accomplished and diverse cast including pre-“Gunsmoke” Jim Arness, James Whitmore, ol’ Santa Clause himself, Edmund Gwenn, ubiquitous Western character actor Dub Taylor, and Sigourney Weaver’s wacky uncle, Doodles Weaver. I hadn’t seen it for a while, and forgot that it included one of the most blatant examples of Rationalization #58. The Universal Trump, or “Think of the children!” on film.

Scientists and the military have determined that the giant ants—We’re talking THIS big:

—have invaded California (from outer space, in ant-shaped space ships!), that they pose a threat to LA, the state, and entire country, and that there may be hundreds of thousands of them. California has declared martial law. A military commander announces that the best strategy is to gas underground passages where the ants are presumably gathering, and then kill the ones who escape to the surface. No, says Big Jim. It seems that there are two small children missing that were taken by the ants from their now thoroughly masticated and dead father. As long as there’s a chance they may still be alive,  Jim says, we can’t take the chance of harming them. The man is gob-smacked. “You mean you’d risk all of Los Angeles for two kids who are probably already dead?” he asks, in a fair framing of the issue. “Why don’t you ask their mother?” says Arness. “She’s right over there.”

The Return Of Louis C.K. For Ethics Dummies

Ick.

Reading the news media and entertainment websites, one would think that Louis C.K.’s return to stand-up comedy after nearly a year in exile or rehab or something raises ethics conundrums that would stump Plato, Kant and Mill. It’s not that hard. The fact that everyone, especially those in the entertainment field, are displaying such confusion and angst just tells us something useful about them. They don’t know how to figure out what’s right and wrong.

In case you have forgotten, cult comedy star  Louis C.K. admitted last November at the peak of the #MeToo rush that he had masturbed in front of  at least five women without their consent. Ick. His cable show and other projects were cancelled, and he disappeared from the public eye. Then, last weekend, he returned to the stage at the Comedy Cellar in New York, performed for about 15 minutes, and received a standing ovation.  This apparently alternately shocked or confused people. I’ll make it simple.

Does the comedian have a right to practice his art after the revelation of his disgusting conduct?

Of course he does. He wasn’t sentenced to prison. He has a right to try to make a living at what he does well. In fact, he has a First Amendment right to tell jokes any where others will listen to him.

OK, he technically has a right. But is it right for him to come back like nothing has happened?

What? The man was publicly shamed and humiliated. He can’t come back as if nothing has happened, because everyone knows that something has happened. Nevertheless, his art does not require the public trust. It does not demand good character, or even the absence of a criminal record. Does a great singer sound worse because he was abusive to women? No. Is there a law that says men who are abusive to women should never be able to work again? No, and there shouldn’t be. I wouldn’t hire C.K. to work in an office, because I see no reason to trust him around others. But he’s not a worker, he’s an artist. He never engaged in inappropriate conduct on stage. He can be trusted as an artist,at least when he’s performing solo.

Comedian Michael Ian Black tweeted regarding Louis C.K.that “Will take heat for this, but people have to be allowed to serve their time and move on with their lives.I don’t know if it’s been long enough, or his career will recover, or if people will have him back, but I’m happy to see him try.” For this he apologized,  saying this position was “ultimately, not defensible.” after he was broiled on social media. Saturday Ethics Warm-Up, 9/1/18: Ethics Is Like Making Hamburger…[UPDATED]

1. More fake news, future news, and “if you hate Trump, you’ll like this” news. Nah, there’s no mainstream media bias!

Ann Althouse performs an expert take-down of an inexcusable piece of hackery by Megan McArdle in the Washington Post titled “Poll by sinking poll, Trump inches toward impeachment.”

[The wrong link to Althouse was up yesterday: it’s fixed now.]

How I love it when other do my work for me: Ann has been getting increasingly eccentric, but here she is at her best. Read both McArdle’s trash and Ann’s defenestration of it, but here are some key points from Althouse:

  • “what made me want to blog this is the first line of the column, “By any metric, Trump is in trouble,” which is followed by:

A poll out from The Post and ABC on Friday shows that 60 percent of voters disapprove of the job he’s doing as president, a new low. But that’s just one poll; the polling average at statistician Nate Silver’s FiveThirtyEight shows Trump with a mere 53.4 percent disapproval rating, which is better than its 56.8 percent peak last December.

So there’s an obvious “metric” — the famous Nate Silver metric — by which Trump is doing better than last December, but “By any metric, Trump is in trouble”?!

  • But a presidency is not in good shape when the best spin on the new poll is “It’s an outlier! Only 53 percent of the country thinks the president is terrible.” The poll is especially ugly for Republicans with midterms looming in two months.

No. 53 percent didn’t say “the president is terrible.” They said “disapprove” when asked whether they approve of disapprove. And they might disapprove of other options too, such as impeachment or even (if it could be magically possible) Hillary for President.

  • More McArdle:

It’s all too easy to imagine a similar scenario for Democrats intent on impeaching Trump as they come up short looking for Republicans to help them make it across the finish line. But it’s not entirely impossible to picture a few Republicans going along….

We’ve gone from “by any metric” to “it’s not entirely impossible.” Come on! Were we not supposed to read this far into the column? WaPo is all headlines and first lines these days. Get your hit, and maybe you can face another day with Trump as President.

Ann’s last line is spot-on, and describes exactly what social media is like these days. Oooo! Trump flew the White House flag full-mast a couple of days early! What a monster! …What? People say Trump doesn’t like Jeff Sessions’ accent? He’s horrible!Hey! The Trump Administration is doing pretty much exactly what the Obama administration did, but it’s Trump, so now it’s wrong!”

2. More Aretha Franklin Ethics. Even a funeral of a beloved pop star can’t proceed without manufactured outrages, controversies and PC offenses. Bishop Charles H. Ellis, III, felt that he had to apologize for touching singer Ariana Grande like this after she performed during the funeral service for Aretha Franklin…

The funny thing is that this could indeed constitute sexual harassment in a workplace setting, if the singer decided that the touch—unconsented, arguably a mini-grope–was “unwelcome.” So the Bishop had to grovel, which he did, saying,

“It would never be my intention to touch any woman’s breast. … I don’t know I guess I put my arm around her,” Ellis said. “Maybe I crossed the border, maybe I was too friendly or familiar but again, I apologize….I hug all the female artists and the male artists. Everybody that was up, I shook their hands and hugged them. That’s what we are all about in the church. We are all about love. The last thing I want to do is to be a distraction to this day. This is all about Aretha Franklin.”
