Happy Non-Birthday, Frederick! And Welcome Rationalization 25A, Frederick’s Compulsion or “It’s My Duty!” To the Ethics Alarms Rationalization List

As any Gilbert and Sullivan fan knows, February 29 is the troublesome birthday of Frederick, the dim and conflicted hero of “The Pirates of Penzance.” (He doesn’t get a birthday this year.)  Apprenticed to a pirate as a child by mistake (his nurse heard “pirate” rather than “pilot”),  the lad was bound to serve as a cutthroat until his 21st birthday, and thinking that the terms specified his obligation to reach until his 21st year, quits the pirate band that raised him and joins the police, who are  seeking to put his old comrades behind bars, or worse. But poor Frederick  learns that because he would only be free of his obligations until his 21st birthday, and since he was born–Oh, horror!—on Leap Year,  he is technically only five (“and a little bit over”), and won’t be 21 by the terms of his apprenticeship until he is 84 years old. His beloved, the equally dim Mabel, vows to wait for him. Meanwhile Frederick, declaring himself a “slave of duty,” joins the pirates again, as they prepare to murder Mabel’s father.

W.S. Gilbert, who wrote this famously nutty plot, was satirizing the substitution of duty (and legal contracts) for reason, morality, ethics, and sanity. The latest addition to the Rationalizations List,  Frederick’s Compulsion is a sub-rationalization of #25. The Coercion Myth: “I have no choice!” Frederick believes that the existence of a contract creates a duty that he must obey without question, regardless of the consequences. “I don’t know…I think we are in a weird place in the world when the following things are considered political. Five things, I’m going to tick them off. These are the five things that were on his and our president’s agenda. Caring for the marginalized and the poor — that’s now political. Advancing economic opportunity for all. Political? Serving as good stewards of the environment. Protecting religious minorities and promoting religious freedom globally. Welcoming [and] integrating immigrants and refugees globally. And that’s political?”

—-Fox News anchor Shep Smith last week, responding to critics of the Pope’s visit to the U.S. and his message, as it was being celebrated by Democrats, Catholics, intellectually dishonest progressives, and, apparently, naive news anchors.

The short answer to Smith’s question is, “Of course it’s political. All of those issues are political.” I would also add, “How can you report political news and not understand that they are political?”

Now I’m going to tick them off:

….”Caring for the marginalized and the poor” requires time, money and personnel, as well as planning and efficiency. All of those in turn require re-allocating resources away from other needs and activities, including important ones that allow people to avoid poverty and marginalization. A society that makes cariung for the non-productive members of society its first priority becomes non-productive itself. So where does “caring for the marginalized and the poor” fit on the priority list? What is the definition of  “the marginalized and the poor”? The Pope doesn’t have to define them, but to seriously create policy that accomplishes the goal of “caring for” them—which also requires a definition—is a political task.

“I think abortion is evil, but it is a necessary evil.” Discuss.

This blog doesn’t discuss evil very often because it is not a term appropriately associated with ethics. Evil is a concept related to morality. In an ethics discussion, I would take evil to mean something extremely, irredeemably unethical by any ethical analysis or system. The statement “I think abortion is evil, but it is a necessary evil” appeared parenthetically in a comment by Beth, a frequent commenter on Ethics Alarms who is a mother and a lawyer, regarding the Planned Parenthood videos. Though the news media appears to have successfully distorted that story by focusing only on whether the videos were evidence of illegal “trafficking in body parts” by Planned Parenthood, that was not the reason I posted the essays, and it is not the reason those videos are significant in the ongoing debate over abortion rights. Two high ranking individuals in the organizations casually discussed the crushing and crunching of the heads and torsos of living and helpless individuals with the sensitivity I would associate with stepping on a roach. If this doesn’t disturb you, it should. If it does disturb you, as it did Beth, what does that mean?

Abortion is one of the most important and difficult ethics issues in the culture, indeed in world culture. It involves millions of lives and millions of deaths, law, bioethics, religion, social policy, science, human rights and feminism, as well as society’s ultimate respect for life itself. I have written about the ethics of the abortion debate frequently (you can find most of the relevant posts here), but to summarize the Ethics Alarms views on the topic:

1. Abortion is an ethics conflict, meaning that there are ethical principles in opposition to each other, requiring society to set priorities.

2. The absolutist position on the anti-abortion side is that abortion involves the taking of innocent human life, which begins from conception, and is thus unethical in all cases. It is a strong position if one accepts the underlying assumption.

3. However, no absolute position is really absolute. Every ethics absolute has an exception, or several: there must be some circumstances when abortion is necessary and right. (This is not true of moral absolutes, since moral absolutes are self defining. If the power dictating a moral precept says it is absolute, it is so.)

4. The absolutist position on the abortion side of the argument holds that a woman’s right to have complete dominion over her body, reproductive activity and health justifies abortion in all cases. This is not a strong position, and in fact is one that cannot be honestly argued or sustained. It supports abortion on demand for any purpose or preference, entirely at the mother’s discretion.

5. To make that argument, extreme pro-abortion advocates have had to deny the humanity and human rights of unborn children, even to the point of arguing that they are not individuals at all, but mere “parasites,” or “tumors.” The removal of a second life from the equation that is at the core of the abortion problem makes the abortion decision easy and guilt-free; it also settles the debate by pretending the central issue doesn’t exist. That issue is that there is another life involved, not just the mother’s.

6. The debate over the ethics of abortion has been handicapped by the tactic of both sides to pretend a legitimate interest championed by the other doesn’t exist. A woman’s ability to control her own life, career and what happens to her body is an important societal issue, yet the term “pro-life” ignores it entirely. It is not the only important interest involved in the abortion decision, however, as the term “pro-choice” suggests.

7. Neither absolute position, whatever its theoretical virtues, is practical from a policy perspective. Desperate women who are pregnant will seek abortions, people will help then (or exploit them, or kill them), and public policy cannot pretend otherwise. Society will not tolerate punishing women for aborting their unborn children, whether they deserve to be punished or not. Yet allowing mothers to have unborn children killed on a whim leads to the callous, ugly, dangerous attitude toward innocent life on display in the Planned Parenthood videos. Callousness toward any human life, history has shown us, is a slippery slope with the potential of doing terrible harm to the culture.

8. Roe v. Wade was a premature Supreme Court decision and a badly reasoned one. Until and unless it is overturned, abortion is a right. That does not mean, and never meant, that abortion necessarily is right.

9. Because absolutism fails here, abortion is a problem that demands utilitarian analysis–balancing of interests and values, in the best interests of society, long and short-term, and everyone in it, according to the facts as we understand them.

10. Balancing requires an honest acknowledgement that there is something to balance. The “pro-choice” and “pro-life” dichotomy doesn’t acknowledge that in their most extreme incarnations, and since abortion is currently a right, the pro-choice lobby detects no reason to yield to logic, science and reality. When we buy a product or service, we don’t just buy the end result. We buy a long string of tasks leading up to that final product and sometimes we buy even more things than just the final product*. In this instance, that doesn’t just mean the food on your plate, as tasks, upon deep consideration are actually HUMONGOUS things that are composed of the Time necessary to complete, Material either used up in preparation or as a component of the end item, Personnel Knowledge needed to perform, Equipment which facilitates, and Space needed to complete the task.. You don’t purchase just the food. You purchase the time and care EACH employee puts into the process. From Day 1, you purchase the time a procurer makes a deal with a vendor OR personally hand selects the ingredients of your meal. You purchase the time and quality of the food storage in the pantry/refrigerator. You purchase the chef’s level of knowledge. You purchase the time he devotes to ensuring the burners are a certain temperature. You purchase the manager’s level of knowledge in keeping things efficient and cost effective. Americans Opine On Abortion: Thank You, USA Today, Now I Know Why We’re Doomed

USA Today fashions itself as the newspaper of the average American, and it may well be true. Especially since its redesign, it contains less substance than a single section of the New York Times, pedestrian writing, and mostly bite-size features designed for an audience with an attention span that finds fortune cookies challenging. Every now and then, however, a bit like Family Feud, USA Today’s proud low brow style yields valuable insight. Yesterday’s feature on abortion was such an instance, as the paper gathered reader comments on its Facebook and Twitter locales for America’s opinion regarding Missouri’s new mandated three-day waiting period for women seeking an abortion.

Now that I have reviewed the responses, it all makes sense to me now, and I think I know where we are headed. Oh, there is no valuable insight regarding the measure or abortion among the comments. What is revealing is that among all the responses chosen by USA Today, not single reader could manage sufficient objectivity and critical thinking to produce  well-reasoned, fair, thoughtful insight regarding a public policy issue that demands measuring and balancing interests, values,  and outcomes, the essence of ethical decision-making. Not one.

Kids On Leashes: Final Hypotheticals

Not to beat a dead dog, but while conversing about this surprisingly contentious issue (here, and here) on Facebook with the ever-thoughtful and provocative Lianne Best (Ethics Alarms congratulations go to Lianne for being honored by NARAL as an Outstanding Advocate For Choice), I realized that I should have posed one more hypothetical for the enthusiastic child-leashers to chew on, to wit:

“Have you ever seen anyone in public with both a kid and a dog on leashes simultaneously?”

Would you do that? And if you wouldn’t, why would having a child on a leash without the dog be any better?

To which Lianne countered with an even better hypothetical:

“How about a parent walking in public with the child on a leash but the dog walking along without one?”

The damndest essays ignite furious debates here. I raised CNN’s mid-day quiz about parents walking children on a leash-–did I mention it featured a video of one mother dragging her prone harnessed child through a store like the kid was a sack of potatoes? I should have—-primarily because 1) it reminded me of “The Simpsons,” 2) because I was struck by the fact that ethics was never brought into a conversation that I would deem as concerning an ethics issue, and 3) because it was notable that CNN wasn’t talking about sunken Malaysian airplanes.

Still, I have been enlightened by the unexpectedly lively discussion, if not encouraged. In particular, this never struck me as an ideological issue, but it certainly seems to be one. Upon reflection, I should have predicted it, though this is not flattering to liberals.

I’ll return to this in a bit.

The defenses of the demeaning practice have been mostly pragmatic, which involves a utilitarian argument: “It works, and the ethical violations either don’t exist, or are too small to care about.” The most annoying defense so far has required  intentionally taking a statement in my post literally that also has an important figurative message, as well as misstating even the literal meaning, all to make it easier to dismiss the intended point. That’s some kind of record for straw men. Or would that be straw dogs? No, I think that’s something else.

The phrase in question was “whether it was fair, kind, respectful or right to treat your child like a cocker spaniel…” To make it easier to attack, my critic has changed that to “…to treat your child in a manner associated with the treatment of dogs.” Sneaky. It is true that dogs are typically kept on a leash, but that is only half the message, as fair readers will acknowledge. The term “treated him-her-them like a dogs/dogs” means, and has meant for a very long time, treating a human being in an inhuman, demeaning, humiliating, unkind, unfair fashion showing a lack of respect and making the human being in question miserable. The description has been used to describe both treatment that is seen in the treatment of actual dogs—such as substandard living conditions, lack of autonomy, domineering oversight, feeding of food not fit for human consumption, and in this case, use of a leash in public, as well as used to describe treatment that would never be literally possible with real dogs, such as too many typing assignments, refusal to give credit or bonuses for effective research, not allowing a family member a sufficient allowance, forcing a child to dress in old, outdated or unattractive clothes, etc. In the current case, both meanings apply, and focusing on just one is intentionally misrepresenting the issue.

As to whether the use of leashes on human children is demeaning, try this thought experiment: Would any white nanny dare to walk in public with two black children on a leash? How about the mother in a mixed marriage, in which the mother is blonde and the children are black? Would not the imagery of whites leashing blacks be inherently distasteful, regardless of the age of the African-Americans involved? Continue reading

Child Care Ethics And Leashes For Toddlers: CNN and Its Viewers Flunk An Ethics Alarm Test

It is constantly amazing to me that journalists so seldom identify obvious and critical ethics issues in the topics and events they cover. The rest is mixed emotions: this absence of ethics awareness is a serious culture-wide problem; then again, were this not so, I’d probably be in a different, and less stimulating profession.

Today I sat down to lunch as CNN engaged in a breathless discussion of whether using leashes on toddlers and even older children was a good idea, as it is either a growing trend among parents, or CNN was having a slow news day. The phone lines were open, and many viewers weighed in, with the primary camps expressing the following positions:

1. “If it makes children safer, then there is no reason not to do it. Safety is everything. Kids have been killed running into the street.  A leash will prevent that.”

2. “This shows the decline of child-rearing skills in the United States. If you can’t control your kid better than this, you are the problem.”

If the question of whether it was fair, kind, respectful or right to treat  your child like a cocker spaniel occurred to anybody in this discussion (I know the CNN staff never considered it), I saw and heard no evidence of this. Yet that is the central question, and it is an interesting one to consider. The fact that matters of human dignity, responsibility, respect, fairness, autonomy, kindness, proportion and prudence need to be balanced to answer the question at hand never came into the discussion, and those debating the issue demonstrated neither awareness of the competing ethical values, nor the ability to know how to employ them. Autonomy: The Ethics Alarm That Obamacare Should Be Setting Off, But Isn’t

Autonomy. This is the ethical value, a sub-set of the “respect” section of the Josephson Institute’s Six Pillars of Character, that is suddenly absent from the value set of the New American Left. This is cause for concern to say the least, because autonomy is the very value that was the impetus for the nation’s founding, and that is at the core of the Bill of Rights as well as the “inalienable rights” that introduce Mr. Jefferson’s mission statement for our strange experiment in self-governance. Beginning back in Bill Clinton’s administration, advocates of a nationalized health care system, including President Clinton himself, began floating the historical and logical nonsense that Jefferson and the Founders would have enthusiastically supported national health care. This is, of course, a cynical lie if one is educated (as it was in Clinton’s case) or proof positive of complete unfamiliarity with, oh, everything about the Founders, their political philosophy, and political philosophy generally. Whatever the value of a national health care program, the idea that the government would presume to dictate how one managed something so personal and intimate as one’s own health would have horrified  every signer of the Declaration, from its author to Button Gwinett.

That Mr. Jefferson’s supposed followers—he is the Original Democrat, by most lights, would reach the point of maintaining that the public’s beliefs, opinions and attitudes must be bent to their will is a development that threatens the existence of United States society and culture as we know it. The recent flare in this emergency arrived via the mugging of Brandon Eich, ex-CEO of Mozilla, who was deemed by the liberal elite as unworthy of keeping his job (though Mozilla is an internet company and he is an innovator in the field) because he was not convinced of the rightness of same-sex marriage by the elite’s newly determined, and well past,  deadline—a deadline that such progressive icons as Barack Obama and Hillary Clinton also missed, but never mind. Conformity to Progressive Truth has become the order of the day, and woe be to any good citizen who dares to oppose it. Does this sound like freedom to you? “Choice,” to use a popular rallying cry in the protest against the “War against Women?” It doesn’t sound like freedom to me. Continue reading

Twelve Post-Veto Ethics Observations On The Arizona “Religious Freedom” Bill

1. As we now know, Governor Brewer vetoed AZ SB1062, the so-called “religious freedom” bill that was widely (and accurately) interpreted as support for discrimination against gays. In the previous post, I suggested that her delay in doing so sent a message that was as hostile to gays as the law itself: if she felt the law was ethically wrong, then she should have and would have announced that she would not sign the bill long ago. Instead, she waited to see how much economic damage the law would do to the state, and then vetoed it, not because this was the right ting to do, but because it was the pragmatic thing to do. (As the satiric Borowitz Report put it, “The state of Arizona found itself in the middle of a conundrum today as it awoke to the awkward realization that gay people have money and buy stuff.”) USA Today noted that, to the contrary,”Some political insiders believe Brewer has allowed furor over the legislation to build to thwart social conservatives’ attempts to push a similar bill later.” I doubt it, but if so, Brewer allowed her state and her fellow Republicans to be represented nationally as homophobic for as long as possible to spare herself the inconvenience of vetoing a second bill.

2. Despite the extravagant debate over the bill, almost no commentators actually published the bill’s text in the commentary. The reason appears to be that since the bill is really an amendment of an existing law, it takes a modicum of intelligence to figure out what’s going on.
