Ethics Observations: Comey’s Second Letter On The Clinton E-mail Investigation

FBI director James  Comey informed Congress yesterday, two days before the culmination of the Presidential campaign, that the recently re-opened inquiry into Hillary Clinton’s  irregular handling of classified e-mails uncovered no new evidence that would change July’s recommendation that she shouldn’t face criminal charges.

“Based on our review, we have not changed our conclusions that we expressed in July with respect to Secretary Clinton,”  Comey wrote in a letter to the leaders of several congressional committees.

Observations:

1. Good.

If Clinton wins the election, she should be able to start her term of office without this scandal of her own making still hanging over her head. After all, there are sure to be new scandals in due time, unless she turns over a new leaf like Richard Nixon did when he finally became President in 1968. Herblock, the Washington Post’s iconic Republican-hating cartoonist, even symbolically gave him a shave. (Herblock drew Nixon with a five-o’clock that made him look like an axe murderer.) Yes, the irony is intentional.

If Hillary loses, Comey’s late “never mind!” might stop Democrats from claiming that her inevitable coronation was prevented by a deliberate FBI plot, and allow them to further undermine trust in law enforcement. It might, but it probably won’t.

2. In fact, this process has already started. The Washington Post’s political columnist Chris Cillizza quickly filed a piece called “It’s hard to see how James Comey could have handled this last 9 days any worse.”

Election Extra! This News Story Illustrates Why You Can’t Trust Hillary Clinton: Corruption! Conflict Of Interest! Lies! Cover-Up! And Of Course, The Mainsteam News Media Doesn’t Want You To Understand It, Which Is Part Of The Story Itself

[ I apologize: this is long. I also think it is important: I know this may be a tipping point for me. I hope you’ll read it, and share it.]

Yesterday, I saw this news item from Reuters, one of the few respectable news sources on the U.S. election that has not been distorting and withholding information to tip public opinion one way or the other. I tracked it all day to see whether the mainstream news media would highlight, or even mention it.

Significantly, the information involved came in a post-workday news dump on a Friday, a technique that has become a favorite of the Obama administration, and has been adopted by its party too.  If you missed it, in other words, that was the intention.

I’ll bold the most critical points:

Reuters:

The Clinton Foundation has confirmed it accepted a $1 million gift from Qatar while Hillary Clinton was U.S. secretary of state without informing the State Department, even though she had promised to let the agency review new or significantly increased support from foreign governments.

Qatari officials pledged the money in 2011 to mark the 65th birthday of Bill Clinton, Hillary Clinton’s husband, and sought to meet the former U.S. president in person the following year to present him the check, according to an email from a foundation official to Hillary Clinton’s presidential campaign chairman, John Podesta. The email, among thousands hacked from Podesta’s account, was published last month by WikiLeaks.

Clinton signed an ethics agreement governing her family’s globe-straddling foundation in order to become secretary of state in 2009. The agreement was designed to increase transparency to avoid appearances that U.S. foreign policy could be swayed by wealthy donors.

If a new foreign government wished to donate or if an existing foreign-government donor, such as Qatar, wanted to “increase materially” its support of ongoing programs, Clinton promised that the State Department’s ethics official would be notified and given a chance to raise any concerns.

Clinton Foundation officials last month declined to confirm the Qatar donation. In response to additional questions, a foundation spokesman, Brian Cookstra, this week said that it accepted the $1 million gift from Qatar, but this did not amount to a “material increase” in the Gulf country’s support for the charity. Cookstra declined to say whether Qatari officials received their requested meeting with Bill Clinton.

Officials at Qatar’s embassy in Washington and in its Council of Ministers in the capital, Doha, declined to discuss the donation.

The State Department has said it has no record of the foundation submitting the Qatar gift for review, and that it was incumbent on the foundation to notify the department about donations that needed attention. A department spokeswoman did not respond to additional questions about the donation.

According to the foundation’s website, which lists donors in broad categories by cumulative amounts donated, Qatar’s government has directly given a total of between $1 million and $5 million over the years.

The Clinton Foundation has said it would no longer accept money from foreign governments if Clinton is elected president and would spin off those programs that are dependent on foreign governments.

“MATERIAL” INCREASE

Foundation officials told Reuters last year that they did not always comply with central provisions of the agreement with President Barack Obama’s administration, blaming oversights in some cases.(reut.rs/2fkHPCh)

At least eight other countries besides Qatar gave new or increased funding to the foundation, in most cases to fund its health project, without the State Department being informed, according to foundation and agency records. They include Algeria, which gave for the first time in 2010, and the United Kingdom, which nearly tripled its support for the foundation’s health project to $11.2 million between 2009 and 2012.

Foundation officials have said some of those donations, including Algeria, were oversights and should have been flagged, while others, such as the UK increase, did not qualify as material increases.

The foundation has declined to describe what sort of increase in funding by a foreign government would have triggered notification of the State Department for review. Cookstra said the agreement was designed to “allow foreign funding for critical Clinton Foundation programs” to continue without disruption.

The State Department said it has no record of being asked by the foundation to review any increases in support by a foreign government.Asked whether Qatar was funding a specific program at the foundation, Cookstra said the country supported the organization’s “overall humanitarian work.”

“Qatar continued supporting Clinton Foundation at equal or lower levels” compared with the country’s pre-2009 support, he said. He declined to say if Qatar gave any money during the first three years of Clinton’s four-year term at the State Department, or what its support before 2009 amounted to.

In another email released by WikiLeaks, a former Clinton Foundation fundraiser said he raised more than $21 million in connection with Bill Clinton’s 65th birthday in 2011.

Spokesmen for Hillary Clinton’s campaign and Bill Clinton did not respond to emailed questions about the donation.

Now let’s get this out of the way up front: the import and significance of the facts in this story were covered up…by Clinton, by her Foundation, by State, and by the news media.This story was buried in October by the Donald Trump “pussy-grabbing” video, and the news media focused the public’s attention on little else. For The Sixth Straight Year, Jimmy Kimmel Reminds Us That Child Abuse Is Hilarious

I know I’ve already condemned Jimmy Kimmel, TV’s  most revolting and  successful fick , this year, and I wish that was enough. I don’t like even thinking about the man; it depresses me profoundly that a major network pays millions to such a miserable human being to be such a miserable human being. Jimmy is a proud ethics corrupter, an advocate of parents making their children cry so they can get a sliver of fame—infamy, really—on YouTube and Jimmy’s late night show on ABC. Disney owns ABC. Disney. Disney pays this smug, cruel man to urge parents to make their children miserable for big laughs.

Think about it.

I have to revisit this asshole-blight on the culture, however, because this morning I watched supposedly lovable News Babe Robin Meade on HLN this morning as she showed some of the segments from the video above and laughed hysterically, along with everyone in her studio. The idea, Jimmy’s idea, after he decided to scotch the concept of asking parents to punk their toddlers by telling them that grandma was dead (just speculating here), is for parents to tell their beloved children that Mom and Dad had eaten all of their Halloween candy, and record their reactions. It’s sooooo funny! The little kids wail! They weep! They fall on the ground in abject grief! Robin couldn’t stop laughing. Child abuse is so hilarious.

Jimmy has proven that.

He’s also proven that a shocking number of  parents and ABC viewers have the ethical instincts of the Marquis De Sade. Continue reading →

James Comey’s Ethical Conflict

We now know that James Comey’s decision to inform Congress that the Clinton e-mail investigation had been re-opened (If I hear one more Clinton spinner  tells me that no case is ever “closed,” even one that is “completed,” I am going to run naked through the Safeway, screaming dirty limericks in pig latin. Be warned.) was “against Justice Department policy,” specifically the policy of “not acting in such a way as could influence an upcoming election.” Comey understood he was violating these guidelines, sources tell us,but felt he was obligated to do so because he had promised members of Congress he would inform them of any further developments related to Clinton’s email server misuse. Thus he sent a letter to F.B.I. employees after alerting Congress of the (possible) new evidence that necessitated re-opening the investigation. In the letter,  Comey acknowledged that his actions were unprecedented, but explained that…

I feel an obligation to do so given that I testified repeatedly in recent months that our investigation was completed. I also think it would be misleading to the American people were we not to supplement the record. At the same time, however, given that we don’t know the significance of this newly discovered collection of emails, I don’t want to create a misleading impression. In trying to strike that balance, in a brief letter and in the middle of an election season, there is significant risk of being misunderstood, but I wanted you to hear directly from me about it.

According to the Washington Post,  Comey was also concerned that the discovery of the emails would be leaked to the media after he briefed a team of investigators about them, causing the  F.B.I. to be accused of a coverup to benefit Clinton.

Some ethics conclusions:

1. Comey’s actions are consistent with an understanding of the Ethics Incompleteness Principle, which is often discussed on Ethics Alarms:

“The human language is not sufficiently precise to define a rule that will work in every instance. There are always anomalies on the periphery of every normative system, no matter how sound or well articulated. If one responds to an anomaly by trying to amend the rule or system to accommodate it, the integrity of the rule or system is disturbed, and perhaps ruined. Yet if one stubbornly applies the rule or system without amendment to the anomaly anyway, one may reach an absurd conclusion or an unjust result. The Ethics Incompleteness Principle suggests that when a system or rule doesn’t seem to work well when applied to an unexpected or unusual situation, the wise response is to abandon the system or rule—in that one anomalous case only— and use  basic ethics principles and analysis to find the best solution. Then return to the system and rules as they were, without altering them to make the treatment of the anomalous situation “consistent.”

Assuming that the “policy” is a sensible and ethical one to begin with (though it isn’t), this was an anomalous case. The FBI, and Comey personally, were rightly under intense criticism for their handling of the investigation. Among other puzzling decisions, Clinton’s aides were given immunity for no apparent reason; Clinton’s interview was neither videoed nor under oath; and Cheryl Mills, who was directly involved in the private server fiasco, was allowed to serve as Clinton’s lawyer when she was questioned. The policy was designed to protect the Justice Department and its component from suspicions of bias and partisan complicity, and the inept handling of the investigation  had already created those suspicions. When such a policy appears likely to have the opposite effect that it was established for, the rational and ethical approach is to make an exception, which is what Comey did.

“Black Mirror” Ethics

I finally am getting around to examining “Black Mirror,” the British anthology series that explores, sometimes in a science fiction context, ethics issues involving technology. It is a critical hit, and has just had its  third season posted on Netflix.

Technology ethics is a dynamic and crucial topic. I sure hope the series is better than the  first episode, “National Anthem.”

If you are going to do a series about ethics, knowing something about ethics is mandatory. This episode is so absurd and its resolution so idiotic that it’s barely worth analyzing, No spoiler alert necessary, because I’m only going to reveal what would be in any preview synopsis. The Royal Family’s princess is kidnapped by terrorists—I think that’s a fair description—and they release a video on YouTube in which the terrified young woman announces that she will be executed unless the Prime Minister has live sex with a pig, on all TV networks.

The rest of the episode’s 60 minutes involves the PM’s “ethical dilemma” as social media weighs in and his staff and family apply various kinds of pressure. I wouldn’t waste an Ethics Quiz on this alleged “dilemma.” Continue reading →

Of Bundys, Trump, Wikileaks, Rebellion—You Know, The Whole 2016 Election Thing

jury-nullThe jigsaw puzzle of an existential national crisis, a real one, are assembling sufficiently so an image can be distinguished. It is uglier than I imagined.

1. Item:  The Bundy Brothers were acquitted. This was pure jury nullification, because they were guilty as hell. It might be an aberration, but I fear it is not. The jury is a fractal of democracy, and when juries start finding lawbreakers innocent, they are sending a message that those in power ignore at their peril. They say “We don’t like or respect you or your laws, and you better change, or else.” The complete class, regional and ideological estrangement from the Federal government this decision represents shows how completely Barack Obama has divided the nation, and portend a long, long, difficult and, one can only hope non-violent recovery, if some competent leaders emerge who can handle it. As trust in our institutions have collapsed with accelerating speed over the last decade, civility has deteriorated and authorities have increasingly threatened the basic Constitutional rights of citizens while extending privileges to non-citizens for political motives, the connective tissue of our society has been frayed to the snapping point. Responsible leadership, objective  and rational citizens must not shrug this verdict off as just a bunch of gun nuts and cowboys throwing a tantrum.

2. Item: Donald Trump keeps saying that the election is “rigged.” This is beyond irresponsible, in isolation not more irresponsible than what Trump has said about other things, but the timing and sheer intensity of this drumbeat from him is truly horrible….and also likely to be effective.  Continue reading →

The Unethical Candidacy Of Evan McMullin

“McMullin will likely not appear on enough ballots to win the necessary Electoral College majority of 270 electoral votes. However, McMullin hopes to deny a majority of the electoral vote from either of the two major party candidates. In such a scenario, under the the terms of the Twelfth Amendment, the House of Representatives would select among the top-three electoral vote winners. McMullin hopes that he could win the presidential election by finishing among the top-three electoral vote winners, and then winning the contingent election in the House.”

Reportedly, Evan McMullin also hopes to some day be able to burrow to China, like a mole, so he can see the terracotta warriors without paying airfare and going through Customs. (All right, I made that up.)

How ridiculous do  a Presidential candidate’s “hopes” have to be before they disqualify him to be President? Whatever the answer is, Evan McMullin has lapped it. Either he is dangerously detached from reality, or he’s exploiting deperate voters by lying to them. On the chart above, only the orange states have McMullin on the ballot. The yellow states allow write-ins, which mean he is on the ballot exactly as I am, or Donald Duck, Batman, and Britney Spears. In the rest, you can’t vote for him at all.

McMullin didn’t even announce his candidacy until August 8. Why the rush, Evan? This is like the joke about Poland’s greatest comedian being asked what the secret to comedy is, and before the question is completed he shouts, “Timing!” Timing is essential to effective leadership too, as the dithering style of Barack Obama has shown in many tragic ways. [I expect him to give an eloquent speech about the dangers of racial distrust and attacks on the rule of law —as, for example, in this fiasco—sometime in 2018. Probably on a golf course.] It was clear to anyone paying attention that the U.S. was going to be stuck with a Donald Trump-Hillary Clinton binary hell-choice by the end of May, when the Libertarian Party demonstrated to the world that it is a joke. Was McMullin not paying attention? That’s a bad sign, don’t you think?

The U.S. Presidency is important, and elections are important. One of the first times I wrote a post critical of Donald Trump was when he first floated the idea of running for President several cycles ago, and it was clear—then— that he was doing it as a publicity stunt.  This was signature significance, I wrote.  Only a massive jerk (I already knew Trump was a massive jerk, of course) with no concern for his country sets out to confuse and confound the easily confused and confounded American voter by throwing random pollution into the Presidential campaign. After the 2000 election, where the twin ego-driven campaigns of Ralph Nader and Pat Buchanan probably changed the identity of the next President by sheer chance, it was obvious that nobody should put themselves on the ballot unless there is a very good reason related to the nation’s welfare. Building a credible third party option over time is a good reason, or can be if the party doesn’t try to do it by nominating an incompetent. Running for President for vanity, or to sell merchandise, or to get speaking gigs, is not a good reason. It is unethical. Continue reading →

Ethics Dunce: The Smithsonian Institution

The new Smithsonian Institution’s National Museum of African American History and Culture is intended to celebrate the two aspects of African American influence on the nation mentioned in the title, and that includes honoring  influential and historically significant African American leaders. Among the figures ignored by the museum’s displays is Associate Justice Clarence Thomas, only the second black member of the Supreme Court. The museum does, however, celebrate the “heroism” of his last-minute accuser at Thomas’s confirmation hearings, law professor Anita Hill.

This is another and particularly sad reflection of the petty partisan bias and lack of integrity demonstrated by the Obama Administration at so many levels. It is stuffed with so many intractable ideologues, and often incompetent ideologues, that objectivity, respect and fairness are frequently too great an effort to muster. The museum honors Hill, who was recruited as a last ditch effort by Democrats to block President George H.W. Bush’s nomination of a black conservative judge to the Supreme Court and whose accusations of sexual harassment were never verified except by the confirmation bias of Democrats and Thomas’s enemies. It chose to snubThomas, which all involved had to know would be seen as an insult to the Justice, and a calculated one.

By all logic and reason, Hill should be, at best, a footnote to a Thomas display. Mean-spirited bias from the empowered Left under Obama has extended even to museum curating, which should be non-partisan. Continue reading →

Debate Ethics: Trump’s “Breathtaking Repudiation Of American Democracy”

Substance, of course, is officially irrelevant to the 2016 Presidential election. This is a bitter “be careful what you wish for” realization for Ethics Alarms and its author, as I have long argued that leaders’ values and character are more important and should be given more weight in any choice of candidates than their political affiliations or official policy positions. I did not foresee  a race in which both candidates have definitively proven that they are unfit for office and corrupt beyond repair or redemption, and one of those candidates is so unfit that even the epic dishonesty and democracy-corroding conduct of his opponent cannot begin to justify a vote for him by anyone with the sense of a bivalve mollusk.

Thus, once again as in the first two debates, the leading story coming out of last night’s snark-fest relates to character, not substance. In this case, it doesn’t even relate to practical reality. Donald Trump was asked by debate moderator Chris Wallace,

Your running mate Governor Pence pledged on Sunday that he and you, his words, will absolutely accept the result of this election. Today your daughter Ivanka said the same thing. I want to ask you here on the stage tonight, do you make the same commitment that you’ll absolutely accept the result of the election?

..and after talking around the question interminable, as usual, Trump finally answered,

What I’m saying is that I will tell you at the time. I’ll keep you in suspense, okay?

Hillary Clinton immediately pronounced the answer “horrifying,” and her assessment is currently being echoed on editorial pages and by pundits and analysts as if Trump announced that he was raising an army of NRA members to take the White House by force. Gasped the Washington Post this morning, in an editorial titled, “Trump’s Breathtaking Repudiation of American Democracy,” “Respecting the will of the voters has since the end of the Civil War allowed for a peaceful transition of power that has made this country the envy of the world….[Clinton’s flaws] fade to the status of trivia in the face of an opponent who will not accept the basic rules of American democracy.”The New York Times, in its editorial titled “Donald Trump’s Contempt for Democracy,” pontificated,

Mr. Trump’s meltdown in the closing weeks could be dismissed as a sore loser’s bizarre attempt at rationalizing his likely defeat. But his trashing of the democratic process, in service of his own ego, risks lasting damage to the country, and politicians of both parties should recoil from him and his cynical example.

It in no way excuses Donald Trump to take notice of the “breathtaking” dishonesty here.

Ten Ethics Observations On The New Bill Clinton Sexual Assault Accusation

Leslie Millwee, a former reporter for local Arkansas TV station KLMN-TV, has accused former president Bill Clinton of sexually assaulting her three times in 1980, while Clinton was governor of Arkansas…Millwee told Breitbart she interviewed Clinton about 20 times publicly and also met with him in KLMN-TV’s newsroom. She said he groped her and rubbed his genitals on her while they were alone in KLMN-TV’s small editing room.

“He came in [to the editing room] behind me, started hunching me to the point that he had an orgasm,” she told Breitbart’s Aaron Klein. “He’s touching, trying to touch my breasts and I’m just sitting there very stiffly, just waiting for him to leave me alone. And I’m asking him the whole time, ‘Please do not do this. Do not touch me. Do not hunch me. I do not want this.’ And he finished doing what he was doing and walked out….Breitbart also interviewed three of Millwee’s friends, who said Millwee told them in the late 1990s about the alleged assaults.

…Millwee’s accusations are new, and Breitbart, which published a 19-minute video interview with Millwee, has been supportive of Trump and dismissive of the numerous women who have accused him of sexual assault. The site is led by Steven Bannon, who took a leave from Breitbart to serve as CEO of Trump’s campaign.Millwee said she considered coming forward in the late 1990s, during the Monica Lewinsky scandal, but she was intimidated after seeing how the media treated other women who accused Clinton of sexual assault.

“I almost came out during the Monica Lewinsky and Kathleen Willey situation,” she said. “I watched that unfold a little bit. I was very prepared to go forward then and talk about it, and I watched the ways the Clintons and Hillary slandered those women, harassed them, did unthinkable things to them, and I just did not want to be part of that. I had very small children at the time, I had a job at pharmaceuticals, it was a very conservative situation. I didn’t want to do anything to bring harm to my career and my family.”

Millwee said she decided to finally go public now because she believes that the media still has not held Clinton accountable for his alleged sexual assaults. A Breitbart spokeswoman said Millwee reached out to Breitbart on her own “months ago after Hillary’s ad that sex assault victims have a right to be heard.”
