Robert Mueller’s Disastrous Testimony And Its Significance, Part Two

Random Observations on the Mueller testimony and aftermath:

  • Observing the desperate spin offered by frustrated “resistance” members, desperate Democrats and social media Trump-Haters has been almost as revealing as Mueller’s performance. The most positive  takeaway they could muster is that Mueller clearly said that his investigation didn’t exonerate the President. That’s meaningless. It is not a prosecutor’s job to exonerate anybody, ever. An investigation’s goal is to determine whether there is probable cause to determine that a crime or crimes have been committed, not to prove anyone’s innocence. The hearts of the impeachment mob leaped for joy briefly during the morning hearing of the Judiciary Committee when Mueller answered “yes” to Rep. Ted Lieu’s (D–Calif.) question whether he had declined to indict Trump because of an existing Department of Justice Office of Legal Counsel (OLC) opinion stating that a sitting president couldn’t be charged with a crime. Ah-HA!  Mueller had found evidence of illegal activity committed by the President and was only prevented from indicting him by Justice Department policy! Start those impeachment hearings!

Never mind. In the afternoon hearing before the House Intelligence Committee, reversed himself,   saying that that OLC opinion prevented him from making any determination, period, of Trump’s culpability in obstructing justice. “As we say in the report, and as I said in the opening, we did not reach a determination as to whether the president committed a crime,” Mueller told the Committee after specifically referencing the Lieu exchange.

“I want to go back to one thing that was said this morning by Mr. Lieu, who said, and I quote, ‘you didn’t charge the president because of the OLC opinion.’ That is not the correct way to say it,” Mueller said.

This did not prevent journalists, pundits and my Facebook friends from ignoring the second statement so they could falsely promote the first. “They got him to confirm that he didn’t make a charge because of the Justice Department memo,” said “Meet the Press’s” Chuck Todd in an NBC panel. No, they didn’t. That’s a direct lie, as well as fake news.

  • The contention that Mueller was only a convenient figurehead for what was designed as a partisan hit job was made more credible by Mueller’s confusion. Mueller’s chief deputy, the infamously over-zealous,  partisan and controversial prosecutor Andrew Weissmann, headed a group of mostly left-leaning investigators. Complaints about the apparent rigged nature of the investigation were met by reminders of Mueller’s party affiliation and reputation for fairness and rectitude. That defense was left in the dust.

Now the anti-Trump tenor of the report no longer suggests the objective conclusions of a political neutral, but the partisan bias of prosecutors with an agenda.

  • Mueller’s weakness also suggests an answer to the persistent question of why the investigation appeared to be so incompetently managed, as with, for example, the involvement of Peter Strzok.

It didn’t appear that Mueller was capable of competent oversight, or even paying attention.

  • The most damaging and disturbing Mueller answer by far was when he was asked about Fusion GPS, which hired Christopher Steele to compile the infamous Russian-sourced ‘dossier’ against Trump.  Mueller said that he was ‘not familiar‘ with it. KABOOM! How is this even possible, unless Weissman and the other anti-Trump Jauberts on his team kept the old man locked in a closet somewhere? The involvement of the Steele dossier undercut the legitimacy of his investigation, and the investigation’s leader  was that uninformed about its origins? Was this wilful ignorance? Blatant incompetence?

Finally, how could the investigators and Mueller justify following bread crumbs that led to indictments of various Trump administration and campaign figures for crimes unrelated to the subject of the investigation, but be oblivious to the strong indications of wrongdoing—the FBI’s FISA fraud, the conflicts of interest, the surveillance of Carter Page—related to the investigation itself?

  • In another ridiculous addition to the Ethics Alarms, “Nah, there’s no mainstream media bias!” files—at this point, I  cannot maintain any respect for the intelligence and/or integrity of anyone who denies the obvious partisan bias of CNN, MSNBC, and the major networks—I watched CNN for over 30 minutes this morning to see how they would cover the hearings. Over at Fox News, of course, Mueller’s disturbing demeanor was being dissected in detail. The “Fox and Friends” blonde of the day said, sympathetically, that she would be “praying for him and his family,” since something is definitely seriously wrong.

At CNN, however, there was just a crawl representing Mueller’s testimony as straightforward, sticking to the report, and, of course, emphasizing the “no exoneration” statement and his answer to Lieu, retracted though it was. CNN showed no video of Mueller from either hearing, and its panels all focused exclusively on “where the Democrats go from here.”

Incredible. (Can something be simultaneously incredible and unsurprising?)The big news from the hearings, what those who didn’t have the time or stamina to watch them needed to know, was unquestionably Mueller’s frightening lack of preparation, clarity, or knowledge of the report he had signed and the investigation he had supposedly overseen, and how this undermined the report’s legitimacy, especially as an anti-Trump document.  Not only did he fail to give Democrats more ammunition for their coup as they clearly hoped it would, he undermined the credibility of the entire report.

Spin is one thing; intentionally hiding what occurred to make spin easier is something very different, and a major breach of journalism honesty and integrity.

  • Mueller’s repeated concern during his testimony regarding Russian interference in our elections, past and future, is being largely ignored by CNN and the rest because it directly points the finger of accountability to Barack Obama. The Mueller report  states that Russia began interfering in American democracy in 2014, with the operation becoming full-blown during the 2016 presidential election. The Obama administration knew this was going on, and took no discernible action.  In 2016, Obama’s National Security Adviser Susan Rice told her staff to “stand down” and “knock it off” as they drew up plans to “strike back” against the Russians, according to  Michael Isikoff and David Corn in their book “Russian Roulette: The Inside Story of Putin’s War on America and the Election of Donald Trump.”

Yet I continue to read attacks on Trump because he didn’t take adequate steps to foil the Russians,

  • Where is the accountability? House Judiciary Chairman Jerry Nadler had said over the weekend that Mueller’s report showed “very substantial evidence” that President Donald Trump is “guilty of high crimes and misdemeanors” — an impeachable offense. “We have to … let Mueller present those facts to the American people, and then see where we go from there, because the administration must be held accountable,” Nadler,  said on “Fox News Sunday.” Yet Mueller’s testimony, orchestrated by Nadler,  confirmed none of this. Nadler was intentionally misleading the American public.

The amazing thing is that the Democrats held the hearings at all. Mueller, as a matter of legal ethics and client confidentiality, was severely limited regarding what he  could say beyond what was already in his investigation’s report. Desperate to gain some public relations traction in their endless, nation-rending determination to end a legal and duly elected Presidency without the inconvenience of an election, one can only surmise that Mueller’s ethically problematical press conference led them astray, and not only astray, but into a disaster of their own making.

The first hint that something was amiss was Mueller’s request that an aide sit by him and assist in his testimony. That was not only unusual but ominous, and the Republicans on the committee quickly rejected it. Once Mueller started answering questions, it was painfully clear why this request had been made. He looked disoriented and confused. The 75-year-old Justice Department veteran had to ask committee members to repeat their questions repeatedly, as if he was having difficulty focusing. He often did not know whether the representatives were asking him questions or if they were reading from his own report. In  the first 90 minutes of the hearing, Mueller asked for clarification of questions more than 10 times. Under questioning from Rep. James Sensenbrenner (R-Wisc.), Mueller asked: “And where are you reading from on that?” “I’m reading from my own question” was the answer.  “Then can you repeat it?” Mueller asked. The audience laughed. By the end, the audience had stopped laughing. As Obama strategist David Axelrod tweeted, the performance was “painful” to watch.  Mueller asked Rep. Sheila Jackson Lee to restate her question three times.  Rep. Matt Gaetz (R-Fla.) asked the 14 word question, “Attorney #2 in the Inspector General’s report and Strzok both worked on your team, didn’t they?” and Mueller appeared to be confused by it.“Pardon me?” Mueller replied. After Gaetz restated his question, Mueller replied: “And the question was?” Asked by Head Trump-hunter Judiciary Chairman Jerry Nadler (D-N.Y.) to explain what his investigation  found “in plain terms,” Mueller answered: “Well, the finding indicates that the president, uh, was not, uh, the president was not exculping, uh, exculpated, uh, for the acts that he allegedly committed.”

Ah! Well thank you, sir, that explains everything! Nadler looked as if he wanted to start banging his head on the table.

Unethical Quote Of The Week, And Incompetent Elected Official: Senator Cory Booker (D-NJ)

“My testosterone sometimes makes me want to feel like punching [Trump], which would be bad for this elderly, out-of-shape man that he is if I did that — a physically weak specimen.”

U.S. Senator—yes, that’s Senator, not “junior high locker room blow-hard”—Cory Booker, on “Late Night with Seth Meyers.”

How statesmanlike and dignified. How elevating to the public discourse. How respectful to our institutions. What a fine example of civility to pass on to the young. How substantive and intellectually edifying. And what a factually ridiculous assertion: Trump’s energy at 70+ is remarkable, as the seven day a week regimen of any President would floor many a younger man.

Booker might be able to beat up several of the women running against him for Congress, as well as ancient Joe Biden and Bernie Sanders. I’m surprised he is boasting about that. It’s pretty much the extent of his claim to be any better candidates than they are, and they’re nothing to cheer about.

What a stunning dimwit this man is, to think that pandering to Seth Myers’ foolish audience by spewing ad hominem insults and posing as some kind of warrior by saying what he would like to do but never would [Blogger Jim Treacher: “Let’s take a moment to imagine any Republican going on national TV and saying something like this about a Democratic POTUS. And let’s take another moment to contemplate the amusing idea of Cory Booker possessing testosterone….”] enhances his status as a worthy candidate for the Presidency.

He’s not even an honorable member of the Senate.

Morning Ethics Eye-Opener, 7/22/2019: Boycotts, Bushes, And Weenies

Mornin’!

Just trying to think about ethics while I sit calmly by the phone…my doctor wants to tak to me about something. I’m hoping it’s the Red Sox…

1. There is hope: the latest cable ratings show that CNN’s  Brian Stelter’s slot “Reliable Sources” has lost more about 42% of its audience in the last six months. This indicates people must recognize a fake ethicist when they see one. Unlike his predecessor, Howard Kurtz (who had his own problems), Stelter refuses to focus any media criticism on his own network, which is one of the prime journalism ethics offenders extant, and his obsession with Fox News is nearly Media Matters-like. In short, he’s a biased, partisan hack, highlighted by his risible claim that the news media (and sainted CNN, of course) covered the Mueller investigation objectively.

The rotting American mainstream news media desperately needs  objective, credible qualified critics. What it does not need is a fake authority like Stelter, and it is encouraging to see that the audience is reacting accordingly.

2. A Party of Assholes. This is nice: Here’s the statement issued by Virginia Senate Minority Leader Dick Saslaw, Senate Democratic Chair Mamie Locke, House Minority Leader Eileen Filler-Corn, and House Democratic Chair Charniele Herring regarding the upcoming commemoration of the 400th anniversary of the Jamestown settlement.

We will not be attending any part of the commemorative session where Donald Trump is in attendance. The current President does not represent the values that we would celebrate at the 400th anniversary of the oldest democratic body in the western world. We offer just three words of advice to the Jamestown-Yorktown Foundation: ‘Send Him Back.’

There we see the priorities of the great mass of the Democratic Party since the 2016 election, in which marginalizing the elected President and insulting him (and, not incidentally, his office) at every opportunity for illusory political gain has taken precedence over the best interests of the nation.

I also strongly doubt that the President’s recent deliberately provocative tweets changed anything, as Democrats have been boycotting events where he was scheduled to participate for three years, beginning with his inauguration. They would have found some reason to do this, even without the tweets.

In contrast, at least one Virginia Democrat understands her duty. US Rep. Elaine Luria, a Democrat representing Virginia’s 2nd District, said

I will attend the Jamestown 400th anniversary of the founding of democracy in America because our democracy is not about the President or Congress—as President Lincoln said, “it is a government of the people, by the people, for the people and it shall not perish from this earth.”

Plan K: Election law violations in pay-offs of old sex-partners

Now from the New York Times today:

“Federal prosecutors signaled in a court document released on Thursday that it was unlikely they would file additional charges in the hush-money investigation…. that ensnared members of Donald J. Trump’s inner circle and threatened to derail his presidency. In the document, the prosecutors said they had ‘effectively concluded’ their inquiry, which centered on payments made during the 2016 presidential campaign to buy the silence of two women who said they had had affairs with Mr. Trump…. The president’s former lawyer, Michael D. Cohen, was convicted in the case. He has said he helped arrange the hush money at the direction of Mr. Trump, and prosecutors have repeated the accusation in court papers. Mr. Cohen is serving a three-year prison sentence.”

It’s fun watching the anti-Trump media try to spin this. Here’s AOL:

“The FBI believed then-candidate Donald Trump was closely involved in a scheme to hide hush-money payments to adult film star Stormy Daniels, who claimed an affair with Trump, court documents from the closed campaign finance case against former Trump-fixer Michael Cohen show.

The documents, released Thursday, describe a “series of calls, text messages, and emails” between Cohen, Trump, Trump campaign aide Hope Hicks, Keith Davidson — an attorney for the woman, porn star Stormy Daniels — and David Pecker, an executive of the company that published the National Enquirer.”

Oooh, “scheme.” That sounds sinister and illegal, but paying off old adultery-enabling sex partners who are threatening to embarrass you when you’re a public figure is business as usual for people like Donald Trump (and Jack Kennedy, and Bill Clinton, and so on) and it isn’t illegal. Nor is lying about whether such relationships ever existed, unless it’s under oath or to investigators.

The reason charges aren’t going anywhere is because the theory that this was an election law violation, or that if it was, it was sufficiently dire to be impeachable, was always a ridiculous stretch. Michael Cohen, who promised to be the worst and most unreliable witness of any lawyer in history if this ever reached trial, had been persuaded to plead guilty to a non-crime as part of his plea deal, purely to assist the quixotic effort to make the politically motivated case that an individual running for President doing exactly the same thing that he would have done had he not been running for President was violating federal elections laws despite the fact that no law prohibits that act. Unethical Quote Of The Week: Democratic Presidential Candidate, Washington Governor Jay Inslee

Ladies and Gentlemen, the next Secretary of State…No, really! I’m serious! I wouldn’t kid about something like that!”

“My first act will be to ask Megan Rapinoe to be my secretary of state. I haven’t asked her yet so this could be a surprise to her.I actually believe this because what I think what she has said that has inspired us so much is such an antithesis of the president’s foreign policies.”

And you thought President Trump’s appointments have been bad!

So it’s come to this, has it? Megen Rapinoe is a soccer player, and nothing but a soccer player. She played soccer to the subordination of everything else in high school and college. She has no academic credentials, proven expertise, experience or even interest in government, diplomacy and foreign affairs, and a supposedly serious candidate for President states that he would appoint her as his Secretary of State.

How can we explain this? Could he have been joking? It’s not funny by any analysis. It is horrifying, in fact. Still, candidates for office don’t typically say “my first act” if elected will be to do something if they have no intention to do such a thing and everyone realizes it. That’s insane; it’s both a lie and a transparent lie.  It is an insult as well: the statement says that the candidate thinks the public is so box-of-rocks stupid that they will believe utter nonsense.In addition to everything else that’s wrong with it, Inslee’s stated “first act” would be futile. Even Democrats aren’t so far gone that they would vote to confirm a Secretary of State nominee with the worst credentials of any Cabinet nominee in U.S. history—yes, even worse than Ben Carson, and I didn’t think that was possible. A Head-Spinning Ethics Movie For 2019: 2005’s “Good Night And Good Luck”

I avoided George Clooney’s film “Good Night And Good Luck” when it was released, because I knew it had been designed as an anti-Bush administration allegory, weaponizing Edward R. Murrow’s battle with Senator Joe McCarthy as progressive propaganda. See the courageous and principled journalists stand up against ruthless Republican bullies! See the dangerous power-abusers strike back with guilt by association allegations and by attacking the messenger! See the objective, non-partisan journalists help bring down the threat to democracy!

I finally watched the film this week, and was struck by several things. First of all, the movie, which Clooney directed as well as co-starred in (as Fred Friendly) was much better and fairer than I expected: let that be a lesson to me.

Second, David Strathairn as Murrow once again showed what an excellent and under-appreciated actor he is, although his voice is an inadequate substitute for Murrow’s rich baritone. Third, Senator McCarthy really was a sinister creep, and it radiates from the screen. Those who still defend him, like Ann Coulter, are allying themselves with the Prince of Darkness. The man claimed that the ACLU was a Communist front organization!

Most of all, however, I was struck by how ironic and convoluted the film’s analogies had become in just 14 years, and found myself wondering who Murrow would regard as the bad guys today.  For example, Murrow, speaking of McCarthy’s hearings on Communists in the Army and elsewhere, tells his audience that while Congressional hearings are an important part of the body’s oversight function, the line between legitimate hearings and “persecution” is thin. What would he think about today’s Democrats’ endless fishing expeditions designed to find some justification for impeaching the President?

Murrow went on television to condemn McCarthy’s repeated accusations based on assertions of facts, evidence and documents that didn’t exist. Would he have done the same today, but with his target being Rep. Adam Schiff (D-Ca) or Gerald Nadler (D-NY), both of whom have repeatedly, McCarthy-like, claimed to have “proof” of President Trump’s collusion that didn’t exist? Continue reading →

“Never Mind!”*….And A Few Questions

House Democrats on The Committee on Oversight and Reform tweeted the photo above  to promote their investigation into “inhumane treatment” at the border The hearing,  titled “Kids in Cages: Inhumane Treatment at the Border,” is supposed to examine this alleged inhumane treatment—as illustrated by the photo— that members of the committee allegedly witnessed. The photo was intended as a graphic  sample of the “grotesque treatment of children” at the camps under the Trump Administration.

The photo and tweet were quickly sent down the memory hole when Democrats discovered that, not for the first time, they had used an old photo of camps during the Obama Administration.

After deleting the tweet, the Oversight Committee put up a second tweet with a different photo. This photo also turned out to  be from the Obama administration, and  was also deleted.

Morning Ethics Warm-Up, 7/2/2019: Monkeys, Howlies, Nikes, And The Great Tag Hoax

Gooooood Morning!

1. Talk about a newspaper column that is exactly the opposite of the truth! The Times had an essay in its “Review” section this Sunday with a title that gave me a shock: “Want to Be Less Racist? Move to Hawaii”

The headline would have been more accurate if it read, “Want to live in the only state with lawful and open racial discrimination? Move to Hawaii!” Hawaii gives special benefits to residents with full or partial Native Hawaiian ancestry. There is a special  Hawaiian registry program which verifies an individual’s Native Hawaiian ancestry, so the favored race can receive such goodies that are unavailable to other racial groups as buying land for a home at only $1 a year,  low-interest loans, and admission for their children to the elite Kamehameha Schools.

Anecdotally, I can also state that the only time in my life that I felt I was the target of racial epithets was in college, when the Hawaiian contingent frequently derided me and my white room mates as “howlies,” a disparaging Island term reserved for anyone who is not a native Hawaiian. I will always remember my 6’5″ roommate Dave ending the practice by saying to the two main offenders, “If I ever hear that word from any of you again, I promise that I will shove you, Howie, directly up Reggie’s ass, head first.  Are we clear on that?”

Dave never bluffed, and seldom joked. That was the last time we were called “howlies.”

2. Nike is not just scum, but cowardly, sniveling scum. Nike Inc. cancelled a U.S.A.-themed sneaker featuring the Betsy Ross American flag because Head NFL Kneeler Colin Kaepernick, a Nike endorser, told company officials that he and others felt that the  historic flag is an offensive symbol because of its connection to an era of slavery.

The Air Max 1 USA had been designed for release in celebration of the July Fourth holiday, and scheduled to go on sale this week. The heel of the shoe featured a U.S. flag with 13 white stars in a circle, the original flag created during the American Revolution and known as the Betsy Ross flag.

Wow! How racist can you get!

The Attack On Andy Ngo

This is yet another story among many exposing the ugliness at the heart of the “resistance” and the increasingly fascist American Left…and, as the night follows day, another story that the mainstream news media is attempting to minimize.

Andy Ngo, a conservative journalist and pundit with the emerging online opinion and news website Quillette, attended  a Portland, Oregon “Him Too” rally over the weekend. “Him Too” is a counter #MeToo movement that focuses on false rape and sexual assault allegations.  It was a small rally, with only a few dozen attending; heck, there are probably only a few dozen non knee-jerk progressives in Portland.  The left-wing/Anfifa/Trump Hate  mob that showed up as a counter-protest (aka. “organized effort to constrain free speech by intimidation”), however, was much larger.

That group generated masked thugs who attacked Ngo, a recognized  anti-Muslim critic, a hate-crime skeptic and a foe of the Antifa itself.  Proving his assessment correct, the Antifa beat him and threw what the news media is calling “milkshakes” at him, a description that  is literally a lie designed to trivialize what occurred.  Several of the missiles were cups full of quick-setting cement, not dairy products.  Bloody and battered, Ngo  began livestreaming  on his phone after the attacks, and could be heard asking a police officer, “Where the hell were all of you?” He was admitted to a local hospital for treatment, and at last report, was still there.

While this was occurring, Portland’s finest did nothing to intervene; the police just watched, even as some of them were struck by eggs thrown by the Antifa and the Left’s counter-protesters  threw trash cans, newspaper stands, and patio furniture into the streets. . Portland’s mayor, Ted Wheeler, is also the police commissioner, so media accounts that he cannot be said to have encouraged this dereliction of duty are also partisan, misleading spin.

Wheeler avoided commenting on his police force’s disgraceful performance until yesterday, when he tweeted some insulting boilerplate:

But “we” didn’t stand against the violence, not when a journalist whose political positions are anathema to the hard left views of Wheeler’s city was in the process of being beaten. Note also that the Mayor slyly blames the victim, who, like the group that dared to rally against a popular progressive cause, “incited violence.”
