The Penn State-Sandusky Disgrace: Time For Paterno Worshippers To Face Facts

Yesterday CNN revealed that e-mails uncovered in Penn State’s internal investigation of the Jerry Sandusky scandal show that beloved, ever-so-ethical Jo Pa appears to have stopped the university from reporting the child-molesting ex-coach to authorities. The e-mail trail seems to show, the New York Times reported, that the university’s president, Graham B. Spanier; the athletic director, Tim Curley, and the official in charge of the campus police, Gary Schultz, were ready to report Sandusky in the wake of assistant football coach Mike McQueery’s eye-witness account of seeing Sandusky molesting a child in the showers.  Curley then wrote the group that talks with Paterno had persuaded him that it would be more “humane” to confront Sandusky, bar him from bringing his young victims on campus, and  urge him to get professional help. This, of course, freed Sandusky for a decade more of  child sexual predation, with the kids foundation he had founded serving as his hunting grounds.

The Homophobic Counselor, the Ethical Bigot, and the One-Legged Tarzan

Jennifer Keeton was expelled from the graduate program at Georgia’s Augusta State University in 2010 because her Christian religious convictions dictate that homosexuality is sinful and voluntary conduct, rather than an innate sexual orientation. A court upheld the school’s right to expel her on the basis that her beliefs made it impossible for her to meet their counseling standards, which the court ruled were neutral, and did not discriminate against her speech or religion.

The case may raise legitimate constitutional issues. The Alliance Defense Fund (ADF), a conservative legal group, and Constitutional Law professor Eugene Volokh (of Volokh Conspiracy fame) are assisting Keaton as she attempts to get reinstated. Ethically, however, I don’t think she has a leg to stand on.
In fact, I think her position resembles the old Dudley Moore-Peter Cook comedy routine where Moore is one-legged amputee who cries foul at being “discriminated against” by a film director who refuses to consider him for the role of Tarzan:

Carolyn Hax Tackles An Ethics Classic

What do you do when you find out that the husband or boyfriend of one of your friends is cheating on her with another one of your friends?

This perennial advice column ethics teaser has been botched in more columns than I can count, so it was a pleasure to read the response to the dilemma by Carolyn Hax, the syndicated relationship advice columnist whose ethical instincts are invariably superb. Here was the substance of her answer:

“…to the husband or husband-poacher (whoever’s the closer friend), say something akin to: “I’ve heard this is happening, which means others have, too. That’s Issue 1. Issue 2: I want no part of this — I don’t even want to know what I already know. Issue 3: If Wife asks me something, I won’t lie. As someone who stands to lose friends in this mess, I hope you’ll clean it up.” Then butt out, knowing that if someone forces your hand, your next move has been declared in advance — and if your friend finds out that you knew, you can say: “I’m sorry. —-WMAL syndicated conservative radio talk show host Chris Plante, riffing on the anti-Fox MSNBC’s new star, Chris Hayes.

As someone who often talks extemporaneously for a living, and who has slammed both legs up to the hip into my mouth more than once, I am genuinely sympathetic to the perils faced by radio and TV talk show hosts who have to be edgy, insightful and witty for three hours a day without a script, knowing that words, once out of their mouths, are irretrievable, and can lead to career meltdowns with the speed of Chernobyl. It’s a tough job that is akin to walking a high wire over a pit of crocodiles, and I usually have great sympathy for those who fall.

The Gaby Rodriguez Virus—Hoax Your Friends For Fame and Profit—Spreads

Be careful! If you catch the virus, you might lie to your family that you’re going to die, and write a book about it!

High school senior Gaby Rodriquez got fame, a book, a movie deal and awards, not to mention an A for her school project, by traumatizing her family and friends with an extended pregnancy hoax. It was inevitable that when such blatantly unethical and destructive conduct is hailed as “courageous” by media pundits and pays off in speaking fees and book contracts as well, other ambitious liars would try the same trick. Sure enough, a young straight male Christian decided to hoax his friends and family by telling them he was gay.

It’s worth lying to everyone who cares about you and trusts you for a book deal, right? Timothy Kurek’s experience posing as gay for a year is the basis of his “Jesus In Drag” coming out this fall. The Today show should slobber all over this one, and I’m sure Timothy will become a familiar butt on the couches of Ellen, Dave, Jimmy and others. And, like Gaby Rodriguez, he will be hailed for his “courage” to exploit the trust of his family and to betray his friends so he could use their discomfort as book material. Continue reading →

The 77% Lie: Just Because a False Statistic Is Useful and Traditional Doesn’t Make It Less Unethical To Keep Using It.

Sure, lie to us, Mr. President. As long as its for a good cause.

In 2000, CNN anchor Bernard Shaw used the statistic that “women are paid only 77 cents for every dollar men receive for the same work” in a question to Joe Lieberman during the Vice Presidential candidates debate, prompting me to turn or the TV and write a letter to CNN. The statistic had long been debunked as misleading and inaccurate for years by every objective observer who examined it. The unspoken assumption that figure is meant to convey is that this supposed gap reflects sexism in the workplace. It dates from the early days of NOW and the feminist push for the Equal Rights Amendment, an activist-concocted lie, like many of the global warming “facts” mouthed by Al Gore, designed to simplify a complex phenomenon into something unequivocally persuasive. For Shaw, a journalist, to repeat a false and misleading statistic as fact in a nationally televised debate was inexcusable, and irresponsible journalism.

Did I mention that this was in 2000?

The 77% stat is one of my two pet fake statistics (the other being the statement that 50% of all U.S. marriages end in divorce, used by culture warriors on both the left and right), and I have vowed not to let either pass without a red flag until I either drop dead or people stop lying. So I don’t care to hear, thank you, about how I’m picking on the President Obama when Mitt Romney has been using some misleading facts too. I know he has. But when a President of the United States whose supporters laud as a genius and scholar, and who pledged not to mislead the American people promotes his campaign with a widely publicized statistic that he has to know misinforms the public, I believe that’s alarming, insulting, and infuriating.  The fact that Democrats and feminists have been using the same lie for over three decades doesn’t make it less offensive, but more. No, THIS Is An Irresponsible Parent

“MOM???”

Mistie Atkinson, 32, was sentenced to jail for four years and eight months b in Napa County Superior Court, California this week. After police caught her and her 16-year-old son naked together in a motel room, investigators discovered a sex video, made by Mistie, of her giving her own son oral sex. Mom had no contact with her son for 15 years, then tracked him down on Facebook and began sending him sexually provocative photographs.

This is known as “Not only corrupting a minor, but guaranteeing that his psychiatry bill will approach the national debt.”

Naturally Mistie, who has a disturbingly loose grip on concepts like right, wrong,  boundaries, impulse control, fairness, adulthood and personal responsibility, says that she should not have been charged with incest because the attraction between the two was “genetic.”

The one generous and responsible thing Mistie had done for her son his whole life was to keep him as far away from the toxic influences of her warped, self-centered and destructive character as possible. Then she couldn’t even do that.

Now I do not claim it to be a sin any worse than other sins. It ranks in God’s eyes the same as murder, lying, stealing, or cheating…”

Professional Tip, Lawyers! It’s Unethical to Sexually Assault Opposing Counsel When the Judge Leaves The Room.

NOT the ethical way to “present a motion”…

New York has suspended  lawyer Lawrence Baker from the practice of law for two years after it was determined that he behaved unethically with a female opposing counsel after  a judge overseeing a pretrial conference in chambers left the room to attend to another matter. For his part, Baker only admits to engaging in inappropriate conversation and giving the women a “love tap” on the shoulder. Uh, well, it seems to have been a bit more than that. An investigation determined that Baker kissed the lawyer, plunged his hands down her blouse, fondled her, and, <cough>, exposed himself.

The technical term for this, in the ABA’s ethics rules, is “engaging in conduct prejudicial to the administration of justice.” 

The old gag about this kind of conduct was that the lawyer “presented his briefs” to opposing counsel.

The vernacular term for it is, “YIKES!”

The Reporter and the Diplomat: Anatomy of an Ethics Train Wreck

Gina Chon, who handled the Iraq beat for the Wall Street Journal, “quit under pressure,” a.k.a. “was fired”, yesterday after it had been discovered that she had carried on  a romantic affair with Brett McGurk, a high-placed American official, while both lived in Baghdad in 2008. McGurk was on the National Security Council staff during the Bush administration and has been nominated by President Obama to be ambassador to Iraq.  Chon was covering McGurk’s activities while she was also romantically engaged with him, a cardinal ethics sin for a journalist. She also shared “certain unpublished news articles” with him, also a violation of Journal policy and journalism ethics. The relationship had been hidden by Chon, and only came to light when racy e-mails between the two were revealed. Of course, the fact that they had recently divorced their respective spouses and married each other probably should have been a clue.

This is a full-fledged ethics train wreck, and it is not over yet.  Let us review the participants so far:

Typical of ETW’s, the coverage itself was ethically flawed. The Washington Post story about the Chon-McGurk affair appeared in the Post’s Style section, which covers media, entertainment, and gossip. McGurk is the current Obama administration nominee to be Ambassador to Iraq, a key post. This was the last line in the Style story:

“The disclosure has intensified doubts about McGurk’s nomination for ambassador among some Republican members of the Senate, but the Obama administration has stood by him.” Continue reading →
