It would be good for the nation and national discourse on gender-related matters if there existed a national organization, operated with integrity, intelligence and dignity, that addressed legitimate issues of women’s rights with the zeal of an advocate as well as professionalism and common sense. There was a time, so long ago now that I can’t even recall exactly when it was, that the National Organization for Women appeared capable of evolving into just such an organization. As this incident shows beyond a shadow of a doubt, that chance has passed. NOW has descended into permanent knee-jerk hackery, the realm where its neighbors are such predictable and rightly-maligned one-note fanatics as PETA, the NRA, NARAL, and Media Matters. What a shame. What a lost opportunity to do good.

When the Worst of Ethics 2015 is finally published here (It’s coming! I swear!), the “Rolling Stone” fiasco featuring the fantasy rape accusation of “Jackie” against a University of Virginia fraternity will take one of the “honors,” and maybe more. From that collision of campus sexual assault hysteria and incompetent journalism came real harm, and several of the victims are suing the publication for defamation. One such victim is a University of Virginia associate dean named Nicole Eramo, who is alleging in her lawsuit that the magazine falsely portrayed her as negligently unconcerned with allegations of sexual assault on campus and as the now totally discredited fraternity gang rape tale’s villain.

Counsel for Eramo has asked that a court require “Jackie” to turn over any communications ,related to the alleged assault, between Jackie and  the magazine, friends, family and a campus support organization. Now NOW has presumed to interfere, and is trying to derail the lawsuit. In an open letter published this week, NOW president Terry O’Neill called on UVA president Teresa Sullivan to get Eramo to drop the suit. (She cannot force her to do that, however, and it would be unethical for Sullivan to try.) Continue reading →

In Washington State, Not “Over-Incarceration,” Just Incompetent And Cruel Incarceration

Since 2002, the Washington State Department of Corrections (DOC) has allowed a sentencing-calculation glitch in its computers to allow more than 3000 inmates to walk out of prison before their sentences were complete. Now the state is rounding-up  ex-prisoners, in many cases after they have built back their lives, settled down, found jobs, and done all of the things, difficult things, former felons are supposed to do once they have paid their debts to society.

Last month, Governor Jay Inslee and DOC Secretary Dan Pacholke  revealed that incorrectly programmed computer software  had been  miscalculating release dates Washington convicts sentenced to extra prison for violence related to their crimes. Although DOC employees have been aware of the problem since 2012,an assistant attorney general advised against an urgent review, allowing the error, and the early releases, to continue for three more years as a software fix was delayed repeatedly. (Yes, there is an investigation.) Finally, a fix is supposedly in the works.

None of this was the fault of the prisoners who were released early, but they are the ones being made to suffer for it. Most of those who have been out for long periods are being left alone, according to the standards for review, but for those deemed to need additional prison time, the trauma is significant. The Seattle Times interviewed Miranda Fontenot, whose fiancé, James Louis, was taken into custody last week when he checked in with his community corrections officer. Continue reading →

The Unethical Web-Shaming Destruction Of Holly Jones

“I will never go back to this location for New Year’s Eve!!!” young Holly Jones ranted on an Indianapolis bar and restaurant’s Facebook page. “After the way we were treated when we spent $700+ and having our meal ruined by watching a dead person being wheeled out from an overdose my night has been ruined!” The angry post accused the evening’s restaurant manager of rudeness, the party’s waitress of profanity and the establishment itself of inattention.

After a sharp on-line rebuttal by the restaurant, the Web Furies were unleashed. Jones’ post became the latest web-shaming catalyst and an invitation to join a cyber-mob where fun could be had by all turning an ordinary jerk into a national villain. Lots of people signed up. The mob tracked down Jones and bombarded her own Facebook page with hate—she took the page down—then moved on to the salon where she worked as a hairdresser, threatening a boycott unless it fired Jones.

So it did.

These exercises in vicious web shaming can be ranked along an ethics spectrum. At the most unethical end is the destruction of Justine Sacco, who had her legitimate marketing career destroyed by social media’s  hysterical over-reaction to a self-deprecating, politically incorrect tweet. Now she works promoting a fantasy sports gambling website, a sleazy enterprise that entices chumps into losing serious cash with a business model derived from internet poker—she not only had her life derailed, she was corrupted too.

At the other end is Adam Smith, the one-time executive who wrecked his own career, with the help of another cyber-mob, by proudly posting a video of himself abusing an innocent Chic-fil-A  employee because Smith didn’t like her boss’s objections to gay marriage.  Somewhere between the two is Lindsay Stone, who lost her job by posting a photo showing her pretending–she later said— to scream at the Tomb of the Unknown Soldier while flipping the bird at the “Silence and Respect” sign.

The distance between Smith and Jones is the difference between words and conduct. Smith’s video showed him abusing a young woman, and his posting of the video indicated that he saw nothing wrong with it. Jones, in contrast, did nothing, other than prove herself to be, at least at the moment she posted her rant, an utter jerk. Everyone along the spectrum, however, including Jones, were excessively and unjustly harmed by the web-shaming  campaign against them. Last I checked, Smith was unemployed and destitute three years after his episode of atrocious judgment.

In the current case, the cyber-mob forcing Holly’s employer to fire her is ethically worse, by far, than anything she can reasonably be accused of doing by posting her criticism of the restaurant. Continue reading →

New Rule For 2016: Elected Officials, Politician And Presidential Candidates Will Be Accountable For What They Say, Not What They “Meant To Say”

We have a growing mass of public figures in politics and government who increasingly communicate in sloppy, vague, hyperbolic and ambiguous language and assume that they can wait and see how the public reacts to it before they, their spokespersons, defenders, enablers or friendly pundits need to clarify what they “really meant.”

Well, the hell with that.

Communication precision is more crucial than ever in the new, technology-driven public media, when tweets can be circulated to millions within minutes, and on-camera statements live on YouTube forever. This habit of allowing influential figures to spout lies, nonsense , smoking gun revelations about their character and worse and then insist on a do-over when they are called on the obvious meaning of their own words must stop. Among other things, it appears to be killing the little switch in the brains of these people that is supposed to stop human beings from saying stupid things before they say them. That switch goes by the name Prudence, which  encompasses common sense, respect, responsibility, restraint, honesty in communication, and more. We should want our leaders to have that switch working perfectly. Unfortunately, most of our most prominent leaders and would-be leaders appear not to have a functioning switch at all. Observations On Donald Trump Playing The Bill Card On Hillary Clinton.

Veeery interesting.

After Hillary accused Donald Trump of being a sexist, which, of course, he indubitably is, Trump, who believes that when hit one should hit back twice as hard, immediately pointed out, in his typically clumsy, sloppy but somehow effective way, that for someone married to Bill Clinton to play “the woman’s card” was, shall we say, hypocritical. Then fate took a hand: Bill Cosby finally faced a few bars of music in court, and some journalists and pundits began musing about the differences and similarities between Bill C. and Bill C. (I flagged this problem for the Clintons over a year ago.)

Then elder pundits did some figuring, and realized that a large number of younger voters, the Democratic Party’s base, don’t know very much at all about Monica, Paula, Kathleen, Juanita, Gennifer and Dolly, Bill Clinton’s impeachment, or loss of his law license, in part because the news media has been an active Clinton family enabler for over a decade, and in part because our education system fails to educate. Thus a decisive component of the Hillary cheering section just think of Bill as a revered former President elder statesman, and did not gag, as I did, when this guy of all guys was made the centerpiece of the 2012 Democratic National Convention themed to decry the “war on women.”

But wait! There’s more! When Trump carried his new vendetta to the Today Show, lovely, light-weight, biased co-host Savannah Guthrie revealed herself to be both ignorant and a tool by calling the Monica affair “alleged.”  Mary Bruce on  Good Morning America also referred to Bill’s infamous womanizing as “alleged sexual misconduct and infidelity.” Ignorance or Clinton protecting? Bill’s infidelity is as “alleged” as O.J.’s skills with a knife.

Finally, a feminist, Democrat, usually reliable Clinton ally on the Washington Post editorial staff, Ruth Marcus, Trump is right: “Bill Clinton’s sordid sexual history is fair game.” for Hillary opponents.

Which, of course, it is.

Professionalism Tales: The Hilarious Prosecutor

Clown lawyerDeputy District Attorney Robert Alan Murray is a funny guy. Having apparently decided that it was too obvious to tell an arrested kid that he would be summarily shot, which is always a gas—you should see their faces!—and a bit too risky to put a whoopie cushion on a judge’s chair behind the bench—those old fogies have no sense of humor—the young California prosecutor hit on the brilliant idea of altering the transcript of the police interrogation of a Spanish-speaking defendant who was charged with lewd or lascivious acts with a child younger than 14 years old.

Murray, the dickens, added this wacky exchange to the transcript:

Officer: “You’re so guilty, you child molester.”

Suspect: “I know. I’m just glad she’s not pregnant like her mother.”

He kills me, he just kills me! Inexplicably, though, the assistant public defender complained about the altered transcript, told a judge, and the judge dismissed all charges against the accused child molester.Who would have guessed the public defender would use the gag to defend his client? Signature Significance: Bernie Sanders’ Ignorant Tweet

Yesterday, the Democratic candidate for President of the United States, a long-time member of the United States Senate, tweeted this message to his “followers,” and also, given the nature of Twitter, the nation:

“You have families out there paying 6, 8, 10 percent on student debt but you can refinance your homes at 3 percent. What sense is that?”

Now, if you don’t instantly recognize why this is an astoundingly ignorant statement, especially for a Presidential candidate running on a platform of economic restructuring, that’s okay. Don’t feel badly. It’s a weekend, you’re probably groggy from all the holiday cheer, and most important of all, you aren’t presuming to hold yourself out as qualified to be President, or constantly lecturing about the evils of capitalism. Sanders is, however, and this cretinous statement is signature significance. Nobody who understands loans, interest, collateral, banking, or economics would say, write or publish such a fatuous statement, even once. This is signature significance: an informed, logical, attentive, competent individual will not make such a bone-headed mistake…never. Sanders, however, has said this at least twice; in October, he tweeted a variation on the same economically ignorant theme:

“It makes no sense that students and their parents pay higher interest rates for college than they pay for car loans or housing mortgages.”

Actually, it does, Senator; it makes perfect sense, unless you are twelve. The concept is called “collateral.” That is something of value that  a lender can take if a borrower defaults on the loan. The deal is interest, plus security, the collateral. A house or a car are tangible collateral, so the interest rate can be lower. When the loan is for college tuition, however, there is no collateral. If the borrower defaults on the loan, the bank can’t take the student’s diploma, or education, or download all of the alleged knowledge the loan paid for from brain to laptop. Of course the interest rate is higher. That is, “of course” if you know anything at all about finance.

The unavoidable and shocking conclusion: Sanders is holding himself out as the leader to revolutionize how the U.S. economy works, stimulate growth and jobs, and show the way to a fairer and more just financial system, yet he is stunningly uninformed about the basics of finance, hasn’t learned a thing in all his years in the Senate, and worse, lacks the diligence to learn what he has an obligation to understand in order to justify having a vote on economic matters in the U.S. Senate, never mind setting policy as President.

This is bad.

Is there any excuse or defense for that tweet? No. Should anyone trust an elected official this ignorant and so lazy and arrogant that he makes no effort to disabuse himself of financial illiteracy? No. Does such a bone-brained misunderstanding mean that no intelligent person should listen to or take seriously any of his pronouncements about the economy? Yes.

Ethics Hero: CNN’s Jake Tapper

tapper-rhodesIt is tragic that it takes bloody murder to raise the press out of its journalism ethics torpor, and force it to ask tough questions of the administration it helped put in power and  has pampered,  pimpeda nd covered for ever since.  Still, progress is progress. CNN’s Jake Tapper, probably the closest thing to an objective journalist in captivity, has obviously had enough of the seven-year pattern of pretending that all Obama policies are working just marvelously thank-you, even as the stench of fakery, dishonesty and incompetence fills the air.

Over the weekend, Tapper was having none of the spin offered by Deputy National Security Adviser Ben Rhodes and Rep. Adam Schiff (D-CA), both sent out by the White House for damage control, after the President’s statement that “ISIS has been contained” was rendered ludicrous by the deaths in Paris.“If this is what ISIS looks like contained, I shudder to think what ISIS looks like uncontained,” Tapper told Rhodes.

Bazinga!

President Obama ended the war on terror, put tepid measures in place in Syria, dismissed ISIS as “the junior varsity, ” and in the aftermath of the Benghazi attack, coordinated a campaign of media disinformation to blame it on a YouTube video rather than admit that Al Qaeda was not “decimated” as he had puffed, all while taking unseemly personal credit for the killing of bin Laden and feeding the public what has been called a “narrative of success.”

Maybe the news media will finally insist that he accept accountability for his inept and feckless terrorism strategies. I doubt it, but at least Tapper gave us a reminder of what unbiased journalism looks like, lest we forget.

Obama’s Avoidance Of Accountability Reaches Previously Unimagined Heights

Having encountered this immediately prior to last night’s debate among the Democratic contenders for the 2016 Presidential race, the praise heaped on Barack Obama’s abysmal record, repeated defiance of law and ignorance of basic leadership mandates—never honestly identified as such, of course—approached head-exploding levels of dissonance. It briefly subsided when Jim Webb, answering the question of what the candidates would do differently, so diplomatically delivered damning criticism that I doubt many in the room realized it. He said in part…

[If] there would be a major difference between my administration and the Obama administration, it would be in the use of executive authority…I have a very strong feeling about how our federal system works and how we need to lead and energize the congressional process instead of allowing these divisions to continue to paralyze what we’re doing. So I would lead — working with both parties in the Congress and working through them in the traditional way that our Constitution sets up…

Translation: Under Obama, the Constitution has been violated repeatedly because this President won’t deign to work closely with Congress, and has chosen instead to govern by executive fiat, which is not how the Constitution requires laws to be made.

He also said he would lead, which he undoubtedly would do. Obama, just two days earlier in his “60 Minutes” interview, demonstrated yet again why he can’t lead. He is incapable of accepting accountability for what he does, and what those under his authority do. Sometimes the utter awfulness of his values, usually because of his narcissism, makes me want to challenge his supporters to defend what is manifestly indefensible.

This is such a time.
