Morning Ethics Warm-Up, 2/1/2019: Dumb, Dumber, Fake, and Fakiest

1. Update. Wow. My furious ex-Ethics Alarms commenter actually filed a motion to oppose my motion to extend the time to file a response brief to his rambling 70+ page, incoherent rant of an appellant brief, as he tries to get the dismissal of his defamation suit against me overturned. Such extensions are granted as a matter of course and courtesy, and real lawyers never oppose them, so a petty motion like that sends a strategically unwise signal to the court that this is not really a legal matter but an abuse of process to pursue a grudge. Of course, reading the brief itself makes that clear.

2. Incompetent Elected Official Of The Day: Rep. Jason Crow (D-Co), who tweeted about the President sending troops to the border,

This guy needs to be sent back to government kindergarten. Troops are almost always deployed for political reasons, both national and international. Does he remember when LBJ sent troops into Selma? How about Truman using troops to break the railroad worker’s strike? Commenter Tim Levier correctly notes, “What troop was ever deployed for a non-political agenda? They go where the politicians send them. And what better place than in their home country defending their actual borders for national defense?”

ARRGH!!!

Too many festering ethics issues to cover in as much detail as they deserve…

1. The deterioration of the New York Times, and with it respectable print journalism, continues. Over the weekend, the Times published a very large, front page diagram showing the President in the middle of a circle of indicted aides, advisers and others with some connection to his campaign. (I’m looking at it right now; I can’t find a version on the web to post.) It belongs in the Guilt by Association Hall of  Shame, and some other shameful halls as well. Literally none of the indictments involve any campaign activities by Trump or his campaign that would constitute illicit cooperation with Russia to affect the 2016 election—you know, the supposed point of having a Special Counsel. The bulk are so-called “process” violations, which means that the individuals lied in some aspect of the investigation, and was charged to pressure him to “flip” on the President.The one individual whose charges are linked to Trump is Michael Cohen, whose actual crimes had nothing to do with Trump, and whose alleged crime involving Trump–paying off an adulterous sex partner to keep quiet—is probably not a crime at all, even though Cohen pleaded guilty to it to save his skin.. The graphic proves nothing and clarifies nothing. It is just raw meat for Trump-haters, asserting guilt without substance. Similar circles could be assembled around many, many national figures and politicians (Bill Clinton comes to mind, and Barack Obama), especially following two years of targeting their associates.

2. Ann Althouse vivisects Tom Brokaw.  Just go to this link and read Ann’s expert commentary on Tom Brokaw’s bizarre turn on “Meet the Press,” and the even more bizarre tweets he issued to apologize to the social media mob for opining that “Hispanics should work harder at assimilation.” (Hispanics assimilate just fine, especially when they are here legally.)

Yes, poor Tom really did tweet, ” my tweet portal is whack i hv been trying to say i am sorry i offended and i so appreciate my colleague.” 

3. This would be an unethical quote of the day except that CNN fake media ethics watchdog Brian Stelter says and writes unethical things so often that it is no longer worth highlighting. Stelter re-tweeted with favor this quote from a panelist on his show as they discussed Rep. Alexandria Ocasio-Cortex:

“She’s got a target on her back because she ticks every box that makes conservative men uncomfortable.”

Of course, this is pure race- and gender-baiting, the progressive and media reflex response to any criticism of female or minority Democrats, and insulting to women and progressive men as well. I assume many of the latter—the smart ones, anyway—are also made “uncomfortable” by arrogant, ignorant, under-qualified, anti-Semitic, Socialist naifs who garner a disproportionate amount of publicity while advocating absurd and irresponsible policies. A member of Congress who blathers like AOC would be like fingernails on a blackboard if she were a midde-aged he of Nordic descent.

Boy, Stelter is terrible. I hereby apologize to Howard Kurtz for being so hard on him when he had Stelter’s job. Compared to Stelter, Howard is me. Continue reading →

Sunday Ethics Warm-Up, 1/13/19: Walking Through The Ethics Woods On A Snowy Evening

Good evening!

1. Pro tip for James Comey: appealing to the Cognitive Dissonance Scale is the tactic of a scoundrel. Also an idiot. Comey, responding to one of President Trump’s anti-Comey tweets—it doesn’t matter which–responded yesterday,

It takes only a rudimentary knowledge of world history to recognize how many absolute villains, psychopaths and sociopaths could and would make that statement. Vlad Tepes (aka “Dracula,”), feared foe of the Turks. Joseph Stalin, enemy of Hitler. Hitler, enemy of Stalin. Comey and President Trump are both equally loathed by Hillary Clinton: puzzle that out.

How did someone with Comey’s character deficits last as long as he did, and what damage did he do over that time that we don’t know about? The mind boggles.

2. And speaking of mind-boggling: Alexandria Ocasio-Cortez. Apparently not capable of figuring out that her problem is her own big mouth and some serious critical thinking issues, the irrepressible Congresswoman from New York is playing the pity AND the victim cards simultaneously. Unfortunately, as is her wont, she also inadvertently played the “unqualified to be in Congress because she never read the bill of Rights” card. “When does nonstop criticism of me by the Daily Caller rise to the level of ‘harassment’?” she tweeted plaintively.

Of course, as any reasonably well-educated 6th grader should be able to explain, the answer is “never,” or perhaps, “Never, you idiot,” even if the frequent criticism wasn’t warranted, which it obviously is.

3. Political Hot Stove suggestion. This is the time between baseball season known as the “Hot Stove League,” where baseball fans concentrate on free agent signings and trades, real, hoped for, or imagined. Here’s one involving politics: the Republicans should offer to trade Steve King (R-Iowa) to the Democrats for Rep. Ocasio-Cortez. The problem is that even the Democrats aren’t stupid enough to take the bait. King is a long-running disgrace and embarrassment, the embodiment of what the news media and Democrats want the public to think every Republican and conservative is really like. Continue reading →

Incompetent Elected Official Of The Month: House Speaker Nancy Pelosi

I don’t think it is too much to ask for the Speaker of the House to comprehend the limits of her power and position, do you?

Yesterday, as Nancy Pelosi officially seized the gavel from Republican Speaker Paul Ryan, she  declared that she is equal to the President:

Asked if she considers herself Mr. Trump’s equal, she replied, “The Constitution does.”

The mainstream media, invested in defending and bolstering Pelosi, are already spinning the exchange to mean merely that Pelosi considers women the equal of men, and that the Constitution obviously (now) embodies that principle. However, that would have been a question and answer neither worth asking or answering. The question was whether Pelosi, as Speaker, felt that she was the equal of the President in power and Constitutional authority, and she replied in the affirmative to cheers from the “resistance.” Here’s Scott Dworkin, for example, frequent MSNBC contributor and  co-founder of the Democratic Coalition on Twitter:

“The Constitution considers me equal to Trump.” Speaker Nancy Pelosi. Damn straight. Trump is not the boss of Congress, no matter what Trump’s lapdogs Ryan & McConnell made it look like. Speaker Pelosi reminds us how the pathetic GOP is owned by Trump. Weak & useless pushovers.

“Immoral And Ineffective”

Hmmm. I have now, in a single day, heard two Congressional Democrats, in the course of discussing the so-called government shut down, describe the Trump border wall as “immoral and ineffective.” Does this mean that the phrase is an official, focus group tested Democratic talking point now, issued to the troops to be relentlessly repeated over and over again to end debates rather than illuminate them? I assume so, and thus it joins “comprehensive immigration reform,” “sensible gun laws,” and others. If I am right, it is a remarkably dishonest catch phrase. It’s also internally hypocritical.

Simply put, if the wall is ineffective, why is it immoral? And if the wall is immoral, why is being ineffective an indictment of it?

Arguing in the alternative like this is a red flag that signals that the advocate just wants to defeat the proposition, and doesn’t care how he or she does it.  The device originated in the legal profession, as a strategy to advance several competing and often mutually exclusive arguments with the goal of showing that regardless of interpretation there is no viable conclusion other than the advocate’s. Most often, the trick is used in criminal law: My client didn’t know the victim, and if he did, he was too far away that night to kill him, and even if he was the last one to see the victim alive, the evidence against him is circumstantial. In criminal law, the approach is justifiable, for the accused must be convicted beyond a reasonable doubt, and any doubt will do. The criminal defense lawyer isn’t seeking justice, or the best result for the community, just the best result for his client, as his (or her) clients defines it. It’s a better device to use in court briefs to other lawyers and judges than to a jury, who are likely to think, “Wait, does this lawyer care what the truth is?” The answer to that question is, of course, “no,” as long as the end result serves the interests of the lawyer’s client. If the client is Jack the Ripper, and the lawyer  arguing in the alternative allows him to escape conviction to kill again, the lawyer did the job required by his or her profession. The consequences of freeing the client literally is not the lawyer’s concern: if it is, then he or she is in the wrong profession. Continue reading →

Morning Ethics Warm-Up, 1/2/2019: A Drunken City Council President, A Head-Exploding Political Charity, NBC’s Strange Welcome To The New Year, And Facebook Calls Reality “Hate Speech”

Good Morning!

1. First candidate for “Incompetent Elected Official Of 2019”! The Troy New York City Council president got drunk and then went behind the wheel to chased another motorist at high speeds for nearly 30 miles last week . State police arrested Carmella R. Mantello, 53, after troopers received a call from a terrified driver who told dispatchers that some crazy person was tailgating him and driving erratically. When troopers  pulled Mantello over, she denied following the man and claimed he was following her—interesting, since  troopers stopped her when she was behind the complaining motorist. She also refused to take a breathalizer test.

Later, Mantello  issued this statement:

“I understand the severity of my actions and take full responsibility. I apologize to my family, friends and constituents and am deeply sorry that I let you down,” she said. “I expect more from myself. Finally, I would like to personally thank the New York State Troopers for their professionalism in this matter and the service they render every day to keep our communities safe.”

The best way for her to honor professionalism and keep communities safe is to resign immediately.

Oh—I assumed that Mantello was a Democrat, since the news story didn’t mention her party affiliation. Nope! She’s a Republican.

2018 Ethics Retrospective Poll #2 and #3: “Unethical Profession Of The Year” And “Incompetent Elected Official”

The effort to prompt some input into the 2018 Ethics Alarms Awards will obviously continue for another day or two, as my promise to “be posting these periodically during the day and evening” was foiled by intervening priorities yesterday.  There are two polls this time (here was the first, still open), and again, please don’t hesitate to expand on your votes.

Once, there was never any question about the “winner” of this  category: it was inevitably educators or, more often, journalists. One of the horrible consequences the 2016 Post Election Ethics Train Wreck, however, is that almost all the professions dived into the muck, sought headlines by making the kind of biased and irresponsible statements that society depends on professionals to eschew, and they have continued their self-debasement ever since. Incompetent Elected Official Of The Month: Rep. Steve King (R-Iowa)

You know when I mentioned that Ted Lieu was NOT the most “foolish, dumb, frightening” member of Congress? Steve King was one of the people I was thinking of.

In case you haven’t heard the widespread mockery, King asked Google’s CEO Sundar Pichai  at this week’s House Judiciary Committee hearing about alleged bias and abuse of power by the tech behemoth,

“I have a 7-year old granddaughter who picked up her phone during the election, and she’s playing a little game, the kind of game a kid would play. And up on there pops a picture of her grandfather. And I’m not going to say into the record what kind of language was used around that picture of her grandfather, but I’d ask you: How does that show up on a 7-year old’s iPhone, who’s playing a kid’s game?”

Pichai responded,  “Congressman, the iPhone is made by a different company.”

Incompetent Elected Official Of The Month: Rep. Ted Lieu

I guess there are more foolish, dumb, frightening members of Congress than this guy. Think about that.

Lieu, the very model of a modern California Democrat, told CNN host Brianna Keilar, among other things,

“I would love to be able to regulate the content of speech. The First Amendment prevents me from doing so, and that’s simply a function of the First Amendment, but I think over the long run, it’s better the government does not regulate the content of speech.”

And then, he tweeted,

“Would I like to regulate Fox News? Yes, but I can’t because the First Amendment stops me. And that’s ultimately a good thing in the long run.”

You see, people qualified to the leaders of a democracy don’t want to operate like totalitarians. I don’t trust people who want to summarily execute or imprison political opponents without due process or a trial, but who add “But I can’t because of the Constitution, and I guess that OK.” Or, say things like “I wish I could keep slaves/ outlaw religions/ confiscate guns/ nationalize businesses/ take away private property and give it to whoever I want but there’s that dang Constitution.” Such people are wannabe totalitarians, don’t really like our rights, and would crush them in a second if they saw a chance.

That’s Ted Lieu. That’s a lot of Democrats and progressives. Lieu is just of the few dumb enough to admit it.

 

Unethical Quote Of The Week: Senator Kirsten Gillibrand

“Our future is: Female. Intersectional. Powered by our belief in one another. And we’re just getting started.”

—Senator Kirsten Gillbrand, via tweet this week, calling out to her anti-male bigot supporters everywhere.

It is almost fun watching people twist themselves, language, common sense and decency to justify Gillibrand, Congress’s premier misandrist. As a U.S. Senator, she is pledged and ethically obligated to be working for the entire nation, not a single race, creed, ethnic group or, obviously, gender. The two “our”s and single we is not meant to represent all Americans, by common English construction. She is talking about women, and excluding men. In particular, by adding “intersectionality,” she is excluding white men above all.

It isn’t surprising to see Gillibrand proclaiming the increasingly popular anti-male bigotry that more and more public figures, all Democrats–coincidentally–are openly promoting. After all, she is the same sexist bigot who championed the destructive vendetta by “Mattress Girl” against a male Columbia student, even after he was exonerated. She is the same person who ran Al Franken out of the Senate. She is the same prejudiced hypocrite who declared that she believed Bret Kavanaugh’s accuser simply because he was a man and she was a woman. “I believe her,” Gillibrand said fatuously. “Her story is credible.” That’s a non-sequitur. The fact that a story is “credible” does not mean it should be believed without evidence. Credible means that a story is believable, but untrue stories are frequently believable. Kavanaugh’s defense was also credible, except to bigots, like Senator Hirono, who said she didn’t believe him because he is a conservative, and Gillibrand, who elevates women in status and trustworthiness over men.
