Morning Ethics Warm-Up, 9/15/17: Lafayette, Harvard, Manning, And “Shut Up And Give Us The Score!” [Updated]

Good Morning!

1 Commenter Other Bill had to ruin my evening by posting this defense of Jamele Hill from a Sports Illustrated writer, which would be enough for me to cancel my subscription if I had one.

“I was going to give this a pass. Truly, I was. Jamele Hill, the gifted young woman who co-hosts ESPN’s The Six every night with my old Morrissey Boulevard running buddy Michael Smith, got on her electric Twitter machine and tweeted out her unremarkable—and damned near irrefutable—opinion that the current president of the United States is a racist and a white supremacist. This drew the usual screams from the political flying monkeys of the American Right. ESPN responded with a craven corporate response that I’ll get to in a minute, but let me just say right now that you will not believe that the response was written by anyone who ever came within a light-year of any newsgathering operation. OK, so I thought that was pretty much it. I agreed with everything Hill tweeted. I thought what she said should be obvious to everyone in America at this point. She delivered her opinion. There was the customary cyber-bullying pushback, and we all move on.”

This is a perfect example of why sports writers should be seen and not read or listened to on non-sports topics. Let’s see:

a) The fact that she is “gifted”—a matter of opinion: a smart ESPN broadcaster wouldn’t do something this stupid—is irrelevant to the controversy. So a bad sports journalist  would be less justified in attacking the President like this?

b) A journalist calling the President of the United States a racist is in fact quite remarkable, and if an ESPN employee had called Barack Obama equivalent things, he or she would have been fired so fast her hair would have combusted.

c) OK, asshole, give me your closing argument about how President Trump is irrefutably a white supremacist. You can’t use the fact that he believes in enforcing immigration laws, or the fact that white supremacists tend to support him, when his political opponents are addicted to saying and writing things like “the whole white race is a virus.” You can’t use the fact that he doesn’t believe that tearing down statues of Civil War heroes is smart or valid, because I agree with him, and I am not a white supremacist. The fact that he implicitly defended the right of white nationalists to exercise their First Amendment rights makes him a supporter of the Constitution, as his oath of office requires, and not a nascent totalitarian like the hate-speech banning politicians you probably support.

So what have you got? I’d say nothing. It’s “irrefutable” to you because your left-wing friends say it is….

d) …not that whether Hill was right or not is the least bit relevant to whether ESPN is sending the message that gratuitous public anti-Trump, race-baiting grandstanding from employees is acceptable, but anti-Democrat/Muslim/Trans statements are not. It is sending that message, and that’s a double standard and obvious bias.

e) ESPN’s response was craven all right, but for the opposite reason that this guy says.

f) The fact that mostly conservatives correctly condemn Hill and ESPN only proves that the Left has lost its ethics alarms and professional compass, or broken them while stomping and screaming during their post 2016 election tantrum. It’s not a partisan or political verdict, except that “the resistance” would defend the Zodiac killer if he attacked the President. That’s their flaw, not ours.

Observations:

  • This is a classic. Biff and his various incarnations in the “Back to the Future” trilogy must be kicking themselves.  They said,

 “Eight o’clock Monday, runt. If you ain’t here, I’ll hunt you and shoot you down like a duck.”
(“Mad Dog” Tannen’s Gang Member : “It’s “dog”, Buford. Shoot him down like a dog.“)

KABOOM! I Thought I Had Seen The Most Ridiculous Theories Of How President Trump Obstructed Justice, But I Was Wrong!

To be clear, the KABOOM! in this case, which is the announcement that something has made my head explode, is not because of the ridiculous theory itself, but because I was wrong to believe that theories coming out of the Trump Deranged Who Were Once Smarter Than This couldn’t get worse.  I thought the theory that it was obstruction of justice for President Trump to fire an employee and subordinate, James Comey, whom not only he clearly had the authority to fire, but that just about everyone in the country in both parties had declared inept, biased, or criminal at one time or another over the past 12 months, and who had clearly committed firing offenses under Trump.

How could anyone of any authority or expertise whatsoever come up with a more idiotic theory than that? I was certain the answer was, “They can’t.” I bet my head on it.

Ah, but the hate of “the resistance” and the professionalism-corroding power of the Anti-Trump Brain Eating Virus is stronger than even I thought. Get this, and hold on to your heads:

In a USA Today story President Trump’s counsel John Dowd—he’s the one who doesn’t use obscenities or look like an axe-murderer—acknowledged that he had engaged in communications with the Special Counsel on behalf of his client, conveying how much the President “appreciates what Bob Mueller is doing.” Dowd said that the President asked him to convey his “appreciation and greetings.”

Ah-HA! Notre Dame professor Jimmy Gurulé, a former U.S. assistant attorney general under President George H.W. Bush, told LawNewz.com that the message from Dowd could be construed as intimidation or an effort to influence the investigation. “‘I’m watching you.’ How else could it be interpreted?” Gurulé said. ‘ Thank you for conducting an investigation into my campaign. Thank you for conducting an investigation into my son and my son-in-law.’”

How else? Gee, I don’t know. I’d interpret it as, “I appreciate what a difficult task you have, and understand that we all have to do our jobs”…

I wouldn’t have thought that a Trump Administration employee’s unethical conduct could make my head explode. I thought I was safe. After all, my hopes may be too high, but my expectations are so low. But there are my brains, dripping off the ceiling.

President Trump has a ludicrous burning crisis of chaotic management, undisciplined leadership, incompetent subordinates and mass competition for the National Foot-Shooting Championship. I suggested that months ago that this could only be addressed by the President appointing an experienced political professional with proven management skills and leadership ability to whip the White House into shape. President Trump had a better solution to the burning crisis: throw the human gasoline named Anthony Scaramucci  on it!

Brilliant!

What an idiot.

Yes, the Incompetent Elected Official of this post is President Donald J. Trump.

But the rest is all Scaramucci, the new White House Communications Director with no experience or acumen in the field of communications and public relations. This was immediately evident from his first substantial communication with the news media,  a vulgar, unprofessioal, undignified, embrrassing and vicious phone interview with the New Yorker’s Ryan Lizza unlike any interview by any White House figure ever.

Highlights, or rather points of signature significance, each showing that a) the man is an arrogant asshole and 2) President Trump possesses no judgment in his choices of staff whatsoever. Negative judgment.

1. He said, “I’m not [Trump advisor] Steve Bannon, I’m not trying to suck my own cock … I’m not trying to build my own brand off the fucking strength of the President. I’m here to serve the country.”

2. After Lizza asked Scaramucci about a private dinner that he had with President Trump,  Scaramucci boasted: “I fired one guy the other day. I have three to four people I’ll fire tomorrow. I’ll get to the person who leaked that to you. Reince Priebus—if you want to leak something—he’ll be asked to resign very shortly.” Continue reading →

Multiple KABOOMS! From “The Good Illegal Immigrant” Files: The Good, Well, OK, Maybe Not So Good, Illegal Immigrant Driver

One head explosion after another splattered my office with gore as I read the New York Times sad, sad, <sniff> piece about poor, abused, illegal immigrants who drive without licenses. It began:

“Heading to church one evening in late March, a farmworker and her sister were stopped for speeding in the village of Geneseo, N.Y. They were driving with their five children in the back of the minivan. Two were not in car seats, as required. The police officer, trying to cite the driver for the infractions, discovered she had no driver’s license, so he called Border Patrol to review her Guatemalan passport. Both sisters were undocumented immigrants. They were detained and are facing deportation.”

Good.

The Times, however, currently engaged in a full-on “Let’s make illegal immigrants as sympathetic as possible” campaign—how can we  be so mean to people who were just trying to go to church?—makes it clear that such an event is just more cruelty and lack of compassion emanating from the Trump Presidency.

“Under a Trump administration that has taken an aggressive stance on illegal immigration, the moving car has become an easy target. A broken headlight, a seatbelt not worn, a child not in a car seat may be minor traffic violations, but for unauthorized immigrants, they can have life-altering consequences.”

KABOOM! #1. How shameless will the Times’s misrepresentations regarding this issue get? These people are not being deported for “minor traffic violations.” They are being deported because they ahve absolutely no business being in the country at all. The Yorkshire Ripper was caught because of a police stop for a minor traffic violation.  By the Times reasoning, this, and not  the 13 women he murdered, is why he was sentenced to life in prison.

These drivers are also not “undocumented.” Undocumented is what I was when I was stopped for speeding with an expired license. I was, however, still a citizen. “Undocumented” is a Times and illegal immigration lobby cover-word for what illegal immigrants really are: illegal immigrants.

The term deceitfully suggests that the “undocumented” individual was just missing some papers—t could happen to anybody! No, you are not just “missing papers” that you never had the right to have.

KABOOM! #2:

“As many as 12 states, along with the District of Columbia and Puerto Rico, offer driver’s licenses for unauthorized immigrants, up from three in 2010. New York, which has the third-largest immigrant population in the country, is not one of them.”

Three was unconscionable. Twelve is a scandal and a dangerous attack on sovereignty and the Rule of Law.

KABOOM! #3 and #4:

Supporters of efforts to allow those who are undocumented to get driver’s licenses say that public safety would improve because they would be required to pass road tests and obtain insurance. But critics said that licenses represented a privilege that unauthorized immigrants should not hold, because they should not be here in the first place.

The first sentence is a logical disconnect: Let’s make what these people do legal, because they’ll break the law if we don’t. Yes, and the fact that they’ll break the law if they can’t do something legally is why they are here illegally and why they cannot be trusted as citizens. To its credit, the Times at least quotes a Republican lawmaker who is not deceived, though the paper suggests that she has a comprehension problem:

Senator Kathleen A. Marchione, a Republican representing the Upper Hudson Valley…does not understand the argument for giving licenses to those who are undocumented.“Driving without a license should not give you a right to have a driver’s license when you are already breaking the law in two instances,” she said in an interview. “That’s like saying if a kid is drinking at 16 years old, we might as well let him.”

That is exactly what it is like. She “doesn’t understand” the argument because it doesn’t make sense and never has. The Times won’t accept this, as the second sentence in the quote above makes clear. This isn’t merely what “critics” say. It is a fact. There is no “other side” to facts, and the Times is misleading its readers to suggest that this is just a contrarian position.

KABBOOM #5 and #6 came after reading this quote:

Anne Doebler, a private immigration lawyer in Buffalo, said that undocumented immigrants want to follow traffic laws, and that civil law and immigration law should be kept distinct. “Why do we want to use our vehicle and traffic laws to enforce an immigration policy when it’s detrimental to public safety?” she asked. “I don’t want someone to hit me who doesn’t have insurance…I don’t care what their immigration status is.”

“Undocumented” as a cover-word for “illegal” no longer makes my head explode, it just makes me angry. But Doebler’s spin is outrageous. Oh, the illegal immigrants want to obey laws that make it easier for them to live here illegally, do they? Well, isn’t that wonderful! Why don’t they want to obey the immigration laws? Heck, why don’t we just stop enforcing all laws, since avoiding law enforcement often makes criminals and law breakers breach other rules, laws, and ethical obligations?

The Times cites statistics showing that hit and run accidents by illegal immigrants declines significantly when they are allowed to have licenses and insurance. Hey! I just thought of an even better way to reduce hit and run accidents by illegal residents!  Can you guess what that would be?

Would Doebler care what the immigration status of someone who, say, ran down her child was, if that individual had been allowed to stay in the country after a previous traffic infraction? Would she really think, “Illegal, legal, what’s the difference?” I think not. I think she would say, “the driver who killed my kid should not have been on the streets at all,” because that would be obvious and true.

It’s an All-Fred Morning!

Every day, Ethics Alarms head scout Fred sends me multiple suggestions for posts from he finds heaven-know-where. Even when I can’t fit them in, they often serve as references and always are enlightening.

1. I suspect this belongs in the Polarized Nation of Assholes files: For two years, since he returned from service combat zones in Iraq and Afghanistan, Lieutenant Commander Joshua Corney, has kept his promise to salute his fallen comrades in arms by playing a recording of Taps every evening before 8:00 p.m on his five-acre property in Glen Rock, Pennsylvania. It takes 57 seconds. It does not exceed volume limits. My dog barks longer that that every night after midnight when we put him out. Nonetheless, some of Corney’s neighbors have filed objections with the  borough. Now Glen Rock, which allows church bells to ring, among other sounds, ordered Corney to limit the playing of taps to Sundays and what it termed “flag holidays.” Each violation of the borough’s order would bring a criminal fine of 300 dollars. But the borough’s enforcement action involves two big constitutional no-nos: the heckler’s veto and content-based censorship. The borough is relying on a nuisance ordinance that prohibits sound that “annoys or disturbs” others, and just one individual annoyed by the somber Civil War era bugle solo is enough to deliver a “heckler’s veto.’

The ACLU is on the case, and backing Corney as he fights the action. It writes,

“If a “heckler” could shut down anyone who said or played something that annoyed or offended them by complaining to government officials, freedom of speech would be no more. For more than 75 years, it has been black letter First Amendment law that the government cannot censor speech simply because it is not universally appreciated.

Moreover, the borough cannot use its vague nuisance ordinance to single out only Lt. Commander Corney’s musical expression for censorship from the range of sounds that are part of the borough’s regular sonic landscape. The borough has not ordered Lt. Commander Corney to lower the volume of taps or claimed he has violated a noise-level ordinance.

And it could not claim such a violation because the recording neither exceeds any established noise levels nor is it as loud as many other sounds the borough tolerates — including many sounds that do not communicate a message, like lawnmowers, leaf blowers, chainsaws, and vehicles. Censoring clearly protected expression, like taps, for being too loud, while allowing louder sounds that carry no constitutionally protected message turns the First Amendment on its head.”

Bingo. It is in cases like these that the American Civil Liberties Union shows how essential its role is in protecting the freedoms here that are so frequently under attack.

2. I was surprised when I learned some time ago that undercover police officers used to routinely have sexual relations with prostitutes before arresting them (homosexuals too, when they werebeing persecuted and  prosecuted). Just two months ago, Michigan became the last state in the U.S. to make it illegal for police officers to have sexual intercourse with prostitutes in the course of an under-cover (or covers) sting. Now Alaska wants to go an additional step, banning “sexual contact” with “sex workers” entirely. This could be mere touching or kissing. Advocates of Alaska’s House Bill 73 and Senate Bill 112 argue that police catching sex workers in the act by engaging with them sexually is a human rights violation, and Amnesty International has made an official statement supporting that claim: “Such conduct is an abuse of authority and in some instances amounts to rape and/or entrapment.” Police, quite logically, point out that the bill would make  successful undercover investigations impossible, which is, of course, the whole idea.

“[The prostitutes] ask one simple question: ‘Touch my breast.’ OK, I’m out of the car. Done. And the case is over,” Anchorage Police Department Deputy Chief Sean Case told the Alaska Dispatch News in a hypothetical example. “If we make that act (of touching) a misdemeanor, we have absolutely no way of getting involved in that type of arrest.”

Ethics Alarms is anti-prostitution. As with recreational drug use and probably polygamy, prostitution, which harms families and the young women and men exploited and abused to support it, is almost certainly on the road to legalization. Government won’t protect vital society ethics norms, but it will order you to buy health insurance because it’s for your own good. Continue reading →

Morning Ethics Warm-Up: 7/2/17 [UPDATED]

1. I wonder when and if the LGTBQ community will ever grow up. I had an annoying exchange yesterday when a Facebook friend began whining that President Trump hadn’t done or said anything to honor Gay Pride Day, proving again that he was the spawn of Satan. A friend of that friend then added, to the usual flood of “likes”—all you hve to do is insult the President to get likes— that for him to honor Gay Pride Day would be like Hitler observing ceremonies for Holocaust victims. Of course, nobody had the integrity or the decency to point out what an idiotic comment that was, so I did. When will people stop making me defend Donald Trump? He is the first and only President to enter office fully accepting same sex marriage (unlike Obama and Clinton) and the unending slur that he is hostile to gays is the product of two factors: fearmongering (He was going to put gays in camps!) and bigotry (If he’s a Republican, he must hate gays.) One response to my rejoinder was someone posting this NBC story as a “rebuttal.” The sum total of the anti-gay actions of the Trump administration, according to this alleged indictment? Here’s the description:

“For many LGBTQ Americans, the early days of Trump’s Republican administration have been fear-inducing. A series of Cabinet appointments have been roundly criticized by LGBTQ advocacy groups. An early draft of a reported executive order legalizing broad discrimination against LGBTQ people threw the community into a panic. The dismantling of Obama-era protections through executive orders came with the simple stroke of a pen.”

Ethics Observations On Bill Maher’s Incest Joke About Ivanka Trump

This is my favorite photo of Bill Maher. It captures the essence of his charm, his manners and his wit so perfectly…

Following the (much deserved and still not sufficient) criticism of Fox News’ Jesse Watters’ leering “joke” about Ivanka Trump’s handling of a microphone, HBO’s Bill Maher gave conservative critics an opportunity to trot out the  “we have standards, where are yours?” accusation against liberals when the host of “Real Time” made suggestive gestures while talking about how the First Daughter “helps” President Trump.

“What do you make of Ivanka and her efforts to sort of humanize her father?”, the comic asked guest Gabe Sherman ( a writer, book author, Fox News critic and a vocal one regarding Watters’ incivility). “We see all this misogyny at Fox News [ KABOOM!, incidentally. If there is anyone on earth other than the President more ethically estopped from accusing someone else of misogyny, it’s Maher, who flings “cunt” and “twat” at women he disagrees with and who cheered Bill Clinton’s exploitation of Monica Lewinsky on the grounds that “he works hard, and he deserves it”); we see it in Donald Trump himself. A lot of us thought, Ivanka is gonna be our saving grace.” Then, as he mimed Ivanka masturbating her father, Maher continued, “When he’s about to nuke Finland or something, she’s gonna walk into the bedroom and—”Daddy, Daddy…’Don’t do it, Daddy!”‘

This most recent vulgarity by Maher as his audience of hateful left-wing boors hooted on cue even moved the progressive tool Daily Beast to complain that “if liberals are going to castigate Donald Trump for his boorish, sexist behavior, they shouldn’t behave in a similar fashion” —a point that is too little and far too late in the case of proudly boorish, sexist Bill Maher.

Incompetence Saturday’s Grand Finale: The Most Incompetent Story Ever Told!

The promise (L) and the reality (R)

I have now read about ten articles about the collapse of the Fyre Festival in the Bahamas, and I still find it hard to comprehend.

The Fyre Festival was conceived by rapper Ja Rule and associate Billy McFarland in the Bahamas, and promoted by pop celebrities (I barely, just barely, know these people) Kendall Jenner, Emily Ratajkowski, Hailey Baldwin and Bella Hadid, In a promo video posted January, the Fyre Festival promised..

“The best in food, art, music and adventure…on the boundaries of the impossible, Fyre is an experience and festival…A quest to push beyond those boundaries!”

I have no idea what that means, but it sounds exciting, doesn’t it?

“You’ll be flown roundtrip on a custom, VIP configured Boeing 737 aircraft between Miami International Airport and Exuma International Airport on Great Exuma,” said the festival’s website. “Guests will be staying in modern, eco-friendly, geodesic domes. … Unplug from the everyday and ignite your flame in the Exumas!” Among theacts scheduled to perform were Major Lazer and Blink-182, as well as a DJ “who specializes in producing ’70s and ’80s rock remixes for clients that include Middle Eastern and European royalty.”.

Celebrities with ties to the organizers  tweeted and Instagrammed, building buzz about Fyre.  Ja Rule tweeted just a month ago, “This is where the cool kids will be April 27-30 May 5-8!!! #fyrefestival #fyre.”

Ticket packages to experience the self-proclaimed “cultural event of the decade” included accommodations and chartered flights from Miami, with a low price of $900 and a luxury tag of $399,995 for access to the performers.  Days before the festival was to begin, @fyrefestival  was still ginning up anticipation.

Then the festival-goers arrived on the first day to find…nothing. Well, worse than nothing: chaos. Those who had  paid $500 apiece for what the festival’s promotion described as “villas” found that the only shelter provided were FEMA-style refugee tents. There was no food, except some hastily packaged cheese sandwiches. All of the scheduled performers canceled.

The festivalgoers who hadn’t arrived by private yachts found themselves confused and stranded, with luggage but nowhere to sleep for the night. Some paid festival employees $100 to return them to the airport in a flatbed truck, but when they arrived at the airport gate, they were told that they couldn’t access the airport, requiring more bribes to get to a plane, if they were lucky. The stampede of shocked glitterati desperately trying to flee backed up the local airports, stranding many attendees in deplorable conditions, like understaffed kitchen tents with  pots of uncooked food.

And where were the organizers during all this? Nowhere near the “festival,” in Ja Rule’s case. (McFarland was  either partying on a yacht the first night of the festival, or he actually showed his face and tried to assist the victims of his ineptitude. I tend to the first account, because if he did show up, I would assume that he would be chum by now.)  Ja Rule was performing… in Chicago. He later issued a ridiculous statement, saying in part,

“I’m heartbroken at this moment. My partners and I wanted this to be an amazing event, it was NOT A SCAM as everyone is reporting. I don’t know how everything went so left but I’m working to make it right by making sure everyone is refunded … I truly apologize as this is NOT MY FAULT … but I’m taking responsibility I’m deeply sorry to everyone who was inconvenienced by this.”

Comments:

1. If you organize and promote an event and it turns out like this one, it IS your fault. You idiot.

2.  If it was a scam, at least the results could be explained as something other than someone persuading many people to trust and rely on him when he had no idea what the hell he was doing.

3. Inconvenienced? INCONVENIENCED? Selling tickets to an event in the Exumas that requires people to fly there and be met with a total fiasco is a lot more than an inconvenience.

His partner, Billy McFarland, had equally jaw-dropping comments, which included these gems..

We started this website and launched this festival marketing campaign. Our festival became a real thing and took [on] a life of its own. Our next step was to book the talent and actually make the music festival. We went out excited, and that’s when a lot of reality and roadblocks hit. 

The Exumas didn’t have a really great infrastructure – there wasn’t a great way to get guests in here – we were a little bit ambitious. There wasn’t water or sewage. It was almost like we tried building a city out of nothing and it took almost all of our personal resources to make this happen, and everything we had, to make this festival go on. We thought we were ready and built two different festival sites….The morning of the festival, a bad storm came in and took down half of our tents and busted water pipes. Guests started to arrive and the most basic function we take for granted in the U.S., we realized, “Wow, we can’t do this.” We were on a rush job to fix everything and guests were arriving and that caused check-in to be delayed. We were overwhelmed and just didn’t have the foresight to solve all these problems….We thought we were making timeframes that were correct. We were a little naïve in thinking for the first time we could do this ourselves. Next year, we will definitely start earlier. The reality is, we weren’t experienced enough to keep up.

KABOOM! United Air Lines. Unethical. Incompetent. Stupid. Insane. Unforgiveable. [UPDATED]

Just read this, which goes with the video.

Quick summary: a United flight supervisor came on board a sold-out flight and demanded that four seated passengers leave the plane  so four United employees could take their seats. Four passengers were chosen at random, and one, an older man, refused. Police were called and he was beaten and forced off the plane.

Really.

It’s hard to type with all these brains from my head explosion on the keyboard, but…

1.  No business that treats customers like this deserves to stay in business.

2. Any solution would have been better. Anything. Charter a flight for the United employees. Pay 10,000 bucks per passenger as incentive. Offer a lifetime ticket. That the united employees couldn’t come up with a less abusive and disrupting solution shows terrible training, terrible judgment, and a terrible corporate culture.

3. I am stunned that no passenger, when the older man who refused to go began to be abused by the police, stepped forward to take his place. I would think that would be an obvious response. Can we all pledge here and now that before someone is dragged screaming of a flight we are on, we’ll step forward and give up our seats?

4. I have to travel a lot for my business, but I will move heaven and earth not to have anything to do with United.

5. The carrier should pay dearly for this.  It is inexcusable.

While United’s customer service policies in this case are clearly heinous and absurd, let’s not forget to also cast blame on the police officers who actually committed the brutality on United’s behalf. NPR reports that the cops attacking the man “appear to be wearing the uniforms of Chicago aviation police.”

While there may be something to be said for the ability for private businesses to summon the help of the police to remove people from their premises if they refuse to leave peacefully and their presence is unwanted, there is no excuse for the police to cooperate when the reason their presence is unwanted is not “causing a disturbance” or being violent or threatening to other customers, or stealing goods or services, or doing anything wrong at all, but rather wanting to peacefully use the service they legitimately paid for.

Shame on both United for calling the cops on a passenger to make the lives of their employees and business easier, and shame on the police for having any part of it.
