Comment Of The Day: “How Many Rationalizations Can You Spot In This Op-Ed?”

In the post, How Many Rationalizations Can You Spot In This Op-Ed?, I challenged readers to read the depressingly meat-headed New York Times op-ed by a defender of Nashville mayor Megan Barry. and challenged them further to identify all of the rationalizations and fallacies it contained. Only one of you took on the challenge in its full, horrible scope, in part because not everyone pays to get past the Times paywall. Fortunately one who did take it on was the newly-minted Michael West, who dissected the essay as if it were a pithed frog.

Here is his Comment of the Day, freeing me from the obligation to post the answers to my question.

Having reviewed the Rationalizations List, here’s my go:

Paragraph 2:
“Along with this confession, the mayor offered the kind of full-throated apology we almost never get from public officials: “I accept full responsibility for the pain I have caused my family and his,” she said. “I knew my actions could cause damage to my office and the ones I loved, but I did it anyway.””

But she doesn’t accept full responsibility. If she did, and clearly her affair led to extreme financial irregularities which amount to defrauding the public, then accepting responsibility probably requires resignation.

Paragraph 3:
“She ended her statement with a pledge: “God will forgive me, but the people of Nashville don’t have to. In the weeks and months to come, I will work hard to earn your forgiveness and earn back your trust.””

I don’t think “God will forgive me” is a rationalization. It may be an actual deeply held belief, but the State of Tennessee is a bit more hard-nosed. At best this is just poll-tested platitude, but at worst, it is meant to convince some people to forgive her also (which makes it a diversion, not a rationalization). Working to earn their forgiveness and trust is an appeal to 21A Ethics Accounting: Criminal’s Redemption. She thinks future “good works” can atone for past sins. They cannot. What atones for past sins is having that sin and its effects blotted out, which in the case of defrauding the public, the only atoning that works is resignation.

Paragraph 4:
“This promise did not seem like an act of damage control. This is the way Megan Barry really talks. The language of full emotional availability is her native tongue.”

Appeal for sympathy, which is the opener for the next string of rationalizations.

Paragraph 5:
“Perhaps that’s why this city loves her. She hugs schoolchildren. She looks genuinely joyful at city parades and festivals. She grieves that too many Nashville teenagers are slain by guns. When Max Barry, her own son and only child, died suddenly last summer, the people of Nashville wept with her. When she spoke openly about the drug addiction that killed him, we marveled at her courage and admired her resolve to bring addiction out of the shadows of shame.”

This is Ethics Accounting again. She’s a really great person…so it’s implied we should overlook this one thing.

Paragraph 6:
“But in a red state like Tennessee, this liberal mayor also has powerful opponents, and they are not idiots. An editorial in the conservative Tennessee Star wasted no time in calling for her resignation: “Barry and the fawning, liberal Nashville media are trying the Clinton defense.””

This is a diversion away from the miscreant by accusing the accusers of bad faith motives. #48 Haters gonna hate. Her critics are ONLY demanding accountability because they want a political advantage or want to win a tactical maneuver. Continue reading

How Many Rationalizations Can You Spot In This Op-Ed? [UPDATED!]

 

At the beginning of the month we discussed the scandal in Nashville, Tennessee, where the female mayor, —the news media tried oh so hard to bury her party affiliation deep in reports, but she’s a Democrat— was carrying on an adulterous affair with the head of her security detail.  Some quotes from the Ethics Alarms essay to refresh your memory for the horrors to come:

—She apologized “for the harm I’ve done to the people I love and the people who counted on me” but said she won’t be resigning. In a news conference, she said nothing illegal happened and no policies were violated.

—“I know that God will forgive me, but that Nashville doesn’t have to,” Barry said. “And I hope that I can earn their trust and I can earn your trust back, and that you will forgive me

—-This is classic appearance of impropriety.

—-In the Bill Clinton mold, the mayor is framing this as a matter of marital fealty rather than official misconduct—which it is—so she can argue that it’s just “personal private conduct.”

—-The conduct is unethical whether there are policies or not.

—-This is sexual harassment. The officer was a subordinate, and she was his boss, with the power to fire him or worse. There can be no genuine consent in such situations. In these cases with the typical genders reversed, neither the news media, nor the public, nor, in all likelihood, a hypothetical jury, would see it that way.

—-Barry’s playing the God Card is grounds to remove her all by itself.

—-Come on, #MeToo, show some integrity. Get this workplace predator kicked out of office.

Interestingly, a prominent and respected female, feminist Democrat who comments here with distinction argued in the comments to that post that this wasn’t even a newsworthy story outside of Nashville. Also interestingly, the New York Times disagrees, and even published a spirited—but stupid!—defense of Barry’s conduct, arguing that unlike, say, Al Franken, who was forced to resign for pre-political career conduct and unproven post-political career allegations, the fact that a Democratic mayor—FEMALE! Don’t forget that she is female!–was using state-paid employees under her supervision as a personal, state-funded dating pool does not mean she’s untrustworthy or qualified for high office.

Okey-dokey then! What we have here is an old-fashioned convenient double standard!

And this just in! Nashville’s main newspaper, the Tenneseean, reports that Rob Forrest, the Mayor’s married lover, earned substantially more overtime than the other bodyguards on Barry’s secuirty detail, $173,843.13  between July 2015 and January 2017, which was nearly $53,000 more than the other four bodyguards received combined. But, as several internet wags have noted, let’s be fair: Rob was doing more for the mayor than those other bodyguards..

Now let’s all read the op-ed*, by Margaret Renkl , whom the Times proudly describes as ” a contributing opinion writer.” This time around, I won’t get into such matters as the odd silence of the #MeToo warriors, who have set out to destroy successful men who were accused of being boorish on a single date. I won’t even question the competence of the Times editors, allowing such unethical, illogical, poorly reasoned hypocrisy to make its way into its pages to make Times readers more ethically inept than they already are. No, I just want to focus on Renkle and her claim that Barry shouldn’t have to resign, and the unethical rationalizations for wrongful conduct she gainfully employs along the way.

The Reason We Can’t Trust Progressives With Power: They Really Don’t Like Free Speech [CORRECTED!]

It’s not just “hate speech,” and speech questioning climate change, and conservative speakers on campus, and professors using offensive words to discuss how we should treat offensive words, and political speech by citizens banding together to support candidates and express issue positions. and employees making jokes that others choose to find offensive.  Increasingly prominent progressive elected officials, activists, scholars and pundits are advocating the elimination of free expression in realms that have been long protected by the Supreme Court, and that are currently protected as First Amendment speech by the Constitution.

Witness New York Times  columnist Ros Douthat’s recent op-ed flippantly titled, “Let’s Ban Porn.”  Buried in the essay’s Authentic Frontier Gibbberish designed, I assume, to numb the ethics alarms is a call for content-based government censorship, meaning that communicating “porn”–which the Supreme Court never got closer to defining than Justice Potter Stewart’s  famous and pathetic “I know it when I see it”—would be a crime.

How can a journalist, of all people and professions—excuse me,professions—advocate doing what the Bill of Rights specifically prohibits? By stooping to an argument like this one..

“But we are supposed to be in the midst of a great sexual reassessment, a clearing-out of assumptions that serve misogyny and impose bad sex on semi-willing women. And such a reassessment will be incomplete if it never reconsiders our surrender to the idea that many teenagers, most young men especially, will get their sex education from online smut….The belief that it should not be restricted is a mistake; the belief that it cannot be censored is a superstition. Law and jurisprudence changed once and can change again, and while you can find anything somewhere on the internet, making hard-core porn something to be quested after in dark corners would dramatically reduce its pedagogical role, its cultural normalcy, its power over libidos everywhere. That we cannot imagine such censorship is part of our larger inability to imagine any escape from the online world’s immersive power, even as we harbor growing doubts about its influence upon our psyches.”

No, Ross, the reason that we can’t imagine such censorship is because the United States of American is predicated on the core principle, among others, that the government restricting what can be imagined, said, expressed, written and published is far, far more dangerous that any content that can be imagined,  said, expressed, written and published, and thus the remedy for controversial, ugly or otherwise controversial speech is more speech, not laws. What Douthat’s op-ed translates as, and heaven knows it needs a translation though there is no “Leftist Virtue-Signalling Bloviation” to English handbook that I can find on Amazon, is that porn is bad for people, though apparently only men, because the Left’s official position of the moment is that Men Are The Problem.”  For example,  douhat writes,

“So if you want better men by any standard, there is every reason to regard ubiquitous pornography as an obstacle — and to suspect that between virtual reality and creepy forms of customization, its influence is only likely to get worse.”

Ten Points Regarding The Rob Porter/White House/Domestic Abuse Scandal…

1 We know that the FBI had told the Trump White House about allegations from Porter’s two ex-wives that he had been physically abusive. Apparently, the FBI did not confirm, or could not, that the accusations were true. The allegations were still sufficient to prevent Porter from getting security clearance, whether they were true or not. There are good reasons for this. That does not mean that it is fair that someone’s career can be derailed and his reputation smeared without proof of wrongdoing, but it is necessary.

2. The position of an employer that has its own integrity and reputation to protect when an explosive allegation of personal and criminal misconduct regarding an employee arises is an ethics conflict. The Golden Rule suggests that such an employer should not jettison such an employee absent due process and sufficient proof of wrongdoing. However, the greater duty in this case is to the administration.

3. Porter should have resigned. In fact, that he did not resign was the best reason to fire him. This was his domestic problem, and he had no right to  inflict it on the White House, even if he was innocent.

4. There was nothing inconsistent about President Trump’s tweets condemning domestic violence and regretting the lack of due process and fairness in the current #MeToo witch hunt environment. He is right on both counts. As usual, he was not as articulate as he needs to be when opining on such delicate topics. He is not going to become more articulate, however.

5. Porter’s denials of wrongdoing, absent more, should carry no more nor less weight than the accusations against him.

6. Nobody who does not know Porter, the women involved or the intimate details of their relationships should be saying things in public like “I believe the wives” or “I don’t believe them.”  This flips us back to “I believe Anita Hill but don’t believe that slut Paula Jones” territory. People believe who they want to believe. Women who accuse men of abuse have no more claim or right to be believed without evidence than any other accuser, including those who accuse you.

7. Domestic disputes are infamous for the frequency with which previously honorable combatants will use false or exaggerated accusations to gain legal leverage or for old-fashioned revenge. It is possible that Porter’s two wives want to destroy his life. They seem to be doing a good job of it, if that’s their objective. Continue reading

Ethics Quote Of The Week: Andrew Sullivan

“When elite universities shift their entire worldview away from liberal education as we have long known it toward the imperatives of an identity-based “social justice” movement, the broader culture is in danger of drifting away from liberal democracy as well. If elites believe that the core truth of our society is a system of interlocking and oppressive power structures based around immutable characteristics like race or sex or sexual orientation, then sooner rather than later, this will be reflected in our culture at large.”

      —-Andrew Sullivan, in a New York Magazine essay titled “We All Live On Campus Now”.

Once again, blogger-turned-essayist Andrew Sullivan arrives at an accurate assessment of an ethics problem in society without being able to avoid his own biases in trying to assess where the problem came from, which would be extremely easy if he were capable of objectivity. I recommend the whole piece, though Sullivan is an infuriating truth-teller and iconoclast trapped inside an angry gay man who can’t muster  the integrity to directly criticize his sexual politics allies.  Incredibly, Sullivan substantially blames Donald Trump for the phenomenon he assails here, which is ahistorical in the extreme, bordering on delusion:

“Polarization has made this worse — because on the left, moderation now seems like a surrender to white nationalism, and because on the right, white identity politics has overwhelmed moderate conservatism. And Trump plays a critical role. His crude, bigoted version of identity politics seems to require an equal and opposite reaction. And I completely understand this impulse. Living in this period is to experience a daily, even hourly, psychological hazing from the bigot-in-chief. And when this white straight man revels in his torment of those unlike him — and does so with utter impunity among his supporters — there’s a huge temptation to respond in kind.”

Good God, Andrew, show some backbone. Trump, as can be documented and proven beyond a shadow of a doubt, was the “response in kind” to the identity-based social justice movement that was weaponized and reached the point of madness under the leadership of Barack Obama. Why should anyone listen to you when you equivocate like this and make false excuses for what was spinning out of control before anyone thought Donald Trump had as good a chance of becoming President as Martin O’Malley? The University of Missouri meltdown that triggered an across-the-nation epidemic of identify politics warfare occurred in 2015. You know that, and you still write this fiction? Comment Of The Day: “KABOOM! So It Has Come To This: The Book-Of-The-Month TV Commercial”

The recent post about Madison Avenue continuing its effort to coarsen the popular culture and society with gratuitously vulgar commercials, in this case Book-Of-The-Month Club believing that it is hilarious to fake out viewers into thinking they are watching a tampon commercial, was not one that I felt would ignite much controversy or varied comment. As is often the case, I was wrong. The essay generated several surprising threads, including a comment by prolix, controversial blog warrior Alizia, whose commentary here ranges all the way into another post, the article about a high school musical casting controversy and the school’s unethical response to it.

She also raises the question of whether Ethics Alarms should engage more frequently in meta-ethics and philosophy. One reason I selected her comment as a Comment of the Day is that I’m interested in other readers’ views on that topic, not that I’m interested in turning in that direction. My focus as an ethicist has always been practical ethics, and the posts here about grand ethics issues of the sort that have been debated to no productive end for centuries have been incidental and few. Frankly, those topics don’t interest me very much; certainly not enough to devote the blog to it. About a year ago an erudite young woman briefly submitted some provocative comments here but want to argue about competing philosophical theories. She was shocked, indignant and angered when I refused to engage, and after yelling at me for a while, left the forum.  For those seeking what she sought, I recommend going here.

Abstract and scholarly ethics have undermined the subject of ethics to the degree that it is not one  most people can tolerate or understand, effectively removing ethics from public education and general discourse, and thus undermined the goal of an ethical society as well. They are still relevant to the discussion; I just know from hard experience how philosophy tends to send normal people fleeing like the Tokyo crowds in a Godzilla movie.

One things I noticed and have mentioned a few times in respect to the Ethics Alarms blog and, naturally, the people who participate in it, is that it often clearly distinguishes a situation or event in which an ethical issue is brought out and then it successfully and interestingly provokes an examination of the problem or issue. Yet what I notice as well is that the issue is not brought out in a larger context. Or, the larger context is rarely explored. The reason why it is not explored is more interesting and it seems to me more important than what is allowed to be explored or what is acceptable. I can think of two instances and I will mention them.

In this present instance it is noticed that advertising is incorporating vulgarity. But it is really far more than that, at least as I see things. What is the real issue? The real issue is the pornographication of culture. It is, I think this is true, coming about because this is the sort of things you-plural have allowed to go on. It is certainly true (as I have scoldingly said) that ‘it is your generation that has allowed these levels of moral and ethical corruption to creep in’ and I think that this is a necessary stance to take. In my view, though it is not appreciated much here, ‘the pornographication of culture’ connects to sexual expression of many sorts and also extends to ‘the homosexualization of culture’.

There is an active agent, either in the business culture itself, or perhaps in academic culture, that has set in motion these pornographic processes. And just as media culture and Hollywood has gotten continuingly infected with this material (which I assume *you* find titillating and exciting and do not oppose), similarly one can now notice the insinuation of homosexuality into the culture-productions. It becomes visible, included, and influential thereby. Normalized. But behind these appearances, behind this increasing in-flux, stands something far more raw, far more brutal, far more elemental, far more powerful and influential, and that is ‘the pornographic’, a truly ugly and vile *world*. Morning Ethics Warm-Up, 2/9/2018: Post 2016 Election Ethics Train Wreck Update Edition. Sorry.

 

Good Morning.

I don’t say “I told you so” as often as I could or would like to. One continuing theme at Ethics Alarms since the 2016 election that drove progressives mad has been the accusation leveled at me that I have been under-emphasizing the existentially perilous character and conduct of the President while concentrating too much on the conduct of his critics. My answer has been that I believe that the reaction of progressives, Democrats and the news media to President Trump’s election has been, by far, the most disturbing ethics story of the past year, and in historical context one of the most serious and dangerous periods in U.S. history. That conclusion has been reinforced as the year progressed. I was and am right.

None of that makes the ethical conduct of the Trump Presidency any better than it is; as I made clear in last year’s ethics audit,  he has largely behaved as I expected he would when I declared him, over and over again, unfit and unqualified. However, if our institutions and the public’s trust in them remain as strong as they have through-out U.S. history, a single odd-ball President, even for two terms, will not do irreparable damage. What the resistance and its allies in the Democratic Party and the news media are doing, however, threatens to wreck many of those institutions and tear down public trust to a point of no return. That’s my professional assessment. It is not one based on partisan politics or ideology, but on American history, cultural history, and ethics.

1 Fake news and fake history. I knew it was manufactured nonsense when my Facebook friends, Democrats, pundits and the mainstream news media began once again screaming “Fascist!” and claiming that the President’s expressed desire for a major military parade was a terrifying departure from American tradition. I knew a little research would prove it so, but then, I thought, surely some news source would have the integrity to do its job, and some “nationally recognized historian,” like go-to Democratic shills like CNN’s Douglas Brinkley, would set the record straight. Why should I have to do the work for free that these people are paid handsome fees to do, and have a duty to do besides?

Yet few corrections from these supposedly objective sources were registered while Rep. Adam Smith (D-CA) said, “A military parade of this kind would also be a departure from the values of our constitutional democracy,” and Rep, Ted Lieu (D-CA) sneered, “Because authoritarian regimes like Russia and North Korea hold massive military parades does not mean that we must as well. Politico headlined, “Trump’s Military Parade Draws Bipartisan Rebuke.” The Washington Post told readers,  “Military Parades Are About Ego and Power. Of Course Trump Wants One.”  Normally reasonable bloggers were similarly triggered, like Prof. Jonathan Turley, who wrote, “The United States has long rejected the holding of military parades featuring tanks, missiles and other heavy weapons as a symbol of authoritarian regimes like the Soviet Union, North Korea and other countries.”

I guess this depends on what one’s definition of “long” is. Such parades have been out of style since the Vietnam War caused much of the public and the political class to turn against the military, though politicians still give deceit-laden lip-service to “supporting the troops,” just not what they do. Military parades featuring heavy weaponry were not uncommon between the end of the Civil War in 1865 through 1961 during the peak of the Cold War, when it was arguably strategically beneficial to remind the USSR that if it was going to bury us, there would be a fight.  Many of these parades, in 1919, 1942, 1946, 1953, 1957, 1961, and as recently as 1991, featured tanks, missiles, and sometimes many thousands of troops  Let’s see: that’s Presidents Wilson, Roosevelt, Truman, Eisenhower, Kennedy, and George H.W. KABOOM! So It Has Come To This: The Book-Of-The-Month TV Commercial

We have discussed here the increasingly common phenomenon of companies building their TV ads on the juvenile gag of suggesting a vulgar, obscene or rude word, or a topic not discussed publicly in polite society but not really saying what is clearly implied.

Kraft Heinz Company advertised its products with a TV ad in which a boss caught  his employee becoming sexually aroused by his lunch, with the tagline: “Food You Want to Fork.” Get it? HAR! Heineken featured a gay-themed beer ad about “flipping another man’s meat”–“Huh? It’s just barbecue! You must have a dirty mind!.” Wonderful Pistachios uses “nuts” as sexual innuendo, Booking.com uses “booking” in phrases suggesting “fucking,” and K-Mart uses “ship” to suggest “shit.” Reese’s Peanut Butter Cups has run commercial featuring the tags Women want like to make it last…Men are done in seconds…Typical.”  Last year, Volkswagen had Dean Martin crooning about “The Birds and the Bees”  while we see a VW bouncing up and down as the couples within engage in vigorous sexual intercourse, unless they are tying to use pogo sticks.

Comment Of The Day: “Morning Ethics Warm-Up, 2/7/2018: Something In This Post Is Guaranteed To Send You Screaming Into The Streets” [Item #3]

Curmie is one of my favorite bloggers, and also a fellow stage director, a teacher, and a learned man with a keen understanding of ethics. As soon as I encountered the jaw-dropping story about the high school that cancelled its scheduled musical after a protest was mounted because a white student was cast in the role of the show’s Romani heroine, I knew it was in Curmie’s wheelhouse.

Here us Curmie’s Comment of the Day on the third topic in the post, Morning Ethics Warm-Up, 2/7/2018: Something In This Post Is Guaranteed To Send You Screaming Into The Streets:

Re #3: I’d seen this story a few days ago, but luckily for my sanity I had too many other things on my mind to contemplate too deeply what was going on in my old stomping grounds (I went to high school a little over a half hour from Ithaca, and spent four years in grad school at Cornell).

I’m not sure I agree with you that the school is supporting “per se racism,” but I do think the decision was equal parts stupid, repressive, and cowardly. Even if we discount your entire argument, Jack (and I don’t), we still left with this: the character is Romani. The fact that a POC actor played the role in the biggest production of this particular iteration of the story doesn’t change the fact that many Romani are indeed white. What they definitely aren’t is black, although one suspects that casting such as actor in the role would have been at least condoned if not applauded. And if I’m identifying the complaining student correctly, she is far from the body type one would associate with the role. Continue reading

Question: Is There Any Justification For A State Censoring Vanity Plates? (And What’s Wrong With “KAIJUU”?)

My answer to the first question? Absolutely not.(  My answer to the second is, “I have no idea.” ) If a driver can put a sign in his rear view mirror or a bumper sticker on her bumper without state sanctions, then a driver should be able to have whatever he or she chooses on a vanity plate.

Utah, for examples, bans vanity plates with profanity, “derogatory language,”  drug references,  sex talk, references to bodily functions, “hate speech,” targeting a particular group, or advocating violence advocates, as well as alcohol references and the number combo “69.” Ethics verdict: None of their business. These are words and numbers, and the state is declaring content and intent impermissible. When I see a car with an obnoxious vanity plate, I’m grateful. This is useful information. Racist or vulgar plates translate into “I am an asshole, and want you to know it!”

Below are the plates banned by Utah over the past five years. Most of them fly right over my head. If you have to be a cryptographer to figure out why a plate is offensive, then it’s not offensive.

The less our governments interfere with freedom of expression, the safer we are.
