Joe Biden, The Double Standard Candidate

The fact that Joe Biden is even taken seriously as a Democratic candidate for President is an indictment of his party, as well as evidence that  progressive principles are instantly alterable, optional or ready for deep freeze any time they become inconvenient.

The ethics value issue, of course, is integrity. If the Democratic Party cared about it, Joe Biden would be looking forward to spending his Golden Years playing with his grandchildren and copping feels with their baby-sitters.

That’s the threshold hypocrisy, as we know. Joe is a serial and unapologetic sexual harasser. There are many photographs online, and probably many more to be found, of him hugging, sniffing, and fondling women of all ages while they seem approximately as comfortable as if Joe were a rabid octopus. The conduct displayed is the equivalent or worse  of behavior that has caused hundreds of executives and  many  high-profile leaders in a wide range of sectors to be removed from their jobs. The Democratic Party styles itself as the party of women and #MeToo, but has been flagrant about applying double and even triple standards: witness Virginia Lieutenant Governor Justin Fairfax, still in office with the support of his party despite both a credible rape accusation and an allegation of sexual assault, both more serious than any of the accusations made against Senator Al Franken, a Democrat, who was forced to resign. None of the Republicans or Democrats who have been pilloried for sexual harassment carry the photographic evidence that indicts Biden, and yet there he is, topping the polls.

The Democratic Party’s hypocrisy goes far beyond harassment where Joe is concerned, however, as a recent Times article called “Joe Biden Knows He Says the Wrong Thing,” itself a naked rationalization to excuse incompetence. Hmmmmm...Is this rationalization  on the Ethics Alarms list? Give me half a minute while I check…

NO!

Incredibly, Joe’s excuse, “I know I’m doing it,” has so far escaped the definitive rationalizations list! That will be remedied shortly.

Joe and his defenders regularly employ other rationalizations for his groping problem (and others), among them, #1. The Golden Rationalization, or “Everybody does it” variations “Everybody is used to it.,” “Everybody accepts it,”“Nobody’s complained before” and “It’s too late to change now,” #8. The Trivial Trap (“No harm no foul!”),#13A The Road To Hell, or “I meant well,” #19A The Insidious Confession, or “It wasn’t the best choice,’  #21A. The Criminal’s Redemption, or “It’s just a small part of what I am!,”#22. The Comparative Virtue Excuse: “There are worse things.,” #41 A. Popeye’s Excuse, or “I am what I am,”  #42. The Hillary Inoculation, or “If he/she doesn’t care, why should anyone else?,” 43. Vin’s Punchline, or “We’ve never had a problem with it!,” and #64A. Bluto’s Mistake or “I said I was sorry!.”

Sorry for the digression. Back to the Times article: I seriously considered posting the whole piece with Donald Trump’s name replacing Biden’s. How could the Times reporters write this, or anyone read it, without noticing that all the habits and tendencies being cited as Joe’s problems are the exact same proclivities that Democrats claim should disqualify Trump for high office, and all of the defenses on behalf of Joe echo the arguments of Trump defenders? WAKE UP!

Oh, great: started this post at 7 am, hell broke lose at ProEthics, and now it’s after noon. Well, the hell with it: I’m not going back to change the headline or the intro, and I like Lenny’s version of the Stars and Stripes at any time of day.

So there.

1. Unprofessional and dangerous stuff from  Above the Law….as usual. The legal gossip and snark online tabloid is run and written by lawyers who are not practicing law, so they feel free to engage in conduct that lawyers are forbidden from engaging in, like misrepresentation.  Lately the cyber rag has been cyber-ragging on Jones Day, a long-time, distinguished D.C. mega firm. Why are they doing that? Come on, it should be obvious.

ATL takes the position—and it has company— that Jones Day is eeeevil and must be shunned because it represents the Trump campaign. Hence you get headlines like “IF YOU HAD TO GUESS WHICH FIRM WOULD DO THIS:New allegations claim Jones Day lightened the skin and narrowed the nose on the picture of one of their lawyers.” Continue reading →

Addendum: To Be Fair, Elizabeth Warren Wasn’t The Only Democratic Presidential Candidate Who Lied About The Death Of Mike Brown Last Week. She Was Just The Worst…

Last week, on Friday and Saturday, Democratic Presidential candidates Elizabeth Warren, Rep. Tim Ryan,  Cory Booker, Kamala Harris, Beto O’Rourke, Kirsten Gillibrand, Bernie Sanders, and New York City Mayor Bill de Blasio all tweeted out deliberately false statements about the shooting of Michael Brown in Fergusen, Missouri 5 years ago, all apparently doing so to pander to African Americans, especially those who don’t read newspapers.

Ethics Alarms focused on Warren, being the biggest and most shameless demagogue of the group, in this post, which concluded,

“Warren isn’t intellectually lazy, or flummoxed by a false narrative. She is pandering. She is lying. She is doing what she evidently thinks will gain her power and the Presidency: saying what she thinks will attract needed support, even though she knows, knows, that it is false. Warren is a law professor and a litigator, and from all reports skilled in both roles. She knows that the facts made it obvious that Brown wasn’t murdered. She knows that competent, fair citizens must not call other citizens murderers when not only have they not been charged, tried, or duly convicted, but when authorities have concluded that there is insufficient evidence for an official accusation.The tweet isn’t a mistake or an opinion. It is a deliberate lie, a public and a defamatory one. I see no reason why Darren Wilson could not sue Warren and win.”

That is still accurate and true. Several Ethics Alarms readers pointed out that Kamala Harris also advanced the long de-bunked narrative that Mike Brown was a nice, friendly, “gentle giant” heading for college who was gunned down by a racist cop while holding up his hands and pleading for his life. “Unethical” Is Too Mild To Describe Elizabeth Warren, And “Gullible” Is Too Nice To Describe Her Supporters

Above is what Massachusetts Senator Elizabeth Warren, who presumes to tell us that she is qualified to be President of the United States,  tweeted to her followers last week. This deliberate and disgraceful lie could be presented on Ethics Alarms as evidence that Warren is an Ethics Dunce. It would easily qualify as an Unethical Quote of the Week (Month…Year…). It is fully qualified as an Unethical Tweet of the Week, in a category that is becoming increasingly contested. Early Poll: Who’s The Most Unethical Democratic Presidential Candidate?

My inquiry has been slightly different of late: I’ve been trying to decide on the most loathsome Democrat candidate, which so far is a dead heat with multiple contenders. However, the degree to which some of these people make me want to retch is a distraction, and I will be periodically polling on the more relevant topic of this blog as we crawl to the August 2020 conventions, a year from now.

To head off the inevitable “whatabout” responses, let me stipulate that, of course, Donald Trump, our President, is unethical in many, many ways, based  on what we know about his character, what he says, and what he does.

That is not a verdict on whether he should be removed from office, or whether he is corrupt or “unfit to be President.” If unethical character or deeds alone were grounds for impeachment, we would have had about 30 of them by now. There has been no evidence that Trump is a corrupt President, which is what matters, just assumptions based on the general distrust by those who will never give him a chance.

Fitness for Presidency is self defining: elections determine whether a President is fit, because in a democracy that’s the people’s right to determine, not pundits, no ethicists, not other politicians. Once found to be fit to serve by an election, a President’s subsequent conduct determines whether the public was right. It doesn’t matter whether those who voted against him think he’s fit. Their standard did not prevail. At the point of election, all good citizens are obligated to wipe the slate clean and allow the elected President to proceed in the most difficult job in the land with the nation’s symbolic support. A large chunk of the Left has refused to do that this time, ever. That means they are unethical, and unfit to live in a democracy. It is the job of those who are fit to either convince them of their dangerous error, or to minimize the damage they are doing to the nation. Continue reading →

Elizabeth Warren’s Brazen Breast Implant Lie

This story, which was just breaking through the Mueller fiasco yesterday, literally woke me up. If I’m ever going to get any sleep, I have to write this post now, because it simultaneously disgusts me and brings me great satisfaction.

I  decided long ago that Elizabeth Warren was a principle-free demagogue and a liar. The first clue was her tap-dancing around the uncomfortable fact that she had been practicing law without a valid license in Massachusetts. Then there was her cynical use of a Cherokee heritage she didn’t have to gain diversity benefits when she was seeking positions on law school faculties, and her long, long, stubborn resistance to coming clean about the fact that she was not, in her words, a “woman of color” despite posing as one for decades.

This last should have permanently made a run for the Democratic Party 2020 nomination futile, but Warren threw her war bonnet into the ring anyway, counting on her considerable talent for demagoguery  and her willingness to say anything and espouse any extreme position  to make her candidacy viable in a shockingly weak field.  She is, when you think of it, the closest equivalent to Hillary Clinton that the Democrats have, and as this story demonstrates, in all the worst ways.

Warren has been claiming for years that as a lawyer she fought for the women who were victims of dangerous silicon breast implants. Not only is that not accurate, it’s an audacious  and calculated lie.

The truth was initially exposed by Professor William Jacobson, the proprietor of the conservative blog,  Le*gal In*sur*rec*tion when Warren was running for the Massachusetts Senate in 2012, though it was largely ignored then: the news media was too invested in getting Democrats control of the U.S. Senate. Then she brazenly continued the false narrative in 2019, prompting Jacobson to tell Tucker Carlson about it this week on Fox news, but more importantly, inspiring the Washington Post to resort to actual journalism even though it harms a sweetheart of the “resistance” and a relentless critic of President Trump. Saturday Ethics Run-Down, 7/20/2019: Perry Mason, Kamala Harris, And Home Runs-On-Demand

I’m calling it a run-down because I’m run down….

1. More “phantom document” ethics. Last moth I wrote about the ethically dubious “phantom document” tactic, in which a lawyer alludes to a document he or she either does not have, or suggests a document has content it does not in order to trick a witness into recanting testimony.

I just saw the Eighties made-for-TV movie “Perry Mason Returns” that rebooted the classic series (and not so well) for an aging Raymond Burr. The great defense lawyer comes out of retirement to defend old legal assistant Della Street (Barbara Hale), who has been accused of murder. In the trial’s climax, Perry’s investigator Paul Drake, Jr. (played by Hale’s real-life son, actor William Katt of “The Greatest American Hero” fame) bursts into the courtroom and hands Perry a document, which he then holds as he asks the witness (Richard Anderson, playing a different role than he played in the original series) he was in the midst of cross-examining, “Would you like to reconsider your testimony? Would you like me to read a sworn statement from Bobby Lynch, in which he says you hired him to kill Arthur Gordon?”

The witness confesses that he planned the murder that Della was being tried for, and framed her. Della goes free! Perry then tells Della that there was no sworn statement. “I didn’t say I had a sworn statement,” he chuckles, “I just asked if he wanted me to read one.” Continue reading →

Unethical Quote Of The Week: Democratic Presidential Candidate, Washington Governor Jay Inslee

Ladies and Gentlemen, the next Secretary of State…No, really! I’m serious! I wouldn’t kid about something like that!”

“My first act will be to ask Megan Rapinoe to be my secretary of state. I haven’t asked her yet so this could be a surprise to her.I actually believe this because what I think what she has said that has inspired us so much is such an antithesis of the president’s foreign policies.”

And you thought President Trump’s appointments have been bad!

So it’s come to this, has it? Megen Rapinoe is a soccer player, and nothing but a soccer player. She played soccer to the subordination of everything else in high school and college. She has no academic credentials, proven expertise, experience or even interest in government, diplomacy and foreign affairs, and a supposedly serious candidate for President states that he would appoint her as his Secretary of State.

How can we explain this? Could he have been joking? It’s not funny by any analysis. It is horrifying, in fact. Still, candidates for office don’t typically say “my first act” if elected will be to do something if they have no intention to do such a thing and everyone realizes it. That’s insane; it’s both a lie and a transparent lie.  It is an insult as well: the statement says that the candidate thinks the public is so box-of-rocks stupid that they will believe utter nonsense.In addition to everything else that’s wrong with it, Inslee’s stated “first act” would be futile. Even Democrats aren’t so far gone that they would vote to confirm a Secretary of State nominee with the worst credentials of any Cabinet nominee in U.S. history—yes, even worse than Ben Carson, and I didn’t think that was possible. Sunday Ethics Warm-Up, 6/30/2019: Post Rugby Edition

This just has to be a better day than yesterday.

And I’m not even referring to the Yankees beating the Red Sox 17-13 in the first MLB game ever played in Europe.

Also, much thanks to the many readers who sent their condolences to me and my family. It helped.

1. Keepin’ a-goin’!  Believe it or not,  having to say farewell to our sweet, vocal and witty Jack Russell terrier  was not necessarily the worst part of our Saturday. This makes today another ethics challenge, that being the theme of the intentionally simple-minded poem used by comic actor Henry Gibson on “Laugh-In,” “The Dick Van Dyke Show,” and later as a country music song in Robert Altman’s “Nashville.”

The ditty was “Keep A-Goin,” and Gibson, unethically, left the impression that he had written it. He hadn’t: the poem was written Frank Lebby Stanton (1857-1927), now forgotten, and Henry (who died  in 2009) bears some of the responsibility for that, though the poem was ripe for stealing since the copyright expired long ago.. The “Nashville” credits claim Gibson was the author of the song. Wrong. Here it is:

  When the fish ain’t on yer line;

Since around 4:30 pm yesterday, I have felt like doing absolutely nothing other than grieving and helping the rest of my family deal with the sadness that engulfs us. But, as another poet memorably said, I have promises to keep, and miles to go before I sleep.

Ethics Observations On Democratic Candidates Debate #2

1. Eric Swalwell literally pressed the ageist position, using the tired cliche of “pass the torch.” The old Democrats like Sanders, Biden and Warren LOOK so old it is hardly necessary to point it out; Swalwell’s harping on “the new generation” reeks of bigotry. What has Swalwell done, other than to be younger than dirt, to justify anyone trusting him with executive power?  Let’s see: he’s been an assistant DA and a House member. He’s never run anything in his life.

2. Every candidate on-stage raised their hands to indicate they are in favor of U.S. health care covering illegal immigrants. All but one want illegal immigration to be only a civil offense. The “Think of the Children!” lies about “children in cages” and evil ICE were treated as fact all night. Biden endorsed the fatuous position that only illegal immigrants who commit ‘major crimes” should be deported. KABOOM. 

So anyone can illegally come here, especially if they are dragging a kid or three, and force Americans to pay for their health care. Under what ethical system other than free-floating altruism is that a fair or responsible position? The Democratic Party wants open borders, and worse, wants to achieve it while denying that this is its position.

3.  Pete Buttigieg unethically and cravenly threw his own police officer to the wolves under the bus by essentially pronouncing South Bend Sergeant Ryan O’Neill guilty of shooting Eric Logan out of racist animus. Buttigieg said that he tried to eliminate racial bias—aka bigotry—by police but couldn’t, and blathered, “I am determined to bring about a day when a black person driving a vehicle and a white person driving a vehicle, when they see a police officer approaching, feels the exact same thing: a feeling not of fear, but of safety.” The problem is that the investigation of the shooting has not been completed, or even begun.

South Bend Sergeant Ryan O’Neill responded to the Central High School Apartments parking lot around 3:30 a.m. on Sunday, June 16, investigating a tip that someone with a flashlight was breaking into parked vehicles. O’Neill was alone when he pulled into the parking lot;  six vehicles had been broken into and had items stolen.

The officer said he saw Eric Logan with his legs sticking out of a vehicle, and that Logan stepped out of the car holding a knife and refused to drop it when O’Neill repeatedly  ordered him to do so. The officer claimed Logan lunged at him with the knife, and in response, fearing for his life, O’Neill fired two shots, fatally striking Logan in the abdomen.

Logan’s family says O’Neill’s version  is inconsistent with Logan’s personality—you know, like Michael Brown was a “gentle giant.” Logan did not have a violent criminal history, he had only  previously served time in prison for drug distribution and had a prior conviction for carrying a handgun without a license—a model citizen, in other words.

The white officer is being convicted of racism and murder on the basis of his occupation and color, and the Mayor of South Bend is helping. Continue reading →
