Once a secret is out, it isn’t a secret any more. Once privacy is shattered, it’s gone: that egg can’t be put back together again. I wish Sony’s e-mails hadn’t been hacked: everyone who isn’t operating under a policy that mandates that their communications must be archived and available for media and public examination, like, oh, say, Hillary Clinton, has a right to have private business and personal communication.

Julian Assange is a fick, and an uncommonly arrogant one. He encourages, aids and abets the theft of proprietary information in the interests of world anarchy, which is in the interests of nobody. So let’s see now…North Korea hacks Sony to chill our First Amendment rights, and Wikileaks helps magnify the damage by spreading private e-mails and documents far and wide.

Yechhh.

But it’s all out there now, and there is no virtue in averting our eyes and plugging our ears. There is a lot of unethical conduct exposed in those 30,000 documents and 170,000 emails hacked from Sony, and while the means by which it was exposed was illegal and wrong, we should still learn from what is now public information.

(Awarded to the unethical public figure whose prominence, popularity and success most corrupts the public’s ethical values)

Janay Palmer Rice, beloved punching bag of NFL star Ray Rice, who was caught on camera smooching with her man shortly after being cold-cocked by him in a hotel elevator, married him, and has repeatedly defended her husband, prompting confused female pundits to defend her. She is not only the embodiment of Rationalization #42. The Hillary Inoculation, or “If he/she doesn’t care, why should anyone else?”, she is also a good bet to get some young women killed by giving them a role model who stands for standing by your abusive man with the hard right hook.

Double Standard Of The Year

In a year of double standards, the treatment of soccer star (and accused child abuser) Hope Solo by her sport, feminists, the media and the public takes the prize. The standard, as I understand it, is that big, strong female athletes can beat up smaller, weaker family members with impunity, and it’s no big deal, but when a male athlete does the same, he is scum. Got it.

Uncivil U.S. Official of the Year

Victoria Nuland, Assistant Secretary of State for European and Eurasian Affairs and the top American diplomat in Europe, was caught saying in a viral Youtube video saying “Fuck the EU.”  Now that’s diplomatic. Of course, she wasn’t fired, because she works for the Obama Administration

First Lady Michelle Obama, who helped her husband make the U.S. look weak and ineffectual (he needs no help), by engaging in this ridiculous effort at hashtag diplomacy. Those kidnapped girls were never found, and Boko Haram, the Nigerian terrorist group that took them, I learned today, just killed a reported 2000 more victims. Time for another sad picture, Michelle!

Most Unethical Sports League

The NFL, last year’s winner, was even more unethical this year, with the Ray Rice and Adrian Peterson fiascos, Commissioner Roger Goodell showing no innate instinct for right and wrong and both the league and its teams making up rules and policies according to talk show calls, polls and wet fingers in the air. Meanwhile, it’s still making billions paying young men to lobotomize themselves. What a great sport.

Sports Cheat of the Year

Alex Rodriguez, suspended Yankee star, had denied, denied, denied, threatened to sue Major League Baseball and the union, and insisted that he had not, as an investigation had determined, used performance enhancing drugs supplied by Biogenesis. Then, just as his season-long suspension was lifted, it was revealed that A-Rod had, under oath, admitted using steroids from 2010 to 2012.

Michael Fine, the Ohio lawyer who allegedly hypnotized female clients in order to sexually molest them.  Runner Up:  Alexa Van Brunt. She didn’t do anything unethical; she just advocates ethics rules that would eliminate the core of legal ethics, proving that she doesn’t understand her own profession.

Unethical Judge of the Year

Wade McCree, the handsome devil pictured above (he circulated this selfie), who, presiding over a felony child-support case, conducted a secret sexual relationship with the woman seeking support from the defendant. This was just the latest of his embarrassments.  Runner up: Texas District Judge Jeanine Howard, who handed down a stunningly lenient sentence of probation and 250 hours of community service at a rape crisis center for a man who confessed raping a 14-year old girl at her school.

 

Unethical National Broadcast Journalist Of The Year

CNN’s Carol Costello. She was biased, smug and incompetent all year long, but reached her nadir when she gleefully played a recording of Bristol Palin explaining to police how she had been assaulted, saying to her viewers, “You can thank me later.” She refused to apologize on the air, or to Palin. TheWrap is a web Hollywood news and gossip site. Picture TMZ crossed with Gawker.  It published an immediate candidate for the most unethical blog post of the year, always a closely contested category, a piece of cyber-offal by an industry writer named Rich Stellar that issued a combined attack on the women coming forward to prove Bill Cosby is a serial rapist, and the media’s coverage of it. I was happily unaware of Stellar, barely aware of The Wrap and definitely unaware of this utter crap until it was flagged in a Salon piece, which was in turn flagged by one of my indispensable scouts, Fred. What unfolded before me was a horrible spectacle of a despicably and dumber than a box of rocks opinion piece that no competent editor should allow to avoid the trash, a subsequent apology of sorts from the writer that shows such an ethics deficit that he should probably have a 24-hour keeper, and, finally, his editor’s defense of her wretched editorial judgment based on the theory of the First Amendment, which she appears to think means “You have to publish any garbage any fool writes no matter how poorly conceived or reasoned, or you are unAmerican.”  But I am getting ahead of myself.

A Jumbo For Press Secretary Josh Earnest

Responding to damning comments from key Obamacare architect Jonathan Gruber that the passage of the ACA  was predicated on avoiding transparency and exploiting “stupid voters,” White House Press Secretary Josh Earnest said this during a press briefing in Burma:

“The fact of the matter is, the process associated with the writing and passing and implementing of the Affordable Care Act has been extraordinarily transparent.”

Extraordinarily!

Except, of course, for the President and other elected officials repeatedly saying that “if you like your plan, you can keep your plan—period.”

Oh…and that it was drafted in secrecy by lobbyists from the health care industry and Congressional aides and voted on before anyone in Congress had an opportunity to read it in its final form.

Then there was the fact that the usual procedure of vetting the bill through committees in the House and Senate was bypassed, and floor debate was curtailed.

Of course, the bill was so long and written in such impenetrable jargon and had so many cross-references that it was unreadable. This is wht Nancy Pelosi explained that we had to pass it to find out what was in it.

Other than that, though…wait!

There was the little device of swearing that the individual mandate was not a tax until the bill was passed, then arguing before the Supreme Court that it was in fact a tax, as the bill’s architects intended from the start.

Extraordinarily transparent.

As readers who travel here often know, I really hate, hate, hate obvious lies. They are cowardly, they are insulting, and when they are authored by public officials, they recklessly foster public cynicism and distrust. You can’t do your job right, and you don’t even know when it’s pointless to lie? Why should we trust you to be able to do anything right?

Of course, we shouldn’t.

You will seldom see a more blatant and embarrassing example of the desperate, immediately apparent lie than this one from the District of Columbia Board of Elections after it mailed out 305,164  copies of the official D.C. voter guide with the D.C. flag on the front cover printed upside-down. This immediately provoked much local media, pundit and social media hilarity and mockery, but no, announced the Board. This was no lazy clerical error from the government famous for them. This was intentional! A devilishly clever strategy!

The election board’s  spokeswoman, Denise Tolliver explained that the upside-down flag was a deliberate move—an upside-down flag is a distress signal, after all—to grab the attention of voters and “see how many clicks we can get.” “People are responding, aren’t they?” Tolliver said. “They’re paying attention. It’s working!”

Nobody believed it, of course, because the only idiot in the conversation was her, and, by proxy, her superiors. Eventually  the board’s executive director, Clifford Tatum, confessed. “No, this is an error,” he e-mailed a D.C. Council member. Continue reading →

To remind not-so-regular visitors here: a Jumbo is a special Ethics Alarms award for conduct that emulates the gag from the Broadway musical and film “Jumbo,” in which Jimmy Durante, as a circus clown trying to steal an elephant, is caught red-handed by a sheriff, and asked, “Where are you going with that elephant?” “Elephant?  What elephant?,” Jimmy replied.

Carl Knochelmann Jr is candidate for Kenton County Family Court Judge court judge in Kentucky. He also owes $2,886.54 in unpaid child support to the mother of his teenage son. He has been delinquent before: at various times a court has ordered him to pay overdue child support, including $9,632 in 2003. The current $2,886 amount dates back to 2008.

His opponent, seven-year incumbent Kenton County Family Court Judge Chris Mehling, said the back child support shows Knochelmann is unfit for a judgeship responsible for enforcing child support payments, among other things.

Why Are American Liberals Espousing Censorship And Mind-Control?

I say “suddenly” because I always thought of censorship and mind-control as Big Brother, “1984” stuff, the tools of fascism and totalitarian dictators. Yet for several years, the primary calls for impeding open debate and limiting the tools that facilitate it have been coming from the left. No labels. No “eliminationist rhetoric.” Ban “retarded.” Ban “nigger.” Now a best-selling feminist, Facebook COO Sheryl Sandberg, has launched a fatuous campaign to ban the word “bossy,’ on the theory that it is wielded against incipient female leaders and crushes their spirits and aspirations. (I would counter that any girl who can’t stand up to a word isn’t a very promising leader to begin with.) Unable to mold human nature to its liking with reason, facts and persuasion, the increasingly popular tactic seems to be removing the ability to engage in the kinds of thinking and conduct that liberals, with varying justification, find repugnant. Linguists have shown that ideas that can’t be expressed are difficult to form, much less argue for. Eliminate bigotry, bias, inequality, and social injustice by making them impossible to articulate, and then even conceive! Brilliant!

Now Lawrence Torcello, an American philosophy professor with a Ph.D. from the University at Buffalo, has published  an essay in the academic website The Conversation arguing that dissent about climate change and the human role in it is so sinister that it “ought to be considered criminally negligent.” Continue reading →

“The claims by President Putin and other Russians that they had to go into Crimea and maybe further into Eastern Ukraine because they had protect the Russia minorities—that is reminiscent of claims that were made back in the 1930s when Germany under the Nazis kept talking about how they had to protect German minorities in Poland, in Czechoslovakia, and elsewhere throughout Europe. So I just want everybody to have a little historic perspective. I’m not making a comparison certainly, but I am recommending that we perhaps can learn from this tactic that has been used before.”

—-Hillary Clinton on the Crimea crisis, showing that she has learned deceit and dishonesty at Bill’s knee, or, perhaps, was really the teacher all along.

Fallen Hero of the Year

Edward Snowden, whose claim to civil disobedience was marred by his unwillingness to accept the consequences of his actions, whose pose as a whistle-blower was ruined by the disclosure that he took his job with the intention of exposing national secrets, and whose status as a freedom-defending patriot lies in ruins as he seeks harbor with not only America’s enemy, but a human rights-crushing enemy at that. The NSA’s over-reach and mismanagement is a scandal, but Snowden proved that he is no hero.

Unmitigated Gall of  The Year

Minnesota divorce lawyer Thomas P. Lowes not only violated the bar’s ethics rules by having sex with his female  client…he also billed her his hourly fee for the time they spent having sex , a breach of the legal profession’s rule against “unreasonable fees.” Yes, he was suspended. But for not long enough…

—–President Barack Obama this week, telling supporters of Organizing for Action what he should have said for three and a half years,  but representing the statement as if he had been saying it all along. A video is here.

There’s not much more to write about this, except to debate whether we should weep, laugh, or take to the streets with torches and pitchforks. The President’s solution to the discovery that his repeated assurances that nobody would lose their doctor or their health plan under the Affordable Care Act were an intentional deception of the American public was not, as his various lackeys and underlings and media lapdogs have claimed in various devious ways, to deny that his statement was a lie (for it obviously was). Neither was it to justify lying, as others among his shameless enablers have done. He didn’t try to minimize the lie and say it was trivial, since only a relative few million Americans will be affected, like the New York Times did, to its eternal shame. No, President Obama is above such demeaning obfuscations and alibis. He simply re-wrote history, and claimed that he said (well, “we” said) words that he never said at all. Continue reading →
