Nah, the Trump Deranged aren’t losing their frickin’ minds…

That’s the most recent cartoon from Ann Telnaes, that witty, subtle, objective and non-partisan political cartoonist who quit the Washington Post who didn’t think her juvenile submission was worth publishing. So now she’s operates from her substack, issuing brilliant art like that. Incredibly, one of my oldest and most accomplished friends posted that crap—it’s the equivilent of a schoolboy drawing of the unpopular kid with blacked out teeth and horns—with approval on his Facebook page, where his decision was roundly praised as he revealed that he subscribed to her visual hate-fests. This is the equivalent of someone announcing that he has decided to subscribe to the “Turd of the Week” service. Another equally rational, intelligent Facebook friend until he went bonkers posted a long, irrelevant quote from the Nuremberg trials about the nature of fascism, and everyone metaphorically nodded and applauded as if it has anything to do with current events.

Ethics Notes on the Reagan National Airport Collision Aftermath

I live less than 15 minutes from Reagan National Airport, so last night’s deadly collision between an American Airlines commuter jet and an Army helicopter from Fort Belvoir was just about the only news available on satellite or network after 9 pm. yesterday. Why, after all this time, is this still the practice in news reporting? All four local networks, plus the PBS outlet, and CNN, Fox News and MSNBC, reported exactly the same lack of developments for the rest of the evening. This used to puzzle me when there was a major news story when I was a kid. The practice makes no sense, wastes money, and leads to not-so-bright people, which is to say most talking heads and reporters on the scene, to resort to saying silly things to fill dead air. What is this, virtue-signaling? To show they care? Why don’t all of broadcast news sources have an advance, rotating agreement for one of them to cover these things after the others put up a screen that states, “We at [station or network] care about X, and you will find complete coverage at [the designated pool broadcast location]. We will let you know about any substantive developments”?

Literally nothing happened last night after the crash itself and the rescue teams arrived. Reagan quickly announced that it was suspending flights at least until morning. Meanwhile, we were hearing dumb statements. A couple of far away videos of the accident showed a tiny light, the aircraft, being met by another tiny light, the copter, followed by brief flash and a hint of something falling into the Potomac. These videos would have had to be explained if one saw them out of context, yet one of the newscasters introducing one felt required to issue a trigger warning: “We must warn you, these images are extremely disturbing.” No, they weren’t. Anyone who is extremely disturbed by little flashes of light needs to be in a home for the bewildered.

At around 11 pm, someone on CNN felt the need to ask some guest in the airline industry who had nothing substantive to say, “What would you tell anyone watching who fears for her life and those of her loved ones in future flights as a result of this tragedy?” The guest blathered something innocuous, but should have said, “I would recommend that anyone who reacts like that brush up on their understanding of statistics and critical thinking. This event has literally no significance as far as calculating the safety of air travel.” The exchange reminded me of the argument I had just had with my occasionally woke-addled sister, who said that she was fearful of going to a movie theater because of the risks posed by legal semi-automatic rifles being legal. (She isn’t really, but was desperate for an anti-Second Amendment argument.) Even asking a question like that makes the vulnerable, the hysterical and the stupid (Hey, wasn’t that the title of a Clint Eastwood spaghetti Western?) dumber still. It’s irresponsible and incompetent.

Well, I Guess There Won’t Have To Be A Revolution THIS Time…

The Trump Deranged really do think this President is capable of being Hitler.

In a post on his usually rational and excellent blog “Simple Justice,” criminal defense lawyer Scott Greenfield embroils himself in an apocalyptic scenario where President Trump decides to break the law, defy the courts, and impose his will on the nation. Greenfield writes in part,

What mechanism exists to prevent a president from simply doing whatever he pleases? I gave the short list of how this works on the twitters.

There are three primary checks on presidential power:

1. Virtue
2. The military’s refusal to support unlawful action
3. Revolution

Some replied that this was wrong, ignoring the constitutional separation of powers, court rulings, Congress’ laws, even elections and impeachment. They missed the point. Honoring all the guardrails built into the system falls within the first check, virtue. It only matters if the president respects the law and the Constitution. Andrew Jackson realized this when he mumbled, “John Marshall has made his decision; now let him enforce it.” What if the president just says “no”?

What is Congress or the Supreme Court going to do if the President tells them to kiss his executive butt? Congress may have the spending authority, but it’s the Treasury that holds the cash and writes the checks. The Supreme Court may have the authority to hold an action unconstitutional, but the military serves under the Commander in Chief.

If the president abides by the limitations of law or constitutional authority, as has generally been the case up to now despite the occasional overstep, then the mechanics of our society work. But what if he doesn’t?

A poll that I saw this morning (and that had mysteriously vanished when I looked for it just now) found that 43% of Los Angeles citizens would consider looking to the Republican Party for future leadership. That was considered significant in a city with only 18% of its residents identifying themselves as Republicans. I thought the amazing finding in the poll was that 48% still say they would only vote for more Democrats.

Two Executive Orders, One Extra-Constitutional, the Other Unconstitutional (and Unethical Too)

Let’s talk about the “un”-EO first. Federal District Court judge, John C. Coughenour, temporarily blocked President Trump’s executive order to end automatic citizenship for babies born on American soil, the so called “anchor baby” phenomenon. Three days after Trump issued his executive order, the judge sided with the first four states that sued, saying, “This is a blatantly unconstitutional order.” 22 states, along with activist groups and expectant mothers, have now filed lawsuits to halt order on the grounds that it violates the 14th Amendment. Courts have always interpreted the amendment’s section stating that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States” as applying to (almost) every baby born in the United States.

“Frankly,” Judge Coughenour added, “I have difficulty understanding how a member of the bar would state unequivocally that this is a constitutional order. It just boggles my mind.” Well, lawyers don’t usually state propositions, even Hail Mary theories like this one equivocally. I think Trump’s lawyers told him that the order would almost certainly be found unconstitutional, and maybe they told him that it is unconstitutional. I am pretty certain it is, and that nothing short of a Constitutional amendment can change the law.

Ethics Quiz: The J-6 Pardons

President Trump yesterday issued a sweeping grant of clemency to nearly all of the approximately 1,600 people charged in connection with the rioting in and around the Capitol on January 6, 2021. Shortly after being sworn in as the 47th President of the United States, Trump issued pardons to most of the defendants and commuted the sentences of 14 members of the Proud Boys and Oath Keepers militia, most of whom were convicted of seditious conspiracy. Trump also directed the Justice Department to dismiss “all pending indictments” against people facing charges for the riots.

While the pardons of many J-6 defendants were expected, the scope of Trump’s clemency was unknown until yesterday. The President even pardoned Enrique Tarrio, the former leader of the Proud Boys who is serving a 22-year prison term after being convicted at trial of seditious conspiracy and using violent force against the government. The pardons were as all-inclusive as anyone could imagine, and, predictably, the Axis is freaking out.

“These pardons suggest that if you commit acts of violence, as long as you do so on behalf of a politically powerful person you may be able to escape consequences,” said Alexis Loeb, who personally supervised many riot cases. “They undermine and are a blow to the sacrifice of all the officers who put themselves in the face of harm to protect democracy on Jan. 6.” The New York Times report stated in part,

Beyond the effect the pardons and commutations will have on the lives of those who received them, they also served Mr. Trump’s mission of rewriting the history of Jan. 6. Throughout his presidential campaign and after he won the election, he has tried repeatedly to play down the violent nature of the Capitol attack and reframe it, falsely, as a “day of love.”

Mr. Trump’s actions were in essence his boldest moves yet in seeking to recast his supporters — and himself — as the victims, not the perpetrators, of Jan. 6. By granting clemency to the members of a mob that used physical violence to stop the democratic process in its tracks, Mr. Trump gave the imprimatur of the presidency to the rioters’ claims that they were not properly prosecuted criminal defendants, but rather unfairly persecuted political prisoners.

As a legal matter, the pardons and commutations effectively unwound the largest single criminal inquiry the Justice Department has undertaken in its 155-year history. They wiped away all of the charges that had already been brought and the sentences already handed down while also stopping any new cases from moving forward.

Within minutes of Trump’s action, my Trump-Deranged sister, a former Justice Department lawyer, called me on the phone to scream about it.

Ethics Alarms Wants To Thank President Biden For His Continuing Efforts To Confirm Its Verdict That He Is The Worst U.S. President Ever

…as with today’s idiocy, that “statement” above.

The President has no say whatsoever in when proposed Constitutional amendment have been ratified (or not). He can express his approval of one, and lobby for it with legislators, but he cannot make a ruling that the [completely superfluous, virtue-signaling] Equal Rights Amendment has been properly ratified (it hasn’t been). He might as well put out a statement that Barry Bonds should be voted into the Hall of Fame, or that broccoli is good for you. This is the President whose party made failure to uphold “democratic norms” one of its main Big Lies against Donald Trump, and Biden’s Presidency has ignored more norms than any Presidency at least since FDR tried to be President For Life. (Come to think of it, he succeeded!)

Making this presumptuous and gratuitous endorsement even worse is the fact that everybody knows now that Biden is in no shape to declare anything of substance, especially a matter of constitutional law debate. This isn’t Biden talking, it is some phantom activist in the White House using Biden’s name and office to advance a personal agenda.

Since his historic, DEI VP was selected by his party’s oligarchs to run for President without any components of the modern nomination process (and I doubt that Harris would have even survived the old-fashioned “smoke-filled room”) Biden—-that is, his puppeteers—has set an all-time Presidential spite record by filling his final months with obstructions for Donald Trump, as well as leniency for murderers, civilian honors for despicable civilians, more unethical student loan waivers, obstacles to U.S. energy independence and climate change grandstanding. Then there was this week’s head-exploding call for censorship in his Orwellian farewell speech.

Meanwhile Ruy Texiera, a generally objective, fair, and honest analyst, is having none of the obsequious claims from the Axis that Biden, in addition to being a figurehead President, was somehow also a good one who will be vindicated by history. On his substack “The Liberal Patriot” he authors a much more exhaustive description of Biden’s failures than I did in selecting poor Joe as “The Worst President Ever,” as well as chronicles Biden’s betrayal of the voters who thought they were voting for a moderate in 2020. (They also thought they were voting for a cognitive functioning leader rather than a marionette.)

It’s a superb piece, and you should read it.

Even if Biden puts out a statement saying that you shouldn’t.

On Trump’s Second Term Portrait

I heard some talking-heads blather about the release of incoming President Donald Trump’s new official portrait on Fox, CNN and MSNBC, and quickly decided it was not worth my time. Then I looked at the thing and decided it was worth a little bit of my time after all.

It is a remarkable choice by Trump, since he obviously approved it, something we cannot say with certainly about the current President’s portrait, or anything he did or said, amazingly. On the Trump-Hating news outlets, they have been saying that it bears an uncanny resemblance to his immortal mug shot…

…which is only true in the sense that he isn’t smiling in either of them and both are images of Donald Trump.

Unethical Quote of the Month: President Joe Biden

“It’s just completely contrary to everything America is about. We want to tell the truth. We haven’t always done it as a nation. We want to tell the truth.The idea that, you know, a billionaire can buy something and say, ‘By the way, we’re not gonna fact check anything,’ and you know, you have millions of people reading, going online, reading this stuff. Anyway, I think it’s really shameful.”

—-President Joe Biden, attacking Meta CEO Mark Zuckerberg decision’s to end its biased, censorious fact-checking system that relied on partisan propaganda operations like PolitiFact and Snopes.

What’s shameful is a President of the United States advocating speech censorship. Like many of Biden’s brain-addled outbursts lately, however, he has committed the cardinal political sin of saying what he and his puppeteers really believe out loud. So now we know, at least those of us who weren’t paying attention before and couldn’t read the metaphorical neon signs flashing before our eyes, Joe Biden and his entire party advocates the censorship of free speech on social media, including opinion, adverse positions and anything that might expose its rotting proto-totalitarian party for the threat to democracy it has become. Thanks, Joe! But it was pretty obvious already.

I’m glad that I have waited to post the resolution of the “Worst President Ever” inquiry until tomorrow, because so much applicable information has been flowing regarding just how awful Joe Biden has been. I think all who have read the series carefully have figured out that the finals are going to come down to Franklin Pierce, James Buchanan, Woodrow Wilson and Biden, and it doesn’t take a PhD to guess who the last two competitors will be either. Once I thought the ultimate “winner” was clear-cut, but Joe is fighting for the title to the bitter end.

He and his fellow censors circulated lie after lie before and during the Presidential campaign (among them that only Donald Trump lies) yet Biden has the astounding brass to talk about wanting to tell the truth. You know, truth like Biden being sharp as a tack. “Truth” like the border being secure.

Incompetent Elected Official of the Month: Los Angeles Mayor Karen Bass

This one is too easy.

If anyone really wants to know why the United States has yet to elect a female President, all that is required is to look at the talent pool. Members of Congress who have no executive experience are usually unqualified to take on the toughest leadership job in the world, so women with a background at least theoretically justifying a run for the White House must have shined as a state governor or a big city mayor unless their entire case for being elected consists of “I’m a woman.” When Gretchen Whitmer is the only female governor ever mentioned in the same breath as “President,” that tells you how deep the state house talent pool is…and then we have the female big city mayors. London Breed in San Francisco, a slow motion car wreck. Uber-woke mayor of Boston Michelle Wu. The Black Lives Matter worshiping mayor of Washington, D.C., Muriel Bowser. Lori Lightfoot was so inept and obnoxious in her term as mayor of Chicago that she was defeated in a landslide by a Marxist.

But the mayor of Los Angeles, Karen Bass, makes all of those look like Fiorello La Guardia in a pants suit. In a classic of bad timing, Bass cut her city’s fire department budget for this fiscal year by more than $17.5 million. Then, the National Weather Service warned that Los Angeles would be in peril in the next few days with this announcement:

“..LIFE THREATENING, DESTRUCTIVE, WIDESPREAD WINDSTORM TUESDAY AFTERNOON THROUGH WEDNESDAY MORNING FOR PORTIONS OF LOS ANGELES AND EASTERN VENTURA COUNTIES– WITH LONG DURATION OF RED FLAG CONDITIONS INTO THURSDAY– POSSIBLY EXTENDING INTO FRIDAY… …RED FLAG WARNINGS IN EFFECT FOR LOS ANGELES COUNTY AND MUCH OF VENTURA COUNTY—SEE TIMINGS IN HEADLINES BELOW… ……Offshore winds are now expected to develop rapidly early Tuesday morning, leading to an earlier start time of the Red Flag Warning for many areas. Confidence is high for a life threatening, destructive, widespread windstorm with dangerous fire weather conditions Tuesday afternoon through Wednesday morning, especially focused on the San Gabriel mountains and foothills, San Gabriel Valley, San Fernando Valley, Hollywood/Beverly Hills, coastal areas adjacent to the Sepulveda Pass, Simi Valley, and Santa Monica mountains into Malibu. Strong mountain wave wind activity will likely impact many of these areas, resulting in very strong, erratic, and damaging wind gusts, capable of widespread downed trees/powerlines, as well as widespread power outages. So, forwarned, the next day, Bass took off for Ghana as part of a Presidential junket. When the fires started raging, it took her more than 24 hours to return to do her job. (Ghana has exactly no relationship to being mayor of L.A. at all.) By the time she arrived, more than 5,000 homes were burned or burning, as fire hydrants ran dry because water demand was so high it drained the city’s reserve tanks. She returned to face pointed questions about her leadership, or lack of it as the crisis loomed. Bass chose to shift into political BS boilerplate, saying,

“Let me just say first and foremost, my number one focus—and I think the focus of all of us here—with one voice is that we have to protect lives, we have to save lives and we have to save homes.”

Asked about Bass’s performance, Christian Grose, a political scientist at the University of Southern California, explained that Bass’ specialty is building legislative consensus behind closed doors “Her skills are building coalitions and working with people,” Grose said of Bass, who is in her first term. “This moment demands a true executive who will stand up and say, ‘this is what we’re going to do.’” Yeah, it’s that thingy called “leadership.” Building consensus is a stereotypical form of female management, but it’s not enough. if the stereotypical male leadership style of taking change and giving everyone confidence that there is someone in charge who knows what to do is too confrontational and icky for female mayors, the White House is going to be a loooong way off.

After she crashed and burned in interviews when she finally arrived on the smoky scene, Bass said, “When the fires are out, we will do a deep dive. We will look at what worked, we will look at what didn’t work, and we will let you know. Until then, my focus is on the TV screens behind you that are showing devastation that has continued. Thank you.”

The tone deafness and absence of leadership instincts that such a statement represents is mind boggling. “Don’t worry! After everything has burned down we will do a thorough analysis!” Just what citizens whose houses are in flames want to hear….
