No, Ashleigh, That Isn’t “Libel,” And Why Are You Hosting A CNN Show Called “Legal Affairs” When You Don’t Know That?

In an epic clash of incompetents, CNN’s Ashleigh Banfield challenged Michael Cohen, one of Donald Trump‘s advisers over his retweeting an internet meme that said that Hillary Clinton “murdered” the victims of the Benghazi mission assault.

After the House Benghazi Select Committee released its final report on the 2012 terror attacks, Cohen delivered his tweet featuring this…

It is about as stupid, lazy and inflammatory as most political memes, and the fact that Cohen would think it worth circulating tells us all we need to know about both him and the man who pays him, who would have probably tweeted this junk himself if Cohen hadn’t. Remember Cohen? He’s the Trump lawyer who crudely threatened the Daily Beast and went on to proclaim that spousal rape was legal, when it isn’t. Cohen is, by definition, a thug, a creep, and a crummy lawyer. Naturally, he’s also a Trump advisor. (Tell me again how Trump, that keen judge of legal talent,  can be trusted to appoint better Supreme Court justices than Clinton would. Or that Honey Boo-Boo would.)

Sparring with Cohen on her show “Legal Views,” Ashleigh Banfield lectured the lawyer and told him, “This is libel.” thus making exactly as accurate a statement of law as Cohen’s earlier one about spousal rape. It was not libel. It was inflammatory political speech in a satirical context (would anyone think Clinton actually said this, as the meme suggests?) about a public figure, clearly an opinion rather than a statement intended to be taken literally, and no more libel than “Bush lied and people died.” Banfield’s diagnosis was 100% wrong, and the fervor with which it was delivered is the calling card of a Clinton defender. Revisiting The “Ten Ethics Questions For Unshakable Hillary Voters”

Less than a year ago, I responded to a series of what I regarded then (and now) as irresponsible expressions of support, bias and denial by Hillary Clinton supporters with ten questions designed to rescue them from corruption. At the time, the possibility that an even worse candidate would (or could) be nominated by the Republican Party never crossed my mind.

Although it was largely buried over the last week in the aftermath of the Orlando shooting, Clinton’s e-mail fiasco was further exposed as the deep evidence of  long-term Clinton corruption that it is.  One of the most damaging e-mails handled on her private server, for example, was not turned over to the State Department (Hillary has sworn repeatedly a that ALL State Department business-related e-mails were turned over, raising the rebuttable presumption that she had other State communications among the 30,000 or so that her personal lawyers had destroyed.) We also learned that State Department staffers struggled in December 2010 over a serious technical problem that affected emails from the improper server, causing State staffers  to temporarily disable security features on the government’s own systems, thus making them more vulnerable to attack.

In a deposition under oath, Clinton’s IT specialist Bryan Pagliano, a central figure in the set-up and management of Clinton’s personal server, invoked the Fifth more than 125 times.  Meanwhile, the shadowy Clinton Foundation machinations came to the fore once again. An Associated Press review of the official calendar Hillary Clinton kept as Secretary of State identified at least 75 meetings with longtime political donors, Clinton Foundation contributors, corporate and other outside interests that were not recorded.  The calendar omissions naturally reinforce suspicions that she sought to hide possibly improper or even illegal uses of her influence and position to raise funds for the foundation. While the news media tried to spin Donald Trump’s statement in his attack on Hillary last week that “Clinton’s State Department approved the transfer of 20% of America’s uranium holdings to Russia while nine investors in the deal funneled $145 million to the Clinton Foundation,” his statement was accurate. For a change.

What was striking about the ten questions, looking at them again, is how little I would alter them today. The major change is that the arguments of those who claimed that evidence of Hillary’s unethical conduct was partisan or inconclusive look even more desperate and dishonest than they did last August. For the same reasons, the passage of time makes Clinton’s shameless and insulting lies seem even more shameless and insulting. The Democratic Party also looks worse and more corrupt: it rigged the nomination for this woman of demonstrably untrustworthy and venal character, as well as of dubious skills. Nothing can surpass the complete abdication of its duty to the United States by the Republican Party and its voters, but this was a betrayal by the Democrats.

Ten Observations On The Trump Assassination Attempt

Perhaps you missed it? Someone tried to shoot Donald Trump. From the Associated Press:

“A British man arrested at a weekend Donald Trump rally in Las Vegas tried to grab a police officer’s gun so he could kill the presidential candidate after planning an assassination for about a year, according to authorities. U.S. Secret Service agents said Michael Steven Sandford approached a Las Vegas police officer at the campaign stop to say he wanted Trump’s autograph, but that he then tried to take the weapon.”

Observations:

1. Wow. Talk about being incompetent at your chosen avocation! This guy has been “planning an assassination for about a year” and the big plan was “try to get a police officer’s gun”?

Assassins, like everything else, just aren’t what they used to be.

2. Remember, however, that the only difference between a failed assassination attempt and a successful one is moral luck.

3. The Washington Post asks why the incident didn’t provoke more news coverage. Isn’t that a strange question to come from one of the news organizations responsible for the lack of coverage? Why doesn’t Callum Borchers just ask his own editors at the Post?

The answer seems clear to me: the news media doesn’t want any public sympathy going Trump’s way, or to give him what would amount to positive publicity. This is the double standard we are being told that we need to get used to. Does anyone want to make the case that an assassination attempt on Hillary’s life would be a multi-day story, with a repeat of the U.S. Representative Rep. Gabrielle Giffords shooting mass accusation, now holding  that Republican “hate speech” and anti-Hillary rhetoric nearly resulted in a tragedy?  Rush Limbaugh and Sarah Palin were being fingered as the reason why a deranged man went on a killing spree in Tucson. Secret Service agents await the arrival of U.S. Presidential candidate Obama in Durham

The Association of Former Agents of the United States Secret Service has reportedly condemned member Gary Byrne and his unethical tell-all “Crisis in Character.” A formal statement will be released later today, in which the group strongly denounces the book, which it says will make protecting Presidents more difficult by eroding the trust between agents and the people they protect.

I hope the statement goes farther than that. “It will make security more difficult” is a practical, non-ethical consideration. What about ethics? Byrne, who was a Secret Service agent at the Clinton White House, has written what he claims is an account of disturbing behavior by the Clintons, and especially Hillary, behind closed doors. How dare he? The duty of confidentiality is as crucial and near absolute for Secret Service agents as it is for doctors, lawyers or priests. Unless they witness a serious crime, agents may not reveal what they see or hear. It is a massive breach of trust, and cannot be justified or rationalized by saying “But we have to stop Hillary Clinton from becoming President!” That is not the concern of the Secret Service. From The Man Who Would Be President, And Who Thinks That Rationalizations Are Cogent Arguments, A Perfect #22

Just two weeks ago, I breathlessly announced that Former Secretary of State Madeleine Albright, against all odds. had pulled into a lead over Donald Trump for the 2016 Unethical Rationalizations Championship by giving us a perfect #22, the worst rationalization of them all. That’s this one:

22. The Comparative Virtue Excuse: “There are worse things.”

If “Everybody does it” is the Golden Rationalization, this is the bottom of the barrel. … It is true that for most ethical misconduct, there are indeed “worse things.” Lying to your boss in order to goof off at the golf course isn’t as bad as stealing a ham, and stealing a ham is nothing compared selling military secrets to North Korea. So what? We judge human conduct against ideals of good behavior that we aspire to, not by the bad behavior of others. One’s objective is to be the best human being that we can be, not to just avoid being the worst rotter anyone has ever met.

Behavior has to be assessed on its own terms, not according to some imaginary comparative scale. The fact that someone’s act is more or less ethical than yours has no effect on the ethical nature of your conduct. “There are worse things” is not an argument; it’s the desperate cry of someone who has run out of rationalizations.

Now, Donald Trump never runs out of rationalizations; as I wrote in the Albright post, “Trump is capable of hitting the entire list of rationalizations, all 68 of them (including the sub-rationalizations) given the opportunity.” He also rose to the challenge posed by Albright quickly, for he not only gave America a Full 22, he did so in the context of arguing for an unconstitutional government breach of First, Second, and Fifth Amendment rights on a massive scale! Bravo!

On Face the Nation  yesterday, talking about the Orlando shooting,  this idiot—sorry, sorry!—Mr. Trump said..

“Well I think profiling is something that we’re going to have to start thinking about as a country.Other countries do it, you look at Israel and you look at others, they do it and they do it successfully. [DINDINGDINGDINGDING! There are two more rationalizations right there:#1, Everybody Does It, and  #3, Consequentialism, or  “It Worked Out for the Best”! I mean,this guy is a rationalization machine! ] And I hate the concept of profiling but we have to start using common sense and we have to use our heads. Seven Facts About News Media Bias, And Yet Another Smoking Gun That Reaffirms Them

Here are seven facts about mains stream news media bias. People deny them, some even sincerely, but they have been well proven over many decades. 

FACT: The U.S. mainstream news media is partisan and biased.

FACT: It is shockingly shameless about this.

FACT: The results of this bias include slanted news, withheld information, warped priorities, and discrediting new sources that cover stories thye intentionally ignore, all with the collective and intentional result of misleading the U.S. public.

FACT: This is arrogant, unfair, incompetent, unethical, and harmful to the proper functioning of democracy.

FACT: The news media employed this bias to make certain that Barack Obama was elected President in 2008, and has already made it obvious that it intends to be at least equally biased in its efforts to make certain that Donald Trump is not elected in 2016.

FACT: Among the techniques the news media employ is holding Republican candidates and elected officials to different standards than what it applies to Democratic candidates and officials.

FACT: Journalists, pundits, and Ethics Alarms readers who continue to deny that there is a mainstream media bias favoring Democrats and progressive policies are either lying, not paying attention, or in denial.

I must say, the last is very frustrating, and often infuriating. I have a good friend who really does believe that the mainstream news media is outrageously biased toward conservatives, because he is so far at the end of the ideological spectrum that everything is too far right for him. I have a business and a life-style that both compels me to follow many news sources on all sides of the political spectrum, and my profession and training requires me to work hard at achieving objective analysis. (I know I don’t always succeed.) I know my biases and preferences, and have to say that all seven of the facts I presented above are facts, not opinions, and because they describe a very dangerous situation, the fact that so many progressives refuse to acknowledge them makes me wonder if their ideology is inconsistent with basic integrity.

All American citizens should want and demand as objective, unbiased and fair a national news media as possible. We won’t get one until progressives admit that even though their President, elected officials, candidates and policies are the beneficiaries of unethical journalism, it is still wrong, still unhealthy, and still has to stop.

This is why I must salute Joe Concha, Mediaite’s thoughtful conservative reporter, for his excellent work in finding one of the most powerful smoking gun proofs of this bias I have ever seen.

Last week, Donald Trump horrified the pundit class when he announced that he was stripping The Washington Post of access to his campaign, announcing,

“Based on the incredibly inaccurate coverage and reporting of the record setting Trump campaign, we are hereby revoking the press credentials of the phony and dishonest Washington Post.”

Of course this was a petty, cowardly and anti-democratic move by Trump. I didn’t post on it because the ethics  position here on Trump is clear and immutable, and because if I covered all of the unethical things this crude, reckless idiot says and does, I’d have no time for anything else. The man has little judgment, few values, no restraint, and an arrested (at about age 10) ability to distinguish right from wrong. We know this, or should. Nobody should be surprised, and this incident should not change anyone’s opinion of him.

The news media, however, reacted to it as if Trump had leaned in to kiss a baby and bitten its head off:

The Post’s Chris Cillizza:  “Barring reporters from public events because you disagree with what they write is a dangerous precedent.”

Slate: on Trump’s decision: The revocation “marks an unprecedented escalation in his war” against media.

WaPo executive editor Marty Baron: Trump’s decision is “nothing less than a repudiation of the role of a free and independent press.”

  CNN Contributor Bakari Sellers: It was “fascism at its worst.”  Also on CNN, Sara Murray opined that Trump’s revocation of The Washington Post’s press credentials was “alarming.”

Give Concha credit. Although his own opinion of Trump’s actions were as low as those of his Trump-hating colleagues, the spark of a memory stirred. He went back into the archives. What’s this? Unethical Quote Of The Week (And Nominated For Un-Self-Aware Quote Of The Year): Hillary Clinton

“If the FBI is watching you for suspected terrorist links, you shouldn’t be able to just go buy a gun.”

—–Hillary Clinton, forgetting all sorts of things in her speech in response to the Orlando massacre.

Cowabunga, Hillary!!! Do you think, while I am trying to explain why the only responsible course for an ethical citizen is to vote for a horrible candidate like  you in order to stop Donald Trump from becoming President Asshole, you might at least try not to make it harder by talking like an autocratic idiot yourself? Do you think you could do that, please?

Not for the first time, Hillary Clinton just made one of those boomerang assertions that applies to her as much as those she is supposedly criticizing. Her all-time classic, of course, was when she said that the victims of sexual abuse had the right to be believed (unless, of course, the sexual abuser is her husband and meal-ticket, in which case she personally will see that said victim is discredited and destroyed.)

Was the statement in her speech even worse? Hmmm, close one! Here is Hillary, herself under a criminal investigation by the FBI for violating a federal law or five and still running for President because, after all,  it’s just an investigation, and in the Land of the Free and the Home of the Brave one does not lose rights and privileges until one is actually convicted in a court of law. And yet here she is saying that an FBI investigation should suspend a Constitutional right.

Talk about throwing blood in the water. Talk about cynically appealing to low information voters. Talk about pandering. Talk about walking into a buzz-saw.

Talk about stupid…

I would not be the first to ask, fairly and accurately, if Hillary also believes that merely being investigated should suspend other rights, like the right to not to be subjected to unreasonable searches and seizures, the right to have a lawyer, the right not to have to incriminate oneself, and the right to free speech? Does she know that the right to purchase a gun is also as much of a right as any of these? Or is she really saying that she wants to eliminate that right?

Perhaps she was just speaking carelessly, irresponsibly and in vague generalities–like, oh, just to pick an example out of the air, Donald Trump.

You’re not making it easy for me, Hillary.

The Times’ Timothy Egan Doesn’t Get It: Hillary Lies, Trump Just Has No Respect For Facts

In a Sunday Times op-ed called Lord of the Lies, Timothy Egan argues that Donald Trump, and apparently only Donald Trump, should be fact-checked live in any Presidential debates. Egan is adopting the current fad among journalists, which is the argument that Trump is so bad, the media should apply a double standard, making sure his misrepresentations are immediately debunked, while presumably allowing Hillary to continue to issue whoppers every time she talks about Benghazi, her State e-mails, the Clinton Foundation, her record as a champion for victims of sexual assault, etc.

I already pointed out how unethical it was for CNN to employ an  on-screen fact-check of a Trump speech ( “Trump: I never said Japan should have nukes (he did).” ) especially since they will never do the same to Hillary (“Hillary:I never sent e-mails marked classified (She did…)”)  Egan thought CNN’s intrusion was just peachy, though, because the news media now believes their task isn’t to be fair to both candidates and treat them the same, but to employ any means necessary to defeat that one journalists have determined shouldn’t win.

A larger problem with Egan’s thesis—even more than his apparent belief that the notoriously biased PolitiFact is “non-partisan”)—is that he doesn’t know what a lie is. He adopts the flat-out wrong definition of lie used by most fact-checkers in fact: if they disagree with a statement or can show it is untrue, it’s a lie. That’s not what makes a statement a lie. For example, PolitiFact is demonstrably biased and Democratic-leaning, far more so than the Washington Post’s Factchecker or Fact Check.org. But I wouldn’t assume that Egan is lying when he says otherwise. Progressive journalists just assume PolitiFact is fair and non-partisan because they think they are fair and non-partisan. Donald Trump has said and done so many outrageous things since his November, 2015 mockery of a disabled journalist that many have probably forgotten how ugly, cruel and undignified it was. Trump also, you may recall, denied that he even knew the journalist was disabled—one of his many Jumbos (“Elephant? What elephant?”) since that accursed day that he entered the presidential race. Now a super-PAC supporting Hillary Clinton has taken that moment and employed it to make a vivid point, easily summarized as, “This guy wants to be President?”

What are the stupidest lies of all? Gilding the lily lies. Lies that accomplish nothing that the truth wouldn’t accomplish just as well. Gratuitous, lazy, pointless lies, that only serve to make the world more incredulous, cynical and distrusting.

Here is a  wonderful example, and the liars are the folks in Conservative Nation. After that San Jose, California, Trump rally where protesters attacked the Trumpites, the pro-Trump Conservative Nation tweeted out the fake picture above of an alleged Trump-supporting woman after her beating  by demonstrators. “Here’s what happened to female Trump supporter when she met ‘peaceful’ and ‘tolerant’ liberals” the tweet said, as if the genuine footage of the violence wasn’t enough.

But actor Bruce Campbell (a guilty pleasure of mine, I admit it) pointed out the truth. He tweeted,

Check your facts, folks. This is an actress named Samara Weaving from . This is a make-up test. Sad.

If you haven’t seen “Ash vs. The Evil Dead,” and unless you are a hard core, cult comedy-gore fan, I wouldn’t advise doing so, this is the cable series starring Campbell as he reprises his iconic role from the “Evil Dead” Trilogy, most famous for this classic sequence from “Evil Dead II,” in which hardware salesman Ash (Campbell), trapped in a cabin under assault by demons,  finds his right arm possessed and trying to kill him:

Anyway, Bruce is right. This is sad. And dishonest.
