Actually, that’s dishonest: it’s been a terrible day, morn to now.. A catalogue retailer took an email address my wife sent them a year ago and bombarded her account with hundreds of promotional messages yesterday, crashing her email. Then her efforts to fix the problem resulted in a Proethics system email crash that I have been trying to address for the past five hours. I finally decided to get something productive done, so I’m getting up this post while talking to my tech people. UPDATE: They just gave up.
1 Trump Tweets.Ugh. The President criticizing his own Cabinet member, in this case Jeff Sessions, in public via tweet, is horrific leadership and management practice. If I were Sessions, I would resign, It is disrespectful, disloyal, undermines morale on the President’s team, and is just plain stupid. I don’t understand how Trump had any success at all treating employees and subordinates like this. While we’re on this perpetual subject. the fact that the President would say out loud that he would have rushed the Parkland shooter without a weapon is just more evidence of a) a flat learning curve b) the lack of the usual filters from brain to mouth and c) the unethical tendency of third parties to critique the actions of others in rescue situations. No question: the resource officer who was required by policy, assignment and duty to try to intervene in the shooting deserves all the criticism he has been getting, and is accountable. But the President of the United States announcing that he is Batman is something else entirely.
My objections to the non-stop personal ridicule of our elected leader stands, but he also has a duty, as the steward of the Office, not to make himself look ridiculous.
2. An unethical boycott tactic, but I repeat myself. The anti-gun zealots have decided to attack a free and constitutionally protected Bill of Rights advocacy group as part of the news media-assisted effort to demonize the NRA as being somehow responsible for a school shooting that none of the proposed “common sense gun reforms” would have prevented. Now the Second Amendment-gutting crowd is using the boycott, a particularly odious weapon favored by progressives, which depends on the venality and spinelessness of corporate executives to constrict free speech. Delta Airlines announced it was ending a promotional discount with the National Rifle Association after threats and a social media campaign, then tried the weaselly explanation that its decision to stop offering discounted fares to the N.R.A. “reflects the airline’s neutral status in the current national debate over gun control amid recent school shootings.” Continue reading →
Of course it’s a good morning…the 2018 Winter Olympics ended last night!
1 The Schiff Memo. The Democrat’s alleged rebuttal to the Devon Nunes memo regarding how Carter Page came to be the object of secret surveillance that extended into the Trump campaign should have been the big story of the weekend, along with the fact that government systems repeatedly failed to protect the students in Parkland from an unbalanced young man who had been repeatedly identified as a risk for exactly the kind of mad act he ultimately engaged in. But the left-biased news media downplayed it after trying to spin it, because the hyped memo did not rebut the key allegations in the previous Republican House document. The FISA court was not informed that the Russian dossier was created and funded by the Democratic National Committee and the Clinton campaign. The dubious dossier was a key component of the evidence that led a secret court to remove the Constitutional rights of a citizen, while interfering with a Presidential campaign.
Amusingly, the Schiff memo spins that the Obama Justice Department application was “transparent,” and then describes transparency as a FISA warrant application that said that Christopher Steele, referred to as “Source #1,” was “approached by” Fusion GPS founder Glenn Simpson, referred to as “an identified U.S. person,” who
indicated to Source #1 that a U.S.-based law firm had hired the identified U.S. Person to conduct research regarding Candidate #1’s [i.e., Trump’s] ties to Russia. (The identified U.S. Person and Source #1 have a longstanding business relationship.) The identified U.S. Person hired Source #1 to conduct this research. The identified U.S. Person never advised Source #1 as to the motivation behind the research into Candidate #1’s ties to Russia. The FBI speculates that the identified U.S. Person was likely looking for information that could be used to discredit Candidate #1’s campaign.
Andrew McCarthy, in the National Review, concludes that the Schiff memo does the Democratic narrative more harm than good. I agree: it looks like a desperate spin attempt to me, so desperate that the news media abandoned the story as quickly as it could.
1 The kids are all right! Ethics Alarms has recently been graced with comments by some intrepid and articulate high school students on the guns and schools issue. I salute all of them, as well as the teachers who sent them our way. Some of the students also encountered the tough debate style and sharp rhetoric that our regulars also engage in. One of the students who found himself in a particularly spirited exchange, mostly with me, just sent me a long, self-flagellating and abject apology. My response in part..
Relax. Apology accepted, and I am grateful for it, and admire you for writing it. But you impressed me in many ways. I wish I could meet you.
When I was growing up, there was no internet. I just managed to earn as reputation as a clown, a master of sarcasm and insults, and someone who would never back down from an argument the old-fashioned way—by talking. I made a million gaffes along the way. I made an ass of myself. I hurt people. I also scared some people, but eventually I learned some boundaries. Meanwhile, the skills I acquired being a jerk sometimes have served me well, in college, in law school, in management, in theater, in ethics. (I’m still a jerk sometimes. You have to keep that edge.)

2. Packaging designed to make you feel stupid…I’d do a whole essay on this again, but there have been a lot of “yelling at clouds” posts lately. The common practice of generics intentionally imitating the packaging of the original product they derive from is per se unethical. (I’m sure I have written about this before, but cannot find it. I know I criticized the practice of cheap kids animated videos of stories like “Beauty and the Beast” copying the artwork and color scheme of the corresponding Disney version to fool inattentive purchasers.) My wife just got caught by a CVS scam—the company is a long-time offender—that fooled her into buying for my use an inferior knock-off of Pepcid A-C which I need because the Parkland shooting deception and agitprop is giving me ulcers. It is intentionally packaged with a red fez-shaped cap to look sufficiently like the good stuff to deceive consumers.

Of course, as with the video, it isn’t exactly like the original: the shade of red is different, the cap shape isn’t quite the same, giving them plausible deniability.

I was going to make this an Ethics Quiz, but category that can’t quite encompass the issues involved, and the more I considered it, the more certain I became of what should have happened. Here is the story:
A student-drawn cartoon was published last month in the La Jolla High School’s “Hi-Tide” newspaper. It depicted eight ethnic groups in a blatantly stereotypical manner ( which is to say, it was a cartoon), with each figure pictured wearing T-shirts with messages reinforcing the stereotypes. The cartoonist’s purpose was to lampoon the controversial H&M ad that caused the company to pull the ad and apologize:

The requisite number of sensitive students and /or their sensitive parents complained about the cartoon to compel the school principal to grovel an apology, saying that the decision to publish the cartoon was an “error in judgment and a breach of all the values we hold dear at La Jolla High School,” since the cartoon depicted multiple ethnic groups as “ugly racial stereotypes.”
1 Oh no! Not my permanent record! My wife gave a small contribution to Mitt Romney’s campaign, and has been hounded by RNC robocalls and mailings ever since. GOP fundraising started getting really slimy under the indefensible Michael Steele’s leadership, and continued to use unethical methods after Steele went on to job at a bait shop or something. Last week my wife got an envelope in the mail with a block red DELINQUENCY NOTICE! printed on it. A lie, straight up: there was no delinquency, just a my wife’s decision that she would rather burn a C-note than give it to the fools and knaves running the Republican Party. She registered an official complaint with the RNC, and received this response from Dana Klein, NRCC Deputy Finance Director:
“My job as the Deputy Finance Director is to communicate with supporters to let them know the status of their NRCC Sustaining Membership. Unfortunately, I have bad news for you. As of right now, you have a delinquency mark on your record for your failure to renew your membership. But, I have some good news. You can remove this delinquency mark if you renew by the FEC deadline on Wednesday.”
Both my wife and I were professional fundraisers for many years. This is deceptive and coercive fundraising, and anyone who voluntarily supports an organization that uses such tactics is a victim or an idiot.
Or, I suppose, a Republican.
2. Another one…This is another one of the statements that I am pledged to expose every time I read or hear it: a Maryland legislator, enthusing over the likelihood that a ballot initiative will result in legalizing pot in the state, ran off the usual invalid, disingenuous and foolish rationalizations for supporting measure. (Don’t worry, pot-lovers: I’m resigned to this happening, not just in Maryland, but nation wide. As with the state lotteries, our elected officials will trade the public health and welfare for easy revenue every time. Minorities and the poor will be the most hurt, and the brie and pot set couldn’t care less.) Only one of his familiar bad arguments triggered my mandatory response pledge: ” to legalize a drug that is less harmful than alcohol.”
This is the bottom of the rationalization barrel, “it’s not the worst thing.” Alcohol is a scourge of society, killing thousands upon thousands every year, ruining families and lives, wrecking businesses, costing the economy millions of dollars. Just yesterday there was a report that fetal alcohol syndrome was far more common that previously believed. There is no question, none, that U.S. society would be healthier and safer without this poison accepted in the culture: unfortunately, it was too deeply embedded before serious efforts were made to remove it. Now pot advocates want to inflict another damaging recreational drug on society, using the argument that it’s not as terrible as the ones we’re already stuck with. Stipulated: it’s not as harmful as alcohol. It’s not as harmful as Russian Roulette or eating Tidepods either. I have a bias against taking seriously advocates who use arguments like this; it means they re either liars, and know their logic is absurd, or idiots, and don’t.
3. Riddle me this: What do you get when you cross casting ethics, weak and lazy school administrators, political-correctness bullies-in-training with “The Hunchback of Notre Dame”?
Answer: a cancelled high school musical, and per se racism supported by the school.
New York’s Ithaca High School was beginning production of the Disney film-based musical “The Hunchback of Notre Dame” but made the unforgivable error, in the eyes of student activists, of casting of a white student as a Romani heroine Esmeralda, played in the classic film by that gypsy wench, Maureen O’Hara, and in the Disney version by a Toon. Several students quit the show in protest, and formed an activist group to reverse the decision. It sent a letter calling the casting “cultural appropriation” and “whitewashing,” calling the student the “epitome of whiteness.” The letter admitted that she was also “a stellar actor, singer and dancer” that any stage would be “lucky to have,” but what is the talent, skill and competence required for a role compared to what really matters, her skin color? The students demanded that the school either choose a different show or recast Esmeralda a black and brown actress. Continue reading →
My answer to the first question? Absolutely not.( My answer to the second is, “I have no idea.” ) If a driver can put a sign in his rear view mirror or a bumper sticker on her bumper without state sanctions, then a driver should be able to have whatever he or she chooses on a vanity plate.
Utah, for examples, bans vanity plates with profanity, “derogatory language,” drug references, sex talk, references to bodily functions, “hate speech,” targeting a particular group, or advocating violence advocates, as well as alcohol references and the number combo “69.” Ethics verdict: None of their business. These are words and numbers, and the state is declaring content and intent impermissible. When I see a car with an obnoxious vanity plate, I’m grateful. This is useful information. Racist or vulgar plates translate into “I am an asshole, and want you to know it!”

Below are the plates banned by Utah over the past five years. Most of them fly right over my head. If you have to be a cryptographer to figure out why a plate is offensive, then it’s not offensive.
The less our governments interfere with freedom of expression, the safer we are.
Perhaps more than any other field of endeavor, advertising depends on the Secret of the Cognitive Dissonance Scale. But the scale abused is a jealous and angry mistress, as Chrysler/ Fiat discovered when its Super Bowl for Ram Trucks turned into a public relations disaster.
It must have seemed so simple! Brainstorming about how to promote Ram Trucks while appealing to a divided the country during the iconic NFL game, after a year in which pro football in particular was torn by strife over players, mostly black, kneeling during the National Anthem to protest something or other, depending on which helmeted social justice warrior you asked, some rising, present-day Mad Man, cynical to the core, drew Dr. Festinger’s scale on a white board as he shouted, “Eureka!”
“It’s perfect!” the fuzzy cheeked, rising young advertising genius cried, marking the diagram with the red marker. “I know how we drag our truck up the scale!”
“Ram is a powerful truck and a symbol of toxic manhood, when everyone’s talking about how men, and especially white men, are the source of all that’s rotten in Denmark! Well, not Denmark, but here. You know what I mean. Anyway, for some of our clients we’ve been using little, scrawny, androgynous guys as spokesmen, like the geek Lou dreamed up for Petsmart.
He’s not scary, and you know he must be a Hillary voter. But come on: this dork probably drives a Smartcar. We can’t use someone like him to promote a truck. No, Fred, we can’t use a sexy female model, either, like we used to. Sexy models are now below zero on the scale. They’d pull our trucks DOWN. Oh, a lot of men would still secretly love this stuff like we used to do,
but now their girl friends or wives or daughters would glare at them, and getting flack from women in the family is LOW on the scale. So sex is out. Sorry.
Now, the Petsmart geek does have a dog with him. Dogs are high on the scale, as we all know: Ralph, you were the one came up the ad with the Golden Retriever driving the Subaru, right?
Gold! But come on: kids and dogs have been done to death in Super Bowl ads. There will probably be all sorts of cute dog ads during the Super Bowl; there always are. [ Actually, there weren’t…] So think: we want a man’s voice, a manly man, but one that doesn’t scream white male patriarchy or Harvey Weinstein. We want someone the fans of those National Anthem protests and Black Lives Matter will have high on their Cognitive Dissonance Scale, so associating Ram Trucks with him will yank the trucks right up. We also want someone the fans who were getting sick of political grandstanding when they wanted to watch a football game also admire, someone who knew how and why to protest. And, at the same time, we want Ram to look socially conscious—you know, “woke.”
One figure, and only one, will do all that, from a position so high on the scale that we can’t lose! Martin Luther King!Heck, all of those blue collar workers just got a day off because of the guy; it’s fresh on their minds. They love him! A day-off pulls MLK right up the scale himself!
And look: I did some googling, and found this from some speech he gave: “If you want to be important, wonderful. If you want to be recognized, wonderful. If you want to be great, wonderful. But recognize that he who is greatest among you shall be your servant. That’s a new definition of greatness. … By giving that definition of greatness, it means that everybody can be great. … You don’t have to know about Plato and Aristotle to serve. You don’t have to know the theory of relativity to serve. You don’t have to know the second theory of thermodynamics in physics to serve. You only need a heart full of grace, a soul generated by love.”
Great stuff, right? There’s “greatness: for the MAGA crowd, and “love,” which is Scale magic, and we can fill the ad with heartwarming scenes—with kids!

The cheering in the meeting room was deafening.

Today, that once rising ad exec starts his new job at Taco Bell.
Martin Luther King didn’t pull Dodge Trucks up the scale. Cynical exploitation of a civil rights icon and turning a black martyr into Morgan Freeman’s competition as a rival pitch man (Morgan was doing Mountain Dew) is so low on the Cognitive Dissonance Scale that it pulled the product’s rating right through the floor.
This is rank incompetence. If you are going to try to exploit the image and words of a dead hero, at least learn something about him. At the time of his death, King was getting ready to make a push for socialist reforms, which meant attacking capitalism. You also should read the whole speech you are cherry picking from; you can bet someone else will. Here’s a section from that same speech:
“…we are so often taken by advertisers. You know, those gentlemen of massive verbal persuasion. And they have a way of saying things to you that kind of gets you into buying. In order to be a man of distinction, you must drink this whiskey. In order to make your neighbors envious, you must drive this type of car. In order to be lovely to love you must wear this kind of lipstick or this kind of perfume. And you know, before you know it, you’re just buying that stuff. … I got to drive this car because it’s something about this car that makes my car a little better than my neighbor’s car. … I am sad to say that the nation in which we live is the supreme culprit. And I’m going to continue to say it to America.”
This means that using King’s voice and words to appear to endorse a truck ad seen by millions is a lie.
The King family’s greed and poor stewardship of King’s image also shares some of the blame for the fiasco. The King Center quickly went on Twitter to say that neither the organization nor the Rev. Bernice King, one of Dr. King’s daughters, was responsible for approving the offensive Super Bowl commercial. That’s not exactly true. Eric D. Tidwell, the managing director of Intellectual Properties Management, the licenser for the estate, said that Ram, as it must, came to them for permission to use King’s name, voice and words. “Once the final creative was presented for approval, it was reviewed to ensure it met our standard integrity clearances,” he said in a statement. “We found that the overall message of the ad embodied Dr. King’s philosophy that true greatness is achieved by serving others.”
Obviously the King family did not take proper steps to ensure that those who handle the family profit center depending on commercial uses of Dr. King’s legacy understand the difference between embodying Dr. King’s philosophy and cynically distorting it to sell stuff. Intellectual Properties Management is paid to take the PR hit, but I’d be willing to bet that such a high profile use of King was approved by the family itself. After all, King isn’t pulled down the scale by a foolish commercial. The controversy might even help King’s image, by sending people to read the speech. Maybe the King family knew the commercial would burn Ram, but was willing to take their fee and watch the fun, as the Cognitive Dissonance Scale wreaked its terrible vengeance on those who would abuse its power.
Justin Timberlake, who will headline the Super Bowl LII halftime show while I’m not watching, was asked at a news conference this week whether he would support his son Silas if he wanted to play in the NFL. said Thursday that he will not allow his 2-year-old son play football. Timberlake responded : “Uh, he will never play football. No, no.”
Let us assume, for the sake of the quiz, that the reason Timberlake will veto football for his son is that he does not want his offspring ending up with the IQ of his fellow Mickey Mouse Club cast member and one-time girlfriend, Britney Spears. So why, if the singer does not approve of what playing NFL football does to brains, is he participating in the biggest showcase of the most dangerous major professional sport?

Is Timberlake a hypocrite to accept payment to promote the Super Bowl and participate in pro football’s biggest event, while stating that he would not permit his son to play football?
My answer: sure he is. This isn’t like the cases we have discussed in past posts where American performers have accepted huge amounts of cash to perform for dictators abroad. Those have been private events, and a performer does not endorse his audience. Timberlake, however, is actively participating in the promotion of football and the NFL, to to the nation, and particularly to children. The Super Bowl has always been equal measures of sport and hype, and the half-time shows are hype. If he believes football is dangerous, which it is, he should not accept a fee to make the sport attractive to kids, or help the NFL attract impressionable young viewers.
[Update and Correction: readers Arthur in Maine alerted Ethics Alarms that star performers in the Super Bowl halftime show are typically not paid, but do the show for publicity. This doesn’t change my answer at all.]
You know that by watching the Super Bowl, you’re helping to kill and cripple young men, right?

You and people like you watch the Super Bowl, maybe hold parties around it, allowing the NFL to make millions of dollars selling ads and merchandise off of the most watched sporting event of the year. And, of course, the popularity of the Super Bowl makes it the year’s #1 promotion for the billion dollar mega-industry that is the National Football League, and down the line, for billion dollar corrupt big time college football, and in places like Texas and other regions warped by the “Friday Night Lights” mentality, high school football, and further down the line, youth football, where kids a young as 8 begin getting the blows to the head that will help make them confused and dysfunctional in their fifties or earlier if they play long enough…and maybe even if the don’t.

The film above, “Concussion Protocol,” was released this month, and shows a compilation of every reported concussion this season. Directed by Josh Begley and produced by Laura Poitras, it is believed to be a nearly complete compilation of the NFL’s reported 281 concussions this season, the most since 2012. The NFL, which is affirmatively evil, is spinning this as a good thing, pointing out that it means that players are self-reporting their head injuries more often.
