[UPDATE: Apparently, the “news story” that prompted this post is a fake. In that case, I want to thank the hoaxers for  inadvertently sparking a useful discussion—nothing in my post is dependent on the factual nature of the story. I wasn’t the only one fooled, and I originally noted the links on reliable sites. On the other hand, to hell with people who plant fake stories that are not obviously tongue in cheek or satirical: it’s a despicable practice, and abuse of the web, and right down there with public vandalism and creating computer viruses as unforgivable public conduct. I apologize to readers here for misidentifying a false story as true, but I’m not the unethical jerk involved. If anyone knows who that is, please forward their names. I have some choice words for them.]

As I wrote the first time I stuck my ethics big toe into this kind of controversy, I am conflicted over the current trend of forcing certain kinds of service providers to serve customers they just don’t feel like serving. I have consistently come down on the side of the rejected customer, even when the service, as in the case of bakeries and photography salons, edges perilously close to art. I think I am there still, but my resolve is weakening. I think. Let’s look at this again, in the context of the kind of recent case that always eventually occurs when one sits on the slippery slopes.

A three judge panel of a Georgia appellate court recently ruled in favor of Marshall Saxby, the Grand Wizard of a local KKK chapter, after he sued a local bakery for refusing to bake a cake for the KKK chapter’s  annual birthday party. Elaine Bailey, who owns Bailey Bakeries, said she rejected the Klan its activities violated her religious beliefs, and Saxby claimed that Bailey’s refusal of service discriminated against his religious beliefs.

The difficulty with making an ethical call on this case and others like it (and sort of like it, arguably like it or a little bit like it) is that the crucial question in ethics analysis, “What’s going on here?” cannot be answered with certainty or clarity. There are ethical arguments and ethical principles, on both sides, making the issue an ethical conflict (rather than an ethical dilemma). In an ethical conflict, we must prioritize among important ethical principles that are opposing each other.

More Name Ethics: An Incompetent Judge Blocks An Irresponsible Name

Let us stipulate that while  parents in the United States have an absolute right to name their children whatever they please, it one of those aspects of free speech that is often horribly abused by irresponsible, self-centered or just plain dumb parents who treat their children as bumper stickers or social science experiments. Naming your boy “Sue,” (You know) or your daughter “North West,” (Kanye West) or your daughter “Fifi Trixibelle” (Bob Geldof) is unforgivably and gratuitously cruel, virtually guaranteeing that your child will be a target, a head case, or will change his or her name the second legal majority comes around. Nonetheless, the state doesn’t raise children in America—yet—and parents can still decide what they wear, watch, learn and eat, as well as the name they have to answer to. The operative term is “free country.” Many of our fellow citizens don’t like or understand that concept, which is also their right in a free country. Judges, however, must not only understand the concept but constrain their power by it.

This is why Cocke County (Tennessee) Child Support Magistrate Lu Ann Ballew needs to be a) removed from her job and b) set on a more appropriate career path, like say, taking tolls in a tunnel or orders at Papa John’s. She ruled—it doesn’t matter how or why this came about—you can read the ridiculous story here-–that the parents of a baby couldn’t name him “Messiah,” because, she said in an interview with a reporter whose mouth had to be surgically closed afterward, “The word ‘Messiah’ is a title, and it’s a title that has only been earned by one person – and that one person is Jesus Christ.”  Continue reading

“A “passionate argument” about 18th-century Enlightenment philosopher Immanuel Kant, renowned for his treatises on ethics, “deteriorated into a fistfight” between two men waiting in line for beer during an outdoor City Day event in the southern Russian metropolis of Rostov-on-Don, police said Monday. The argument ended when one of the debaters pulled out an air gun and shot the other in the head, local police said in a statement. The shooter then fled the scene but was later detained, police said. The other man’s wound was not critical, but he was hospitalized, the statement said…”

I am fairly certain that Kant would have said that shooting someone in the head with an air gun to settle a debate over ethics violates his Rule of Universality, which has the seldom-cited codicil, “Don’t shoot people in the head, unless you want to live in a world where everyone gets shot in the head.” It is a perfect example of losing an argument by winning an argument.

John McCain’s tweet in response to Putin’s cheeky op-ed was on target: “Putin’s NYT op-ed is an insult to the intelligence of every American.” [Aside: Of course, so was President Obama’s speech. As always these events give us a chance to gauge which journalists warrant ever regarding seriously again. On one side there are the likes of the Daily Beast’s toadying Michael Tomasky, who pronounced the President’s speech “great.” On the other is the Washington Post’s generally left-leaning Dana Milbank, who decided to be honest, pointing out how the President’s speech arising out of his contradictory and incoherent statement about Syria was…contradictory and incoherent: “The president, in the space of his 16-minute address, was often at odds with himself. He spent the first 12 minutes arguing for the merits of striking Syria — and then delivered the news that he was putting military action on hold. He promised that it would be “a limited strike” without troops on the ground or a long air campaign, yet he argued that it was the sort of blow that “no other nation can deliver.” He argued that “we should not be the world’s policeman” while also saying that because of our “belief in freedom and dignity for all people,” we cannot “look the other way.” He asserted that what Bashar al-Assad did is “a danger to our security” while also saying that “the Assad regime does not have the ability to seriously threaten our military.” In other words, “great.”] It was more than an insult, however. “Mild Pedophilia” and Richard Dawkins’ Ethical Blind Spot

When you are a public intellectual and your primary mission is using reason and scholarship to enlighten the public, you have an obligation to guard scrupulously against making careless,  irresponsible or easily misunderstood statements that will be accepted as inspired wisdom by the less analytically able. Or to be more direct, if you are Richard Dawkins and because of some serious neural malfunction you really think that there is such a thing as “mild pedophilia,” you want to ever to be taken seriously again, shut up about it.

Dawkins, for reasons only known to himself, used a wide-ranging  interview to airily wax on about what he regards as his contact with a harmless child-molester.  Reminiscing about his  days at a boarding school,  he recounted how one of his schoolmasters “pulled me on his knee and put his hand inside my shorts.” Noting that other children in his school peer group had been molested by the same teacher, he concluded: “I don’t think he did any of us lasting harm.”
The world’s most famous atheist explained, “I am very conscious that you can’t condemn people of an earlier era by the standards of ours. Just as we don’t look back at the 18th and 19th centuries and condemn people for racism in the same way as we would condemn a modern person for racism, I look back a few decades to my childhood and see things like caning, like mild pedophilia, and can’t find it in me to condemn it by the same standards as I or anyone would today.”

What (in the name of Holy Hell) is “mild pedophilia”? Dawkins went on to say that the most notorious cases of pedophilia involve rape and even murder and should not be bracketed with what he called “just mild touching up.”

Ethics Hero: Miss America Contestant Theresa Vail

theresa-vailMiss Kansas, also known as Theresa Vail, would be a standout in current 2014 Miss America pageant just based on her unusual set of experiences and talents: the 22-year-old student at Kansas State is a member of the Kansas Army National Guard’s Medical Detachment, a serious bowhunter, a former motorcycle racer, an  M16 marksman, a boxer, an auto mechanic, and an opera singer.* What is ethically of interest, however, is that she wore a bathing suit that  revealed her two tattoos.

This just isn’t done in beauty pageants, not that many contestants are the tatooing sort. Tatoos have traditionally been regarded as ruining a contestant’s “perfection,” and aesthetically, I have to agree: a beautiful woman is still beautiful with something scribbled on her side, but it is hardy an enhancement. But Vial, in announcing her decision on her blog, made a compelling ethical argument for letting her tats show:

“What a hypocrite I would be if I covered the ink. With my platform, how could I tell other women to be fearless and be true to themselves if I can’t do the same?…But I am who I am, tattoos and all.”

That is as good a definition of integrity as you will find. Brava.  Where integrity lies, you can usually find honesty, trustworthiness and courage as well. Continue reading

Regarding Ariel Castro’s Suicide: Good!

I won’t go so far as to call him an Ethics Hero, but killing himself was probably the ethics highlight of Ariel Castro’s miserable, evil life.

The state of Ohio can’t navigate the moral-ethical logic necessary to execute a monster like Castro ( I see nothing ethical or moral about preventing society from making a crime like his just cause for capital punishment), so Castro took matters into his own hands and did the right thing.

Good.

Oh, I agree that the state has an obligation to do everything it can to prevent a prisoner from doing harm to himself, just as it would have an obligation to let Castro have gender reassignment treatment (though I am amused by wondering whether the advocates for Bradley Manning would be as vociferous if the subject was a sick rapist-kidnapper rather than a popular traitor). But I don’t want to pay my tax dollars to keep the likes of Ariel Castro in food, lodging and medical care, and I doubt many Ohio taxpayers do either. Taking himself out was an ethical act all around for Castro: we benefit, the system benefits, justice is served, and Castro is dead, all the better to make sure some future regime of touchy-feely uber-humanists don’t declare all sentences over 20 years as “cruel” or Ohio jails don’t become California Crowded, resulting in an elderly Castro being released to do the talk show circuit and star in a documentary.

Was his act cowardly? I heard an angry pundit declare so today, but I don’t feel we have any way of knowing that. Personally, I’d rather keep living, even in prison, than kill myself. I don’t really care if it was cowardly or not. They guy was a serial rapist-kidnapper-torturer, and his memory is supposed to be further stained by “And he was a coward, too”?

Is it’s a sin? I don’t think killing Ariel Castro can possibly be a sin…even if the killer is Ariel Castro.

A wiser society should have ended Castro’s life.

He did us all a favor by doing it on his own.

Here is David Shuster’s superb Comment of the Day, which is wise and greatly appreciated, on the post No, It’s Actually Allison Benedikt Who’s A Bad Person.

“Can we please drop/reform the “liberal” and “conservative” labels already? You state that Benedikt is a bad liberal; not quite true, she is utterly illiberal. She argues for state-compelled coercion circumventing individuals’ choice of how to raise their children. Her argument rests on illogical Marxist claptrap that prioritizes “the good of society” ie: the collective, over individual free will. I take back my previous statement, she is not illiberal, she is positively anti-liberal.

“I realize that this is quibbling over semantics, but in this case a rose by any other name really does smell differently. The Left and Democrats in general have self-identified for decades as “liberal”. While this label may have been appropriate 50 years ago, it certainly is not now. The Republicans’ social conservatism is rightly derided as illiberal in that it expects individuals’ sexual preferences to be dictated by the state. However, the Democrats’ claims of being “liberal” are becoming more laughable everyday; so much so that they have essentially become a parody of the classical liberal values they assure the population that they stand for. In fact, it appears as though the only things the Democrats envision people being free to do are the things the social conservatives oppose; in short, the Republicans want the state in your bedroom, the Democrats want the state everywhere else.

“We don’t have a “conservative” party and a “liberal” party, we have two statist parties with no alternative. Take gay marriage. I gave tentative applause for the Obama admin taking an explicit stand in support of it (truth be told, IMO the true “liberal” stand on this issue would be for the state to get out of the marriage business altogether, straight, gay, polygamous, whatever and let freedom of association dictate how people live with one another, but I guess that makes me a radical…). However, look at the illiberal consequences of this stance; wedding vendors with an admitted religious opposition to gay marriage but no prejudice against gays personally being forced by the government to render services against their will to gay weddings (see NM supreme court case). It’s beyond belief and IMO a violation of the 13th amendment; how can that be considered “liberal”? Continue reading

Ayo Kimathi And The Freedom To Hate

Ayo Kimathi, an African-American, is an acquisitions officer for Immigration and Customs Enforcement ( a section of the Department of Homeland Security), and has been, apparently without incident, since 2009.  He also operates and authors a web site, War on the Horizon, which predicts an “unavoidable, inevitable clash with the white race,” and explains how to prepare for it.

The latter fact is none of the government’s business, nor yours, nor mine, and certainly not that of Sarah Palin, who in her own inimitable style of making ignorance catchy and cute, exclaimed on her Facebook page, “His side ‘job’ running the ‘War On the Horizon’ website was reportedly approved by supervisors. Really, Fed? Really? Unflippingbelievable!”

No, it’s not. You can scour the government regulations and ethics requirements all you want—I have (Palin hasn’t.) There is nothing in them that prohibits a government employee in the Executive branch from espousing any political position he pleases, or that bans outside activities that do not interfere with the duties of the employee or constitute a conflict of interest. Nor should there be. As I read the rules, Kimathi had no obligation to ask permission to run his website, because his supervisor had no authority to stop him.

It is called freedom of speech, my friends.

Ethical Quote Of The Month: Justice Richard Bossun of The New Mexico Supreme Court

[The quote that follows is from the concurring opinion in the just-decided case of  Elaine Photography v. Willock, which challenged the proposition, discussed and endorsed on Ethics Alarms in several posts, that a business could not and ethically should not refuse service to same-sex couples.]

“On a larger scale, this case provokes reflection on what this nation is all about, its promise of fairness, liberty, equality of opportunity, and justice. At its heart, this case teaches that at some point in our lives all of us must compromise, if only a little, to accommodate the contrasting values of others. A multicultural, pluralistic society, one of our nation’s strengths, demands no less. The Huguenins are free to think, to say, to believe, as they wish; they may pray to the God of their choice and follow those commandments in their personal lives wherever they lead. The Constitution protects the Huguenins in that respect and much more. But there is a price, one that we all have to pay somewhere in our civic life.

“In the smaller, more focused world of the marketplace, of commerce, of public accommodation, the Huguenins have to channel their conduct, not their beliefs, so as to leave space for other Americans who believe something different. That compromise is part of the glue that holds us together as a nation, the tolerance that lubricates the varied moving parts of us as a people. That sense of respect we owe others, whether or not we believe as they do, illuminates this country, setting it apart from the discord that afflicts much of the rest of the world.”

——- New Mexico Supreme Court Justice Bossun, concurring with opinion in Elaine Photography v. Willock, which rejected the claim that legally requiring a photography shop to take photographs of a same-sex marriage was a violation of the First Amendment.
