No, This Isn’t Impeachable Either, Just Unethical And Illegal

They are whooping it up at the Trump-Haters Club, because President Trump will have to pay $2 million in damages to nonprofit groups as a penalty for what can only be called a fraudulent use of his foundation in 2016. As part of the settlement agreement,  the President had to admit misusing funds raised by the Donald J. Trump Foundation, accessing them to assist his campaign, pay off debts of businesses he owned, including Mar-a-Lago and the Trump National Golf Club in Westchester County,  and, as an especially obnoxious move,  purchasing a $10,000 portrait of himself to hand in one of his Florida hotels. New York’s Attorney General  filed suit  accusing the Trump family of using the foundation to benefit various businesses and assist Trump’s  presidential run. You can’t use a non-profit like that; this is the kind of scam that got Tom DeLay thrown in prison.

The President admitted that the alleged charity charity gave his campaign complete control over the $2.8 million that the foundation had raised at an Iowa fund-raiser for veterans in January 2016. It was in fact a fund-raiser for the campaign, not veterans.

The Coup In Progress: Presidential Impeachment/Removal Plans

I am finally devoting a dedicated post  to this list, in part because I am sick of searching for the thing every time I want to reference it. I will eventually deposit the list along with the Apology Scale and the Rationalizations List as another separate page in the “Rule Book” to your right.

One note on the use of the term coup. Some media pundits, their hands already bloodied, have been making the sophist claim that what has been going on since November 2016 isn’t a coup under the dictionary definition, which requires violence and usually a military take-over. Using cover-terms and euphemisms is a form of lying, and it is an especially common practice from  the Left right now, though the Right has its moments.

A “soft coup,” also known as a silent coup, does not use violence, and is typically based on a conspiracy or plot  aimed at seizing power, overthrowing existing legal authority, exchanging political leadership, changing the political system or the current institutional order. We are watching a long-running soft coup. A soft coup is still a coup.

There have been 19 Plans to abuse various processes, laws and theories, all put forward and promoted by members of the Democratic Party/”resistance”/mainstream news media alliance since President Trump’s election.  The  desired effect of this barrage, apart from serving the goal of removing him without the bother (and risk) of an election,  has been to make it impossible for the President to govern, and to destroy his support among the public.

When Plan S, which late novelist Robert Ludlum might have called “The Ukrainian Perversion” if it had been one of his novels, fails like the rest, or if President Trump is re-elected, the list will keep growing.

Unethical Tweet Of The Month: Rep. Alexandria Ocasio-Cortez (D-NY)

Ugh.

Call it demagoguery, grandstanding, ignorance, rabble-rousing or whatever you choose, an elected representative of the government tweeting such nonsense to those foolish enough to follow her is irresponsible in the extreme.

Hundreds of protesters hit the streets Friday and Saturday in Brooklyn to protest  police brutality by the NYPD and its crackdown on subway fare evaders. Naturally the demonstrators chanted “No justice, no peace,” the current content free, no thought required  slogan of choice by those who couldn’t articulate what they consider justice if they had a teleprompter. Ethics Hero: McDonald’s

Neat, clean, unambiguous: Katie Hill take notice.

McDonald’s has either fired CEO Steve Easterbrook or forced him to resign (it’s unclear which)  after it was determined that he had a sexual relationship with an employee, and thus a subordinate.  The relationship was determined to be “consensual,” to the extent a non-workplace, intimate relationship with a superior who controls your livelihood and professional advancement can ever be regarded as truly consensual. The position of Ethics Alarms is that it can not be; this was once the official position of the National Organization for Women until the principle threatened the tenure of Bill Clinton in the White House, whereupon Gloria Steinem suddenly declared that such relationships were swell.

“Mickey D’s” Board of Directors found Easterbrook had “demonstrated poor judgement,” the company announced today, and had violated written company policy. Easterbrook, 52 years old, had seen the company’s shares nearly double  in value since he became chief executive in March 2015.  The board therefore definitively rejected the King’s Pass, sending an unequivocal message to other managers that treating the workplace as their personal dating bar wouldn’t be tolerated no matter how important they were or how effective they were at their jobs.

Just What We Needed: The Naked Congresswoman Principle

Rep. Hill? Is that really you? AND WHAT THE HELL IS THAT GUY DOING?”

There have been many variations on the Naked Teacher Principle since I began tracking the issue, back in the halcyon days of the Ethics Scoreboard (still trapped in website host limbo). Some of the more interesting versions that have been explored on Ethics Alarms include The Female Bodybuilder Firefighter Principle, The Drag Queen Principal Principle, The Online Porn Star Teacher Principle, Naked Naval War College Professor Principle, and many others that one can explore here.

All involve the basic concept that when one has a job that requires respect, an image of dignity, the perception of good judgment and role model status, allowing naked, semi-naked, sexually provocative or otherwise compromising photos to be created, and they eventually find themselves online and available to those the individual thus exposed is responsible for leading, teaching, or guiding, the individual  cannot reasonably protest if this results in their losing their job. This is true even if the Naked Teacher or equivalent has been betrayed, victimized, or wronged. The Naked Teacher Principle involves strict liability. The lesson: if you intend to have a career requiring the public trust, don’t get photos made of yourself that you would not want to show to your mother or have appear on the front page of USA Today.

Now Democrats, feminists and progressives are defending Democratic Rep. Katie Hill  elected in 2018 as the first openly bisexual congresswoman from California. In connection with allegations that Hill had extramarital affairs with a female campaign staffer and a male congressional aide,  RedState, a conservative news website, and The Daily Mail, a British tabloid site,   published sexually explicit photos of Hill engaged in various versions of flagrante delicto. These are now viral. Some are porn mag-graphic; I’m not even going to discuss the bong she appears to be using in one of them. (And who was taking those photos?)

The House Committee on Ethics has begun an investigation, since it is against House rules for representatives to have sexual relationships with congressional staff.

Morning Ethics Warm-Up, 10/23/2019: On “Lynching” And Other Things

The day looks good, feels bad…

1. No, “lynching” is not the right word for the Democratic Party/”resistance”/news media impeachment assault. The word worked for Clarence Thomas during the Anita Hill ambush, but someone ought to remind the President that Thomas was and is black.

The correct word is coup. This has always been what the effort to delegitimatize and remove Trump has been, and this is what it remains. “Witch hunt,” which some idiot issued as an anti-impeachment talking point again a couple of weeks ago, is also an inappropriate term. It may accurately evoke the McCarthy-like methods being used, but it is historically and politically confusing, focusing on methodology rather than objective.

The inability of this President and his staff to communicate competently is a dangerous weakness. It has always been so, but now more than ever. The public literally doesn’t understand what is going on, and a clear, credible, trustworthy advocate for the President who is able to explain what is so wrong, so insidious, and so damaging to democracy about what the “Troika of Totalitarianism” (I’m trying to imagine what Spiro Agnew would have called them) have been doing since the 2016 election is an essential bulwark against impeachment and conviction. Even someone like—I can’t believe I’m writing this—Lanny Davis would be an upgrade.  Kellyanne Conway destroyed her credibility with her “alternate facts” gaffe. Rudy Giuliani got himself enmeshed in the Ukraine controversy. Mick Mulvaney proved, with his naive and ham-handed explanation about why there is nothing criminal or inappropriate about any President using the leverage of his office to persuade a foreign government to do something that needs doing, that he isn’t up to the job. And the President is foolish to believe that his tweet-storms are an effective remedy against  a news media determined to tell only one side, the “resistance” side,  of the issues.

Why, for example, isn’t there an advocate for the White House who can point out, clearly, that the misleading characterization in this morning’s Times front page “news” story—the New York Times no longer does “news” involving Trump, only adversary spin—that the President used strong-arm tactics to force the Ukraine to “investigate Mr. Trump’s political rivals”? Joe Biden isn’t “political rivals,” he’s a former Vice President of the United Sates who may have been using his high position to enrich his son and warp foreign policy.

At this point, Joe Biden isn’t an official election opponent of the President either. It is completely legal and responsible for our government to find out exactly what was going on in the Biden-Biden-Ukraine tango, and the idea that a President cannot legally pursue investigation of serious misconduct in the previous administration because the members of it can now be called his “rivals” is, or should be,  a transparent Catch-22 concocted to advance the coup. Is that really so hard to explain? Why isn’t anyone explaining it?

A prominent  reason is that one of the more effective and damaging tactics in the coup attempt has been to intimidate and threaten any competent D.C. professionals who could advise and assist a President under siege. Until the Trump administration, the accepted norm when a patriotic member of the Washington establishment, regardless of party,  was invited to help a President was for the individual so invited to say, “Of course.” This was how President Clinton persuaded Reagan advisor David Gergen to rescue his administration from self-immolation.

Today, any political establishment figure, no matter how well-respected before, can count on being savaged in the news media if he or she agrees to join the administration, as well as harassed if they go out for dinner. The phenomenon effectively gives this White House a lobotomy by making it a huge and risky sacrifice to try to assist the White House.  It also isolates the President, and increases the chances of him making his situation worse out of anger, frustration, and his unfortunate lack of impulse control.

This too has been part of the coup strategy from the beginning: withhold from this President all of the honors, respect, fairness, deference and cooperation every other President has earned as a right of office by virtue of being elected, and eventually he will do something that will justify impeachment.

It’s a coup. “Lynching” just muddies the waters, and in this dirty business, muddy waters is exactly what the “resistance” wants and needs. Continue reading →

Sunday Ethics Warm-Up, 10/20/19: Ancient Icelanders And Others Behaving Badly

Good Morning!

1. Confession: I called a stranger an asshole on Facebook yesterday. I had patiently explained to a Facebook Borg-infected friend that no, the Justice Department report on Hillary’s email fiasco had not proven for all time that she hadn’t “done anything wrong,” quite the contrary. The report revealed that she was directly responsible for over 600 security breaches (after saying otherwise for more than a year). That means that she was reckless, incompetent, irresponsible and dishonest, and, since the applicable statute doesn’t require intent, could have been prosecuted. The report did find that there was no evidence that Clinton deliberately set out to endanger national security, which was never the issue.

Some clod following the thread wrote that you “could sure tell who follows Fox News talking points.” Well, I’m sick of that lazy deflection, and anyone who uses it, especially on me, is an asshole, and needs to be told.  maybe ist not too late to get treatment. It’s even more of an asshole thing to say than the reflex “But ….Trump!” retort.

2. Yes, this is unethical. Yes, it is newsworthy. No, it is receiving almost no national coverage outside of conservative news sources. Rep. Katie Hill, Vice Chair of the House Committee on Oversight and Reform, has been engaged in a three-way sexual relationship involving a  staffer and her husband. This would not matter to me, and should not matter to you, except that the woman involved is Hill’s subordinate. The workplace is not a dating bar or personal harem, not in the private sector, not in Congress. In addition, close personal relationships create conflicts of interest for the supervisor in any office. I would mention the inherent imbalance of power that makes it impossible for an employee to consent to a superior’s advances in such a situation, but of course Lee knows that, being an ardent #MeToo and Time’s Up! supporter.

The hypocrisy in the Democratic Party on this issue is wide, deep, and nauseating, except, I guess, to Democrats. Last week, discussing this issue with lawyers following my ethics seminar, a usually smart, fair, male attorney actually opined that Joe Biden’s serial non-consensual groping wasn’t really a problem because “he didn’t mean it to be sexual assault.” The lawyer really said this, though “I didn’t mean anything by it” has been the reflex excuse of every sexual harasser from Bill O’Reilly to Louis C.K.

3. Stipulated: President Trump’s harsh rhetoric in the aborted White House meeting with Democrats was one more stupid self-inflicted wound. Given the barrage of ad hominem attacks by the party that she leads, and the disrespect for the office that Pelosi herself has orchestrated (that mocking clap at the State of the Union speech alone was unforgivable), Trump was certainly provoked, but the President is not supposed to slide into the gutter just because his adversaries live there. It’s swell to be a “fighter”—Trump is probably correct that Mitt Romney would have been elected President in 2012 if he had a some Trump in him—but that doesn’t mean that gratuitous incivility and nastiness is a competent or responsible political strategy.

Ethics Villains Of The Impeachment Coup, Part One

I admit it: just as I sensed that it was important for Ethics Alarms to lend ethical clarity to the potentially (and possibly already) disastrous effort by the Democratic Party to abuse its power and Constitutional processes to remove (that is, overthrow) the President of the United States, I was overcome with a crippling combination of unrelated professional responsibilities and crippling weariness. I’m sick of writing about this topic; I’m even sick of thinking about it. I’m definitely sick of arguing about it on social media. The tag “2016 post-election Ethics Train Wreck” has been appended to more posts than any other, with no end in sight.

I floated the idea of creating a spin-off website that would endeavor to provide one-stop shopping for members of the public who wanted to counter media spin and information suppression on the topic. I do think this is an important project, and I have received a few generous offers to help. I’m still trying to figure out if I have the time to do it right; if I don’t, then it would be unethical to do it at all.

The fact that some polls show that the relentless pro-impeachment propaganda has led to a majority of Americans believing the President should be impeached is troubling, though 1) polls, and 2) on this topic even more than others, all the number shows is how many ignorant Americans are willing to opine at the moment on topics they know nothing about. “Survey Finds More People Would Support Impeachment If They Knew What Crime Trump Was Supposed To Have Committed” snarked the Babylon Bee.

Exactly.

I have several longish essays that I need to write, notably one titled “The Ethics Context of the Trump Impeachment Push.” It should have been written last week, and I’ll be lucky if I can get it complete next week.  I know how important the Democratic Party/ “resistance” /mainstream media coup attempt is. As I have been writing here since January 2017, it is the most important ethics story of modern U.S. political history.

I’ve got to keep the analysis moving, even if it’s too slow.

Unethical Quote Of The Week: Hillary Clinton

“So get over it.”

—Hillary Clinton, explaining why Joe Biden’s serial unconsented-to touching, hugging, sniffing, and other discriminatory, harassing conduct toward  women he encounters in the course of his professional activities shouldn’t matter to the “Party of Women” and the voting public generally.

This was prefaced by her saying , in response to a question about Biden’s #MeToo defying behavior,

“For goodness’ sake, I’m sorry, I have to jump in because I’ve heard a little bit about that. You could take any person who sticks their little head above the parapet and says, ‘I’m going to run for president,’ and find something that … a little annoying habit or other kind of behavior that people are going to pick apart and disagree with. But this man who’s there in the Oval Office right now poses a clear and present danger to the future of the United States. So get over it.”

The only remaining question, after that self-indicting outburst, is whether only Hillary Clinton among the Democratic leadership is a cynical, dishonest hypocrite who has no reliable core values or integrity, and whose utterances to the contrary are to be regarded as Machiavellian calculations to achieve power and nothing more.

The evidence suggests that she is not alone, but also that she is a bad as the rest of them could be.

Ethics Cool-Down, 9/25/19: Democracy On The Rocks

I remember kindergarten classmates, boys and girls, frequently going on kissing sprees. Adults knew it was nothing decades ago. Had #MeToo really made people this unable to make obvious distinctions? Proportion is an ethical value.

2. Regarding today’s earlier post from the same files...Yes, I think that the transcript of the President’s call to the Ukraine, on its face, should make Democratic claims of an impeachable offense look as silly and contrived as they are. This does not, however, allow for confirmation bias, which is at fever pitch in “the resistance” with some toxic frustration and desperation mixed in. This is one reason the mainstream media keeps calling the transcript a “summary,” which implies that something material is missing, and your Deranged friends keep raising Nixon’s edited versions of White House meetings on Watergate matters, as if this has any similarity to that at all.

Calls with foreign leaders are typically not recorded, so this was a reconstructed transcript, which is as close to an exact one as we are going to get. For those who presume that everything this President does is impeachable, that’s a problem. For those who accept that he was elected President and should have the same opportunity to do his job as all the others, it isn’t, and there are too many like that in the public for this latest manufactured offense to work.

I guess this is Plan S.

I’m so, so sick of this.

The Complete Presidential Impeachment or Removal Plans A-S (Updated 9/25/2019)

Plan A: Reverse the election by hijacking the Electoral College.

Plan B: Pre-emptive impeachment. 

Plan C : The Emoluments Clause.

Plan D: “Collusion with Russia”

Plan E : ”Trump is mentally ill so this should trigger the 25th Amendment.”

Plan F: The Maxine Waters Plan, which  is to just impeach the President because Democrats want to, because they can.

Plan G : “The President obstructed justice by firing incompetent subordinates, and that’s impeachable.”

Plan H: “Tweeting stupid stuff is impeachable”

Plan I:  “Let’s relentlessly harass him and insult him and obstruct his efforts to do his job so he snaps and does something really impeachable.”

Plan J : Force Trump’s resignation based on alleged sexual misconduct that predated his candidacy.

Plan K: Election law violations in pay-offs to old sex-partners

Plan L: The perjury trap: get Trump to testify under oath, then prove something he said was a lie.

Plan M: Guilt by association. Prove close associates or family members violated laws.

Plan N: Claim that Trump’s comments at his press conference with Putin were “treasonous.”

Plan O: The Mueller Report proves the Trump is unfit for office even if it did not conclude that he committed any impeachable offenses. 

Plan P: Summarized here as “We have to impeach him because he’s daring us to and if we don’t, we let him win, but we can’t, but then he’ll win!”.”

Plan Q: Impeach Trump to justify getting his taxes, and then use the presumed evidence in his taxes to impeach him.

Plan R: Rep. Adam Schiff announced on July 24 that President Trump should be impeached because he is “disloyal” to the country. This desperate response to the fizzle of the Mueller Report was ignored and forgotten the second it came out of Schiff’s mouth, but it confirmed what the list above already proved: the Democrats don’t want to impeach the President for something he did; they want to find something he did to justify impeaching him.

Plan S: Trump should be impeached because his call to Ukrainian President Zelensky was really an effort to shake down the Ukraine and force it to find dirt on Joe Biden, thus “interfering” in the 2020 election even though Biden hasn’t been nominated (and won’t be), even though a President has every justification to seek evidence of a prior administration’s wrongdoing in foreign relations, and even though there isn’t a whiff of a threat of quid pro quo in the only transcript of the call.
